We, KAGAME Paul, President of the Republic;

THE PARLIAMENT HAS ADOPTED AND WE SANCTION, PROMULGATE THE FOLLOWING LAW AND ORDER IT BE PUBLISHED IN THE OFFICIAL GAZETTE OF THE REPUBLIC OF RWANDA

THE PARLIAMENT:

The Chamber of Deputies, in its session of 13 August 2013;

The Senate, in its session of 12 August 2013;

Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 11, 37, 38, 39, 45, 62, 66, 67, 88, 89, 90, 92, 93, 95, 108, 112, 113, 118, 126, 181 and 201;

Having reviewed Law n° 22/2002 of 09/07/2002 on General Statutes for Rwanda Public Service

ADOPTS:

CHAPTER ONE: GENERAL PROVISIONS

Section One: Purpose, scope of this Law and definitions

Article One: Purpose of this Law

This Law establishes the General Statutes for Public Service.

Article 2: Scope of this Law

This Law shall govern public servants employed on permanent basis.

Public servants subject to employment contracts shall be governed by the Law Regulating Labour in Rwanda.

The Statutes governing political leaders, judges and judicial personnel, Prosecutors and support staff of the National Public Prosecution

Authority shall be established by special laws.

A presidential Order may establish a special statutes governing public servants of any given profession where considered necessary.

Article 3: Definitions

For the purpose of this Law, the following terms shall have the following meanings:

1° week: a period of seven (7) consecutive calendar days;

2° gross misconduct: a misconduct which depends on the seriousness of the act committed, omission or behaviour displayed, circumstances, impact on public service, service delivered and beneficiaries of service;

3° salary index grid: a table showing all indexes likely to be assigned to different grades and job positions, and on the basis of which basic salaries are calculated;

4° organizational structure: a table showing the organizational arrangement of a public institution according to its departments, job positions and their related requirements as well as the profile required to filling such job positions. The organisational structure shall accurately indicate the number of jobs and posts provided for in the budget, the number of occupied and vacant posts;

5° job classification: a table used to compare job positions in order to determine their hierarchical value and corresponding salaries;

6° grade: a system expressed in letters, figures, or letters and figures accurately showing the employment level of a public servant as well as the vertical and horizontal ranking of his/her job position;

7° job description: a mechanism which is accurate and understandable used to indicate particular requirements of the job position, the work conditions, nature of corresponding tasks and responsibilities, role played in performing the work as well as all requirements for the potential holder of such job position;

8° Commission: Public Service Commission;

9° Minister: the Minister in charge of public service ;

10° public service: a whole of public institutions and public servants established by the Government to serve the population;

11° month: a period of thirty (30) consecutive calendar days;

12° index: is an exact number indicating the value of the grade of a public servant or his/her job position upon which his/her salary is calculated;

13° public servant: any person with a permanent job position or working on employment contract in public service and who is paid out of the public funds;

14° job: designation given to an activity carried out in public service. A job may be comprised of one or more positions;

15° salary: payment made to a public servant to compensate services delivered;

16° job position: a single and physical position where a public servant is appointed in order to carry out duties related to his/ her job;

17° job category: a set of jobs with similar characteristics such as the nature of tasks and responsibilities, modalities for access, promotion and work conditions.

Section 2: Competence in public service management

Article 4: Competent authority

Every public institution shall have an authority entrusted with competence to make decisions regarding the management of public servants.

A Presidential Order shall determine the competent authority and modalities of authority delegation as regards the management of public servants.

Section 3: Comparison of jobs

Article 5: Job classification

Jobs and related positions as well as each job category in the public service shall appear in the job classification table.

A Presidential Order shall determine the job classification table in public service.

CHAPTER II: RECRUITMENT

Article 6: Requirements for recruitment

Each public servant shall be appointed to a job position whose level is indicated in the job classification table.

Recruitment in Public Service shall be carried out only if:

1° the job contains one or more vacant job positions described in accordance with point 7° of Article 3 of this Law;

2° the job position was budgeted for.

Article 7: Requirements for being integrated in public service

For a person to be integrated in Public Service, he/she must fulfil the following requirements:

1° to be rwandan;

2° to be at least eighteen (18) years old;

3° not to have been definitively sentenced to a term of imprisonment equal to or exceeding six (6) months;

4° not to have been dismissed definitively from public service;

5° not to appear on black list of public service;

6° not to be prosecuted for the crime of genocide;

7° not to have been sentenced for the crime of genocide or genocide ideology and other related offenses .

Other requirements shall be determined by a Presidential Order governing modalities for the recruitment, appointment and nomination of public servants.

Article 8: Recruitment modalities

The recruitment in Public Service shall be carried out through competition or nomination by a competent authority.

A Presidential Order shall govern modalities for the recruitment, appointment and nomination of public servants.

Article 9: Public servants governed by employment contracts

CHAPTER III: PERFORMANCE OF DUTIES

Section One: Commencement of duties and probation period

Article 10: Taking oath

Before commencing his/her duties, each public servant shall take oath, in presence of the competent authority in the following words:

“I, ……………….…………solemnly swear to the Nation that I shall:

1° remain loyal to the Republic of Rwanda;

2° uphold the Constitution and other laws;

3° respect Government institutions;

4° diligently fulfil the responsibilities entrusted to me and respect rights of all service beneficiaries;

5° be honest in my functions and keep the professional secrecy.

Should I fail to honour this oath, may I face the rigours of the Law.

So help me God”.

Article 11: Modalities of taking oath

A public servant shall take oath by holding the National Flag with his/her left hand while raising the right hand with a stretched palm.

A public servant with disability which does not enable him/her to comply with provisions of the Paragraph One of this Article shall be made to wear the flag.

If a public servant who took oath at the time of commencing his/her duties is appointed to another public institution, he/she shall not be required to take oath unless he/she is appointed as Senior official or appointed in organs where employees are governed by special statutes.

Article 12: Probation period

Any public servant who commences duties in public service shall be subject to a probation period of six (6) months whereby his/her immediate supervisor shall evaluate his/her performance in terms of his/her professional capacities, moral qualities and behaviour.

If a public servant commences the probation period, he/she shall be informed in writing by the competent authority, of his/her responsibilities and duties.

A public servant under the probation period shall enjoy the same basic rights as any public servant who successfully completed the probation period.

A public servant who has successfully completed the probation period of at least six (6) months, shall no longer be subject to a new probation period, when he/she is recruited in a similar position.

The probation period for public servants governed by special statutes shall be determined in accordance with the nature of their duties.

Article 13: Completion of the probation period

When a public servant successfully completes the probation period, the competent authority shall immediately notify him/her in writing that his/her appointment is confirmed.

If the probation proves that public servant is incompetent, he/she shall be automatically removed from office by the competent authority.

However, the competent authority may order to retake the probation for a period not exceeding three (3) months due to clear and convincing reasons.

Article 14: Appeal against a decision about probation

A public servant who is not satisfied with the performance assessment may appeal in writing, at first instance, to the authority responsible for his/her institution, in a period not exceeding five (5) working days after being notified of the decision taken against him/her. The authority responsible for the institution must decide on the appeal in a period not exceeding fifteen (15) working days from the receipt of the appeal.

If a public servant is not satisfied with the decision taken, he/she may appeal in writing, in the last instance, to the Commission within five (5) working days from the notification of the response. The Commission shall respond in a period not exceeding thirty (30) days from the receipt of the appeal.

Section 2: Determination and respect of working hours

Article 15: Working hours

CHAPTER IV: STATUTORY POSITIONS FOR A PUBLIC SERVANT

Section One: Position of a public servant

Article 16: Mobility of a public servant

The position of a public servant describes his/her status while exercising his/her duties.

A public servant in service may be:

1° in service;

2° on transfer;

3° on secondment;

4° at another administration disposal;

5° on suspension of duties;

6° on leave of absence for a specific period.

Sub-section One: Public servant in service and one considered to be in service

Article 17: Public servant in service

A public servant shall be in active service if he/she occupies a position to which he/she was appointed and effectively performs his/her duties related to that position.

A public servant shall be considered to be in service when he/she is:

1° on leave;

2° on official mission;

3° in training.

Article 18: Types of leave

In addition to the annual leave, a public servant may receive an incidental leave, maternity, sick leave or authorized absence.

Article 19: Annual leave

Article 20: Deadline for taking annual leave

When a public servant does not take his/her annual leave within a period of one year for work related reasons though he/she had applied for it in writing, he/she must take his/her annual leave in the first month of the subsequent year.

Article 21: Incidental leave

A public servant shall enjoy incidental leave on full pay in case of fortunate or unfortunate events occurring in his/her family within the following limits:

1° employee’s civil marriage: two (2) working days;

2° in case of his wife’s delivery: four (4) working days;

3° in case of death of his/her spouse: six (6) working days;

4° in case of death of the first-degree ascendant: three (3) working days;

5° in case of death of the employee’s child in the direct line in the first degree or adoptive child: four (4) working days;

6° in case of death of the employee’s brother or sister in the direct line in the first degree: two (2) working days;

7° in case of death of the employee’s father-in-law or mother-in-law: two (2) working days.

Article 22: Maternity leave

A female employee who gives birth shall have the right to maternity leave of twelve (12) consecutive weeks including at least two (2) weeks she can enjoy before delivery.

A female employee who wishes to take her maternity leave shall submit to the competent authority a certificate issued by a recognized medical doctor indicating the presumed or exact date of childbirth before taking the leave or immediately after childbirth, as appropriate.

A female employee who gives birth to a still-born baby or whose baby dies before a period of one month shall receive a leave of four (4) weeks from the occurrence of the event.

Article 23: Salary during maternity leave

A female employee who gives birth shall be entitled to her full salary during the first six (6) weeks of maternity leave. She may return to work during the last six (6) weeks of maternity leave and be entitled to her full salary, otherwise she shall only gets twenty percent (20%) of her salary.

Article 24: Additional leave in case of complication

In case of birth related complications for the mother or the child which are ascertained by a recognized medical doctor, the competent authority shall grant to the mother an additional leave not exceeding one month paid at hundred per cent (100%).

An additional leave of twenty (20) calendar days in addition to incidental leaves shall be granted to the father of the child when the child’s mother dies in childbirth, leaving behind her baby.

Article 25: Coincidence of leaves

When the annual leave coincides with incidental leave or maternity leave, the annual leave shall be suspended and resume after the incidental leave or maternity leave.

Article 26: Breastfeeding period

Within twelve (12) months from the birth of the child and after her maternity leave, a female employee who gives birth shall be entitled to breastfeeding breaks of one (1) hour per day.

However, a female employee who returns to work at the expiration of the first six (6) weeks of maternity leave shall be entitled to breastfeeding breaks of two (2) hours per day until the expiration of the last six (6) weeks of maternity leave.

The statutory breastfeeding break granted to a breastfeeding women shall be taken during working hours and must be paid for.

Article 27: Short-term sick leave

A competent authority may grant to a public servant a short-term sick leave not exceeding fifteen (15) days for reasons of sickness ascertained by a recognized medical doctor.

Article 28: Long-term sick leave

When a sick leave exceeds fifteen (15) days while ascertained by a medical committee composed of three (3) recognized medical doctors, the competent authority shall grant to a public servant a long-term sick leave not exceeding six (6) months and notification thereof shall be made to the Commission.

