FOR TWO(2)YEARS VAILIDATION ពីថ្ងៃទី១៧ ខែធ្នួ ឆ្នាំ២០១០ ដល់ ថ្ងៃទី១៧ ខែធ្នួ ឆ្នាំ២០១២ ( 17thDECEMBER 2010-17thDECEMBER 2012) អនុសញ្ញារួមលើកទី៤ រវាង និយោជកនៃក្រុមហ៊ុនសណ្ឋាគារសាន់វេ និង សហជិពនិយោជិតនៃសណ្ឋាគារសាន់វេ (SEU)សេចក្តីផ្តើម
អនុសញ្ញារួមគឺជាកិច្ចព្រៀងជាលាយល័ក្ខអក្សររវាងសហជីពនិយោជិត និងនិយោជក ក្នុងគោលបំណងកសាងទំនាក់ទំនង និងជាដៃគូធ្វើការងារល្អរវាងសហជីពនិយោជិត និងនិយោជក លើកកម្ពស់លក្ខ័ណ្ឌការងារ ការគោរពច្បាប់ ការគោរពវិន័យ និងការទទួលខុសត្រូវក្នុងការងារ ។ ជាងនេះទៅទៀត អនុសញ្ញារួមសំដៅលើកនម្ពស់ ប្រសិទ្ធភាពការងារ និងកិត្តិនាមរបស់របស់ សណ្ឋាគារព្រមទាំងការពាជម្លោះការងារនានាដែលអាចកើតមាននៅពេលអនាគតដោយរក្សាកា រពារផលប្រយោជន៍ភាគីទាំងសងខាង ។ សហជីពនិយោជិតនៃសណ្ឋាគារសាន់វេ និងអ្នកគ្រប់គ្រងសណ្ឋាគារសាន់វេ បានព្រម ព្រៀងគ្នាលើប្រការនានាដូចខាងក្រោមៈ សហជីពនិយោជិតនៃសណ្ឋាគារសាន់វេ ( Sunway Employees Union Hotel Phnom Penh ) ហៅថា << សហជីព >> ដែលមានទីតាំងនៅផ្ទះលេខ ១២ ផ្លូវលេខ ៦១៨ សង្កាត់ បឹងកក់២ ខណ្ឌ័ទោលគោក រាជធានីភ្នំពេញ ។ ឯអ្នកគ្រប់គ្រង (Management ) នៃសណ្ឋា គារសាន់វេ ចាប់ពីពេលនេះតទៅហៅថា << និយោជក >> ដែលមាន ទីតាំងនៅ សណ្ឋាគារ សាន់វេ ។ កិច្ចព្រមព្រៀងនេះ យកច្បាប់ស្តីពីការងារនៃព្រះរាជាណាចក្រកម្ពុជា ជាមឲបន្ទាត់អប្បរមា មិនមានចំណុចណាមួយត្រូវមានកំណត់ទាបជាងច្បាប់ឡើយ ។ រាល់ចំណុចនានាដែលមិនបាន ចែង ក្នុងកិច្ចព្រមព្រៀងនេះ ត្រូវអនុវត្តតៅតាមច្បាប់ស្តីពីការងារនៃព្រះរាជាណាចក្រកម្ពុជា ។ សហជីពនិយោជក នឹងចរចាដោយភាពស្មោះត្រង់ និងគោរពទៅតាមនីតិវិធីនៃការចរចា ដែល បានព្រមព្រៀង និងចុះហត្ថលេខារួចហើយនោះ ។ប្រការ១: ការទទួលស្គាល់សហជីព
ក. និយោជកទទួលស្គាល់តែសហជីពនេះទេ ដែលមានភាពជាតំណាងបំផុត និង ទទួល ស្គាល់ដោយរដ្ឋមន្រ្តី ក្រួងសង្គមកិច្ច ការងារបណ្តុះបណ្តាលវិជ្ជាជិវះ និងយុវនីតិសម្ប ទាតាម លិខិតចុះបញ្ជជីការលេខ ៤៥៧ សកបយ.អក. ចុះថ្ងៃទី០៣ ខែមេសា ឆ្នាំ២០០៣ ដែលជាភាគីតែមួយគត់មានសិទ្ធិតំណាងឱ្យកម្មករនិយោជិតនិងធ្វើកិច្ចព្រម ព្រៀងនានាជា មួយ និយោជករួមទាំងអនុសញ្ញារួមផងដែរ ។ ខ. អ្នកគ្រប់គ្រងថ្នាក់ខ្ពស់ ដូចជាអ្នកមានសិទិ្ធជ្រើសរើស បញ្ឈប់ ដាក់ពិន័យ និងព្រមានដល់កម្មករនិយោជិតមិនអនុញ្ញាតឱ្យចូលជាសមាជិកសហជីព និងមិនគ្របដណ្តប់ ដោយGនុសញ្ញារួមនេះដែរ ។ គ. មានតែសមាជិកសហជីពនេះទេ ដែលមានសិទ្ធិអមកម្មរនិយោជិត ពេលមានបញ្ហា វិវាទបុគ្គល ឬវិវាទរួម និងមានសិទិ្ធស៊ើបអង្កេតបណ្តឹងអំពីកម្មករនិយោជិតទៃងឡាយ នឹងដោះ ស្រាយវិវាទទាំងឡាយព្រមទាំងដោះស្រាយបណ្តឹងសារទុក្ខដោយត្រឹមត្រូវនិងយកជាផ្លូវការ ។ប្រការ២: សិទ្ធិសហជីព
ក. ប្រធាន អនុប្រធាន អគ្គលេខាធិការ សហជីព ឬតំណាងដែលចាត់តាំង អាចចូលរួម ប្រជុំដោះស្រាយបណ្តឹងសាទុក្ខ ជាមួយកម្មករនិយោជិត និយោជករាលពេលមានបញ្ហា ហើយនិ យោជកមិនកាត់ប្រាក់ឈ្នួល ប្រាក់រង្វាន់ ចំពោះប្រធានអនុប្រធាន អគ្គលេខាធិកា និងកម្មករនិយោជិតរាល់ពេលប្រជុំដោះស្រាយបណ្តឹងសាទុក្ខ ។ ខ. សហជីព និងទីប្រឹក្សាជាន់ខ្ពស់ ទីប្រក្សានៃសហជីព និងនិយោជក និងរៀបចំ ឱ្យមានការប្រជុំដោះស្រាយវិវាទឱ្យបានលើនដើម្បីបន្ថយឱ្យតិចបំផុតក្នុងការរំខានដល់សង្វាក់ប្រតិបត្តិការសេវាកម្មការងារ ។ គ.ផ្តល់ពេលវេលាសម្រាប់ថ្នាក់ដឹកនាំសហជីបទៅរៀនសូត្រជាមួយអង្គការក្រៅរដ្ឋាភិបាលនានានៅពេលមានលិខិតអញ្ជើញទៅតាមកាសម្រេចរបស់សហជីព និងមានការឯកភាពពីគ ណៈ គ្រប់គ្រងដោយមានប្រាក់ឈ្នួល ហើយនិយោជកមិនត្រូវកាត់ប្រាក់ខែ ប្រាក់រង្វាន់ សម្រាប់ប្រធាន សហជីព អនុប្រធាន អគ្គលេខាធិការ អគ្គហិរញ្ញិក និងទីប្រឹក្សាសរុបចំនួន ១១ នាក់ ដែល មាន ឈ្មោះដូចខាងក្រោមៈ ១. អ្នកស្រី ឈុំ ចាន់ថន ប្រធាន ២. លោក ប្រាក់ សោភ័ន អនុប្រធាន ៣. លោក វាន់ សុខា លេខាធិការ ៤. លោក ជុំ ផល្លា ហិរញ្ញិក ៥. លោក ដាំ សុផាត ទីប្រឹក្សាជាន់ខ្ពស់ ៦. អ្នកស្រី ហឿង សុវត្តី ទីប្រឹក្សា ៧. អ្នកស្រី ហ៊ិន សុម៉ាល័យ ទីប្រឹក្សា ៨. កញ្ញា អេង រក្សា ទីប្រឹក្សា ៩. កញ្ញា លី ថាវី ទីប្រឹក្សា ១០. លោក ប៊ុតបញ្ញា ទីប្រក្សា ១១. អ្នកស្រី សាវិន កញ្ចនា អនុប្រធានគណៈកម្មការស្ត្រី ឃ. សហជីពត្រូវបង្ហាញលិខិតអញ្ជើញ និងឈ្មោះអ្នកចូលរយមដល់និយោជក ដើម្បីធ្វើ ការសម្រេចឱ្យបានឆាប់តាមដែលអាចធ្វើតៅបាន មុនពេលដែលពិធីការងារ មករៀន សូត្រនានា ។ ង. ផ្តល់សិទ្ធិឱ្យតំណាងអង្គការនានាសហព័ន្ធសហជីពកម្មករនិយោជិតវិស័យ ទេសច រណ៍ សេវា កម្ពុជា ឬមេធាវីអាចចូលក្នុងសណ្ឋាគារបានពេលមានការអញ្ជើញ សហជីព ដើម្បី ផ្ទៀងផ្ទាត់ការអនុវត្តអនុសញ្ញារួមនិងដោះបណ្តឹងសាទុក្ខរួមទាំងការអប់រំនានាដូចជាការ បង្រៀន ច្បាប់ការ ងារជាដើម ឬកិច្ចការផ្សេងៗទៀតរបស់សហជីព ។ ច. សហជិពនិងជុនដំណឹងដល់និយោជក ក្នុងពេលដេលមានការអញ្ជើញពីសហជិព នោះត្រូវបានធ្វើឡើង ។ និយោជនមិនត្រូវជ្រៀតជ្រេកកិច្ចការផ្ទៃក្នុងសហជីព គំរាម កំហែង បំផិតបំភ័យ លួងលោម ឬទិញទឹកចិត្តថ្នាក់ដឹកនាំ និងសមាជិកសហជីពទេ ហើយបើកសិទ្ធិឱ្យ កម្ករនិយោជិតជ្រើសរើសថ្នាក់ដឹកនាំសហជីពដោយសេរី ។ ឆ. និយោជកត្រូវកាត់វិភាគទាន សមាជិកសហជីពដែលមានសមាជិកនោះសុំឱ្យកាត់ ចូលគណៈនេយ្យធនាគារសហជីព ឬមន្រ្តីសហជីពទាំងបួននាក់ ប្រធាន អនុប្រធាន អគ្គលេ ខាធិការ និងអគ្គហិរញ្ញិក ។ ប៉ុន្តែត្រូវផ្តល់បញ្ជីឈ្មោះមកផ្នែក គណៈនេយ្យរបស់ សណ្ឋាគារ រៀង រាល់ខែ ដោយមានចុះហត្ថលេខាទទួលស្គាល់នូវខែដំបូងផង ។ ជ. ប្រធាន អនុប្រធាន ឬទីប្រឹក្សា សហជីពយ៉ាងតិច ២ នាក់មានសិទ្ធិ អមកម្មករ និយោជិតពេលចូលប្រជុំជាមួយក្រសួង ឬស្ថាប័នផ្សេងៗ ពេលកម្មករនិយោជិតមានរឿង ត្រូវដោះស្រាយ ដោយរក្សាទុប្រាក់ខែ នឹងប្រាក់រង្វាន់ ប៉ុន្តែត្រូវជម្រាបជូនដំណឹង និងមាន ការឯកភាពពីគណៈ គ្រប់គ្រងជាមុន ។ ឈ. សហជីព និងនិយោជកត្រូវជួបគ្នា្ ២ខែម្តង ដើម្បីពិភាក្សា និងរក្សាទំនាក់ ទំនង ការងារល្អរវាងសហជីព និងនិយោជក ។ ញ. សហជីពអាចមានប្រជុំ ៣ខែម្តងជាមួយសមាជិករបស់ខ្លួនបានក្នុង រយះពេល អតិបរមា មួយម៉ោងសាមសិបនាទី ដោយមិនធ្វើឱ្យមានការប៉ះពាល់ដល់អាជីវ កម្មរបស់ សណ្ឋាការ ហើយ និយោជកនឹងផ្តល់ទីកន្លែងសម្រាប់ប្រជុំដោយមាន ការស្នើរសុំពីសហជីព ជាមុន។ ដ. និយោជិកនឹងអនុញ្ញាតិ្តឱ្យសហជីពរៀងរាល់ពីរសប្តាហ៍ម្តងនូវបន្ទប់រយះពេល មិន លើស ពីបីម៉ោងសម្រាប់ធ្វើការងារសហជីព នឹងអនុញ្ញាតិឱ្យថតចម្លង ឬព្រីនឯក សារបន្តិច បន្តូចប៉ុណ្ណោះ ការព្រីននេះអាចធ្វើនៅ F&B កុំព្យូទ័របាន ដែលសហជីពត្រូវស្នើរ សុំបន្ទាប់ ជាមុន ។ប្រការ៣: សីលធម៌ និងសេចក្តីថ្ងៃថ្នូរក្នុងកន្លែងការងារ
ក. និយោជកផ្តល់ការណែនាំដល់ថ្នាក់ដឹកនាំជាន់ខ្ពស់ ថ្នាក់កណ្តាល និងថ្នាក់ទាបឱ្យ ប្រើអាកប្បកិរិយា ពាក្យសំដីសមរម្យលើកម្មករនិយោជិត អ្នកនៅក្រោមបង្គាប់ ដោយងនុឡោម ទៅ តាមវិន័យការងាររបស់សណ្ឋាគារ ។ ខ. បើមានការជេរប្រមាថ ឬសកម្មភាពមើលងាយនានា ពីអ្នកគ្រប់គ្រងទាំងនោះ និយោ ជកនិងត្រូវផ្តល់ការព្រមាន ១ ដង ឬ ២ដង បើមិនកែប្រែ សហជីពមានសិទ្ធិ ស្នើសុំឱ្យ និយោជកប្តូរការងារ ចាត់វិធានការនានាតាមការជាក់ស្តែង ឬបណ្តេញចេញពីការងារត្រូវ អនុ ឡោម តាមបតបញ្ជាផ្ទៃក្នុងរបស់សណ្ឋាគារដែលមាន ។ គ. កម្មករនិយោជិតដែលរងការមើលងាយ ឬការបៀតបៀននានាត្រូវប្តឹង ជាលាយ ល័ក្ខ អក្សរមកសហជីព មិនឱ្យហួសពី ៥ថ្ងៃក្រោយពីមានរឿងកើតឡើង ហើយសហជីព ស៊ើប អង្កេត យ៉ាងយូរ ៧ថ្ងៃ ទើបសម្រេចជាការមើលងាយ ឬមិនមែន ។ បើរកឃើញថា មានអំពើរ ដូចការ ចោទប្រកាន់ ទើបសហជីពយករឿងទាំងនោះទៅដោះស្រាយជាមួយនិយោជក ។ ឃ. សហជីពនិងនិយោជកនឹងមិនអនុញ្ញាត្តិឱ្យមាននូវអំពើរបៀតបៀនផ្លូវភេទឡើយ ហើយនិយោជកត្រូវដោះស្រាយបណ្តឹងទាក់ទងនឹងការបៀតបៀនផ្លូវភេទដោយយក ចិត្តទុក ដាក់ និងម៉ត់ចត់បំផុត ។ប្រការ៤: គិលានដ្ឋានក្នុងសណ្ឋាគារ
