Mamlaka ya Majisafi na Majitaka Mwanza.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>5.0 MUDA WA KUANZA MKATABA\u003C\u002Fh3>\n\n\u003Cp>1. Mkataba huu utaanza kutumika kuanzia tarehe ya kusainiwa utadumu kwa muda\nwa miezi 24 kuanzia tarehe hiyo.\u003C\u002Fp>\n\n\u003Cp>2.Mkataba unaweza kufanyiwa marekebisho ndani ya kipindi kilichotajwa na\nkipengele cha 5.1 ili mradi tu upande wowote wenye kusudio la kufanya hivyo uwe\numetoa taarifa ya miezi mitatu kwa maandishi na pande zote ziwe zimekubaliana\nna kusajili marekebisho hayo.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>6.0 KAMATI YA MAJADILIANO\u003C\u002Fh3>\n\n\u003Cp>1. Kutakuwa na Kamati ya Majadiliano ambayo itaundwa na wajumbe 4\nwatakaoteuliwa na Mwajiri na wajumbe 4 kutoka Tawi la Wafanyakazi. Kamati\nitachagua Mwenyekiti kutoka miongoni mwa wajumbe. Maamuzi ya Kamati yatafanyika\nkwa kufuata wingi wa kura. Endapo kura zitalingana, Mwenyekiti atakuwa na kura\nya ziada ya uamuzi.\u003C\u002Fp>\n\n\u003Cp>2. Kazi kuu ya Kamati itakuwa kama ifuatavyo: -\u003C\u002Fp>\n\n\u003Cp>(i) Kupokea na kufanyia kazi maoni ya marekebisho ya Mkataba huu.\u003C\u002Fp>\n\n\u003Cp>(ii) Kujadili na kuafikiana juu ya utaratibu wa upunguzwaji wa\nwafanyakazi.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>7.0 AJIRA\u003C\u002Fh3>\n\n\u003Cp>Wafanyakazi wa Mamlaka wataajiriwa kwa mshahara wa mwezi katika masharti ya\nkudumu na ya mkataba kwa kufuata taratibu zinazofafanuliwa na kifungu hiki.\u003C\u002Fp>\n\n\u003Cp>1. Kipindi cha Majaribio:\u003C\u002Fp>\n\n\u003Cp>Wafanyakazi watakaoajiriwa watakuwa katika kipindi cha majaribio cha mwaka\nmmoja (miezi 12) kabla ya kuthibitishwa katika Ajira.\u003C\u002Fp>\n\n\u003Cp>2. Malipo ya Uzeeni:\u003C\u002Fp>\n\n\u003Cp>(i) Kila mfanyakazi atapaswa kujiunga na kuchangia kwenye mfuko wa hifadhi\nya jamii au pensheni kama ifuatavyo: -\u003C\u002Fp>\n\n\u003Cp>(a) NSSF, kwa watumishi walioajiriwa katika masharti ya 'Operational\nServices' au Mkataba.\u003C\u002Fp>\n\n\u003Cp>(b) PPF, kwa watumishi walioajiriwa katika masharti ya kudumu na\npensheni.\u003C\u002Fp>\n\n\u003Cp>(ii) Endapo mtumishi atabadilishiwa masharti ya Ajira atakuwa na haki ya\nkuchagua kuendelea kuchangia katika mfuko wa awali au mfuko stahili kutokana na\nmabadiliko hayo.\u003C\u002Fp>\n\n\u003Cp>3. Haki ya Wafanyakazi katika mabadiliko:\u003C\u002Fp>\n\n\u003Cp>(a) Endapo Mamlaka itafanyiwa marekebisho ya kukodishwa au kuuzwa viwango\nvya mshahara na haki za Wafanyakazi watakaobaki kwenye Ajira katika Taasisi\nmpya itakayoundwa kwa wakati huo, zitatambuliwa na kuheshimiwa na Mwajiri mpya\nkwa mujibu wa mkataba huu hadi hapo Taasisi hiyo itakaposaini Mkataba mpya na\nwafanyakazi hao.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>8.0 KUACHA KAZI\u003C\u002Fh3>\n\n\u003Cp>Iwapo mfanyakazi ataamua kuacha kazi kwa hiari yake, hatahusika na haki\nzilizoainishwa kwenye kifungu cha 11.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>9.0 UPUNGUZWAJI WA WAFANYAKAZI\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contractseverancepay\" class=\"cbaClause highlight\">\u003Cp>Kila mfanyakazi aliyepunguzwa atapewa mkono wa kwa heri kwa kulipwa\nmishahara ya miezi minne (4) kwa wafanyakazi walio kwenye masharti ya muda usio\nmaalum (Unspecified Period Contract) na kwa wale walio kwenye mkataba wa miaka\n4 na 5 watalipwa mishahara ya miezi 5 (mitano).