Last summer, the largest union FNV filed a summons against the small LBV union, claiming that the LBV is not an independent trade union and is therefore not authorised to conclude collective agreements. However, the subdistrict court ruled against the FNV on 15 April. The subdistrict court ruled that there is no basis to qualify LBV as a non-independent trade union and that LBV is not acting unlawfully towards FNV by the way in which it negotiates and the way in which its organisation is structured. The FNV's claims are therefore dismissed. The FNV called it a ‘disappointing ruling’ and is still considering further steps.
