Belgium - Constitutional Court repeals decree on social protection - August 31, 2023

On 20 July 2023, the Constitutional Court ruled on two petitions submitted by the trade union ACV and other civil society organisations. As a co-plaintiff, the ACV was proved right in the case against the decree on Flemish social policy on the one hand and against the amendment decree on adult education on the other. Eighteen months ago, the Flemish Government decided to tighten the rules for Flemish social protection. Nineteen civil society organisations, including the ACV, grouped under the name “Everyone is protected” and went to the Constitutional Court. The Constitutional Court is now blowing the whistle on the Flemish Government because the rules mean a significant deterioration of social protection.
