AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>We, the Tanzania Union of Industrial and Commercial Workers called\n“TUICO” and Scania Tanzania Limited hereinafter called “the Employer”\ndo hereby recognise and subscribe our joint signatures on this Collective\nBargaining Agreement regarding working terms and conditions in accordance with\nthe relevant National Policy.\u003C\u002Fp>\n\n\u003Cp>Both parties agree to actively enable this agreement to be in force.\u003C\u002Fp>\n\n\u003Cp>This agreement supersedes all previous agreements, written or oral,\nconcerning everything covered by this Collective Bargaining Agreement.\u003C\u002Fp>\n\n\u003Cp>It is hereby agreed that the agreement shall be in English language and that\na Kiswahili translation shall be annexed to the agreement. In case of conflict\nthe English version shall prevail.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. RECOGNITION\u003C\u002Fh2>\n\n\u003Cp>The Employer agrees and recognizes TUICO to be the sole and exclusive\nbargaining Agent for all TUICO members employed by the company concerning their\nworking terms and conditions.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. APPLICATION\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-coverunion_trigger\">\u003Ch3>3.1.This Agreement applies to all TUICO members employed by The Employer\nexcept those in Managerial positions namely:\u003C\u002Fh3>\u003C\u002Fdiv>\n\n\u003Cp>(i)Managing Director\u003C\u002Fp>\n\n\u003Cp>(ii)Acting Managing Director\u003C\u002Fp>\n\n\u003Cp>(iii)Departmental\u002FSection Managers\u003C\u002Fp>\n\n\u003Cp>For the avoidance of doubt a Senior Managerial position is one that includes\nthe right to hire, promote, suspend or discharge employees; to direct the work\nof employees and to establish operating policies.\u003C\u002Fp>\n\n\u003Ch3>3.2.This Agreement is applicable only in the United Republic of\nTanzania.\u003C\u002Fh3>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4.VALIDITY OF THE AGREEMENT\u003C\u002Fh2>\n\n\u003Ch3>4.1\u003C\u002Fh3>\n\n\u003Cp>Both parties agree that this Agreement shall come into force on the 1st of\nApril 2012 and shall remain valid for four (4) years up to the 31st March of\n2016. During first year any party wishing to have any clauses of this Agreement\nrevised shall have to follow the procedure laid down under the provisions of\nThe Employment and Labour Relations Act, 2004 [act No 6\u002F2004], Furthermore,\nupon expiry of this Agreement and in the event of absence of a substitute new\nAgreement the expired Agreement shall remain in force until replaced by a new\none within six months of its expiry. If no such agreement is reached within the\nsaid six months, the default terms shall be those specified under the existing\nlabour laws of the country.\u003C\u002Fp>\n\n\u003Ch3>4.2\u003C\u002Fh3>\n\n\u003Cp>Either party wishing to terminate the agreement shall give the other party 3\nmonth notice of termination of the agreement.\u003C\u002Fp>\n\n\u003Ch3>4.3\u003C\u002Fh3>\n\n\u003Cp>The parties also agree that in the event of any problems in the application\nof this agreement during the said life time of 48 months, both parties shall\nmeet to review and rectify the situation amicably. Any such review shall take\ninto account the laws applicable to employment in Tanzania.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. APPOINTMENT\u003C\u002Fh2>\n\n\u003Cdiv id=\"clause-contracttrialperiod\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contracttrial\" class=\"cbaClause highlight\">\u003Cp>Any newly employed employee shall be subjected to a probationary period of\nthree (3) months and may be confirmed upon the completion of the said period\nupon manifested satisfactory performance and proven capability. The Employer\nreserves the right to extend the probationary period for a further term not\nexceeding twelve months depending on the nature of engagement.\u003C\u002Fp>\n\n\u003Cp>Following the probation period an employee may be offered an employment\ncontract in accordance with the Employment and Labour Relations Act of 2004.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. TERMINATION\u002FRESIGNATION\u003C\u002Fh2>\n\n\u003Cp>This Clause applies to permanently employed employees other than employees\nwith fixed contracts whose terms and conditions shall be stated in the\nrespective contract.\u003C\u002Fp>\n\n\u003Ch3>6.1\u003C\u002Fh3>\n\n\u003Cp>.Subject to clause 5 above during the probationary period any party may\nissue a 30 day notice of intention to resign or terminate the contract or pay\nthe corresponding wage in lieu of the said notice as the case may be.\u003C\u002Fp>\n\n\u003Ch3>6.2\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cp>.The period of notice and the rates of wage payable upon resignation will be\nas per Tanzania Labor Law notice period: one (1) month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>6.3.