ក. គិលានដ្ឋាកក្នុងសណ្ឋាគារត្រូវស្អាត គ្មានផ្សែង គ្នានក្លិន មានពន្លឺគ្រប់គ្រាន់ គ្មាន សម្លេងឮខ្លាំង គ្មានធូលី ខ្យល់អាអាកាសគ្រប់គ្រាន់ ។ គ្រែនីមួយៗត្រូវមានសម្ភារគ្រប់គ្រាន់។ គិលានដ្ឋាននេះត្រូវមានឱសថគ្រប់គ្រាន់ និងប្រចាំការដោយគិលានដ្ឋាន ឬគិលាននុបដ្ឋា យិកា ចំនួន១រួប រាល់ម៉ោងធ្វើការ និងវេជ្ជបណ្ឌិត ១រួប ប្រចាំការមួយថ្ងៃ៤ម៉ោងយ៉ាងតិច ឬ៨ ម៉ោង ពេញដូចបុគ្គលិកធម្មតា ។ ខ. គ្នុងគិលានដ្ឋានត្រូវមាន ធុងទឹកក្តៅ និងទឹកត្រជាក់ចំនួន ១ធុង កែវ ប្រដាប់ ទ្រកែវ តុធ្វើការ ១ កៅអីមានបង្អែក២ ទូរដាក់ឯកសារ១ ទូរដាក់ឱសថ១ បរិក្ខាសំលាប់ រោគ (SterListeur)១ព្រមទាំងមានថាមពលអគ្គិសនី គ្រប់គ្រាន់សម្រាប់ប្រើប្រាស់ ឧបករណ៍ សម្លាប់មេរោគនិងគ្រឿងបរក្ខាផ្សេងទៀតដែលមាន ។ គ. ត្រូវមានបរិក្ខាពេទ្យ ពូកខ្នើយ កម្រាលពូកគ្រប់គ្រាន់ និងឱសថគ្រប់ប្រភេទនិងថ្នាំ ពេទ្យក្នុងសណ្ឋាគារត្រូវធ្វើឡើងដោយ មិនគឹតប្រាក់ និងគ្មានការរើសអើង ឡើយ។ ឃ. និយោជកជាអ្នកចេញសោហ៊ុយព្យាបាលជម្ងឺនៅគ្លីនិចសណ្ឋាគារ និងគ្លីនិចខាង ក្រៅដែលសណ្ឋាគារបានកំណត់ដោយអនុលោមតាមគោលនយោបាយសុខភាពដែល មាន ចែងរួច ហើយក្នុង សណ្ឋាគារ ។ ង. បទបញ្ជារបស់សណ្ឋាគារទាំងឡាយណាដែលផ្ទុយពីប្រការនេះត្រូវទុកជាមោឃះ ។ប្រការ៥: ការជួលកម្មករនិយោជិតឱ្យបម្រើការងារ
ក. កិច្ចសន្យាការងារសម្រាប់កម្មករនិយោជិតម្នាក់ៗត្រូវអនុវលោមតាមអនុសញ្ញារួម កិច្ចសន្យាការងារតត្រូវធ្វើឡើងតាមៈ ១. កិច្ចសន្យាការងារសម្រាប់កម្មករនិយោជិតម្នាក់ៗត្រូវជាកិច្ចសន្យាដែលមានថេរវេលាកំណត់ ឬមិនកំនត់ដោយផ្អែកតាមច្បាប់ស្តីពីការងារត្រង់មាត្រាទី ៦៧ ។ ២. រយៈពេលសាកល្បង ឬបណ្តោះអាសន្នយ៉ាងច្រើនបំផុត ៣ខែនឹងព្យាបាន៣ខែ ទៀតប្រសិនបើលើសពីរយៈពេលនេះត្រូវចាត់ទុកថាគាត់ពេញសិទ្ធិដោយស្វួ័យប្រវត្ត ហើយ ប្រាក់ខែ ទាបបំផុត ៧៥ ដុល្លា មានប្រសិទ្ធិភាពចាប់ពីថ្ងៃទី០១ ខែមករា ឆ្នាំ២០១១ តទៅ ។ ៣. កម្មករនិយោជិតបណ្តោះអាសន្នដែលនិយោជកត្រូវកាជួលឱ្យបម្រើការពេលពេល មានការងារច្រើនត្រូវកំណត់ចំនួនយ៉ាងច្រើនបំផុត ២០នាក់ ប្រាក់ខែនិយោជិតបណ្តោះ អាសន្នត្រុវទ ទួលបានយ៉ាងទាបបំផុត ៩០ដុល្លា ក្នុងមួយខែ មានប្រសិទ្ធិភាពចាប់ពីថ្ងៃទី០១ ខែមករា ឆ្នាំ ២០១១ តទៅ ។ ៤. និយោជកមិនត្រូវបណ្តញចេញ ឬបញ្ចប់កិច្ចសន្យាការងារ ព្យូរកិច្ចសន្យាការងារ ឬដាក់ពិន័យដោយអុត្តិធម៌មិនស្រាបច្បាប់ និងដោយគ្មានមូលហេតុសមស្របឡើយ ។ និយោ ជក មិនត្រូវរើសអើងចំពោះកម្មករនិយោជិតដែលដាក់ពាក្យសុំបម្រើការងារនូវ ពូជសាសន៍ សាសនា អាយុ ភេទ និងការចូលជាសមាជិកសហជីពនោះឡើយ ។ គ. អតីតភាពត្រូវទទួលបានរាល់ឆ្នាំ ហើយត្រូវរក្សាបើសិនជាមានការផ្លាស់ប្តូរការងារ ឬទំហំការងារ ។ ឃ. អតីតភាពការងារត្រូវរាប់ចាប់តាំងពីពេលចូលធ្វើការសាកល្បង ឬបណ្តោះ អា សន្នមក ។ និយោជកត្រូវផ្តល់ឱកាសទៅដល់កម្មករនិយោជិតណាដែលមានអតីតភាពការងារយូរ នូវអ តិ ភាពទទួលបានការងារពិសេស និងតម្លើងឋានៈ ឬមានសិទ្ធិស្មើគ្នា ប្រសិនបើបុគ្គលិកទាំងនោះអនុវត្តការងារបានល្អប្រសើរតាមគោលការណ៍របស់សណ្ឋាគារ ។ ង. ការផ្អាកការងារដោយមានបញ្ហាសេដ្ឋកិច្ចនិយោជកមានសិទ្ធិសម្រេច រួចជូនដំណឹង ដល់សហជីព ។ កម្មករនិយោជិតដែលត្រូវបានផ្អាកការងារដោយបញ្ហាសេដ្ឋកិច្ចនេះ ត្រូវបាន ដាក់ ក្នុងបញ្ជីហៅមកធ្វើការវិញមុនគេហើយអាចដាក់ពាក្យសុំការងារជាថ្មីដូចជាកម្មករ និយោ ជិតបច្ចុ ប្បន្នដែរ ។ ច. និយោជកត្រូវជូនដំណឹងអំពីការទទួលយកកម្មករនិយោជិតឱ្យមកចូលធ្វើការសា ជាថ្មីតាមរយះក្តាប្រ កាសព័ត៌របស់បុគ្គលិក និងជូនដំណឹងដល់កម្មករនោយោជិត ណាដែល មានក្នុង បញ្ជីហៅឱ្យចូលមកធ្វើការបានឆាប់តាមដែលអាចធ្វើបាន ។ ឆ. កម្មករនិយោជិតដែលចូលរួមវគ្គបណ្តុះបណ្តាលក្រោមការតម្រូវរបស់នោយោជក នឹង ត្រូវបានប្រាក់ឈ្នួលជាធម្មតា ។ កម្មករនិយោជិតដែលចូរួមវគ្កបណ្តុះបណ្តាល ក្រៅ កន្លែង ធ្វើការងារ ត្រូវតែទទួលបានប្រាក់បេសកកម្មគ្រប់គ្រាន់ដើម្បី ផ្គត់ផ្គង់នូវរាល់ការចំណាយដែល ទាក់ទងនឹងការបណ្តុះបណ្តាលទាំងនោះរួមទាំងការធ្វើដំនើរការហូបចុកការ ស្នាក់នៅ និងការ ចំណាយបន្ទាប់បន្សំផ្សេងៗដោយផ្អែកលើគោលការណ៍ជាក់ស្តែង ។ប្រការ៦: ការផ្លាស់ប្តូរការងារ និងការផ្លាស់ប្តូរជំនាញការងារ

