Paternity Leave

Following revisions to the Employment Act of 2000 in 2021, a male employee shall be entitled to at least two weeks of paid paternity leave every three years. When an employee is on paternity leave, his benefits and rights continue uninterrupted, and his employment time is not deemed interrupted, shortened, or broken.

Parental Leave

No provisions on parental leave could be identified within the law.

Flexible Work Option for Parents / Work-Life Balance

No provisions on flexible work option for parents could be identified within the law.

Special Leaves

No special leaves (compassionate, bereavement, marriage, study, care leave) are provided under any of the Malawi legislation. The Labour Relations Act, however, provides for trade union time-off and leave. As per section 37 of the Act, an officer of a trade union is entitled to a reasonable time off during working hours to carry out union activities. The trade union officers are further entitled to reasonable leave of absence for training or secondment related to union activities.
