charset=UTF-8\">\n  \u003Ctitle>New5\u003C\u002Ftitle>\n  \u003Cmeta name=\"generator\" content=\"Amaya, see http:\u002F\u002Fwww.w3.org\u002FAmaya\u002F\">\n\n\n\n\u003Cp>REPUBLIC OF ZAMBIA\u003C\u002Fp>\n\n\u003Cp>***********************\u003C\u002Fp>\n\n\u003Cp>BANK OF ZAMBIA\u003C\u002Fp>\n\n\u003Cp>**********************\u003C\u002Fp>\n\n\u003Ch1>COLLECTIVE AGREEMENT BETWEEN THE BANK OF ZAMBIA AND THE ZAMBIA UNION OF\nFINANCIAL INSTITUTIONS AND ALLIED WORKERS - 2014\u003C\u002Fh1>\n\n\u003Cp>2014 - 2016\u003C\u002Fp>\n\n\u003Cp>This Collective Agreement is made the 7th day of May Two Thousand and\nFifteen between Bank of Zambia, a body corporate established by the Bank of\nZambia Act Cap. 360 of the Laws of Zambia, and having its Head Office situated\nat Bank Square, Cairo Road, Lusaka in the Lusaka Province of the Republic of\nZambia (hereinafter referred to as “the Bank”) of the one part, and Zambia\nUnion of Financial Institutions and Allied Workers registered under the\nIndustrial and Labour Relations Act, Cap. 269 of the Laws of Zambia, and having\nits registered Office situated at Luangwa House, Cairo Road, Lusaka aforesaid\n(hereinafter referred to as “the Union”), of the other part.\u003C\u002Fp>\n\n\u003Cp>Whereas pursuant to a Memorandum of Recognition Agreement made between the\nparties to this Collective Agreement on the Seventeenth day of September, One\nThousand Nine Hundred and Seventy Nine (17th September, 1979) and renewed on\n1st day of April, One Thousand Nine Hundred and Eighty Three (1st April, 1983),\nthe Bank has recognised the trade union as representative of, and bargaining\nagent for, the eligible employees represented by the trade union so recognised\nfor the purpose of regulating relations between the employer or employers’\norganisation and the trade union.\u003C\u002Fp>\n\n\u003Cp>And whereas the said Memorandum of Recognition Agreement is still in force\nand binding upon the parties to it and Collective Negotiations and Agreement on\nthe matters hereinafter specified have been concluded between the Bank and the\nUnion.\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE, THIS COLLECTIVE AGREEMENT WITHNESSETH AS FOLLOWS:\u003C\u002Fp>\n\n\u003Ch2>1.0 DEFINITIONS\u003C\u002Fh2>\n\n\u003Cp>In this Collective Agreement unless otherwise required words and expressions\nimporting the masculine gender include the feminine gender; words importing the\nsingular number shall include the plural and shall have the meaning hereby\nascribed to it in this clause.\u003C\u002Fp>\n\n\u003Cp>1.1“Salary” shall mean employee’s monthly pay exclusive of all\nallowances.\u003C\u002Fp>\n\n\u003Cp>1.2“Registered dependants\u002Fchildren” shall mean and include an eligible\nemployee’s registered children who are the employee’s offspring, and\u002For\nlegally adopted children who, subject to the qualifications set out below, are\nunder the age of 25 and: -\u003C\u002Fp>\n\n\u003Cp>• if over 21 years are attending a full time course of academic\ninstruction at any educational establishment recognised by the Government;\u003C\u002Fp>\n\n\u003Cp>• are single and without children;\u003C\u002Fp>\n\n\u003Cp>• are unemployed;\u003C\u002Fp>\n\n\u003Cp>Provided that:-\u003C\u002Fp>\n\n\u003Cp>• If dependants\u002Fchildren are physically or mentally challenged, the\nrestriction as to age shall not apply in any manner whatsoever; and provided\nfurther that; \u003C\u002Fp>\n\n\u003Cp>5.2 MERIT AWARDS\u003C\u002Fp>\n\n\u003Cp>It is hereby agreed between the Bank and the Union that an eligible employee\nwho performs an act of an exceptional nature beyond the normal call of duty\nshall be given a Merit Award equivalent to a Labour Day Award.\u003C\u002Fp>\n\n\u003Ch2>6.0 ALLOWANCES\u003C\u002Fh2>\n\n\u003Cp>The Bank shall pay to eligible employees the following as indicated\nbelow:\u003C\u002Fp>\n\n\u003Ch3>6.1 Annual. Leave Allowance\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>An eligible employee proceeding on annual leave shall be paid a leave\nallowance of two (2) times monthly salary when such employee proceeds on annual\nleave. For purpose of this clause, “Annual leave” is as defined in Clause\n9.2 below.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>6.2 Upset Allowance\u003C\u002Fh3>\n\n\u003Cp>Upset Allowance shall be paid at the rate of two times an eligible\nemployee’s monthly salary and shall only be payable under the circumstances\nof transfer between stations at the instance of the Bank.