February 2025 - Brazil - São Paulo Municipality Declares War on 99 and Uber, but Justice prevails: Banning Services is not Costitutional

The mayor of São Paulo, Ricardo Nunes, has filed a criminal case against the transport platform 99 and will ask for the measures taken against 99 to be extended to Uber. These measures include lawsuits and even the confiscation of motorcycles registered with the platform.

The city has filed a public civil lawsuit in the 8th Court of Public Finance, requesting a daily fine of R$ 1 million for "collective moral damage and crimes of disobedience against 99". The court ruled that 99 could not be fined: the judge pointed out that several of the country's capitals have private passenger transport services on motorbikes, and that the STF had confirmed that it was unconstitutional to prohibit or restrict private transport by drivers of applications.

However, the city has said that it will file a complaint with the civil police, informing them of the violation of the law and filing a criminal complaint. This will result in a police investigation.