ក. ត្រូវមានបន្ទប់ទឹក បង្គន់ អនុវត្តតាមប្រកាសលេខ ០៥២ បន្ទប់ទឹកត្រូវស្អាតជានិច្ចដែលមានអ្នកសម្អាត និងធ្វើអនាម័យជាទៀងទាត់ ។ ខ. ត្រូវមានច្រកចេញចូលពេលមានអាសន្ន ការហ្វឹកហាត់ដល់ក្រុមពន្លត់ភ្លើង និងគេចចេញពេលមានអាសន្ន សម្ភារហ្វឹកហ្វឺន នឹងវិធាននានាសម្រាប់សុវត្ថភាពកម្មករនិយោជិត ។ គ. ត្រូវមានកៅអីសម្រាប់អង្គុយម្តងម្កាលសម្រាប់កម្មករនិយោជិតគ្រប់គ្នា ដូចជានៅក្នុង Locker បុរស ស្រ្តី ផ្លូវចេញចុលរបស់បុគ្គលិក និងកន្លែងផ្ញើម៉ូតូជាដើម ។ ដោយឡែកកម្មករ និយោជិត ជាស្ត្រីមានផ្ទៃពោះត្រូវប្តូរមកការងារណាស្រាលដែលអាចជួយសម្រួលឥរិយាបទបានស្រួលដល់ស្រ្តីនោះដោយរក្សាប្រាក់ឈ្នួល ប្រាក់បន្ទាប់បន្សំ និងប្រាក់រង្វាន់ផ្សេងៗទៀតដដែល ។ ឃ. ពេលមើលឃើញថាសុវត្ថភាពការងារមិនល្អ សហជីពត្រូវរាយការណ៍ទៅនិយោជកជាបន្ទាន់ ដើម្បីចាត់វិធានការពារសុវត្ថភាព ។ ង. ប្រព័ន្ធអគ្គិសនី ត្រូវតែធានាសុវត្ថិភាពកុំឱ្យមានការឆក់ ឆ្លងដែលអាចនាំឱ្យឆាបឆេះ ។ ច. និយោជកត្រូវផ្តល់ប្រាក់ចំនួន ២៥០ដុល្លាអាមេរិចជូនដល់កម្មករនិយោជិតសម្រាប់ព្យាបាលជម្ងឺស្រាលៗដែលរួមមាន ថ្ងៃព្យាបាលបន្ទាប់ពីការវះកាត់ទាំងឡាយណាដែលអាចកើតមាន ( កម្មករនិយោជិតត្រូវផ្តល់វិក័យប័ត្រ និងវេជ្ជបញ្ជារបស់វេជ្ជបណ្ឌិត ) ដល់ក្រុមគ្រួពេទ្យរបស់សណ្ឋាគារ ដើម្បីពិនិត្យមុនអនុញ្ញាតឱ្យមានការទួរទាត់សង ។ ការទួរទាត់នេះ អនុវត្តរហូតដល់មានគោលការណ៍ស្តីពីរបបធានារ៉ាប់រងសុខភាពរបស់រដ្ឋចចូលជាធរមាន ។ ឆ. និយោជកការពារទ្រព្យសម្បត្តិកម្មករនិយោជិត មានយាន្តជំនិះនិងមានទូរប្រអប់ដែលមានសោរសម្រាប់កម្មករនិយោជិតទុដាក់សម្ភារមិនឱ្យបាត់បង់ ។ ជ. យោជកផ្តល់ឯកសណ្ឋាន៣សម្រាប់ក្នុងមួយឆ្នាំស្បែកជើង នឹងសម្ភាររក្សាសុវត្ថភាពនានាទៀតតាមមុខងាររបស់គេ ។ ឈ. ផ្តល់ការជប់លៀង១ដងរាល់ឆ្នាំមុនពេលបុណ្យចូលឆ្នាំខែ្មរ ។ ញ. ក្នុងចំណុច “ញ” ភាគីទាំងពីរឯកភាពយកតាមគម្រោងស្តីពី << អត្ថប្រយោជន៍បុគ្គលិក ពេលមានគ្រោះថ្នាក់ >> របស់សណ្ឋាគារដែលមានខ្លឹមសារដូចខាងក្រោមៈ ១). គ្រោះថ្នាក់ការងារ ក. និយោជកផ្តល់បៀវត្តរ៍២ខែពេញ នឹងប្រាក់ធានានុគ្រោះសម្រាប់ពីរខែដំបូង មន្ទាប់មកនិងត្រូវអនុលោមតាមគោលការណ៍ របស់របបសន្តិសុខសង្គម ។ ខ. ចំណាយលើការព្យាបាលខាងវិជ្ជសាស្រ្ត នឹងត្រូវអនុឡោមតាមគោលការណ៍របស់របបសន្តិសុខសង្គម និងឬធានារ៉ាប់រង ។ គ. និយោជកអនុញ្ញាតឱ្យឈប់ ៤ខែទៀត ដោយគ្មានប្រាក់បៀវត្តរ៍ និងរក្សាការងារឱ្យនៅដដែលសម្រាប់គ្រោះថ្នាក់ដែមមិនអាចត្រឡប់មកធ្វើការបាន ។ ២). គ្រោះថ្នាក់ដែលមិនពាក់ព័ន្ធការងារ ក. និយោជកផ្តល់បៀវត្តរ៍២ខែពេញ និងប្រាក់ធានានុគ្រោះសម្រាប់ពីខែដំបូងប៉ុណ្ណោះ ។ ខ. ចំណាយថ្លៃព្យាបាលខាងវេជ្ជសាស្រ្ត នឹងត្រូវអនុលោមតាមគោលការណ៍របស់ធានារ៉ាប់រងរបស់សណ្ឋាគារ ។ គ. និយោជកអនុញ្ញាតឱ្យឈប់ ៤ខែទៀត ដោយគ្មានប្រាក់បៀវត្តរ៍ និងរក្សាការងារឱ្យនៅដដែលសម្រាប់គ្រោះថ្នាក់ដែមមិនអាចត្រឡប់មកធ្វើការបាន ។ ៣). គ្រោះថ្នាក់ដែលបណ្តាលឱ្យពិកា មិនអាចធ្វើការបានតទៅទៀត ក. និយោជកផ្តល់បៀវត្តរ៍២ខែពេញ និងប្រាក់ធានានុគ្រោះគោលការណ៍ដែលសណ្ឋាគារ បានកំណត់បន្ទាប់មកនឹងធ្វើតាមគោលការណ៍របស់ បសស បើសិនជាគ្រោះថ្នាក់ក្នុងម៉ោងការងារ ។ ខ. ផ្តល់ការព្យាបាលខាងវេជ្ជសាស្រ្ត ដូចដែលបានកំណត់ក្នុងគ្រោង ធានារ៉ាប់រង បច្ចុប្បន្ន និងឬអនុលោមតាមឡឲគោលការណ៍របស់បសស ។ គ. អត្ថប្រយោជន័នៃការបញ្ឈប់ពីការងារ ពិចារណាបង់កម្រៃអតិតការងារ តាមគោលការណ៍សណ្ឋាគារដែលបានកំណត់ ។ ប្រសិនប់មានការផ្តល់កម្រៃអតិតការងារ នោះនិងមិនាមានប្រាក់បៀវត្តរ៍បន្ថែមផ្សេងទៀតទេ ។ ឃ. អត្ថប្រយោជន៍ដ៏ទៃទៀត ដែលពាក់ព័ន្ធនិងការប្រើប្រាស់មូនិធិសង្គ្រោះ ត្រូវតែទទួលបានការឯកភាពពីគណៈកម្មការសហជីព និងអ្នកគ្រប់គ្រងសណ្ឋាគារ ។ ៤). គ្រោះថ្នាក់នាំទៅដល់ការបាត់បង់ជីវិត ក. សណ្ឋាគារផ្តល់ប្រាក់តាមរយះក្រុមហ៊ុន ធានារ៉ាប់រងបច្ចុប្បន្ន និងឬតាមរយះរបបសន្តិសុខសង្គម ។ ខ. សណ្ឋាគារផ្តល់ប្រាក់ទួទាត់សរុប ទៅតាមអត្រាឆ្នាំដែលបានបម្រើការងារ ។ គ. អត្ថប្រយោជន៍ដទៃទៀត ដែលពាក់ព័ន្ធនិងការប្រើប្រាស់មូលនិធិសង្រ្គោះត្រូវតែទទួលបានការឯកភាពគឺគណៈកម្មការសហជីព និងអ្នកគ្រប់គ្រងសណ្ឋាគារ ។ប្រការ ១៤: មូលនិធីសុខមាលភាព នីតិវិធីប្រើប្រាស់