A public servant who is granted a long-term sick leave shall be entitled to his/her full salary during the first three (3) months of the leave. In the remaining three months (3), he/she shall be paid two-thirds (2/3) of his/her salary.

Article 29: Authorized absence

Authorized absence for (1) one day maximum not deducted from annual leave may be granted to a public servant by his/her immediate supervisor, for duly justified reasons.

However, a public servant shall not be granted an authorized absence for more than ten (10) days per year.

Article 30: Official public holidays

Article 31: Mission

A competent authority may send a public servant on mission within or outside the country in the interest of service.

A Presidential Order shall determine modalities for sending public servants on mission.

Article 32: Training courses

A competent authority may, in the interest of service, send a public servant on training courses within or outside the country.

A Prime Minister’s Order shall determine modalities for the conduct of various training courses.

Sub-section 2: Transfer

Article 33: Transfer of a public servant

A public servant must occupy the job position to which he/she has been appointed.

However, a public servant may, in the interest of service, be transferred to the job position for which he/she qualifies and of the same grade as his/her usual job position either within his/her institution or another public institution.

The transfer of a public servant shall be decided by the competent authority in the interest of service and shall be in writing.

A public servant who is transferred shall retain his/her right to the grade previously held depending on his/her professional experience and performance.

When the transfer gives rise to a vacant post, such post shall be filled in accordance with public servants recruitment and appointment process provided for in this Law.

Article 34: Change of a job position through competition

A public servant must occupy the job position to which he/she has been appointed.

However, a public servant having completed three (3) years of service in a job position to which he/she was appointed may move from that position to another one within the public service if he/she is selected for that position he/she wishes to occupy and shall be appointed to it in accordance with the recruitment and appointment process provided for in this Law.

When moving to another job position demands that the public servant move to a different institution, such public servant must inform the competent authority in writing that he/she is moving to another post within the public service.

Sub-section 3: Secondment

Article 35: Secondment of a public servant

Secondment shall refer to a situation where a public servant is, in the interest of the country, temporarily transferred from his/her usual post in order to:

1° work for an institution in which the Government has interest;

2° work for a private institution bound to the Government by a convention;

3° work for an international organisation.

Secondment shall be decided by the competent authority and shall be in writing.

Article 36: Duration of secondment

The duration of secondment shall not exceed twelve (12) months.

A public servant on secondment shall be governed by regulations of the institution or organization to which he/she is seconded.

Article 37: End of secondment

If the secondment comes to an end as not a result of disciplinary sanctions, the public servant on secondment shall get back to his/her original public institution and the period of secondment shall be taken into consideration in his/her positioning and in granting him/her related benefits.

Sub-section 4: Placement at another administration disposal

Article 38: Placement of a public servant at another administration disposal

Placement at another administration disposal shall be a situation where a public servant is, in the interest of the country, transferred to another public institution or another entity dedicated to ensuring the development of the population while remaining governed by laws of the institution having transferred him/her.

The placement at another administration disposal shall be decided by the competent authority and shall be in writing.

When an employee is subject to placement at another administration disposal, he/she shall have his/her salary paid by one of the two institution taking into account the highest salary.

Article 39: End of placement at another administration disposal

When the placement at another administration disposal comes to an end not as a result of disciplinary sanctions, the institution to which the public servant was placed shall return him/her to his/her institution of origin for him/her to resume work or else, he/she shall be appointed to another post in public service.

Sub-section 5: Suspension from duties

Article 40: Reasons for suspension from duties

A public servant shall be suspended from duties due to the following reasons:

1° if he/she is provisionally detained for a period not exceeding six (6) months;

2° if he/she is subject to disciplinary proceedings for misconduct that may result in a second degree sanction;

3° if his/her usual post is removed from the organizational structure while the process of finding him/her another post is underway or the required profile for his/her usual post changes and he/she does not meet the new required profile;

4° if he/she is removed from a post filled without competition and is not immediately offered another post.

Article 41: Rights of a public servant suspended from duties

The salary of a public servant referred to under points 1° et 2° of Article 40 of this Law shall continue to be calculated and retained for the employee. For the first three (3) months his/her full salary shall be calculated whereas for the last three (3) months two-thirds (2/3) of his/her salary shall be calculated.

If the public servant is released following acquittal or in case of innocence with regard to disciplinary charges against him/her, he/she shall receive the salary retained for him/her.

If he/she is found guilty, he/she shall not be entitled to the salary that was retained for him/her.

A public servant suspended from duties referred to in points 3º and 4º of Article 40 of this Law shall receive two-thirds (2/3) of his/her net salary corresponding to his/her latest grade for a period of six (6) months. The payment of this salary shall stop only when a public servant finds another permanent job in public service.

Upon expiration of a period of six (6) months without finding another permanent job in public service, the public servant shall be automatically removed from public service and receive termination benefits in accordance with provisions of Article 95 of this Law.

Article 42: Period of suspension from duties

The period of suspension from duties shall not exceed six (6) months.

Article 43: Power to suspend a public servant from duties

Suspension from duties of a public servant shall be approved by the competent authority of his/her employing institution.

Article 44: End of suspension from duties

The suspension from duties of a public servant shall come to an end if:

1° the public servant referred to in point 1o of Article 40 of this Law, is reinstated as result his/her acquittal or an imprisonment of less than six (6) months when he/she has not been automatically removed from office;

2° the public servant referred to in point 2° of Article 40 of this Law, is reinstated;

3° the public servant is offered another post in public service in case of suspension from duties based on reasons provided for in points 3° and 4° of Article 40 of this Law ;

4° he/she is dismissed or automatically removed from office.

Sub-section 6: Leave of absence for a specific period

Article 45: Leave of absence for a specific period

Leave of absence for a specific period is a situation where a public servant is authorized to stop working for a specific period of time due to any of the following reasons:

1° a period not exceeding three (3) months to care for his/her sick spouse, parent or child in the first degree;

2° a period not exceeding one (1) month to accompany his/her spouse who has to live abroad for reasons of service.

A public servant authorized for leave of absence for a specific period shall not be entitled to his/her salary and fringe benefits.

When the period for leave of absence for a specific period comes to an end, the public servant shall resume his/her duties. A public servant who does not resume his/her duties after the expiry of such a period shall be considered as deserter.

Article 46: Modalities for leave of absence for a specific period

Leave of absence for a specific period shall be done by written notification to the competent authority against acknowledgment of receipt.

The competent authority may not grant a leave of absence for a specific period to a public servant in the interest of the service.

A public servant applying for leave of absence for a specific period shall continue to discharge his/her duties until the response to his/her application.

However, if no written response is given to the public servant’s application after the expiry of fifteen (15) days from the receipt of the application by the competent authority, the leave of absence for a specific period shall be considered as granted.

Section 2: Performance appraisal

Article 47: Public servants’ performance appraisal

The performance appraisal shall aim, for the Administration, to clarify the public servant’s value, his/her professional abilities and methods of work. It shall form the essential basis for assessing his/her right to promotion in horizontal scale, and to salary increase every three (3) years.

A Prime Minister’s Order shall determine modalities for performance appraisal and related benefits.

CHAPTER V: RIGHTS OF A PUBLIC SERVANT, AWARDS AND RESPONSIBILITIES OF THE EMPLOYER

Section One: Rights of a public servant

Article 48: Rights of a public servant as a citizen

A public servant shall enjoy the rights and freedoms as other citizens. He/she shall exercise them in accordance with laws and regulations in force in the country.

Article 49: Right on administrative file

The public servant shall be entitled to have an administrative file kept by the administration, containing all documents related to his/her professional performance and conduct, his/her detailed Curriculum Vitae and other required documents for recruitment.

Article 50: Request for updating the professional file

A public servant shall enjoy the right of access to his/her personal administrative file and may request, in writing, the administration for updating it.

Article 51: Right to join trade unions

Apart from political leaders and public servants of security related services, public servants may join any trade union of their choice.

Article 52: Salary

A public servant shall be entitled to a salary.

A salary is calculated in accordance with the job classification table.

Salary shall be based on the weight of the work done and not the person performing it. The principles of its determination shall be uniform and must be respected across the entire public service.

A Prime Minister’s Order shall determine salaries and fringe benefits granted to public servants.

Article 53: Gross salary

Gross salary for a public servant shall be composed of the basic salary plus housing, transport, medical and social security allowances.

In case a public servant is facilitated in housing and transport, allowances related thereto shall not be included in the gross salary. They shall be replaced by service allowance.

Article 54: Salary index grid

A Presidential Order shall determine the salary index grid.

Article 55: Calculation of the basic salary

Article 56: Maximum deductions from the salary

Deductions from salary, seizure by garnishment or deductions upon consent of the public servant can not exceed half (1/2) of his/her net salary.

Article 57: Calculation of salary

The salary of a public servant shall be calculated from the date of commencement of duties and suspended on the date following his/her termination of duties.

When the monthly salary is not wholly due, it shall be divided in thirtieths and paid up to the payable number of days worked.

Article 58: National Salary Committee

It is hereby established a National Salary Committee responsible for monitoring and adjusting the salaries and advising the Government to adjust them whenever necessary.

A Prime Minister’s Order shall determine the organization and the functioning of the National Salary Committee.

Article 59: Allowances

Article 60: Acting public servant

In case a public servant has a reason for not being on duty, the competent authority shall temporarily determine another public servant to replace him/her.

A public servant in an acting position for more than thirty (30) days shall be entitled to the salary and other monthly fringe benefits in relation to the acting position.

The salary and fringe benefits for an acting public servant shall be calculated from the thirty first (31st) day in the acting position.

Article 61: Prescription of payment of salary and allowances

Prescription of payment of salary and allowances shall be of two (2) years. This prescription time limit shall be counted as of the date on which the public servant had to receive them.

However, the time limit prescription of payment of salary and allowances shall cease from running:

1° where the employer has computed all due payments,

2° the employer has agreed with the public servant that the payments are the debt;

3° where the public servant’s case is pending before competent institution or before the court.

Section 2: Awards

Article 62: Award

Section 3: Responsibilities of the employer

Article 63: Manual of administrative procedures

The employer must provide any recruited public servant with a manual of administrative procedures of the concerned institution.

A Prime Minister’s Order shall determine the structure of the Manual of Administrative Procedures in public service.

Article 64: Equipments

The employer shall provide to the public servant, the necessary equipments permitting him/her to carry out his/her duties.

Article 65: Cleanliness at the workplace

The workplace should always be kept clean and equipped with hygiene facilities and means for safety and health protection as well as for hazards prevention.

The employer must educate the public servant on health and safety measures at workplace.

Article 66: Protection equipments against hazards

The Government must put at the disposal of its public servant all necessary and appropriate protection equipments at workplace and ensure their appropriate use. It must possess security means against hazards at workplace.

Article 67: Safety of a public servant

The Government shall have the obligation to guarantee to its employee the protection against any type of violence at workplace during the fulfilment of his/her duties or at anytime it is obvious that the security threat is due to the fulfilment of his/her duties.

Article 68: Premises and equipments not detrimental to the health of public servants

Premises at the workplace shall comply with the safety and health standards.

It is forbidden to import, display, sell, lease out, give away under any circumstances or to use appliances, machines and parts of machines which were manufactured or imported contrary to standards aimed at ensuring protection of the health of public servants and the prevention of hazards.