\u003C\u002Fh3>\n\n\u003Cp>Termination should follow the procedures laid down under the law.\u003C\u002Fp>\n\n\u003Cp>Any employee should not be terminated for the following reasons:\u003C\u002Fp>\n\n\u003Cp>i.To be a TUICO member or member of any party which is in cooperation or\naffiliated with TUICO, or because of taking part in TUICO's activities after\nworking hours or during working hours with permission from the employer.\u003C\u002Fp>\n\n\u003Cp>ii. Airing grievances or giving evidence against the Employer.\u003C\u002Fp>\n\n\u003Ch3>6.4\u003C\u002Fh3>\n\n\u003Cp>The termination benefits shall be in line with the Employment and Labour\nRelations Act, 2004.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. RETRENCHMENT &amp; RE-FILLING OF VACANCY\u003C\u002Fh2>\n\n\u003Cp>This Clause is applicable to permanent employees only.\u003C\u002Fp>\n\n\u003Ch3>7.1\u003C\u002Fh3>\n\n\u003Cp>.Employee retrenchment may be done if the Employer gives notice and consults\nwith TUICO in accordance with the relevant Labour laws. After an agreement is\nreached, the employer shall have the right to act on the retrenchment plans\nunless there is any disagreement and then reference can be made to the\nCommission for Mediation and Arbitration (CMA).\u003C\u002Fp>\n\n\u003Ch3>7.2.\u003C\u002Fh3>\n\n\u003Cp>If Employee retrenchment is agreed then the following criteria may be taken\ninto account to select retrenches where all other factors are equal:\u003C\u002Fp>\n\n\u003Cp>i.Work requirements\u003C\u002Fp>\n\n\u003Cp>ii.Work performance, skills and discipline at work\u003C\u002Fp>\n\n\u003Cp>The retrenched employee shall be given priority of re-employment in case a\nsuitable vacancy arises.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-WORKHOURS_trigger\" class=\"cbaClause highlight\">\u003Ch2>8. WORKING HOURS\u003C\u002Fh2>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-hourspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek_select\" class=\"cbaClause highlight\">\u003Cp>Normal working hours may not exceed 40 hours per week.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-WAGES_trigger\" class=\"cbaClause highlight\">\u003Ch2>9. EMPLOYEE SALARIES\u003C\u002Fh2>\n\n\u003Ch3>9.1.\u003C\u002Fh3>\n\n\u003Cp>Both parties have agreed that the employer shall review employee salaries\nand allowances every year for the purpose of adjusting them according to\nvarious factors including performance of the individual.\u003C\u002Fp>\n\n\u003Ch3>9.2\u003C\u002Fh3>\n\n\u003Cp>.Any minimum salary level will be equal to or exceed what is set down in\nTanzania Labour Law\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-mealvouchers\" class=\"cbaClause highlight\">\u003Ch2>10. MEALS\u003C\u002Fh2>\n\n\u003Cp>It is hereby agreed, in principle that The Employer shall provide a\nsubsidized lunch for employees to be taken at the work place from Mondays to\nFridays.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. TRAVELLING ALLOWANCE\u003C\u002Fh2>\n\n\u003Ch3>11.1\u003C\u002Fh3>\n\n\u003Cp>.For domestic travel the Employer undertakes to cover the cost of normal\naccommodation, meals and in addition, a per diem allowance, in accordance with\napplicable company guidelines.\u003C\u002Fp>\n\n\u003Ch3>11.2\u003C\u002Fh3>\n\n\u003Cp>.A cash advance taken for business travel shall be retired within 48 hours\nafter returning to base. Failure to do so shall amount to misconduct, the\nEmployer reserves the right to take necessary disciplinary action including but\nnot limited to deduction of wages in such cases.\u003C\u002Fp>\n\n\u003Ch3>11.3\u003C\u002Fh3>\n\n\u003Cp>.For International business related travel all legitimate business related\nexpenses and reasonable cost of living expenses will be covered by the Employer\nupon presentation of receipts.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. ACTING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>When an employee member is asked in writing by his employer to act in a job\nat a higher position, he\u002Fshe shall be paid an allowance as agreed between\nemployer and employee.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. UNIFORMS\u003C\u002Fh2>\n\n\u003Cp>All relevant employees will be provided with working uniforms. The Employer\nwill provide washing of workshop and warehouse employee uniforms. All relevant\nemployees will be obliged to wear such uniforms at work. Uniforms are the\nemployer's property and the Employer will have the right to demand their return\nif the employee changes job function or leaves the company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. MEMBERSHIP FEE\u003C\u002Fh2>\n\n\u003Cp>Parties have agreed that the employer, upon notification in writing, will\ndeduct from consenting eligible employees, TUICO membership fee’s and submit\nthe same to TUICO headquarters.