Congés pour motifs exceptionnels
The Labour Code primarily outlines provisions for general leaves such as annual leave, sick leave, maternity leave, and public holidays, but also includes among these the leave for executive training and participation in sports and cultural activities.
It is mentioned that within the annual limit of a minimum of thirty (30) days, which are not deductible from the duration of paid leave, special unpaid leave may be granted to the employee to allow them, as the case may be:
- To attend an official sports or cultural education course;
- To represent the Central African Republic in a national or international sports or cultural competition;
- To attend trade union activities to which they are delegated by virtue of a regular mandate.
In order to be effective, employees wishing to participate in the activities provided above must submit a request. The request for special leave must be submitted by the employee at least one (1) week before its effective date.
Other types of leave, such as compassionate, marriage, and bereavement, are explicitly detailed in the Collective Bargaining Agreement on commerce.
As for the latter case, it is stipulated that exceptional permissions on the occasion of family events directly affecting the employee's own household may be granted to the employee without salary deduction, up to a limit of 15 days per calendar year, upon presentation of civil status documents or conclusive justification under the following conditions: Marriage of the employee(3 days), marriage of a child, brother, or sister(1 day), death of spouse(6 days), death of an ascendant or descendant is for 5 days (2 paid days and three unpaid days), death of a brother or sister for 3 days (1 paid day and two unpaid days), childbirth by the employee's wife is about 3 days (2 paid days and one unpaid day) and Baptism of a child(1 day).
In the case of death and childbirth, the employee must inform their employer by any means within 48 hours following the cessation of work, failing which they will be considered to have resigned.