A Ministerial Order shall determine general and specific instructions relating to health care of public servants, prevention and protection against hazards on workplace.

Article 69: Healthcare of a public servant

The Government shall provide a healthcare support to its employee and other people under his/her care in accordance with relevant laws.

Article 70: Declaration of occupational hazards

The employer shall declare to the Rwanda Social Security Board and the Inspector of labour in the District where the institution operates within four (4) working days of occurrence of all occupational hazards or occupational diseases noticed.

Where the employer does not make the declaration as provided for in Paragraph One of this Article, the person who is the victim of the occupational hazard or suffers from a disease or his/her legitimate representative may do it within a period not exceeding one (1) year from the date of occurrence of the occupational hazard.

Any employer whose institution may cause occupational disease shall inform the Inspector of labour and the Rwanda Social Security Board before the commencement of activities.

CHAPTER VI: OBLIGATIONS OF A PUBLIC SERVANT AND INCOMPATIBILITIES

Section One : Obligations of a public servant

Article 71: Obligations related to discharge of duties

A public servant shall be required to personally perform duties as required, devote him/herself to his/her work all the time with integrity and impartiality, respect and honour his/her institution, preserve public property, and have a sense of responsibility and public interest.

A public servant must respect the particular or general instructions given by his/her hierarchical superior in accordance with laws.

Article 72: Preserving public property

A public servant must preserve public property during and after working hours by contributing to its good management and protection against any destruction and despoliation.

Article 73: Professional secrecy

A public servant must keep professional secrecy, except in circumstances stipulated by the Law or while he/she is authorized by a competent authority.

Article 74: Professional conduct of a public servant

A Presidential Order shall determine the professional code of ethics for public servants.

Section 2: Incompatibilities with the status of a public servant

Article 75: Activities that a public servant is not allowed to carry out

The following shall be incompatible with the status of a public servant :

1° a profession or any business or industrial activities that may likely be detrimental to the performance of his/her duties;

2° any participation in permanent leadership, administration of a company or any other commercial and industrial enterprise likely to be detrimental to the duties of the public servant. However, this shall not apply to those representing the Government interest in private enterprises.

3° having any interest in an enterprise under his/her direct control or one related to him/her, whether as an individual or through a proxy, under any title, in case such interest is likely to compromise with his/her duties or restrict his/her independence, truth, justice and objectivity.

Subject to the provisions of Paragraph One of this Article, where unlikely to be detrimental to his/her duties, a public servant may sign employment contracts with different employers, whether in public or private sector.

However, before signing such contracts, the public servant shall be authorized by his/her employer.

CHAPTER VII: ADMINISTRATIVE SANCTIONS AND APPEAL

Section One: Sanctions

Article 76: Categories of administrative sanctions

Administrative sanctions shall be classified in two (2) categories. The first degree sanctions shall be imposed in case of minor faults and the second degree sanctions in case of serious faults.

The first degree shall be composed of the following sanctions:

1° warning;

2° reprimand.

The second degree shall be composed of the following sanctions:

1° delay in promotion;

2° suspension from duties for a period not exceeding three (3) months without being paid;

3° dismissal.

Article 77: Disciplinary fault

If a public servant breaches or fails to comply with the obligations assigned to him/her, this shall constitute a disciplinary fault punishable by one of sanctions provided for in Article 76 of this Law in consideration of its seriousness.

Procedures for disciplinary action shall be done in writing.

Article 78: Disciplinary liability and criminal liability

The disciplinary sanction of a public servant shall be independent from criminal liability and punishment as provided by the criminal code to the extent that the same fault may cause both disciplinary procedure and criminal procedure.

Article 79: Defence

No public servant shall be sanctioned unless he/she has been given an opportunity to submit in writing his/her defence.

Article 80: Application of a sanction

No sanction can be applied before the accused is proved guilty.

Article 81: Powers to impose administrative sanctions

The first degree sanctions shall be imposed by the head of institution and the second degree sanctions shall be imposed by the authority who appointed the public servant after consultation with the Minister.

Article 82: Modalities for imposing disciplinary sanctions to public servant

A Presidential Order shall determine modalities of imposing disciplinary sanctions to public servants.

Section 2: Appeal

Article 83: Right of a public servant to appeal

A public servant who considers that a disciplinary sanction against him/her is not justified shall have the right to appeal to administrative organs or courts of Law.

Article 84: Appeal procedure

A public servant who considers that the decision against him/her is not justified may file a written appeal in the first instance with the head of his/her institution within a period not exceeding five (5) working days from the date the sanction is notified to him/her and the response to his/her appeal shall be notified to him/her within a period not exceeding fifteen (15) working days from the date the appeal was received.

When he/she is not satisfied with the decision taken at the first instance, the public servant who is subject to a sanction may appeal in the last instance to the Commission within a period not exceeding five (5) working days from the date he/she was notified of the response. The Commission must respond within a period not exceeding sixty (60) days. The decision of the Commission shall not be subject to administrative appeal.

The staff of the Commission shall file appeals in last instance with the Council of Commissioners of the Commission.

Article 85: Filing a complaint with the courts of law

CHAPTER VIII: TERMINATION OF SERVICE FOR A PUBLIC SERVANT

Article 86: Grounds for termination of service for a public servant

Termination of service for a public servant shall result in his/her removal from the record of employees of public service.

Termination of service for a public servant shall take place when he/she :

1° is on leave of absence for non-specific period;

2° deliberately resigns;

3° is automatically removed from office;

4° is dismissed;

5° retires;

6° dies.

Section One: Leave of absence for a non specific period

Article 87: Request for leave of absence for non specific period

Request for leave of absence for non specific period shall be a decision made by a public servant indicating in writing his/her will to cease his/her duties for personal reasons

A public servant shall have the right to request for leave of absence for non specific period after serving at least three (3) years in the job position for which he/she requests for leave of absence for a non-specific period.

A public servant whose request for leave of absence for a non specific period has been accepted shall cease to be in the public service and shall be replaced.

Article 88: Modalities for leave of absence for a non specific period

Leave of absence for a non specific period shall be requested in writing and addressed to the competent authority, and the public servant shall receive an acknowledgement of receipt.

The request of a public servant for leave of absence for a non specific period may be rejected for public interest.

A public servant who has submitted his/her request for leave of absence for a non specific period shall continue to discharge his/her duties until he/she is notified of the decision on his/her request.

However, if no written reply has been given to the public servant within thirty (30) days as of the day the competent authority received the request, his/her request for leave of absence for a non specific period shall be considered as accepted.

Article 89: Reintegration in the public service after leave of absence for a non specific period

A public servant whose request for leave of absence for a non specific period has been accepted shall have the right to apply for the job or to be nominated in the public service after three (3) years as of the date his/her request for leave of absence for a non specific period was accepted and in accordance with recruitment modalities provided for in this Law.

Section 2: Deliberate resignation

Article 90: Request for deliberate resignation

Request for deliberate resignation is a decision of a public servant indicating in writing his/her will to resign from the Public Service.

When the deliberate resignation of a public servant is accepted, he/she shall definitely cease to be a public servant and be replaced.

Article 91: Modalities for deliberate resignation

Deliberate resignation shall be in writing and addressed to the competent authority and the resigning public servant shall receive an acknowledgement of receipt.

A public servant who has submitted his/her resignation request shall continue to discharge his/her duties until he/she is notified of the decision on his/her request.

However, if no written reply has been given to the public servant within thirty (30) days as from the date when the competent authority received the resignation letter, his/her resignation shall be considered as accepted.

Article 92: Reintegration in the public service after deliberate resignation

A public servant whose deliberate resignation has been accepted shall have no right to be reintegrated in public service.

However, for public interest, a public servant whose resignation has been accepted may re-enjoy the right to be recruited or nominated in public service after five (5) years as from the date his/her resignation was accepted, upon authorization by the competent authority and notification to the Commission.

Section 3: Automatic removal from office of a public servant

Article 93: Grounds for automatic removal from office of a public servant

A public servant shall be subject to automatic removal from office:

1° if after the probation period his/her performance appraisal is not successful;

2° if he/she is placed in provisional detention for a period exceeding six (6) months;

3° if he/she is not physically or mentally able to resume his/her duties after a long term sick leave provided for in Article 28 of this Law;

4° if the performance appraisal indicates that he/she is incompetent;

5° after the period of suspension of more than six (6) months.

Article 94: Competence to decide automatic removal from office of a public servant

Automatic removal from office of public servant shall be a decision taken by a competent authority to remove him/her from the public service against the will of the public servant. However, the competent authority shall not give the notice of automatic removal from office to a public servant during his/her official leave.

Article 95: Calculation of termination benefits

Where a public servant is automatically removed from office as a result of job suppression or discontinuance, he/she shall be entitled to termination benefits allocated by the institution where he/she has been working up to his/her departure. Termination benefits for a public servant shall be calculated on the basis of his/her last gross salary with only the deduction of tax and depending on his/her experience in public service as follows:

1° one (1) month salary for public servants with at least one (1) year, but less than five (5) years of experience ;

2° two (2) months salary for public servants with at least five (5) years, but less than ten (10) years of experience ;

3° three (3) months salary for public servants with at least ten (10) and less than fifteen (15) years of experience;

4° four (4) months salary for public servants with at least fifteen (15) and less than twenty (20) years of experience;

5° five (5) months salary for public servants with at least twenty (20) and less than twenty-five (25) years of experience;

6° six (6) months salary for public servants with at least twenty-five (25) years of experience.

Article 96: Requirements for granting of termination benefits

A public servant, who was recruited through nomination and was suspended without being offered another post, shall also enjoy termination benefits provided under the provisions of Article 95 of this Law.

Without prejudice to benefits granted when as political leader leaves office, his/her experience as a political leader shall be added up to his/her experience as a public servant while computing termination benefits.

However, when a public servant was automatically removed from office and granted termination benefits has afterwards been recruited in the public service again and she/he is again subject to automatic removal, her/his current termination benefits shall be calculated on the basis of her/his new experience after the prior automatic removal.

Termination benefits for a public servant automatically removed from office due to job suppression or discontinuance are subject to prescription provided for in Article 61 of this Law.

Article 97: Reintegration in the public service after automatic removal from office

A public servant who was automatically removed from office may be reintegrated in the public service in accordance with recruitment modalities provided for in this Law.

Section 4: Dismissal and reintegration of a public servant

Article 98: Dismissal due to gross misconduct

Dismissal shall refer to a measure, pronounced in writing by a competent authority, of definitive expulsion of a public servant from public service as a result of a gross misconduct.

A gross misconduct shall be punished by a competent authority after consultation with the Minister.

Article 99: Reintegration of a public servant after dismissal

A person who is no longer a public servant following his/her dismissal may request for the right to apply for a job or to be nominated in public service after rehabilitation.

The request for rehabilitation shall be made by the concerned person after at least seven (7) years as of the date he/she was dismissed.

The request for rehabilitation shall be addressed to the competent authority of the institution from which the public servant was dismissed, who shall decide based on the conclusions of the Commission.

The Presidential Order determining modalities of imposing disciplinary sanctions to public servants shall specify conditions and modalities of rehabilitation.

Section 5: Admission to retirement

Article 100: Retirement

A retirement shall mean the normal end of employment of a public servant and entitle him/her to the retirement pension in accordance with the Law on social security.

The retirement shall be decided by the authority who appointed the public servant.