The collective bargaining agreement is the written agreement between the union of employees and the employer for establishing a good relationship and partnership between the union of employee and the employer. It is made to improve working condition respect of law and discipline, and work responsibilities. Moreover , this collective bargaining agreement in made to enhance work efficiency and the reputation of the company in other to prevent any possible work disputes in the future and to provide mutual benefits for both parties. Sunway Hotel Employees Union and Sunway Hotel Management have have agreed upon the following article: Sunway Hotel Employees Union, hereafter to as << Union>>, is locate at No. 12, Street 618, Sangkat Beoung Kok II, Khan Toul Kork, Phnom Penh. Management of Sunway Hotel, hereafter refereed to as << the Employees>>, is situates at Sunway Hotel Phnom Penh. This agreement is made based on labor law of the Kingdom of Cambodia. No items in this agreement are inferior to the ones in the Labor Law. Any items not mentioned in this agreement shall be substituted by those stipulated in the Labor Law of the Kingdom of Cambodia, The union and the employee shall negotiate with honestly and abide by the negotiation procedure that has already been agree upon and signed.ARTICLE 1 RECOGNITION OF UNION
A. The employer to recognize only this union as the most representation and it has been recognized by Minister of MOLSAVY via registration letter no. 457 MOLSAVY. LI. date 3 April 2003 serving as only one party who has right to be representative of employee including CBA covering the company. B. Senior management who has the right to recruit, dismiss, punish or warn employees is not allows to have membership in the union, and he/she is not covered by this CBA. C. This union has the sole right to accompany employee when he/she has individual or collective dispute, and this union also has the right to investing complains files by employee and to solve the problem rightfully and officially.ARTICLE 2 RIGHT OF THE UNION
A. The president, Vie president, Secretary-general or assigned representatives
of the union are able to attend meeting to solve complaints with employee and employer when dispute occurred, and employer not deduct salary, rewards from president, Vie president, Secretary-general, Treasurer and employee, whenever the meeting is held for solving complaints.
B. The union and senior advisor, of union committee and employer to arrange
meeting for solving conflicts as soon as possible to minimize the interruption of service and work operation.
C. The employer shall give union the time for training with organizations when
receiving invitations subject to the decision of the union and approvals of the hotel management, and employer not deduct salary, rewards from Union President, Vie president, Gen Secretary, Treasurer and advisors in the total of 11 persons.

D. The Union shall show invitation and list of participant to employer as soon
as possible before leaving workplace to attend training sessions subject to Management approval.
