Wafanyakazi wote watakuwa katika kipindi cha majaribio ya\nmiezi sita (6) kabla ya kuthibitishwa katika ajira zao.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>5.1.2 Kuthibitishwa:- Baada ya kumaliza vyema muda wa majaribio Mfanyakazi\natapata barua ya kuthibitishwa katika ajira.\u003C\u002Fp>\n\n\u003Cp>5.1.3 Mfanyakazi ataachishwa kazi katika kipindi cha majaribio iwapo\nhatafanya vizuri katika majaribio yake.\u003C\u002Fp>\n\n\u003Cp>5.2 Kutothibitishwa kwa mfanyakazi kwa makosa ya mwajiri hakutachukuliwa\nkuwa mfanyakazi hajamaliza majaribio vizuri.\u003C\u002Fp>\n\n\u003Cp>5.3 Ajira ya vibarua (kutwa) itaendelea kuwepo tu kwa zile kazi zisizodumu\nkwa zaidi ya miezi mitatu (3) na za dharura.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>6.0 KUACHA AU KUACHISHWA KAZI\u003C\u002Fh3>\n\n\u003Cp>6.1 Kama kutakuwepo sababu ya kumwachisha kazi mfanyakazi, taarifa ya\nkuachishwa itatolewa kwa utaratibu unaoelekezwa na ibara hii.\u003C\u002Fp>\n\n\u003Cp>6.1.1 Mfanyakazi akiacha\u002Fkuachishwa kazi taarifa ya mwezi mmoja itatolewa au\nmshahara badala yake.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contractseverancepay\" class=\"cbaClause highlight\">\u003Cp>6.1.2 Mfanyakazi anayeachishwa kazi baada ya kumaliza miaka mitano (5)\nkatika utumishi atalipwa mshahara wa mwezi mmoja mara miaka ya utumishi wake\nkazini (SMB Nyehunge Express).\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>7.0 UPUNGUZAJI WA WAFANYAKAZI\u003C\u002Fh3>\n\n\u003Cp>7.1 Pande zote zinakubaliana kulinda nafasi za kazi zilizopo na kufanya kila\njuhudi kuzuia uwezekano wa kupunguza wafanyakazi ambao wana nafasi zao tayari\nkatika ajira.\u003C\u002Fp>\n\n\u003Cp>7.2 Upunguzaji wa wafanyakazi utachukuwa nafasi tu, baada ya uongozi wa\nKampuni kushauriana na viongozi wa Tawi la COTWU (T) na Kanda COTWU (T), na\nbaada ya kufikiria njia mbalimbali za kukabiliana na hali hiyo ikiwa ni pamoja\nna kuwahamisha wafanyakazi kutoka idara moja kwenda nyingine, mpaka hapo\nitakapokuwa hali nzuri au kama lazima kwa kuwapunguza kidogo kidogo.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>7.3 Ikiwa njia zote zitashindikana kwa kadri ya ujio wake, Kampuni itafuata\nutaratibu wa FILO (first in last out) katika kupunguza wafanyakazi.\u003C\u002Fp>\n\n\u003Cp>7. 4 Pamoja na zoezi hilo masuala muhimu yafuatayo yatatakiwa yatazamwe\nkwanza:-\u003C\u002Fp>\n\n\u003Cp>7.3.1 Juhudi katika kazi\u003C\u002Fp>\n\n\u003Cp>7.3.2 Uzoefu na Uhodari\u003C\u002Fp>\n\n\u003Cp>7.3.3 Uwezo wa kufanya kazi\u003C\u002Fp>\n\n\u003Cp>7.3.4 Uaminifu na Nidhamu.\u003C\u002Fp>\n\n\u003Cp>7.5 Wale wote watakaopunguzwa kazi wawe wa kwanza kurejeshwa kazini hali ya\nKampuni inapokuwa nzuri, kwa kuzingatia vifungu vidogo 7.3.1 - 7.3.4 (ibara ya\n7.4).\u003C\u002Fp>\n\n\u003Cp>7.6 Kampuni itawajibika kuwalipia nauli zao, familia na mizigo kwa viwango\nvifuatavyo:-\u003C\u002Fp>\n\n\u003Cp>7.5.1 Wafanyakazi wa kawaida watasafirishiwa mizigo kwa kiasi cha tani mbili\n(2) kwa kila atakayepunguzwa kazi\u003C\u002Fp>\n\n\u003Cp>7.7 Mfanyakazi ambaye atapunguzwa na mwajiri, asipolipwa malipo yake kwa\nwakati huo huo, basi baada ya juma moja lenye siku saba (7) tangu kupunguzwa\nkazi, mwajiri atalazimika kumlipa mfanyakazi huyo posho ya kila siku sawa na\nmshahara wake wa kutwa mara tatu (kutwa x moja).\u003C\u002Fp>\n\n\u003Cp>7.8 Mfanyakazi atakayepunguzwa kazi atalipwa mshahara wake wa miezi miwili\nmara miaka ya utumishi ili mradi utumishi wake sio chini ya mwaka mmoja.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>8.0 SAA ZA KAZI NA MALIPO YA ZIADA\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-schedulesrestpw\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-SCHEDULE_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-dayspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-dayspweek_select\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek_select\" class=\"cbaClause highlight\">\u003Cp>8.1 Saa za kazi za kawaida zitakuwa arobaini na tano (45) kwa juma moja\nlenye siku za kazi sita (6); Siku za Jumapili na Sikukuu zinazotambulika na\nTaifa, zitakuwa ni siku za mapumziko.