These Website terms and conditions (hereafter also: the “Web T&C”) apply to your use and access of all websites operated by the WageIndicator Foundation, including (but not limited to) WageIndicator.org and all its subsites.
You accept the Web T&C by:
- using any of our tools or databases (such as our unpaid Living Wage or Minimum Wage database);
- otherwise using or accessing any website operated by the WageIndicator Foundation; or
- otherwise indicating you accept these Web T&C.
Do you (or does your employer) also have a paid data subscription or any other services contract with us? Then these Web T&C apply in addition to that services contract. If there is any contradiction between the Web T&C and the services contract, the services contract prevails.
General disclaimer
Use of our websites (including the online tools and databases) and the information on our websites is at your own risk. All data, tools and information are provided ‘as is’, without any guarantees regarding accuracy, fitness for use or non-infringement.
Scope of use
The content (including data, databases, tools and information) on our websites may only be used for internal, personal, non-commercial and informational purposes, such as:
- internal benchmarking of the salaries paid by an employer;
- implementing and following up on wage policies of an employer;
- negotiating a worker's salary or a worker's rights;
- checking for labour law compliance;
- facilitating internal and external reports on compliance of an employer with laws, regulations or codes of conducts; and
- facilitating the annual report of an employer.
When using our content for facilitating reports, please note that no content can be shared through or deduced from these reports. Additionally, it is required that the WageIndicator Foundation is cited as a source. Use of the WageIndicator logo is encouraged for such citations. For these purposes, the WageIndicator logo can be used upon request.
Copying, reverse engineering, web scraping (or using any similar techniques), publishing, selling, transmitting or otherwise making available any part of our content, is not permitted.
How we collect our data
The very concept of WageIndicator requires the data needed for the calculation of salaries, Living Wages and factory pages to be volunteered (anonymously) by visitors to our sites and apps, as well as our trained data collectors.
Limitation of liability
We take great care in developing and maintaining the WageIndicator sites and data. Although the datasets are cleaned, scientifically checked and benchmarked, no responsibility can be taken for its being 100% accurate. The information and data displayed on WageIndicator websites is not necessarily comprehensive, complete, accurate or up to date at all times.
The WageIndicator Foundation, or persons involved in developing and maintaining the sites, can’t be held responsible or liable for any actions, conclusions or advice based on the content on the WageIndicator websites.
The information and data provided is general in nature only and not intended to address the specific circumstances of any particular individual or entity. Therefore, visitors to the WageIndicator websites can in no way derive any rights from this data. Individuals seeking personal, professional or legal advice should always consult a suitably qualified professional. If, in your opinion, the WageIndicator sites include any page, document or other item that contains incorrect information, please let us know.
Third party links
The WageIndicator websites sometimes link to external sites. The WageIndicator Foundation has no control and assumes no responsibility for these third party websites: the content of third-party sites referenced to or linked through the WageIndicator sites, is the sole responsibility of those parties.
Intellectual property and no AI use
The content of the WageIndicator.org websites is protected by intellectual property rights, such as database rights, copyrights and rights related to know-how and trade secrets. All content is owned or controlled by WageIndicator and WageIndicator explicitly reserves all of its intellectual property rights.
It is strictly forbidden to store, review, transmit or otherwise process any of our content in combination with an artificial intelligence tool or similar technology. The user will ensure that WageIndicator content will NOT be:
- Used to train, test, process, analyse, generate output with and/or develop any algorithm, artificial intelligence tool or similar technology.
- Repackaged, duplicated, re-sold, or provided through internal/external artificial intelligence services or similar technology.
In the event of violation of this section ("Copyright & Ownership"), the user shall forfeit to WageIndicator an immediately payable penalty of EUR 25.000 for each violation, increased by EUR 5.000 for each day during which the violation continues, without prejudice to WageIndicator’s right to claim full compensation for damages instead of this penalty and without any notice of default required by WageIndicator.
Miscellaneous
We have the right to change these Terms of Use at any time. The new terms of use will enter into force upon publishing them on our website.
These Terms of Use are governed by Dutch law. In case of disputes related to the use of our websites, the courts of Amsterdam, the Netherlands, have jurisdiction.These Website terms and conditions of use govern your use of the WageIndicator websites. If you choose to use any of our websites, the tools and services on our websites, you accept these terms and conditions.
