Working hours
Additional information e.g. payments of overtime and working at night, bonuses, holidays, and alike:<br/>Paid annual leave (Article 111 Labour Code 2012) An employee who has 12 months in full to work for an employer shall be entitled to annual leave fully paid under the labor contract as follows: a) Twelve (12) working days shall apply to employees working in normal working conditions;<br/>b) Fourteen (14) working days shall apply to persons working in heavy, dangerous, or toxic jobs, or in places with harsh living conditions and to the employee under the age or the disabled employee. c) Sixteen (16) working days shall apply to persons working in extremely heavy, dangerous, or toxic jobs, or to the persons working in places with extremely harsh living conditions . Payments of overtime and working at night (Article 97 Labour Code 2012) 1. Overtime work is paid according to salary unit price or the salary by the job duties as follow: Normal days at least 150% Weekly days off at least 200% On holidays and days-off with pay at least 300% not including the salary of holiday and days-off for employee enjoying daily salary 2. Working at night Is additionally paid at least 30% of the salary calculated by the salary unit price or the work salary under a normal working day 3. Working overtime at night in addition to the salary as prescribed in Clause 1 and Clause 2, the employee shall also be paid an additional 20% of salary calculated by the salary unit price or the salary of work done in the day time Payments of holidays (Article 115 Labour Code 2012) 1. An employee shall be entitled to have fully paid days off on the following public holidays: Calendar New Year Holiday one day (the first day of January of each calendar year) Lunar New Year Holidays five days Victory Day one day (the thirtieth day of April of each calendar year) International Labour Day one day (the first day of May of each calendar year) National Day one day (the second day of September of each calendar year) Hung Kings Commemoriations one day (the tenth day of March of each lunar year) 2. The employees who are foreign citizens working in Vietnam, besides the holidays as prescribed in Clause 1 of this Article, they also take an additional day of traditional Tet and 01 day of their country's National Day. 3. Where the public holidays as prescribed in clause 1 of this Article coincide with a weekly days- off, the employee shall be entitled to take the succeeding compensatory days-off instead. Payments of bonuses (Article 103 Labour Code 2012) Is the amount that employer rewards the employee based on the annual business and production results and the level of work completion of the employee. The regulation on bonus shall be decided by the employer and publicly announced at the workplace after consulting the representative organization of the labor collective at the grassroots level.