\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>10.0 LIKIZO YA MWAKA \u002F DHARURA\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-annleaveallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-PAIDLEAV_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-ANNLEAVE_trigger\" class=\"cbaClause highlight\">\u003Cp>1. Mwajiri na Tawi la Chama cha Wafanyakazi watakubaliana juu ya vigezo vya\nkuchagua wafanyakazi hodari na viwango vya ufanisi na motisha.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>13.0 RAMBIRAMBI\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-funeralpay\" class=\"cbaClause highlight\">\u003Cp>Rambirambi wakati wa misiba itatolewa na Mwajiri kama ifuatavyo: -\u003C\u002Fp>\n\n\u003Cp>(i) Mfanyakazi akifariki, familia itapewa rambirambi ya Tshs. 500,000.00\n(Laki tano tu).\u003C\u002Fp>\n\n\u003Cp>(ii) Mke\u002FMme na mtoto akifariki mtumishi atapewa rambirambi ya Tshs.300,000\n(Laki tatu tu).\u003C\u002Fp>\n\n\u003Cp>(iii) Baba au Mama akifariki mtumishi atapewa rambirambi ya Tshs. 200,000\n(Laki mbili tu).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>14.0 MOTISHA\u003C\u002Fh3>\n\n\u003Cp>1. Mwajiri atamchangia mfanyakazi kodi ya nyumba na usafiri kwa asilimia\nambayo kwa ujumla wake haitazidi asilimia 10 ya mshahara wa mfanyakazi husika.\nMotisha hii haitawahusu wafanyakazi wanaostahili kupewa nyumba kwa gharama za\nMamlaka kwa mujibu wa Kanuni za utumishi za Mamlaka.\u003C\u002Fp>\n\n\u003Cp>2. Kila mfanyakazi atapata posho kwa ajili ya malipo ya maji. Kiwango cha\nposho kitakuwa sawa na mita za ujazo 24 za maji kwa mwezi isipokuwa kwa wale\nwanaostahili kulipiwa gharama za maji.\u003C\u002Fp>\n\n\u003Cp>3. Malengo yanapovukwa kwa mwaka, itatolewa motisha itakayogawanywa sawa kwa\nwatumishi wote baada ya kutoa gharama za uendeshaji. Suala la kiwango na namna\nya kutoa motisha hii itaamuliwa na Bodi baada ya Menejimenti kupeleka\nmapendekezo. Kwa vyovyote vile motisha hii haitazidi kiwango kilichoidhinishwa\nkwenye 'Memorandum of Understanding’ ya wakati husika kati ya Mamlaka na\nWizara inayoshughulikia Sekta ya Maji.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>15.0 HATI SAFI YA UKAGUZI\u003C\u002Fh3>\n\n\u003Cp>Ikiwa Mamlaka itapata Hati Safi ya Ukaguzi wa Mahesabu yake, wafanyakazi\nwatastahili kupata Motisha. Suala la kiwango cha motisha hii litaamuliwa na\nBodi baada ya Menejimenti kupeleka mapendekezo. Menejimenti itapanga namna bora\nya kuitumia motisha hiyo.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>16.0 SARE ZA KAZI\u003C\u002Fh3>\n\n\u003Cp>1. Wafanyakazi wote watastahili kupata jozi mbili za sare kila mwaka.\u003C\u002Fp>\n\n\u003Cp>2. Vifaa vya kinga kwa ajili ya shughuli za kazi kulingana na aina ya kazi\nvitatolewa kwa watumishi wanaostahili.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>17.0 POSHO YA KAZI KATIKA MAZINGIRA MAGUMU\u003C\u002Fh3>\n\n\u003Cp>1. Wafanyakazi wa Kitengo cha Majitaka na Kitengo kidogo cha Madawa watapewa\nposho ya Tshs. 20,000.00 (elfu ishirini tu) kwa mwezi kwa sababu ya kufanya\nkazi katika mazingira magumu pamoja na 1\u002F2 lita ya maziwa kwa siku zote za\nkazi.\u003C\u002Fp>\n\n\u003Cp>2.