E. The employer shall give the right to representative of organizations,
federation of Cambodia tourism employees or lawyer to enter the company upon receiving invitation from union in order for them to verify the implementation of agreement and solve grievance including giving training such as Labour Law training or other duties or union.
F. The Union shall inform employer prior an invitation from union is made.
The employer shall not interfere internal affairs of the Union, coerce, intimidate, discriminate, persuade or use money in exchange of favors from union leadership and union members, and should give right to employees to choose union leaders freely.
G. The employer shall transfer union members’ dues requested by the
employees to union’s bank account or four officer’s of union, president general secretary and treasurer. but it is to give name list of the requested members of accounting when the employees having problem to be solved maintaining their acknowledgement at the beginning month as well.
H. President and Vie President or Advisor of union at least 2 persons are
eligible to accompany the employee to attend the meeting with ministries or institution when the employees having problem to be solved maintaining their salary and rewards the sane. but it is to inform to and get approval from the hotel management in advance.
I. Union and employer to meet each other at least 02 month once order to
discuss the work and maintain good ralation between and employe.
J. Union and employer to meet with the member not more than onc and haft
hour and sourer that there is no disrupt the hotel operation , the employer will allow for the room are requested in advance by union.
K. The employer will be allow the room maximum of three hour for very tow
weeks to union to meet their member, union can have a few document photo copy and printing at F&B clerk desk for their work purpose. Union must have advance request.
ARTICLE 3 ETHICE AND DIGNITY AT WORK
A. The employers shall has advice its senior, middle and lower executives to
behave and use appropriate words with the employees being under his /her supervision in accordance with current internal rule & regulation of the hotel .
B. if having any abusive language and looking down actions from the
management, then employer shall give warning 1 or 2 times, if remains unchanged, the union has right to request employer to change their job or take obvious actions or dismissal in accordance with current internal rule & regulations of the hotel.
C. The abused employee is to loge complaint with union later than 5 days after
an incident is happened. the union shall investigate at the lasts of 7 days then to conclude the facet. If found that it is true, then the Union shall bring such case to solve with the Employee
D. The Union and Employee shall not allow sexual harassment activities, and
employee to solve the complaint concerning to such sexual harassment attentively and seriously.
ARTICLE 4 INFIRMARY IN THE HOTEL
A. Infirmary in the hotel is to be clean, no smoke, enough light, no loud noise,
no dust, enough air. Each beds to be supplied with enough materials od bed. This infirmary to have enough medicines, and standby by i nurse every working hours together with 1 doctor to standby at least 4 hours a day or 8 hours a day as regular employee.
B. Infirmary to consist a container of cold & warm water, glass, glass holder, 1
desk , 2 chair, 1 medicine cabinet, 1 sterilizer, and has enough electricity power for sterilizer as well as other facilities.
C. To have enough medical equipment, mattress pillow, deb sheet and all kind
of medicine. All medicine service & medicine in the hotel to be free of charge and no discrimination.
D. The employer is in charge of payment of medical treatment in the hotel
clinic and outside appointed clinic on accordance with the health care policy of the hotel.
ARTICLE 5 HIRING WORKER/ EMPLOYEES
A. Every local employee employment contract is to confirm to BCA, and this
employment contract to be base on:
1. Every local employee employment contract is to be limit or unspecific contract duration based on the article 67 of the Labour Law.
2. Probationary period last in maximum of 3 months and be able to extend 3 month but is over this period, it is to be come permanent employee automatically with minimum wage US $ 70.00 per month effective from January 2011.
3. Casual employee hired during busy time to be limited in maximum of 20 persons. Salary of casual employee 1s US $ 90.00 per month effective from January 2011.
B. The employer shall not fire, terminate employment contract, suspend
employment contract or punish unfairly, illegally & unreasonable. Employer not discriminate employees applying for jobs in the company due to race, religion, age, sex, and be unionized.
C. An employee is eligible to receive seniority every year and maintain the
same if there being any.
D. Seniority to be counted from probationary or temporary period. The
employer shall give opportunity to long servicer staffs of priority to get special
job and promotion, or to get the right equal if those perform his/he duties well in line with the principle of the hotel.
E. Due to economic crisis, the Employer has the right to suspend employees
from work, then to infirm the Union. Suspend employees due to such economic crisis are listed in the priority list of reemployment, and able to re-apply for job same as employees in service.
F. The Employees shall inform of re-employment via employee information
board, and inform new & old employees whose names are in re-employment list as soon as possible.
G. Employee attending training required by employer are eligible to get salary
regularly. Employees who attending training out of their workplace, they shall receive enough mission allowance in other to support all expenses relating to such training including transport, meal, accommodation, other minor. expenses based on case by case.
ARTICLE 6 CHANGE OF JOB AND WORKING SKILL
A. Change in job scope, from one department to another department being applicable provided it is voluntarily agreed from the interest employee and has no enforcement from the Employer or any Department Head. B. If any transfer in made in accordance with the above provision, the transferred employee shall not get lower salary. Transfer in to base on the principle of same skills or similar, and maintain the same role. C. Whatever reason, the employer shall not demote the employee under pretext of transfer. Demotion is avoided. D. Transferring from one department to anther with difference skill, it is to train employee until he/she can work.ARTICLE 7 WORKING HOURS AND OVERTIME WORK
A. Daily working standard for one day is 8 hours and anther hours for meal
break. Weekly working hours is 6 days per week.
B. Employee who, working in the same department same skill or role, are able
to change by information and get approval from her/ he department head 1 day in advance prior to a change in made.
C. All overtime work is maximum 3 hours in each working shift, should
employee willing to do according to advance request by Supervisor/HOD, and
should have approval from Ministry of Labor. At the end of month Human Resource should send report of overtime to Union committee for reference record.
D. All overtime work during daytime at 22.00 pm hours or before, employee
shall be paid at 1.5 equal 150 % of daily rate of pay and from 22.00 to 05.00 shall be paid at 2 equal to 200 % rate of pay.
E. Departmental weekly duty roster to be posted for employee at least 2 day in
advance. Due holidays such as annual leave, special leave and other leave requested by employee, it is to be authority by each department head.
F. An employee is able to change his/he working day or weekly rest day with
his/her fellow employee who work in the same department if the changing one has similar capacity or same capability or same job position, and that employee has to inform and get approval from his/her department head one day in advance prior to a change is made.
A. An employee is entitled to 1 meal without charge for the period of 9 hours of his/her working shift including change of working shifts and they are entitled to 2 meals without charge if they work on split shifts or overtime hours.
B. Daily pay = (monthly pay) / (no. of working day per month).
Hourly pay = (daily pay) / (8 hours)
C. An employee who works on public holidays has the right to get the same payment as the payment of work on a usual day
Example: Employee has base salary US$ per month and work on 8 March 2008 as paid holiday so he/she will get paid $52+($52 x 1) =US$ 54

D. When employee is scheduled for his/her weekly day-off he/she should not work on that day. If he/she does, the employee should replace his day off within the next few days (maximum of 6 days). No extra salary is allowed. The employee need to rest.