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-overtimeallowancetypeperiod\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-overtimeallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-OVERTIME_trigger\" class=\"cbaClause highlight\">\u003Cp>8.2 Saa zote za ziada zinazozidi arobaini na tano (45) za muda wa kawaida wa\nkazi ’zitachukuliwa kuwa za malipo ya ziada (overtime); Kazi itakayofanyika\nnyakati za siku za kazi na sikukuu zitakuwa na malipo kwa utaratibu\nufuatao:-\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-overtimeallowanceperc1\" class=\"cbaClause highlight\">\u003Cp>8.2.1 Kwa siku za kawaida za kazi malipo ya ziada yatakuwa maaium kwa\nkulipwa mara moja na nusu (1\u002F130) ya mshahara kwa saa wa mfanyakazi.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-sundayallowanceperc1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-sundayallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-SUNDAY_trigger\" class=\"cbaClause highlight\">\u003Cp>8.2.2 Kazi itakayofanyika katika siku za mapumziko na sikukuu, mfanyakazi\natalipwa malipo maaium kwa kulipwa mara mbili (2) (1\u002F90) ya mshahara kwa saa wa\nmfanyakazi.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>8.2.3 Pande zote tumekubaliana kwamba malipo hayo katika 8.2.1na 8.2.2\nyatatolewa kila siku\u002Fyatakuwa ya kila mwezi.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>9.0 VIMA VYA MISHAHARA NA NYONGEZA KWA WAFANYAKAZI\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-lowwageamount\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-lowwageperiod\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-LOWWAGE_trigger\" class=\"cbaClause highlight\">\u003Cp>9.1 Mishahara italipwa kwa wafanyakazi ambao wataajiriwa, kwa mujibu wa\nmakubaliano yetu; Kima cha chini cha mshahara wa kampuni kitakuwa shilingi laki\nmoja na nusu (150,000\u002F=) kwa mwezi. Mishahara mingine itapangwa kwa ushirikiano\nwa mwajiri, uongozi wa Tawi la COTWU (T) na Kanda kwa madhumuni ya kutofautisha\nkazi za ujuzi na taaluma mbalimbali za wafanyakazi wa Gereji na Mabasi.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-wageincreasetype2\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-STRUCINCR_trigger\" class=\"cbaClause highlight\">\u003Cp>9.2 Pande zote katika Mkataba huu tumekubaliana kuwa nyongeza za mishahara\nzitatolewa mwezi Januari kila mwaka. Lakini mwajiri anaweza kuongeza mshahara\nkwa mfanyakazi mmoja au kikundi (section) kabla ya kufika mwaka mzima tangu\nkutolewa nyongeza zilizopita ikiwa mfanyakazi au \"section\" inayohusika watakuwa\nwamefanya kazi ya kuvutia\u002Fkujitokeza kwa faida na manufaa ya kampuni ya SMB\nNyehunge Express.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-wageincreasefirmperformance\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-wageincreaseperc1\" class=\"cbaClause highlight\">\u003Cp>9.3 Kwa maana ya ibara 9.2 ya mkataba huu, Kampuni kwa kushirikiana na Tawi\nla COTWU (T), watakutana kutayarisha viwango vya nyongeza kwa asilimia sio\nchini ya kumi na tano (15%) itakayo kubaliwa na pande hizo mbili kutegemea pato\nla mwaka husika kisha kutoa taarifa kwa Katibu Mkuu na Kanda, miezi mi-wili\nkabla ya nyongeza kwa ajili ya majadiliano.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>10.0 KUSTAAFU\u003C\u002Fh3>\n\n\u003Cp>10.1 Pande zote mbili tunakubaliana kwamba, kila mfanyakazi atakuwa na umri\nwa kustaafu ambao utafikia, au anaweza kustaafu mapema endapo afya yake kwa\nkuthibitishwa na daktari itaonekana haimwezeshi kuendelea na kazi yoyote.\u003C\u002Fp>\n\n\u003Cp>10.2 Mfanyakazi hataendelea kufanya kazi baada ya umri wa miaka sitini (60),\numri kati ya miaka hamsini na mitano (55) na hamsini na tisa (59), mfanyakazi\nanaruhusiwa kustaafu kwa hiari na kulipwa haki zake zote.\u003C\u002Fp>\n\n\u003Cp>10.3 Kwa makubaliano na mwajiri wake, mfanyakazi anaweza kuendelea na\nUtumishi wa Mkataba Maalum baada ya kustaafu kwa lazima na kulipwa haki zake\nzote.\u003C\u002Fp>\n\n\u003Cp>10.4 Mfanyakazi anayestaafu kwa umri wa lazima atalipwa mshahara wa miezi\nnne (4) mara (x) miaka ya utumishi wake kuwa shukrani kwa utumishi mzuri na\nuvumilivu wake kazini.