Article 101: Retirement age

The normal retirement age for a public servant shall be sixty five (65) years.

However, a public servant who attains at least sixty (60) years of age and who has served for at least fifteen (15) years in public service and pays his/her contribution to the Rwanda Social Security Board may apply to the competent authority for early retirement.

Retirement age for public servants governed by special statutes shall be fixed in accordance with the nature of their duties.

Article 102: Retirement benefits

A public servant who retires shall be entitled to retirement benefits allocated by his/her institution on the basis of his/her experience in public service.

Retirement benefits shall be computed in the same way as provided for in Article 95 of this Law.

Retirement benefits shall be incompatible with benefits granted to a public servant removed automatically from office.

Section 5: Death of a public servant

Article 103: Termination of employment of a public servant due to his/her death

The death of a public servant shall mark the definitive termination of his/her employment in the public service and put an end to any disciplinary procedure in all its respects.

Article 104: Death allowances and funeral expenses

In case a public servant dies while still in service, the widow or widower and orphans, and in their absence, the legally recognized successors shall be granted death allowances equivalent to a lump sum of six (6) times the last monthly gross salary of the diseased. These death allowances are subject to prescription as provided for in Article 61 of this Law.

A Prime Minister’s Order shall determine the amount of funeral expenses in case of death of public servant still in service.

CHAPTER IX: TRANSITIONAL AND FINAL PROVISIONS

Article 105: Transitional period

Any dispute arising before the commencement of this Law shall be resolved in accordance with the Law which was into force at the time of the occurrence of such a dispute within a period of twelve (12) months from the commencement of this Law.

Article 106: Drafting, consideration and adoption of this Law

This Law was drafted, considered and adopted in Kinyarwanda.

Article 107: Repealing provision

Law nº 22/2002 of 09/07/2002 on general statutes for Rwanda public service and all prior legal provisions contrary to this Law are hereby repealed.

Article 108: Commencement

This Law shall come into force on the date of it publication in the Official Gazette of the Republic of Rwanda.

CHAPITRE PREMIER: DISPOSITIONS GENERALES

Section première: Objet, champ d’application de la présente loi et définitions

Article premier : Objet de la présente loi

La présente loi porte Statut Général de la Fonction Publique.

Article 2: Champ d’application de la présente loi

La présente loi régit les agents de l’Etat exerçant leurs fonctions de façon permanente.

Les agents de l’Etat sous contrats sont régis par la loi portant réglementation du travail au Rwanda.

Les Statuts régissant les mandataires politiques, les juges et le personnel judiciaire, les officiers de poursuite judiciaire et le personnel d’appui de l’Organe National de Poursuite Judiciaire sont établis par des lois particulières.

Un arrêté présidentiel peut, en cas de besoin, déterminer un statut particulier régissant les agents relevant d’une profession donnée.

Article 3: Définitions

Aux fins de la présente loi, les termes ci-après ont les significations suivantes :

1° semaine : une période de sept (7) jours calendriers consécutifs ;

2° faute grave: faute commise en fonction de la gravité de l’acte commis, d’une omission ou d’un comportement affiché, des circonstances de leur survenance, de leur impact sur la fonction publique, le service et les bénéficiaires du service ;

3° grille indiciaire de salaire: un tableau qui représente l’ensemble des indices pouvant être attachés aux différents grades et postes d’emploi, et à partir desquels les salaires de base sont calculés;

4° cadre organique : un tableau quiprésente le système d’organisation d’une institution publique, suivant ses unités de service, les postes d’emploi qui s’y rapportent, les conditions requises ainsi que le profil des agents qui doivent y être affectés. Le cadre organique indique de manière précise le nombre d’emplois et de postes d’emploi prévus dans le budget, le nombre de postes occupés et le nombre de postes vacants ;

5° classification des emplois: un tableau servant à comparer des postes d’emploi en vue de déterminer leur valeur hiérarchique et des salaires y correspondant;

6° grade : un système exprimé en lettres, en chiffres, ou en chiffres et lettres, indiquant de manière précise le niveau d’un emploi d’un agent de l’Etat ainsi que le positionnement vertical et horizontal de son poste d’emploi ;

7° description de poste: mécanisme précis et compréhensible servant à indiquer les exigences particulières d’un poste d’emploi, les conditions de travail, la nature des tâches et responsabilités correspondantes, le rôle dans l’accomplissement de ce travail ainsi que toutes les conditions requises pour un éventuel occupant de ce poste;

8° Commission: Commission de la Fonction Publique;

9° Ministre: Ministre ayant la fonction publique dans ses attributions ;

10° fonction publique: ensemble des institutions publiques et les agents de l’Etat mis en place par l’Etat pour servir la population;

11° mois: une période de trente (30) jours calendriers consécutifs;

12° indice: chiffre exact qui indique la valeur du grade de l’agent de l’Etat ou de son poste d’emploi, sur base duquel son salaire est calculé;

13° agent de l’Etat: toute personne exerçant un emploi permanent ou régi par un contrat de travail au sein de la fonction publique et rémunérée sur lesn fonds publics;

14° emploi: occupation au sein de la fonction publique; un emploi pouvant être subdivisé en un ou plusieurs postes;

15° salaire : la contrepartie du travail fourni par un agent de l’Etat ;

16° poste d’emploi: position singulière et physique où un seul agent de l’Etat est placé pour remplir les fonctions liées à son emploi;

17° catégorie d’emploi : ensemble des emplois ayant des caractéristiques communes en ce qui concerne la nature des tâches et responsabilités, les modalités d’accès, de promotion et les conditions de travail.

Section 2: Compétence en matière de gestion des agents de l’Etat

Article 4: Autorité compétente

Chaque institution publique dispose d’une autorité habilitée à prendre des décisions dans le cadre de gestion des agents de l’Etat.

Un arrêté présidentiel détermine l’autorité compétente et les modalités de délégation de pouvoir en matière de gestion des agents de l’Etat.

Section 3: Comparaison des emplois

Article 5: Classification des emplois

Les emplois et les postes d’emplois qui s’y rapportent et chaque catégorie d’emploi au sein de la fonction publique sont indiqués dans le

tableau de classification des emplois.

Un arrêté présidentiel établit le tableau de classification des emplois de la fonction publique.

CHAPITRE II: RECRUTEMENT

Article 6: Conditions de recrutement

Tout agent de l’Etat est affecté à un poste d’emploi dont le niveau est indiqué dans le tableau de classification des emplois.

Il ne peut y avoir de recrutement à un emploi dans la fonction publique que si:

1° cet emploi contient un ou plusieurs postes d’emploi vacants décrits conformément au point 7° de l’article 3 de la présente loi;

2° cet emploi est budgétisé.

Article 7: Conditions pour être intégré dans la fonction publique

Pour être intégré dans la Fonction Publique, il faut remplir les conditions suivantes:

1° être de nationalité rwandaise ;

2° être âgé d’au moins dix-huit (18) ans;

3° n’avoir pas été condamné définitivement à une peine d’emprisonnement supérieure ou égale à six (6) mois;

4° n’avoir pas définitivement été révoqué de la fonction publique;

5° ne pas figurer sur la liste noire des agents de l’Etat;

6° ne pas être poursuivi pour crime de génocide;

7° n’avoir pas été condamné pour crime de génocide ou crime d’idéologie du génocide et autres infractions connexes.

Les autres conditions sont déterminées par arrêté présidentiel déterminant les modalités de recrutement, d’affectation et de nomination des agents de l’Etat.

Article 8: Modalités de recrutement

Le recrutement au sein de la fonction publique se fait par concours ou nomination par une autorité compétente.

Un arrêté présidentiel détermine les modalités de recrutement, d’affectation et de nomination des agents de l’Etat.

Article 9: Agents de l’Etat régis par des contrats de travail

Les agents de l’Etat régis par des contrats de travail sont les suivants:

1° les remplaçants temporaires des agents de l’Etat absents pour des motifs prévus par la loi;

2° ceux prestant des services urgents qui ne sont pas prévus au cadre organique ;

3° ceux exerçant des services n’ayant pas des experts suffisants et rares sur le marché du travail.

Un arrêté du Ministre détermine les modalités de recrutement du personnel visé au présent article.

CHAPITRE III: EXERCICE DE LA FONCTION

Section première: Entrée en fonction et stage probatoire

Article 10: Serment

Avant d’entrer en fonction, tout agent de l’Etat doit prêter serment, en présence de l’autorité compétente, en ces mots:

“Moi, ……………………… je jure solennellement à la Nation:

1° de garder fidélité à la République du Rwanda;

2° d’observer la Constitution et les autres lois;

3° de respecter les institutions de l’Etat;

4° de remplir loyalement les fonctions qui me sont confiées et de respecter les droits de tous bénéficiaires des services;

5° d’être honnête dans mes fonctions et de garder le secret professionnel;

En cas de parjure, que je subisse les rigueurs de la loi.

Que Dieu m’y aide ».

Article 11: Modalités de prestation de serment

L’agent de l’Etat prête serment en posant sa main gauche sur le Drapeau National et en levant en même temps sa main droite.

Au cas où l’agent de l’Etat a un handicap de telle sorte qu’il ne puisse pas se conformer aux dispositions de l’alinéa premier du présent article, on lui fait porter le drapeau.

Lorsqu’un agent de l’Etat qui a prêté serment lors de son entrée en fonction est affecté à une autre institution publique, il ne prête pas serment de nouveau, sauf s’il est affecté au poste de cadre supérieur ou à une entité dont le personnel est régi par un statut particulier.

Article 12: Stage probatoire

Tout agent de l’Etat recruté au sein de la fonction publique est soumis à un stage probatoire de six (6) mois au cours duquel son supérieur hiérarchique direct évalue ses performances par rapport à ses aptitudes professionnelles, ses qualités et son comportement.

L’agent de l’Etat qui commence le stage probatoire, doit être notifié par écrit de ses attributions et de ses obligations par l’autorité compétente.

Un agent de l’Etat en stage probatoire bénéficie des mêmes droits de base que l’agent de l’Etat dont le stage probatoire a été concluant.

Un agent de l’Etat qui a effectué un stage probatoire au sein de la fonction publique pendant une période de six (6) mois au moins, n’est plus soumis au stage probatoire lorsqu’il est affecté à un poste similaire à celui qu’il occupait.

La durée du stage probatoire pour les agents de l’Etat régis par le statut particulier est déterminée conformément à la nature des fonctions qu’ils occupent.

Article 13: Fin du stage probatoire

Lorsque le stage est concluant, l’agent de l’Etat est immédiatement notifié par écrit par l’autorité compétente qu’il est confirmé à son poste.

Lorsque le stage n’est pas concluant, l’agent de l’Etat est immédiatement démis d’office de ses fonctions par l’autorité compétente.

Toutefois, l’autorité compétente peut, pour des raisons claires et convaincantes, decider la reprise du stage probatoire pour une période ne dépassant pas trois (3) mois.

Article 14: Recours relatif à la décision du stage probatoire

L’agent de l’Etat qui s’estime lésé par l’évaluation des performances peut introduire, par écrit, au premier degré, un recours à l’autorité responsable de son institution dans un délai ne dépassant pas cinq (5) jours ouvrables suivant la notification de la décision. L’autorité responsable de l’institution doit donner suite à son recours endéans quinze (15) jours ouvrables dès la réception du recours.