E. An employee who works at night shift from 23.00pm – 6.00am shall be paid at 1.5 his/her daily rate of pay. An employee who works on public holiday together with night shift shall be paid at 3 times his/her daily rate of pay.
F. Employee shall pay US$ 20.00 per employee in cash to celebrate Khmer New Year instead of outing party.
ARTICLE 8 PUBLIC HOLIDAYS AND LEAVE
A. Public holidays in Prakas No. 300 MOLSAVY, dated 13 Nov 2001 by Minister of MOLSAVY and rest days for elections to be implemented without deduction of salary, reward & other benefits as in article 7 of this agreement.
B. Annual leave is 18 days. An employee is able to take freely in each year of service without deduction of salary, reward & other benefits as also stated in article 7 of this agreement. An employee shall receive 1 day of annual leave in addition to the number of days of basic annual leave if he/she has seniority of 3 years service (article 166 of Labour Law). This additional day shall be added automatically if seniority of the employee is increasing. If there is outstanding annual leave, it is to carry over to take at the year after.
C. The Employer shall give sick leave with pay in each year of service. For special leave, it is to follow the hotel’s internal rules & regulations (handbook).
D. The Employer shall grand 90 days maternity leave and shall not limit number of times for maternity leave, and maintain salary & other benefits as usual. No discrimination against female employee who is pregnant, on maternity leave and when taking care of her baby.
E. The employer shall grant one (1) day of paternity leave (child’s birth of employee)
F. Matrimonial leave: 5 days with option of additional 7 days in maximum from their entitled leave (PH/AL) to be taken before or after married date.
G. Bereavement leaves for :
Parents-Spouse-Sibling-Children 3 days
Parent-in-law 2 days
Staff is entitled to 1 more day if staying 50km away or more from Phnom Penh city.
ARTICLE 9 SALARY
A. Basic salary to be set to the professional skills, experiences job positions.
B. The employer shall distribute salary in cash at the end of each of month such as basic salary, service charge & other.
C. The Employer shall not deduct salary without permission from the employee or union.
D. The Employer shall consider the yearly increment according to business performance of the hotel, inflation and economic growth. All increment made shall be effective from the 1st day of new calendar year.
E. Collected service charge employer must pay out to staff 8% of 10% collecting.
F. The Employer shall not deduct salary and other pay when they request for leave conforming to provision stated in above article.
G. Employer shall provide all employees of annual bonus at the first month of New Year according to the business situation of the hotel. Annual bonus & other awards shall be pro-rated for new confirmed employee of incomplete year of service.
H. An employee who works on split shift shall receive $1.00 per shift.
ARTICLE 10 DISCIPLINARY PROCEDURES AND TERMINATION OF EMPLOYMENT
This article 10, both parties have agreed to follow << Disciplinary Procedures>> of the Hotel as in the followings: DISCIPLINARY PROCEDURES AND TERMINATION OF EMPLOYMENT POLICY As an employee you are expected to meet standards of performance in both quality and quantity of work, respect the rights and property of others and abide by the Rules and Regulations of the Hotel. Failure to meet such standards of performance or disrespect may result in disciplinary action. The purpose of discipline is corrective in nature and not meant to be punitive. PROCEDURES 1- Principles for Discipline To ensure fair and equitable treatment of all employees, the table describing imposition of discipline (see Disciplinary Guideline – Plan of Action) are designed so that Supervisors, Heads of Departments are able to implement the discipline procedures properly. The principle will take the following into consideration: Nature of mistakes Circumstance leading to mistakes Frequency of mistakes made The employees record of performance, attitude and duration of work 2- Classification of Discipline The discipline shall be classified as follows: a- Counseling b- Verbal warning c- Final warning d- Suspension e- Termination/Dismissal The Hotel reserves the rights to begin disciplinary action at any step to match the severity of the offense. The disciplining of any employee is considered a serious management decision and will only be made after careful thought and investigation. It is our hope that disciplinary action will not become necessary. 3- Disciplinary Procedure The disciplinary procedures vary with the measure taken: A. Counseling The head of department or immediate supervisor shall have to counsel their staff that have got minor mistake, this is to let them correct the mistake before giving out any warning according to the step below to the staff that refuse to follow the advice or instruction. B. Verbal Waning For the first violation of a rule, Verbal warning shall be given by Supervisors, Heads of Departments. The verbal warning shall cover the mistake, any failure to correct the mistake and how to correct the mistake. A written record will be made on the form (refer to appendix A) to prevent future argument whether a verbal warning has been given or not. The document shall be handed over to the Human Resources Department for the employee files. The verbal warning is effective for 3 months. Upon mutual discussion between employee and Department Head, the verbal warning shall be cancelled. C. Written Warning For successive violations after a verbal warning or when a serious rule violation occurs for the first time. Only the Human Resources Department shall issue this warning after a discussion with the Executive Committee Members and the Head of the Department concerned. The severity of the situation and the repletion of the situation shall be written in a form, a copy of which shall be kept in the employee file and another of which shall be kept with the Head of the Department. The written warning is effective for 6 months. Upon mutual discussion between employee-Human Resources Department-Department Head, subject written warning shall be cancelled. D. Final Warning When an offence is committed repeatedly or if the nature of the offence is serious. The employee shall be informed that the repeated mistakes and failure to correct those mistakes will probably lead to the termination of their employment. This final warning note shall be signed by the Human Resources Department, employee, and the General Manager. The copies of this warning note shall be sent to the Executive Committee Members, other Head of Department and be put in the employee’s file. The written and/or final warning shall only be made by the Human Resources Department in the presence of the head of the Department. The final warning is effective for 12 months. Upon mutual discussions between employee-Human Resources Department-Department Head and General Manager, subject final warning shall be cancelled. E. Termination/Dismissal/Suspension Would result when all above disciplinary procedures fail to correct an unacceptable situation. Termination/Dismissal of an Employee is a last resort and requires the agreement of the Human Resources Manager and/or General Manager and Executive Committee Members. Suspension to be implemented when cause for current incident is unclear pending further investigation and/or inquiry before a final decision is made on the course of action to be taken. Suspension means times off are with full pay. However, if the investigation resulting that the employee concerned has mistakes but not appropriate for termination or dismissal, then this suspension shall be reverted to disciplinary action by giving warning instead. Note on Discipline The employee shall sign all disciplinary warning that have been issued. If the employee refuses to sign, the Human Resources Department may invite another person to be a witness and the person will write his/her signature together with the Department Head. In such instance, a further warning will be issued, since the employee refuses to respect the house rules with its relevant established procedures. Disciplinary Guideline – Plan of Action Mistake Group “ A” – Verbal Warning 1. Fraternising with guests. 2. Eating or drinking while on duty. 3. Chewing gum in guest contact areas. 4. Reporting to work in as state of intoxication or under the influence of alcoholic beverages. 5. Entering or leaving the Hotel through the main entrance, all Employees must use the staff entrance. 6. Unauthorized wearing or removal of uniforms from Hotel premises. 