\u003C\u002Fp>\n\n\u003Ch3>6.3 Laundry Allowance\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The Bank agrees with the Union to procure services of laundry firms where\neligible employees who are entitled to suits and weather coats as uniform,\nshall take their uniforms for dry cleaning. The Bank shall meet full laundry\ncosts for up to four suits and one weather coat in a month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>6.4 Shift Differential Allowance\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-NOCTPREM_trigger\">\u003Cp>Eligible employees engaged in night shift work from 18.00 to 06.00 hours\nshall be paid shift differential allowance at 50% of the basic rate per shift.\nAny excess hours shall be paid as overtime.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>6.5 Lunch Allowance\u003C\u002Fh3>\n\n\u003Cp>Eligible employees shall be paid a Lunch Allowance of One Hundred and Thirty\nKwacha Seventy-seven Ngwee (K130.77) gross when made to work under the\nfollowing conditions:\u003C\u002Fp>\n\n\u003Cp>6.5.1 out of station and unable to return to base for lunch;\u003C\u002Fp>\n\n\u003Cp>6.5.2 beyond lunch hour, over weekends\u002Fpublic holidays.\u003C\u002Fp>\n\n\u003Cp>It is hereby agreed that the amount shall be reviewed after every six\nmonths\u003C\u002Fp>\n\n\u003Ch2>6.6 Acting Allowance\u003C\u002Fh2>\n\n\u003Cp>Acting Allowance shall be paid to an eligible employee (hereinafter called\n“the Acting Officer”) who shall be delegated to perform certain duties for\nand during the \u003C\u002Fp>\n\n\u003Ch2>7.0 COUNCIL RATES ON BUILDINGS\u003C\u002Fh2>\n\n\u003Cp>The Bank agrees with the Union to pay 100% of the Local Council rate bill\nbi-annually for rates in respect of those eligible employees who have bought or\nbuilt houses for their own occupation mortgaged to the Bank. Provided that the\ntax burden shall be borne by the employee.\u003C\u002Fp>\n\n\u003Ch2>8.0 GROUND RENT\u003C\u002Fh2>\n\n\u003Cp>The Bank agrees with the Union to pay 100% of the Ground Rent and Lease\nCharges to the Commissioner of Lands or appropriate local authority annually\nfor eligible employees who have bought or built dwelling property for own\noccupation mortgaged to the Bank. Provided that where applicable, the tax\nburden shall be borne by the employee.\u003C\u002Fp>\n\n\u003Ch2>9.0 LEAVE\u003C\u002Fh2>\n\n\u003Ch3>9.1 Leave Days\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>The Bank agrees with the Union that leave days shall accrue to all eligible\nemployees as follows:-\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Grades\u003C\u002Ftd>\n      \u003Ctd>Rate per Annum\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>BOZ 1 to 2\u003C\u002Ftd>\n      \u003Ctd>35 days\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>BOZ 3to 4\u003C\u002Ftd>\n      \u003Ctd>41 days\u003C\u002Ftd>\u003C\u002Ftr>\u003C\u002Ftbody>\u003C\u002Ftable>\u003C\u002Fdiv>\u003Ctable border=\"1\" style=\"width: 100%\">\u003Ctbody>\u003Ctr>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Ch3>9.2 Vacation (annual) Leave\u003C\u002Fh3>\n\n\u003Cp>An eligible employee shall be entitled to annual leave once a year. For the\npurpose of this clause annual leave shall mean a minimum of 21 days to be taken\nat least twelve (12) months after commencement of employment.\u003C\u002Fp>\n\n\u003Ch3>9.3 Commutation of Leave Days\u003C\u002Fh3>\n\n\u003Cp>An eligible employee shall be entitled to commute unutilised leave days for\ncash. Commutable days are those accrued at the time of proceeding on annual\nleave, leaving a balance of seven (7) days each time such commutation is\nmade.\u003C\u002Fp>\n\n\u003Ch3>9.4 Sick Leave\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknessmaxdays\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknesspay\">\u003Cp>The Bank agrees with the Union that on production of valid written medical\nrecommendations, an eligible employee may go on paid sick leave for a maximum\nperiod of 90 days, thereafter for another 90 days on half pay, should\ncircumstances warrant.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-longtermillness\">\u003Cp>Provided that if the employee has not recovered from illness after six (6)\nmonths from the date of illness, the Bank may, on the recommendation of a\nregistered medical practitioner or medical institution designated by the Bank,\ndischarge the employee, whereupon the entitlement to sick leave shall cease.