Lorsque l’agent de l’Etat n’est pas satisfait par la décision prise, il peut introduire un recours, au dernier degré, auprès de la Commission dans un délai de cinq (5) jours ouvrables à compter de la notification de la décision. La Commission doit donner suite endéans trente (30) jours à compter de la réception du recours.

Section 2: Fixation et application des heures de travail

Article 15: Heures de travail

Un arrêté du Ministre détermine les heures de travail hebdomadaire pour les agents de l’Etat et les modalités de leur application.

CHAPITRE IV: POSITIONS STATUTAIRES D’UN AGENT DE L’ETAT

Section première: Position d’un agent de l’Etat

Article 16: Mobilité d’un agent de l’Etat

La position d’un agent de l’Etat décrit sa situation pendant l’exercice de ses fonctions.

Un agent de l’Etat en activité peut être placé dans l’une des positions suivantes:

1° en activité;

2° en mutation;

3° en détachement;

4° à la disposition d’un autre service;

5° en suspension de fonctions;

6° en mise en disponibilité pour une durée déterminée.

Sous-section première: Agent de l’Etat en activité et celui considéré comme étant en activité

Article 17: Agent de l’Etat en activité

Un agent de l’Etat est en activité lorsqu’il occupe le poste auquel il a été nommé et exerce effectivement les fonctions liées à ce poste d’emploi.

Est considéré comme étant en activité, l’agent de l’Etat :

1° en congé;

2° en mission officielle;

3° en formation.

Article 18: Types de congé

Outre le congé annuel, un agent de l’Etat peut bénéficier d’un congé de circonstances, de maternité, de maladie ou d’une permission d’absence.

Article 19: Congé annuel

L’agent de l’Etat bénéficie d’un congé annuel de trente (30) jours calendriers qui peut être fractionné en deux (2) tranches au maximum.

Le congé annuel est calculé sur base de deux jours et demi (2.5) par mois.

Toutefois, un agent de l’Etat nouvellement engagé ne bénéficie de son congé annuel qu’après douze (12) mois y compris la période de stage probatoire.

Article 20: Date limite de prise de congé annuel

Lorsqu’une période d’une année expire sans qu’un agent de l’Etat ait bénéficié de son congé annuel pour des raisons de service alors qu’il en a fait la demande par écrit, il doit en bénéficier dans le premier mois de l’année suivante.

Article 21: Congé de circonstance

Un agent de l’Etat bénéficie des congés de circonstance payés à l’occasion des événements heureux ou malheureux survenus dans sa famille, dans les limites suivantes :

1° en cas de mariage civil de l’agent : deux (2) jours ouvrables;

2° en cas d’accouchement de son épouse : quatre (4) jours ouvrables;

3° en cas de décès du conjoint: six (6) jours ouvrables;

4° en cas de décès d’un ascendant au premier degré: trois (3) jours ouvrables;

5° en cas de décès d’un enfant de l’agent en ligne directe au premier degré ou d’ un enfant adoptif: quatre (4) jours ouvrables;

6° en cas de décès d’un frère ou d’une soeur de l’agent en ligne directe au premier degré: deux (2) jours ouvrables;

7° en cas de décès du beau–père ou de la belle-mère: deux (2) jours ouvrables.

Article 22: Congé de maternité

Un agent de sexe féminin qui accouche a droit à un congé de maternité de douze (12) semaines consécutives dont au moins deux (2) semaines qu’elle peut prendre avant l’accouchement.

Un agent de sexe féminin qui désire prendre son congé de maternité doit soumettre à l’autorité compétente un certificat délivré par un médecin agréé indiquant la date présumée de l’accouchement ou la date exacte d’accouchement avant de prendre son congé ou immédiatement après son accouchement, selon le cas.

Un agent de sexe féminin qui accouche d’un mort-né ou celle dont un bébé meurt avant un mois de sa naissance, bénéficie d’un congé de quatre (4) semaines à compter de la survenance de l’événement.

Article 23: Salaire pendant le congé de maternité

Un agent de sexe féminin qui accouche a droit à la totalité de son salaire pendant les six (6) premières semaines de son congé de maternité. Elle peut, dans les six (6) dernières semaines de son congé de maternité, reprendre son travail et bénéficier de la totalité de son salaire, faute de quoi il ne bénéficie que de vingt pourcent (20%) de son salaire.

Article 24: Congé supplémentaire en cas de complication

En cas de complications chez la mère ou chez l’enfant qui sont imputables à l’accouchement et constatées par un médecin agréé, l’autorité compétente accorde à la mère un congé supplémentaire ne dépassant pas un mois et payé à cent pour cent (100%).

Un congé supplémentaire de vingt (20) jours calendriers qui s’ajoutent aux congés de circonstance est accordé au père de l’enfant lorsque la mère de l’enfant décède lors de l’accouchement laissant derrière elle son bébé.

Article 25: Congés coïncidents

En cas de coïncidence du congé annuel et du congé de circonstance ou du congé de maternité, le congé annuel est suspendu et repris après le congé de circonstance ou le congé de maternité.

Article 26: Période d’allaitement

Durant la période de douze mois (12) à compter de la naissance de l’enfant et après son congé de maternité, un agent de l’Etat de sexe féminin qui accouche a droit à une pause d’allaitement d’une (1) heure par jour.

Toutefois, un agent de sexe féminin qui reprend son travail à l’expiration des six (6) premières semaines de son congé de maternité a droit à une pause d’allaitement de deux (2) heures par jour jusqu’à l’expiration des six (6) dernières semaines du congé de maternité .

La pause d’allaitement statutairement accordée à une femme allaitante est prise pendant les heures de travail et doit être payée.

Article 27: Congé de maladie de courte durée

Une autorité compétente peut accorder à un agent de l’Etat un congé de maladie de courte durée de quinze (15) jours au maximum pour des raisons de maladie attestée par un médecin agréé.

Article 28: Congé de maladie de longue durée

Lorsque le congé de maladie dépasse (15) jours et qu’il est constaté par une commission médicale composée de trois (3) médecins agréés, l’autorité compétente accorde à un agent de l’Etat un congé de maladie de longue durée ne dépassant pas six (6) mois et la Commission en est informée.

Un agent de l’Etat qui bénéficie d’un congé de maladie de longue durée a droit à la totalité de son salaire pendant les trois (3) premiers mois de ce congé. Pendant les trois (3) mois restant, il reçoit deux tiers (2/3) de son salaire.

Article 29: Permission d’absence

La permission d’absence d’une (1) journée au maximum non déductible du congé annuel est accordée à un agent de l’Etat par son supérieur hiérarchique pour des motifs dûment justifiés.

Toutefois, un agent de l’Etat ne peut bénéficier de plus de dix (10) jours de permission d’absence par an.

Article 30: Jours fériés officiels

Un arrêté présidentiel détermine les jours fériés officiels.

Article 31: Mission

Une autorité compétente peut envoyer un agent de l’Etat, dans l’intérêt du service, en mission à l’intérieur ou à l’extérieur du pays.

Un arrêté présidentiel détermine les modalités d’envoi des agents de l’Etat en mission.

Article 32: Formation

Une autorité compétente peut, dans l’intérêt du service, envoyer un agent de l’Etat en formation à l’intérieur ou à l’extérieur du pays.

Un arrêté du Premier Ministre détermine les modalités de déroulement de ces différentes formations.

Sous-section 2: Mutation

Article 33: Mutation d’un agent de l’Etat

Un agent de l’Etat doit occuper le poste d’emploi auquel il a été nommé.

Toutefois, un agent de l’Etat peut, dans l’intérêt du service, être muté au poste d’emploi pour lequel il remplit les conditions requises et du même grade que celui de son poste d’emploi habituel que ce soit au sein de son institution ou d’une autre institution publique.

La mutation d’un agent de l’Etat est décidée par l’autorité compétente dans l’intérêt du service et se fait par écrit.

Un agent de l’Etat muté conserve son droit au grade précédemment détenu en fonction de son expérience professionnelle et sa performance.

Lorsque la mutation entraîne la vacance d’un poste d’emploi , un autre agent est recruté pour occuper ce poste conformément au processus de recrutement et de nomination des agents de l’Etat prévu par la présente loi.

Article 34 : Changement de poste d’emploi par concours

Un agent de l’Etat doit occuper le poste de d’emploi auquel il a été nommé.

Toutefois, un agent de l’Etat ayant réalisé trois (3) ans de service au poste d’emploi auquel il a été nommé peut changer ce poste pour occuper un autre au sein de la fonction publique lorsqu’il a été retenu pour ce poste qu’il désire occuper et y a été nommé conformément au processus de recrutement et de nomination des agents de l’Etat prévu par la présente loi.

Lorsque le changement de poste d’emploi exige que l’agent change son institution, il doit informer l’autorité compétente par écrit pour lui notifier qu’il va occuper un autre poste d’emploi au sein de la fonction publique.

Sous-section 3: Détachement

Article 35: Détachement d’un agent de l’Etat

Le détachement est une situation dans laquelle un agent de l’Etat est, dans l’intérêt du pays, muté provisoirement de son poste habituel pour :

1° travailler au sein d’une institution dans laquelle l’Etat a des intérêts ;

2° travailler au sein d’une institution privée liée à l’Etat par une convention ;

3° travailler au sein d’une organisation internationale.

Le détachement est décidé par l’autorité compétente et se fait par écrit.

Article 36: Durée du détachement

La durée du détachement ne peut dépasser douze (12) mois.

Un agent de l’Etat détaché est régi par les règlements de l’institution ou de l’organisation à laquelle il est détaché.

Article 37: Fin du détachement

Si la fin du détachement a lieu sans être occasionnée par les sanctions disciplinaires, l’agent de l’Etat détaché regagne l’institution publique qui l’a détaché et la période de détachement est prise en compte dans son positionnement ainsi que pour les avantages y afférents.

Sous-section 4: Mise à la disposition d’un autre service

Article 38: Mise à la disposition d’un autre service d’un agent de l’Etat

La mise à la disposition d’un autre service est la situation dans laquelle un agent de l’Etat est, dans l’intérêt du pays, muté dans une autre entité de la Fonction Publique ou dans une entité ayant pour vocation d’assurer le développement de la population tout en continuant d’être régi par les lois de l’institution qui l’a mis à disposition.

La mise à la disposition d’un autre service est décidée par l’autorité compétente et se fait par écrit.

Lorsqu’un agent est mis à disposition, il est payé par l’une des deux institutions en considération du meilleur salaire.

Article 39: Fin de la mise à la disposition d’un autre service

Lorsque la mise à la disposition d’un autre service se termine suite aux motifs autres que ceux de sanctions disciplinaires, l’institution à la disposition de laquelle l’agent de l’Etat a été mis le retourne à son institution d’origine pour y reprendre son travail ou est affecté à un autre poste d’emploi au sein de la fonction publique.

Sous-section 5: Suspension des fonctions

Article 40: Motifs de suspension des fonctions

Un agent de l’Etat est suspendu de ses fonctions pour les motifs suivants :

1° s’il est détenu provisoirement pour une période ne dépassant pas six (6) mois;

2° s’il est poursuivi pour une faute susceptible d’entraîner une sanction disciplinaire de second degré;

3° si son poste habituel est supprimé du cadre organique alors que la démarche pour lui trouver un autre poste est en cours ou le profil exigé pour son poste habituel change et qu’il ne remplit pas les conditions liées au nouveau profil;

4° s’il est démis d’un poste non soumis au concours sans être immédiatement affecté à un autre poste.