7. Unauthorized use or change of locker, locks, or keys. 8. Littering on the Hotel premises. 9. Inviting friends or relatives to restricted areas of the hotel (back of the house) without prior permission from your Department Head or Supervisor. 10. Leaving your work area whilst on duty without prior permission from the Department Head or Supervisor. 11. False representation or concealment of any material fact made on the “ Sunway Hotel Phnom Penh’ employment application form” or the Hotel’s other records. 12. Not reporting to work as scheduled. Being late for no acceptable reason. 13. Returning to the Hotel remises after work without reason or permission. 14. Wearing the Hotel uniform and going out of the Hotel premise after duty. 15. Failing to report any contagious disease whilst employed by the Hotel, e.g. measles. 16. Using loud voice during work and in guest areas. Mistake Group “B” – Written Warning 1. Unauthorised intrusion into guest’s rooms. 2. Sleeping while on duty. 3. Smoking while on duty. Employees may only smoke in the designated area, but must dispose their cigarettes and wash their hands before returning to work. 4. Drinking alcoholic beverages in the Hotel while on duty. 5. Gambling or betting within the Hotel premises. 6. Vandalism, such as writing on wall, elevators and other Hotel properties. 7. Spitting on walls or floors. 8. Soliciting tips or any form of gifts from guests. 9. Lying and cheating. 10. Obtaining or attempting to obtain leave of absence by false pretenses. 11. Failure to report all Lost/Found item. 12. Utilising any working equipment for purposes other than that intended. 13. Presence of Hotel property in staff lockers, the Hotel reserves the right to inspect all lockers at any time. 14. Any act of insubordination to Department Head, Supervisor or Management. 15. Soliciting or collection of contribution of any purposes whatsoever at any time in the Hotel premises, except when authorized by the Management to do so. Vending is also prohibited. 16. Distribution of any written or printed material or any description within the Hotel premises unless informed to or authorised by the Management. 17. Abusing authority/deliberately working slowly or inciting others to do so, suspending work and/or restricting output whilst on duty without justified cause. 18. Unauthorized trading in currencies or otherwise. 19. Violating safety rules or practices of the Hotel. 20. Recommending or dealing with outside services instead of directing guest to use hotel services first. 21. Unauthorized absence from work 1 day without any valid reason. 22. Repeat of issues mentioned under verbal warning. Mistakes Group “C” – Final Warning 1. Rudeness to guests and fellow employees. 2. Marking private business transactions in the Hotel or using your position for personal benefits, which may be to the disadvantage of the Hotel. 3. Planning or holding any meeting within and in the Hotel premises unless prior approval is obtained from the Management. 4. Misappropriation in all forms of Hotel funds or theft of Hotel’s funds. 5. Making false or malicious statements about any guest, employee, the Hotel or its provisions. 6. Any conduct prejudicial to the interest or reputation of the Hotel. 7. Spreading rumours and lying repeatedly. 8. Repeat of violations listed under verbal warning and written warning. Mistake Group “ D” – Termination, Dismissal and Suspension 1. Dishonest or theft including illegal possessions of hotel properly or guests or fellow employees property. 2. Uncontrolled temper causing bodily harm. 3. Fighting, threatening, intimidation, compelling or interference with fellow employees or guests in the Hotel premises. 4. Possession within the Hotel premises of firearms, explosives, drugs, illegal items or publications banned by the Government. 5. Committing immoral conduct, actions of indecency, touting or soliciting for purpose of prostitution. 6. Deliberate damage to property of Hotel, guests and/or others. 7. Deliberated removal or damage of time card. Attending to erase or change the time recorded on time cared. Punching another employee’s time card or asking another employee to punch it for him/her. 8. Unauthorized absence from work 3 consecutive days or more. 9. Failure or refusal to submit to a search when required to do so by Hotel security. 10. Committing political activities in the hotel/engaging in illegal strikes. Step 4 1. 2. 3. 4. 5. 6. 7. 8. If the parties fail to resolve the matter within a period of 3 days but agree that discussions should continue, they may agree to appoint a mutually acceptable third party, either from within or external to the Hotel, to facilitate their discussions. Employees have the right to seek assistance from a representative should they consider this necessary. 9. The parties must agree on the third-party, and accept that this procedure is voluntary. The facilitator has no power to make decisions, but may make suggestions and take all possible steps to reconcile the differences between the parties and assist them to make a mutually acceptable decision. 10. If the facilitator is unable to bring the parties to agreement the matter will be submitted to MOSALVY for resolution and settlement under the dispute resolution procedures applying to individual and collective disputes, as appropriate, provided in the labor law.ARTICLE 12 STRIKE AND LOCKOUT
A. The union shall not lead illegal strike. Everyday problem occurred union should ask for discussion with the Employer or vise versa whenever any party asks for discussion, another party should respond as soon as possible. Both parties shall follow procedures stated in the law, and strike is last resort of the union. B. The union has the right to strike and the Employer has the right to lockout conforming to the Labour Law and the circular number 005 dated 06 March 2000. C. No Further Claim For duration of this agreement, the union party to this agreement shall make no further claims. D. Further Parties Any union which may be established in the enterprise during the life of this agreement shall agree to the terms and conditions of this agreement without exceptions or condition.ARTICLE 13 WORK SAFETY, HYGIENE, ENVIRONMENT & ORDER
A The hotel shall have bathroom/toile complying with Prakas number 052. The washroom shall regularly clean by the cleaner.
B The hotel shall have exit/entry gate for emergency, training for fire fighting team and training on how to escape in emergency cases, to have sufficient training materials, measures for the safety of employees.
C The hotel shall have chairs or benches for staffs to sit occasionally, and for pregnant women to be transferred to light works by maintaining their salary and it-cash rewards the same.
D When found that the job safety is not good, employee or union to report immediately to employer for corrective action to be taken.
E The electricity system should be safe, no shock, and no leakage that might cause fire.
F Employer shall pay up to US$ 250.00 per year to the employee to cure minor illness, it will be include medical expense after operation, (employee must present the invoice and doctor prescriptions to hotel doctor/nurse to verify before do reimbursement. The entitlement until healthcare scheme is issued from government.
G Employer to protect employees’ properties such as vehicles, etc.., and provide locker with lock in order for them to keep their belongings.
H Employer shall provide enough uniforms, shoes, and other safeguarding materials according to their designation.
I Organize a party every year during Khmer New Year.

ARTICLE 14 WELFARE FUND AND DISTRIBUTION PROCEDURE
In order to motivate and improve employee’s welfare, union and employer agree to create welfare fund which both parties to contribute money with same proportion . this fund would be provided to employees whose family member passed away or suffered fire hazard, or to help the victims of flood or for other social affairs. Th welfare fund would be managed as follows:
A. Union leadership of 3 persons and hotel’s management of 3 persons to arrange meeting for making decision on withdrawal of this fund in order to support individual or collective employees and to decide how much amount of fund for such support. The decision will be based on the amount of fund in hand and to be attentive in use for coming long period of time. After part of fund is given to anyone or any service, then to copy that document to employees for their information.
B. This welfare fund to be put into a separate account. One representative of union leaders and one representative of hotel’s management shall have the right to collect this fund for agreed purposes.