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>10.3the cost was incurred by the employee while in the employment of the\nBank of Zambia;\u003C\u002Fp>\n\n\u003Cp>10.4the Head of Department certifies relevance to the requirements of the\nBank. Such approval shall be granted in consultation with the Human Resources\nDepartment;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>10.5 that only the costs incurred on the following shall be reimbursed:\u003C\u002Fp>\n\n\u003Cp>10.5.1 Registration fees;” -\u003C\u002Fp>\n\n\u003Cp>10.5.2 Subscription fees where this is a requirement for study\u003C\u002Fp>\n\n\u003Cp>10.5.3 Tuition fees;\u003C\u002Fp>\n\n\u003Cp>10.5.4 Examination fees; and\u003C\u002Fp>\n\n\u003Cp>10.5. 5Project\u002Fresearch fees.\u003C\u002Fp>\n\n\u003Ch2>11.0 REMOVALS\u003C\u002Fh2>\n\n\u003Cp>The Bank undertakes to provide transport to facilitate removal\u002Fshifting of\neligible employees on the occurrence of any of the following:-\u003C\u002Fp>\n\n\u003Cp>11.1Change of accommodation at the instance of the Bank.\u003C\u002Fp>\n\n\u003Cp>11.2 Change of accommodation from Bank residential property to\nowner-occupier accommodation.\u003C\u002Fp>\n\n\u003Cp>11.3 Further, the Bank undertakes to provide appropriate removal services in\nthe event of the Bank transferring an eligible employee between stations.\u003C\u002Fp>\n\n\u003Ch2>12.0 FUNERAL ASSISTANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>12.1 Staff\u003C\u002Fp>\n\n\u003Cp>The Bank agrees with the Union that at the death of an eligible employee, it\nshall meet the cost of funeral expenses as follows:\u003C\u002Fp>\n\n\u003Cp>(a) Provide a funeral grant of K8,000 cash to the family of the deceased.\u003C\u002Fp>\n\n\u003Cp>(b) Conveying a body to a funeral service provider’s premises.\u003C\u002Fp>\n\n\u003Cp>(c) Preparation of the body for burial\u002Fcremation.\u003C\u002Fp>\n\n\u003Cp>(d) Conveying the body from a funeral service provider’s premises to the\npoint of burial\u002Fcremation.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>(e) Provision of a casket of up to K12,000.\u003C\u002Fp>\n\n\u003Cp>Provided that;\u003C\u002Fp>\n\n\u003Cp>- General Workers\u003C\u002Fp>\n\n\u003Cp>- Nurses\u003C\u002Fp>\n\n\u003Cp>- Chefs\u002FCooks\u003C\u002Fp>\n\n\u003Cp>- Note Destruction Officers \u003C\u002Fp>\n\n\u003Cp>- House Keepers\u003C\u002Fp>\n\n\u003Cp>13.2 Further, the Bank shall provide one packet of detergent powder per week\nto the uniformed employees. Where issuance of such detergents falls in arrears,\nthe Bank shall be obliged to issue the outstanding detergent to the eligible\nemployees.\u003C\u002Fp>\n\n\u003Cp>13.3 The Bank and the Union further agree that the Union shall be consulted\nwhen determining the type of uniforms. The said uniformed eligible employees\nshall wear the uniform so issued throughout the year.\u003C\u002Fp>\n\n\u003Cp>13.4 The Bank and the Union further agree that:\u003C\u002Fp>\n\n\u003Cp>13.4.1 Uniforms for eligible employees would be delivered in the first\nquarter of the applicable year.\u003C\u002Fp>\n\n\u003Cp>13.4.2 Uniform shall be provided as per Appendix B.\u003C\u002Fp>\n\n\u003Ch2>14.0 LOANS\u003C\u002Fh2>\n\n\u003Cp>Subject to Section 21 of the Bank of Zambia Act, the Bank agrees with the\nUnion that it shall provide the following Staff Loans to eligible employees as\nper the Bank’s Staff\u003C\u002Fp>\n\n\u003Cp>Advances and Loans Policy:\u003C\u002Fp>\n\n\u003Cp>• House Loan\u003C\u002Fp>\n\n\u003Cp>• Car Loan\u003C\u002Fp>\n\n\u003Cp>• Multi-purpose Loan\u003C\u002Fp>\n\n\u003Cp>• Personal Loan\u003C\u002Fp>\n\n\u003Cp>There shall be such long service award as approved by the Board for eligible\nemployees who would have worked in the Bank for a period of 15 years and 30\nyears unbroken service. The Union and Management through a process of\nconsultation shall determine the award to be given to eligible staff.\u003C\u002Fp>\n\n\u003Ch2>16.0 CHRISTMAS GIFT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The Bank agrees with the Union that it shall pay an equivalent of a\nmonth’s salary to eligible employees as a Christmas gift once every year for\nthe duration of this Agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>17.0 STAFF POLICIES\u003C\u002Fh2>\n\n\u003Cp>Without prejudice to the Board’s power to formulate policy, the Bank\nagrees with the Union that it shall engage the union in the process of\ndevelopment, review and amendment of the following staff matters: \u003C\u002Fp>\n\n\u003Cp>In witness whereof the parties