Article 41: Droits d’un agent de l’Etat suspendu de ses fonctions

Le salaire de l’agent visé aux points 1° et 2° de l’article 40 de la présente loi continue d’être calculé et conservé pour l’agent. Dans les trois (3) premiers mois, son salaire est calculé intégralement, alors que pour les trois (3) derniers mois suivants l’on calcule pour lui deux tiers (2/3) de son salaire.

Si l’agent est remis en liberté à la suite d’un acquittement ou en cas d’innocence à l’égard de la faute disciplinaire, il reçoit le salaire conservé pour lui.

S’il est reconnu coupable, il perd son droit à tout le salaire qui a été conservé pour lui.

L’agent suspendu visé aux points 3º et 4º de l’article 40 bénéficie de deux tiers (2/3) du salaire net correspondant à son dernier grade pendant six (6) mois. Le paiement de ce salaire ne s’arrête que lorsque l’agent de l’Etat trouve un autre emploi permanent au sein de la fonction publique.

A l’expiration du délai de six (6) mois sans que l’agent de l’Etat ait trouvé un autre emploi permanent au sein de la fonction publique, il est démis d’office de la fonction publique et bénéficie des indemnités de départ conformément aux dispositions de l’article 95 de la présente loi.

Article 42: Durée de suspension des fonctions

La durée de suspension des fonctions ne peut excéder six (6) mois.

Article 43: Compétence pour suspendre un agent de l’Etat de ses fonctions

La suspension de fonction de l’agent de l’Etat est approuvée par l’autorité compétente de l’institution qui l’emploie.

Article 44: Fin de la suspension des fonctions

La suspension des fonctions de l’agent de l’Etat prend fin si:

1° l’agent de l’Etat visé au point 1o de l’article 40 de la présente loi, est rétabli dans ses fonctions suite à l’acquittement ou condamnation d’une peine d’emprisonnement de moins de six (6) mois alors qu’il n’a pas été démis d’office;

2° l’agent de l’Etat visé au point 2° de l’article 40 de la présente loi, est rétabli dans ses fonctions;

3° l’agent de l’Etat obtient un autre poste au sein de la fonction publique pour la suspension des fonctions due aux raisons visées aux points 3° et 4° de l’article 40 de la présente loi,

4° il est révoqué ou démis d’office de ses fonctions.

Sous-section 6: Mise en disponibilité pour une durée déterminée

Article 45: Mise en disponibilité pour une durée déterminée

La mise en disponibilité pour une durée déterminée est une situation dans laquelle un agent de l’Etat est autorisé à suspendre ses fonctions pour une période déterminée pour l’une des raisons suivantes:

1° une durée de trois (3) mois au maximum en vue de s’occuper de son conjoint, de son parent ou de son enfant au premier degré qui est maladie;

2° une durée d’un (1) mois au maximum en vue de tenir compagnie à son conjoint qui doit aller s’établir à l’étranger pour des raisons de service.

Un agent de l’Etat autorisé à la mise en disponibilité pour une durée déterminée n’a pas droit au salaire et à d’autres avantages liés au service.

Lorsque la durée de la mise en disponibilité pour une durée déterminée se termine, l’agent de l’Etat reprend son poste. Un agent de l’Etat qui ne reprend pas son poste après l’expiration du délai prévu est pris comme déserteur née

La mise en disponibilité pour une durée déterminée se fait par notification écrite adressée à l’autorité compétente contre accusé de réception.

L’autorité compétente peut ne pas accorder la mise en disponibilité pour une durée déterminée à un agent de l’Etat dans l’intérêt du service.

Un agent de l’Etat qui demande la mise en disponibilité pour une durée déterminée reste en service jusqu’à la réponse sur sa demande.

Toutefois, si l’agent de l’Etat ne reçoit pas une réponse écrite à sa demande après l’expiration d’un délai de quinze (15) jours à compter de la remise de sa demande à l’autorité compétente, la mise en disponibilité pour une durée déterminée est réputée acceptée.

Section 2: Evaluation des performances

Article 47: Evaluation des performances des agents de l’Etat

L’évaluation des performances a pour but d’éclairer l’administration sur la valeur de l’agent de l’Etat, ses aptitudes professionnelles et sa manière de servir. Elle constitue la base essentielle de la détermination de son droit à l’avancement d’échelon horizontal et à l’augmentation du salaire tous les trois (3) ans êté du Premier Ministre détermine les modalités d’évaluation des performances et les avantages y relatifs.

CHAPITRE V: DROITS D’UN AGENT DE L’ETAT, RECOMPENSES ET RESPONSABILITES DE L’EMPLOYEUR

Section première: Droits de l’agent de l’Etat

Article 48: Droits de l’agent de l’Etat en tant que citoyen

L’agent de l’Etat jouit des droits et libertés reconnus aux autres citoyens. Il les exerce conformément aux lois et règlements en vigueur.

Article 49: Droit au dossier administratif

L’agent de l’Etat a droit à un dossier administratif personnel complet tenu par la fonction publique et contenant toutes les pièces relatives à ses performances et sa conduite professionnelle, curriculum vitae et autres pièces requises au moment de son entrée en fonction.

Article 50: Demande d’une mise à jour

dossier administratif personnel et peut, par écrit, demander à l’administration, sa mise à jour.

Article 51: Liberté d’adhérer à des syndicats

A l’exception des mandataires politiques et des agents des services de sécurité, les agents de l’Etat peuvent adhérer à un syndicat de leur choix.

Article 52: Salaire

Un agent de l’Etat a droit au salaire.

Le salaire est calculé sur base du tableau de classification des emplois.

Le salaire est en fonction de l’ampleur de l’emploi exercé et non de la personne qui l’occupe. Les principes de sa détermination sont uniformes et doivent être respectés au même titre partout dans la fonction publique.

Un arrêté du Premier Ministre détermine les salaires et autres avantages accordés aux agents de l’Etat.

Article 53: Salaire brut

Le salaire brut d’un agent de l’Etat est constitué du salaire de base augmenté des indemnités de logement et de transport, des frais médicaux et de sécurité sociale.

Lorsque l’agent de l’Etat jouit des facilités de logement et de transport, les indemnités y afférentes ne sont pas comprises dans son salaire brut. Elles sont remplacées par l’indemnité de fonction.

Article 54: Grille indiciaire de salaire

Un arrêté présidentiel détermine la grille indiciaire de salaire.

Article 55: Calcul du salaire de base

Le salaire de base constitue au moins soixante-dix pour cent (70%) du salaire brut. Il est calculé en multipliant l’indice par la valeur indiciaire.

Un arrêté du Premier Ministre fixe la valeur indiciaire applicable dans la fonction publique.

Article 56: Plafond de retenues salariales

Les retenues, la saisie-arrêt ou la cession volontaire du salaire ne peuvent aller au delà de la moitié (1/2) du salaire net de l’agent de l’Etat.

Article 57: Calcul du salaire

Le traitement de l’agent de l’Etat commence à être calculé dès son entrée en service et est suspendu le lendemain du jour de cessation de service.

Lorsque le salaire du mois n’est pas dû entièrement, il est fractionné en trentièmes et il est liquidé à concurrence du nombre de jours prestés.

Article 58: Comité National des Salaires

Il est institué un Comité National des Salaires chargé du suivi et de la révision des salaires et de conseiller le Gouvernement sur leur révision, le cas échéant.

Un arrêté du Premier Ministre détermine l’organisation et le fonctionnement du Comité National des Salaires.

Article 59: Indemnités

Les indemnités constituent les éléments du salaire brut au titre des contributions de l’Etat vis-à-vis de ses agents.

Un arrêté du Premier Ministre détermine les critères et les modalités de fixation des indemnités des agents de l’Etat.

Article 60: Agent assurant l’intérim

Lorsqu’un agent de l’Etat a un motif le rendant indisponible au service, l’autorité compétente procède à son replacement provisoire par un autre agent.

L’agent de l’Etat qui assure l’intérim au-delà de trente (30) jours est en droit de jouir du salaire et d’autres avantages mensuels inhérents au poste d’intérim.

Le salaire et les avantages à accorder à un agent de l’Etat qui assure l’intérim sont calculés à partir du trente et unième (31ème) jour d’intérim.

Article 61: Prescription de paiement du salaire et indemnités

L'action en paiement du salaire et indemnités se prescrit par deux (2) ans. Cette prescription court à partir de la date à laquelle ils sont exigibles.

Toutefois, le délai de l'action en paiement du salaire et indemnités cessera de courir lorsque :

1° l'employeur a calculé tous les paiements qu’il doit à l’employé ;

2° l’employeur a convenu avec l’employé que les paiements constituent la dette ;

3° la plainte de l’employé est pendante devant une institution compétente ou devant la juridiction.

Section 2: Récompenses

Article 62: Récompense

Une récompense est accordée à un agent de l’Etat en reconnaissance pour sa performance et sa bonne conduite au travail exceptionnellement excellentes.

Un arrêté du Premier Ministre détermine les exigences relatives à l’octroi des récompenses, leur nature et la procédure de leur octroi.

Section 3: Responsabilités de l’employeur

Article 63: Manuel de procédures administratives

L’employeur doit donner un document contenant le manuel de procédures administratives de l’institution concernée à tout agent de l’Etat dès son entrée en service.

Un arrêté du Premier Ministre détermine la structure du manuel des procédures administratives dans la fonction publique.

Article 64: Matériel

L’employeur est tenu de mettre à la disposition de l’agent de l’Etat, le matériel nécessaire lui permettant d’accomplir ses fonctions.

Article 65: Propreté du lieu de travail

Le lieu du travail doit toujours être tenu dans un état de propreté, disposer du matériel de propreté approprié et présenter les conditions favorables pour assurer la sécurité et la santé du personnel ainsi que pour prévenir des accidents.

L'employeur doit dispenser à l’agent de l’Etat l’éducation en matière de santé et de sécurité au travail.

Article 66: Equipements de protection contre les accidents

L'Etat est tenu de mettre à la disposition de son agent, à son lieu de travail, les équipements de sécurité nécessaires et appropriés et de veiller à leur correcte utilisation. Il doit posséder les moyens de protection contre les accidents au lieu de travail.

Article 67: Sécurité de l’agent de l’Etat

L’Etat est tenu d’assurer à son agent, la protection contre toute forme de violence dont il peut être victime en raison de l’exercice de ses fonctions ou toutes les fois qu’il est évident nace sécuritaire dont il fait l’objet est liée à l’exercice de ses fonctions.

Article 68: Locaux et équipements ne constituant aucun danger pour la santé des agents de l’Etat

Les locaux affectés au service doivent satisfaire aux normes de sécurité et de santé.

Il est interdit d’importer, d’exposer, de mettre en vente, de louer, de céder à quelque titre que ce soit ou d’utiliser des appareils, des machines et éléments de machines qui ne sont pas fabriqués ou commandés dans des conditions assurant la sécurité et la santé des agents de l’Etat.

Un arrêté du Ministre détermine les conditions générales et particulières relatives à la santé des agents de l’Etat et à la prévention et la protection contre les accidents de travail.

