Box 7010, Kampala (hereinafter referred to\nas the ''COUNCIL\" ) of the one part;\u003C\u002Fp>\n\n\u003Cp>AND\u003C\u002Fp>\n\n\u003Cp>UGANDA PUBLIC EMPLOYEES UNION of P.O. Box 7060, Kampala (hereinafter\nreferred to as the ''UNION\") of the other part;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>WITNESSETH AS FOLLOWS:\u003C\u002Fp>\n\n\u003Cp>WHEREAS\u003C\u002Fp>\n\n\u003Cp>The Council and the Union are cognisant of the relevant laws and policies of\nthe state and of either party.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS\u003C\u002Fp>\n\n\u003Cp>The council and the Union are committed to safeguard and protect workers\nrights and to generally promote the economic and social aspects of the\nworkers.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS\u003C\u002Fp>\n\n\u003Cp>Both parties are dedicated to general development of Kampala City Council\nand aware of cardinal obligations of delivering services to City Council of\nKampala dwellers.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS\u003C\u002Fp>\n\n\u003Cp>This agreement is made in cognisance of the recognition and procedural\nagreement between the parties to this agreement\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS\u003C\u002Fp>\n\n\u003Cp>This agreement is made in cognisance of the collective bargaining agreement\nbetween the parties to this agreement dated 20th October, 1999.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS'\u003C\u002Fp>\n\n\u003Cp>Both parties bind themselves and their successors to the provisions of\nthis\u003C\u002Fp>\n\n\u003Cp>agreement for the achievement of the foregoing objectives.\u003C\u002Fp>\n\n\u003Cp>NOW THIS AGREEMENT WITNESSETH AS HEREUNDER: \u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>1.COMMITMENTS\u003C\u002Fh2>\n\n\u003Ch3>(i)\u003C\u002Fh3>\n\n\u003Cp>Both parties to this agreement are committed to jointly undertake\nappropriate measures to review and rationalise Council departments and\nfunctions to facilitate improvement of service delivery and the operations of\nCouncil business.\u003C\u002Fp>\n\n\u003Ch3>(ii)\u003C\u002Fh3>\n\n\u003Cp>The parties to this agreement undertake to conduct comprehensive and\nstrategic manpower planning policy that recognises and draws clear and\nfavourable programmes to manage personnel exit.\u003C\u002Fp>\n\n\u003Ch2>2. APPLICATION\u003C\u002Fh2>\n\n\u003Ch3>(i)\u003C\u002Fh3>\n\n\u003Cp>The provisions of this Agreement shall only be enjoyed by members and shall\napply only to subscribing members of\u003C\u002Fp>\n\n\u003Cp>Union\u003C\u002Fp>\n\n\u003Ch3>(ii)\u003C\u002Fh3>\n\n\u003Cp>Council shall while managing the personnel exit from service priority to\nthose who wish to retire voluntarily.\u003C\u002Fp>\n\n\u003Ch3>(iii)\u003C\u002Fh3>\n\n\u003Cp>Council employees who voluntarily retire shall be paid benefits as per this\nagreement.\u003C\u002Fp>\n\n\u003Ch2>3. REDUNDANCY\u003C\u002Fh2>\n\n\u003Ch3>(i) \u003C\u002Fh3>\n\n\u003Cp>The principle of “First in” “Last out\" shall apply to the Union\nmembers. The Union officials shall be \"Last out\". For avoidance of doubt this\nprinciple shall apply where issues of performance, age, qualifications, health\nand other stated issues have been put into consideration.\u003C\u002Fp>\n\n\u003Ch3>(ii)\u003C\u002Fh3>\n\n\u003Cp>Termination shall only be effective when accruing terminal benefits\u002Fpackage\nand other outstanding dues are duly paid.\u003C\u002Fp>\n\n\u003Ch3>(iii)\u003C\u002Fh3>\n\n\u003Cp>The Union leadership shall be involved in the implementation of redundancy\nmanagement measures. For avoidance of doubt, the Union shall particularly be\ninvolved in the verification of the lists and benefits of those to be paid in\naccordance with this agreement.\u003C\u002Fp>\n\n\u003Ch2>4. TERMINAL BENEFITS\u003C\u002Fh2>\n\n\u003Cp>Council employees who have been laid off or have voluntarily retired under\nthis agreement shall be paid terminal benefits as agreed hereunder.\u003C\u002Fp>\n\n\u003Ch3>(i) Notice:-\u003C\u002Fh3>\n\n\u003Cp>Three (03) month’s Gross pay in lieu of\u003C\u002Fp>\n\n\u003Cp>notice\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-ANNLEAVE_trigger\" class=\"cbaClause highlight focus\">\u003Ch3>(ii) Annual leave:-\u003C\u002Fh3>\n\n\u003Cp>One (01) month’s Gross pay in lieu of leave\u003C\u002Fp>\n\n\u003Cp>not taken.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contractseverancepay\" class=\"cbaClause highlight\">\u003Ch3>(iii) Severance pay:-\u003C\u002Fh3>\n\n\u003Cp>Two (02) month’s current Gross pay\u003C\u002Fp>\n\n\u003Cp>obtaining on the payroll multiplied by the number of years worked to the\nmaximum of twenty (20) years of service.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-COMMUTE_trigger\" class=\"cbaClause highlight\">\u003Ch3>(iv) Transport:- \u003C\u002Fh3>\n\n\u003Cp>(a) Shs. 3500\u002F per kilometre — from\u003C\u002Fp>\n\n\u003Cp>Employment Station to Employees home District headquarters. Then;\u003C\u002Fp>\n\n\u003Cp>(b) A flat rate of shs. 200,000\u002F- from the Employees home district\nHeadquarters to the rural home village (Final destination). 5. CERTIFICATE OF\nSERVICE\u003C\u002Fp>\n\n\u003Cp>A certificate of Service stating the period an employee has served in\nCouncil and any other relevant remarks shall be given to Council employees on\nleaving Council service.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. GENERAL PRINCIPLES\u003C\u002Fh2>\n\n\u003Cp>When the Council is recruiting labour, former employees who have been\ndischarged as redundant or who have voluntarily retired shall be eligible to\napply for re-employment provided they have the required quialifications for the\nvacancies to be filled and have clean record.\u003C\u002Fp>\n\n\u003Ch2>7. REVIEW OF THIS AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>This agreement shall be reviewed once every two financial years. Except\nwhere both parties agree for a lesser period.\u003C\u002Fp>\n\n\u003Ch2>8. DURATION OF THE AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>This agreement shall apply to all unionised employees of Council and shall\nbe a legally binding document to both parties thereto\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. EFFECTIVE DATE OF THIS AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>The effective date of this agreement shall be 28th day of June, 2000.\u003C\u002Fp>\n\n\u003Ch2>10.
