Labour Law Updates: Improved Information on Termination, Special Leaves and Pregnancy

Labour Law Change in Indonesia 2026
Particularly regarding the Minimum Wage system. These changes were ordered by the Constitutional Court, which looked at a lawsuit filed by the Trade Union Federation against the Job Creation Law. Under the new government regulation 49/2025, Minimum Wage was set taking into account the cost of a decent standard of living, strengthening the wage council's role, and reinstating sectoral Minimum Wage at the provincial, regency, and city levels. Job loss security has also changed under GR 7/2025. It reduces the portion of the contribution paid by the government and other insurance programs from 0.46% to 0.36% of the workers' monthly wages. But the good news is that the benefits are better than before: workers get 60% of their monthly salary in cash for the first 6 months after being laid off. The laid-off proof to receive the benefits has also been simplified; workers can use a letter from the regional manpower office.
Another revision concerns the company's OSH committee's obligation to report their activities every 6 months to the Ministry of Manpower's information application. Expanding the definition of workplace accidents with physical violence and rape that happens at work or in the context of an employment relationship. Companies are prohibited from discriminating during recruitment, such as imposing age requirements unless the age relates directly to the job type.