Article 69: Soins médicaux de l’agent de l’Etat

L’Etat participe aux dépenses de son agent pour ses soins médicaux et des autres personnes à sa charge conformément aux dispositions légales en la matière.

Article 70: Déclaration des accidents de travail

L’employeur doit déclarer à l’Office Rwandais de Sécurité Sociale et à l’Inspecteur du Travail du District dans lequel l’institution travaille, dans un délai de quatre (4) jours ouvrables, tout accident de travail survenu ou toute maladie professionnelle constatée.

Au cas où l’employeur ne fait pas la déclaration prévue à l’alinéa premier du présent article, elle peut être faite par la victime de l’accident de travail ou la personne atteinte de la maladie ou ses ayants droit dans un délai ne dépassant pas une (1) année à compter de la date de la survenance de l’accident de travail ou de la maladie.

Tout employeur dont l’institution peut causer des maladies liées au travail doit informer l’Inspecteur du Travail et l'Office Rwandais de Sécurité Sociale avant de commencer ses activités.

CHAPITRE VI: OBLIGATIONS DE L’AGENT DE L’ETAT ET INCOMPATIBILITES

Section première: Obligations de l’agent de l’Etat

Article 71: Obligations en rapport avec la prestation des services

L’agent de l’Etat est tenu d’assurer personnellement le service public à sa charge, de s’y consacrer en permanence avec probité et neutralité, de respecter et faire respecter son institution, respecter le patrimoine de l’Etat et d’avoir l’esprit d’initiative, et promouvoir l’intérêt général.

L’agent de l’Etat doit observer des instructions particulières ou générales données par son supérieur hiérarchique conformément aux lois.

Article 72: Préserver la chose publique

L’agent de l’Etat doit respecter les biens publics pendant et après les heures de service en apportant les soins nécessaires à sa bonne gestion et en la préservant contre toute destruction et spoliation.

Article 73: Secret professionnel

L’agent de l’Etat doit garder le secret professionnel, sauf dans les cas prévus par la loi ou lorsqu’il en est autorisé par l’autorité compétente.

Article 74: Ethique professionnelle de l’agent de l’Etat

Un arrêté présidentiel détermine le code d’éthique professionnelle des agents de l’Etat.

Section 2: Incompatibilités avec la qualité de l’agent de l’Etat

Article 75: Activités interdites à l’agent de l’Etat

Sont incompatibles avec la qualité de l’agent de l’Etat:

1° toute profession ou activité commerciale ou industrielle préjudiciable à l’accomplissement de ses fonctions;

2° toute participation à la direction de façon permanente, à l’administration d’une société ou toute autre entreprise commerciale et industrielle de nature à nuire à ses fonctions. Toutefois, cela ne s’applique pas aux agents qui représentent l’Etat dans des entreprises privées;

3° avoir, dans une entreprise soumise à son contrôle direct ou en relation avec lui, par lui-même ou par personne interposée, sous quelque dénomination que ce soit, des intérêts de nature à compromettre ou à restreindre l’indépendance, la vérité, la justice et l’objectivité de son action.

Sous réserve des dispositions de l’alinéa premier du présent article, si ceci n’est pas susceptible de nuire à ses fonctions, l’agent de l’Etat peut signer des contrats de travail avec des différents employeurs, dans le secteur public ou privé.

Toutefois, avant de signer ces contrats, l’agent de l’Etat doit en être autorisé par son employeur.

CHAPITRE VII: SANCTIONS ADMINISTRATIVES ET RECOURS

Section première: Sanctions

Article 76: Catégories des sanctions administratives

Les sanctions administratives sont réparties en deux (2) catégories. Les sanctions du premier degré sont administrées pour les fautes légères alors que les sanctions du deuxième degré sont administrées pour les fautes lourdes.

Les sanctions du premier degré sont les suivantes:

1° avertissement;

2° blâme.

Les sanctions du deuxième degré sont les suivantes :

1° retard dans l’avancement;

2° suspension des fonctions pour une période de trois (3) mois au maximum sans être payé;

3° révocation.

Article 77: Faute disciplinaire

Le manquement de l’agent de l’Etat aux obligations qui lui incombent, constitue une faute disciplinaire qui, suivant sa gravité, est sanctionnée par une des sanctions prévues à l’article 76 de la présente loi.

Toute action se rapportant à la procédure disciplinaire est faite par écrit.

Article 78: Responsabilité disciplinaire et responsabilité pénale

La sanction disciplinaire est indépendante de la responsabilité pénale et de la répression prévue par la législation pénale à tel point qu’un même fait peut déclencher des poursuites disciplinaires et pénales.

Article 79: Défense

Aucune sanction disciplinaire ne peut être prise contre un agent de l’Etat sans que l’intéressé n’ait eu l’occasion de présenter par écrit sa défense.

Article 80: Application de la sanction

Nulle sanction ne peut être appliquée sans que le concerné ne soit reconnu coupable.

Article 81: Pouvoir d’infliger des sanctions administratives

Les sanctions du premier degré sont infligées par le chef d’institution alors que les sanctions du deuxième degré sont infligées par l’autorité qui l’a affecté, après avis du Ministre.

Article 82: Modalités d’application du régime disciplinaire des agents de l’Etat

Un arrêté présidentiel détermine les modalités d’application du régime disciplinaire des agents de l’Etat.

Section 2: Recours

Article 83: Droit de recours pour un agent de l’Etat

L’agent de l’Etat qui s’estime lésé par l’imposition à son endroit d’une sanction disciplinaire, a le droit d’introduire un recours administratif ou juridictionnel.

Article 84: Procédure de recours

Un agent de l’Etat qui s’estime lésé par l’imposition à son endroit d’une sanction peut, dans un délai ne dépassant pas cinq (5) jours ouvrables à compter de la notification de la sanction, introduire un recours formulé par écrit au premier degré auprès du chef de son institution et la réponse lui est communiquée dans un délai ne dépassant pas quinze (15) jours ouvrables à partir de la réception du recours.

Lorsqu’il n’est pas satisfait de la décision prise au premier degré, l’agent de l’Etat sanctionné, peut introduire un recours en dernier ressort auprès de la Commission dans un délai ne dépassant pas cinq (5) jours ouvrables à partir de la notification de la réponse. La Commission doit donner sa réponse dans un délai ne dépassant pas soixante (60) jours. La décision de la Commission ne peut faire objet d’aucun recours administratif.

Les agents de la Commission introduisent leur recours en dernier degré devant le Conseil des Commissaires de la Commission.

Article 85: Recours devant les juridictions

L’agent de l’Etat qui n’est pas satisfait de la décision de l’autorité auprès de laquelle le recours a été introduit au dernier degré peut saisir les juridictions conformément aux lois en la matière.

CHAPITRE VIII: CESSATION DEFINITIVE DES FONCTIONS DE L’AGENT DE L’ETAT

Article 86: Motifs de cessation définitive des fonctions de l’agent de l’Etat

La cessation définitive des fonctions au sein de la fonction publique entraîne la radiation de l’agent de l’Etat du fichier du personnel de l’Etat.

La cessation définitive des fonctions au sein de la fonction publique a lieu lorsque l’agent de l’Etat:

1° est en mise en disponibilité pour une durée indéterminée;

2° démissionne volontairement;

3° est démis d’office;

4° est révoqué;

5° est admis à la retraite;

6° décède.

Section première : Mise en disponibilité pour une durée indéterminée

Article 87: Mise en disponibilité pour une durée indéterminée

La demande de mise en disponibilité pour une durée indéterminée est une décision prise par un agent de l’Etat indiquant par écrit son intention de cesser ses fonctions pour des raisons de convenance personnelle.

Un agent de l’Etat a droit de demander la mise en disponibilité pour une durée indéterminée lorsqu’il exerce ses fonctions pendant au moins trois (3) ans au poste d’emploi pour lequel il demande la mise en disponibilité pour une durée indéterminée.

Un agent de l’Etat dont la demande de mise en disponibilité pour une durée indéterminée a été acceptée cesse d’appartenir à la fonction publique et il est remplacé.

Article 88: Modalités de mise en disponibilité pour une durée indéterminée

La demande de mise en disponibilité pour une durée indéterminée se fait par écrit et est adressée à l’autorité compétente, et l’agent doit recevoir un accusé de réception.

La demande d’un agent de l’Etat de la mise en disponibilité pour une durée indéterminée peut être rejetée pour des raisons d’intérêt public.

Un agent de l’Etat qui a présenté sa demande de mise en disponibilité pour une durée indéterminée est tenu de continuer à exercer ses fonctions jusqu’à ce que la décision sur sa demande lui soit notifiée.

Cependant, s’il n’est pas donné une suite écrite à la demande de l’agent dans un délai de trente (30) jours à compter du jour de la réception de la lettre de demande par l’autorité compétente, sa mise en disponibilité pour une durée indéterminée est réputée acquise.

Article 89: Réintégration dans la fonction publique après la mise en disponibilité pour une durée indéterminée

Un agent de l’Etat dont la demande de mise en disponibilité pour une durée indéterminée a été acceptée a le droit de chercher un emploi dans la fonction publique ou d’y être nommé après trois (3) ans à compter du jour où sa demande de mise en disponibilité pour une durée indéterminée a été acceptée et conformément aux modalités de recrutement prévues par la présente loi.

Section 2: Démission volontaire

Article 90: Demande de la démission volontaire

La démission volontaire est une décision par laquelle un agent de l’Etat marque sa volonté de démissionner de ses fonctions dans la fonction publique.

Lorsque la démission volontaire de l’agent de l’Etat est acceptée, il cesse définitivement ses fonctions dans la fonction publique et il est remplacé.

Article 91: Modalités de démission volontaire

La démission volontaire se fait par écrit et doit être adressée à l’autorité compétente et l’agent démissionnaire doit recevoir un accusé de réception.

Un agent de l’Etat qui a présenté sa démission volontaire est tenu de continuer à exercer ses fonctions jusqu’à ce que la décision sur sa demande lui soit notifiée.

Cependant, s’il n’est pas donné une suite écrite à la demande de l’agent dans un délai de trente (30) jours à compter du jour de la réception de la lettre de demande par l’autorité compétente, sa démission est réputée acceptée.

Article 92: Réintégration de la fonction publique après une démission volontaire

L’agent de l’Etat admis à la démission volontaire n’a pas droit de réintégrer la fonction publique.

Cependant, pour l’intérêt public, un agent de l’Etat dont la démission volontaire a été acceptée peut encore avoir le droit au recrutement ou à la nomination dans la fonction publique après cinq (5) ans à compter du jour de l’acceptation de sa démission et après autorisation par l’autorité compétente et notification à la Commission.

Section 3: Démission d’office de l’agent de l’Etat

Article 93: Raisons de démission d’office d’un agent de l’Etat

L’agent de l’Etat est démis d’office de ses fonctions:

1° si son stage probatoire n’est pas concluant après l’évaluation de ses performances;

2° s’il a été placé en détention provisoire pour une période supérieure à six (6) mois;

3° s’il n’est pas physiquement ou intellectuellement apte à reprendre ses fonctions après le congé de maladie de longue durée prévu à l’article 28 de la présente loi;

4° s’il est déclaré professionnellement incompétent suite à l’évaluation des performances;

5° après une période de suspension supérieure a six (6) mois.

