CCOO and UGT unions have written to the Council of Europe’s Committee of Ministers, demanding stronger pressure on the state to comply with its obligations under Article 24 of the Revised European Social Charter. The country has been formally found in breach of international labour standards on unfair dismissal by the European Committee of Social Rights (ECSR), but the Government has yet to act. The ECSR ruled – in response to separate complaints by both unions – that the severance pay rules do not offer adequate compensation or real protection against unfair dismissal. However, the unions say no meaningful changes have followed. Instead, recent Supreme Court decisions have further weakened dismissal protections, prompting the unions to denounce the government’s inaction as a deliberate failure to respect the Charter system.
