MEMORANDUM OF SETTLEMENT BETWEEN REGENT PLAZA HOTEL & CONVENTION CENTRE AND REGENT PLAZA HOTEL & CONVENTION CENTRE LABOUR UNION - 2013

SHORT RECITAL OF THE CASE
The Regent Plaza Hotel & Convention Centre Labour Union has been certified as C.B.A for the workmen employed in all the establishments of Regent Plaza Hotel & Convention Centre by the National Industrial Relations Commission vide C.B.A Certificate bearing No. 03/2007 dated 14.05.2007 and 22.05.2010. Thereafter the C.B.A vide its letter dated 16.06.2013 submitted to the company a communication along with a Charter of Demands under the I.R.A 2012. A photocopy of the said communication and accompanying charter of demands are annexed herewith and marked A & A/1 respectively. Upon receipt of the said communication negotiations the C.B.A was informed of the financial / business position of the company. As a result of the said negotiations the parties have agreed to sign this settlement. Accordingly, this settlement is being signed between the parties keeping in view the financial position of the company.
TERMS OF SETTLEMENT
In full and final settlement of all the demands contained in annexure A-1, it is agreed as follows:
1.
The minimum wages of the workers as announced by the Federal/Provincial Government shall be paid to the workers and if there is any increase the same shall be paid by the company form the stipulated date.
2.
Laundry and Engineering Department workers will be provided cold-drink/squash to drink in view of the nature of their job.
3.
Workers are presently being given a loan which will continue to be given as per policy of the company.
4.
Workers gathering party as presently being held will also continue to be held in future at the discretion of the Management.
5.
The grievances, if any, in respect of the food, crockery and cleanliness etc. being provided in the canteen to the staff will be looked into. In this respect a committee will be constituted comprising of one representative of workers and one representative of the management to look into the affairs.
6.
Every year 2 pairs of uniform will continue to be provided to the workers.
7.
The attendance allowance of Rs. 100/- per month presently being paid to the C & D category of the workers on full attendance will continue to be paid.
8.
The increment to the worker will continue to be paid at the discretions of the Management as per present practices.
9.
Every year one worker will continue to be sent for Hajj as per present practices.
10.
The Management may provide the facility of internship to the dependents of the workers for training but they shall not be entitled to any stipend or any emoluments.
GENERAL
a. This settlement has been executed in full and final settlement of all demands contained in annexure A-1. Accordingly, subject to what has been agreed above, all demands contained in annexure A-1 and which have not been withdrawn/dropped by the C.B.A.
b. This settlement shall become effective from 15.06.2013 and shall remain in force and binding upon the parties for a period of 3 years up to 14.06.2016.
c. The C.B.A agrees, stipulates and undertakes that it shall not raise any demand during the said period of this settlement which is effective and binding on the parties as stated above.
d. It is further agreed that whatsoever having financial implications or even otherwise directly or indirectly affect the company and/or any of the demands contained in annexure A-1 hereto have been dropped or withdrawn.
e. The C.B.A will cooperate strictly in maintaining discipline, industrial harmony and understanding in the establishment and in this context they will rendered every assistance by itself and through the workers to increase efficiency to promote the business. Any change in the office bearers of the C.B.A or the C.B.A becoming a member of any Federation will not affect the binding nature of this settlement, which shall continue to remain in force and binding upon the parties.
This settlement has been executed on this day of 1st July, 2013.