Article 94: Compétence de décider la démission d’office d’un agent de l’Etat

La démission d’office d’un agent de l’Etat est la décision prise par l’autorité compétente de radier l’agent du fichier des agents de l’Etat indépendamment de la volonté de l’agent. Toutefois, l’autorité compétente ne peut pas donner à un agent un préavis de démission d’office lorsque l’agent est en congé prévu par la loi.

Article 95: Calcul des indemnités de départ

Lorsque l’agent de l’Etat est démis d’office suite à la suppression ou au manque d’emploi, il bénéficie des indemnités de départ versées en une seule fois par l’institution pour laquelle il travaille lors de son départ. Les indemnités de départ de l’agent de l’Etat sont calculées sur base de son dernier salaire brut, déduit seulement des taxes, et en fonction de son ancienneté dans la fonction publique, comme suit:

1° un mois de salaire pour les agents justifiant d’une ancienneté d’une année au moins mais inférieure à cinq (5) ans;

2° deux (2) mois de salaire pour les agents justifiant d’une ancienneté de cinq (5) ans au moins mais inférieure à dix (10) ans ;

3° trois (3) mois de salaire pour les agents justifiant d’une ancienneté de dix (10) ans au moins mais inférieure à quinze (15) ans ;

4° quatre (4) mois de salaire pour les agents justifiant d’une ancienneté d’au moins quinze (15) ans au moins mais inférieure à vingt (20) ans;

5° cinq (5) mois de salaire pour les agents justifiant d’une ancienneté de vingt (20) ans au moins mais inférieure à vingt-cinq (25) ans;

6° six (6) mois de salaire pour les agents justifiant d’une ancienneté de vingt –cinq (25) ans au moins.

Article 96: Conditions pour octroi des indemnités de départ

Un agent de l’Etat dont le remplacement à son poste a été pourvu, qui a été suspendu et qui n’a pas reçu un autre poste alors qu’il avait été recruté suite à la nomination reçoit également les indemnités de départ prévues à l’article 95 de la présente loi.

Sans préjudice des indemnités reçues lors de la cessation des fonctions d’un mandataire politique, son ancienneté dans la carrière politique est ajoutée à son ancienneté en tant qu’agent de l’Etat lors du calcul de ses indemnités de départ.

Toutefois, lorsqu’un agent de l’Etat qui a fait l’objet de démission d’office est par la suite recruté dans la fonction publique et qu’il est encore démis d’office, il bénéficie des indemnités de départ calculées sur base de la nouvelle expérience acquise après la démission d’office précédente.

Les indemnités de démission d’office d’un agent de l’Etat suite à la suppression ou au manque d’emploi sont soumises à la prescription visée à l’article 61 de la présente loi.

Article 97: Réintégration de la fonction publique après la démission d’office

Un agent de l’Etat qui a été démis d’office de ses fonctions peut réintégrer la fonction publique conformément aux modalités de recrutement prévues par la présente loi.

Section 4: Révocation et réintégration de l’agent de l’Etat

Article 98: Révocation pour faute grave

La révocation est une mesure d’exclusion définitive de l’agent de l’Etat, prononcée par écrit par l’autorité compétente, suite à une faute grave de l’agent de l’Etat.

Une faute grave est punie par l’autorité compétente après avis du Ministre.

Article 99: Réintégration de l’agent de l’Etat après révocation

La personne ayant perdu la qualité d’agent de l’Etat suite à une révocation peut demander le droit de chercher l’emploi ou d’être nommée dans la fonction publique, après avoir été réhabilitée.

La demande de réhabilitation est faite par la personne concerné après une période d’au moins sept (7) ans, à compter du jour de sa révocation.

La lettre de demande de réhabilitation est adressée à l’autorité compétente de l’institution qui a révoqué l’agent, qui prend une décision sur base des conclusions de la Commission.

L’arrêté présidentiel déterminant les modalités d’application du régime disciplinaire des agents de l’Etat prévoit les conditions et les modalités de réhabilitation.

Section 5: Admission à la retraite

Article 100: Retraite

La mise à la retraite marque la fin normale de l’exercice de la fonction de l’agent de l’Etat et lui donne droit à une pension de retraite conformément aux dispositions légales en matière de sécurité sociale.

La mise à la retraite est décidée par l’autorité ayant affecté l’agent de l’Etat concerné.

Article 101: Age de la retraite

L’âge normal de la retraite d’un agent de l’Etat est de soixante cinq (65) ans.

Toutefois, un agent de l’Etat âgé de soixante (60) ans au moins et qui a accompli au moins quinze (15) ans de service dans la fonction publique en versant des cotisations à l’Office Rwandais de Sécurité Sociale, peut adresser à l’autorité compétente la demande de mise à la retraite anticipée.

L’âge de la retraite pour les agents régis par les statuts particuliers est fixé conformément à la nature de leurs fonctions.

Article 102: Indemnités de mise à la retraite

L’agent de l’Etat admis à la retraite bénéficie d’une indemnité de mise à la retraite versée par son institution sur base de son expérience dans la fonction publique.

L’indemnité de mise à la retraite est versée en une seule fois et elle est calculée de la même manière que celle qui est prévue à l’article 95 de la présente loi.

L’indemnité de mise à la retraite est incompatible avec les indemnités accordées à un agent démis d’office de ses fonctions.

Section 5: Décès d’un agent de l’Etat

Article 103: Cessation des fonctions d’un agent de l’Etat suite au décès

Le décès d’un agent de l’Etat marque la cessation définitive de son activité dans la fonction publique et met fin à la procédure disciplinaire dans tous ses effets.

Article 104: Indemnités de décès et dépenses funéraires

En cas de décès d’un agent de l’Etat en cours d’activités, une allocation de décès versée sous forme d’un paiement unique d’un montant égal au sextuple du dernier salaire brut mensuel du défunt est accordée au conjoint survivant et aux orphelins, à défaut de ces derniers, aux successeurs légitimes. Cette allocation est soumise à la prescription visée à l’article 61 de la présente loi.

Un arrêté du Premier Ministre détermine le montant des dépenses funéraires en cas de décès d’un agent de l’Etat en cours d’activités.

CHAPITRE IX: DISPOSITIONS TRANSITOIRES ET FINALES

Article 105: Période transitoire

Tout litige survenu avant l’entrée en vigueur de la présente loi sera réglé conformément à la loi qui était en vigueur au moment de la survenance du litige dans une période de douze (12) mois à compter de l’entrée en vigueur de la présente loi.

Article 106: Initiation, examen et adoption de la présente loi

La présente loi a été initiée, examinée et adoptée en Kinyarwanda.

Article 107: Disposition abrogatoire

La Loi nº 22/2002 du 09/07/2002 portant statut général de la fonction publique Rwandaise et toutes les dispositions légales antérieures contraires à la présente loi sont abrogées.

Article 108: Entrée en vigueur

La présente loi entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.

Umukozi wa Leta arahira afatishije Ibendera ry’Igihugu ikiganza cy’ibumoso azamuye ukuboko kw’iburyo akarambura ikiganza hejuru.

Umukozi wa Leta ufite ubumuga butuma adashobora kubahiriza ibiteganywa mu gika cya mbere cy’iyi ngingo, yambikwa ibendera.

Iyo umukozi wa Leta warahiye atangira akazi, agiye gukorera urundi rwego rwa Leta ntiyongera kurahira, keretse igihe ashyizwe ku mwanya w’umuyobozi mukuru cyangwa mu rwego abakozi barwo bagengwa na sitati yihariye.

Umukozi wa Leta wese utangiye akazi mu Butegetsi bwa Leta, ageragezwa mu gihe cy’amezi atandatu (6), aho umuyobozi we wo mu rwego rwa mbere asuzuma imikorere ye ku bijyanye n’ubushobozi, imyitwarire n’imyifatire mu kazi.

Igihe umukozi atangiye igeragezwa agomba kumenyeshwa mu nyandiko n’Umuyobozi ubifitiye ububasha, inshingano ze n’ibyo asabwa kubahiriza.

Umukozi wa Leta uri mu igeragezwa agira uburenganzira bw’ibanze nk’ubw’umukozi wa Leta warangije neza igeragezwa.

2° amezi abiri (2) y’umushahara ku bakozi bamaze nibura imyaka itanu (5) ariko bataruzuza imyaka cumi (10) mu kazi;

3° amezi atatu (3) y’umushahara ku bakozi bamaze nibura imyaka cumi (10) ariko bataruzuza imyaka cumi n’itanu (15) mu kazi;

Umuntu utakiri umukozi wa Leta bitewe n’uko yirukanywe burundu, ashobora gusaba gusubirana uburenganzira bwo gushaka akazi cyangwa gushyirwa mu mwanya mu butegetsi bwa Leta amaze gukorerwa ihanagurabusembwa.

Gusaba ihanagurabusembwa bikorwa na nyir’ubwite amaze nibura imyaka irindwi (7) ibarwa uhereye igihe umukozi yaherewe igihano cyo kwirukanwa burundu.

Inyandiko isaba ihanagurabusembwa ishyikirizwa umuyobozi ubifitiye ububasha w’urwego umukozi yirukanywemo, na we agafata icyemezo ashingiye ku myanzuro ya Komisiyo.

Icyiciro cya 5: Kwemererwa gushyirwa mu kiruhuko cy’izabukuru

Ingingo ya 100: Ikiruhuko cy’izabukuru Ikiruhuko cy’izabukuru ni irangira risanzwe ry’umurimo w’umukozi wa Leta, ari byo bimuhesha uburenganzira ku mafaranga y’izabukuru nk’uko ateganywa n’amategeko y’ubwiteganyirize.

Umuyobozi washyize mu mwanya umukozi wa Leta, ni na we ufite ububasha bwo kumwemerera kujya mu kiruhuko cy’izabukuru.

Ingingo ya 101: Imyaka y’ikiruhuko cy’izabukuru

Imyaka isanzwe kugira ngo umukozi wa Leta abone ikiruhuko cy’izabukuru ni mirongo itandatu n’itanu (65).

Icyakora, umukozi wa Leta wujuje nibura imyaka mirongo itandatu (60) y’amavuko kandi akaba amaze gukora nibura imyaka cumi n’itanu (15) atanga imisanzu mu Kigo cy’Ubwiteganyirize mu Rwanda, ashobora gusaba umuyobozi ubifitiye ububasha kujya mu kiruhuko cy’izabukuru igihe giteganyijwe kitaragera.

Imyaka y’ikiruhuko cy’izabukuru ku bakozi bagengwa na Sitati zihariye igenwa hakurikijwe imiterere y’imirimo bakora.

Ingingo ya 102: Impamba y’izabukuru

Umukozi wa Leta ushyizwe mu kiruhuko cy’izabukuru, agenerwa n’urwego akorera impamba y’izabukuru itangwa mu mafaranga, hashingiwe ku burambe uwo mukozi afite mu Butegetsi bwa Leta.

Amafaranga y’impamba y’izabukuru abarwa mu buryo bumwe n’ibivugwa mu ngingo ya 95 y’iri tegeko, kandi atangwa inshuro imwe.

Amafaranga y’impamba y’izabukuru ntabangikanywa n’amafaranga y’imperekeza agenerwa umukozi usezerewe nta mpaka.

Ubu burenganzira buzima mu gihe n’uburyo biteganyijwe mu ngingo ya 61 y’iri tegeko.