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-ANNLEAVE_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-PAIDLEAV_trigger\" class=\"cbaClause highlight\">\u003Ch2>15. ANNUAL LEAVE\u003C\u002Fh2>\n\n\u003Cp>All employees are entitled to annual leave break of 28 days (20 working\ndays) per full year of employment or on a pro rata basis; and all leave must be\ntaken within 12 month of falling due. A leave allowance equivalent to one\nmonth’s salary shall be paid in the month of the annual leave being taken by\nthe employee.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-trainingprogrammes\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-TRAINING_trigger\" class=\"cbaClause highlight\">\u003Ch2>16. EMPLOYEE TRAINING\u003C\u002Fh2>\n\n\u003Cp>Wherever there is a training need, employees will be trained so as to\npromote efficiency and productivity at their respective workplace. The employer\nshall maintain suitable plans in order to implement and achieve that goal.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-COMMUTE_trigger\" class=\"cbaClause highlight\">\u003Ch2>17. TRANSPORT\u003C\u002Fh2>\n\n\u003Cdiv id=\"clause-commutingallowancetype2\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-commutingallowancetype1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-commutingallowanceamount1\" class=\"cbaClause highlight\">\u003Cp>A transport allowance which is determined by the employer will be paid to\neligible employees via their salary.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-healthcareaccess\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-MEDICAL_trigger\" class=\"cbaClause highlight\">\u003Ch2>18. MEDICAL TREATMENT, SICK LEAVE AND DEATH\u003C\u002Fh2>\n\n\u003Ch3>18.1.\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-healthinsurancerelatives\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-healthinsurance\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-healthcareaccessrelatives\" class=\"cbaClause highlight\">\u003Cp>Parties have agreed that all workers, their spouse and a total of four\nchildren up to the age of 18 years and\u002For for those above 18 and up to 21 years\nof age, provided they have proof of dependency required by the insurers, shall\nbe provided with medical treatment as per the Employer’s medical insurance\nscheme. The Medical care facility extended under this section shall be provided\nat a Hospital or Dispensary approved by the employer or the employers approved\nmedical scheme.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-sicknessmaxdays\" class=\"cbaClause highlight\">\u003Ch3>18.2. Sick leave\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknesspay\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-maxsicknesspayperc\">\u003Cp>Where a permanent employee is unable to attend to his\u002Fher normal duties due\nto illness, she\u002Fhe shall be entitled to a salary in accordance with Tanzania\nLabour Law or for a period of twelve months as follows:\u003C\u002Fp>\n\n\u003Cp>(i)First six monthsFull salary\u003C\u002Fp>\n\n\u003Cp>(ii)Second six monthsHalf salary\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>Payment of salary during the period of illness shall only be authorised if\nthe concerned employee produces a medical certificate duly signed by an\napproved Medical Officer.\u003C\u002Fp>\n\n\u003Cp>On the expiry of the period of twelve (12) months, The Employer shall be at\nliberty to continue with or discontinue the employment contract on Medical\ngrounds and pay termination benefits as required under the Tanzanian Labour\nLaw.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>Should written Medical certification subsequently be produced to the effect\nthat the employee has fully recovered from her\u002Fhis illness the Employer may\nre-employ the worker subject to availability of vacancy.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-paidmaternityleave\" class=\"cbaClause highlight\">\u003Ch3>18.3. Maternity leave shall be as per Tanzanian labour law.\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleaveduration\">\u003Cp>When an employee gives birth, the employee will be entitled to leave of 84\ndays and 100 days in cases of multiple births. At all times Scania Tanzania\nLimited will comply with the relevant Tanzania labour laws.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-funeralpay\" class=\"cbaClause highlight\">\u003Ch3>18.4. Death\u003C\u002Fh3>\n\n\u003Cp>a)Both parties agree that if an employee dies in service and the relatives\nwish to transport the body to the deceased’s village for burial, the company\nshall provide transport and shall contribute TZS 800,000\u002F= to the family.\u003C\u002Fp>\n\n\u003Cp>b)Should the Management decide to send an official delegation to the burial\nceremony, this will be done in consultation with TUICO branch.\u003C\u002Fp>\n\n\u003Cp>c)If an employee’s spouse or own child under the age of 18 dies or their\nbiological parent, the employer shall contribute TZS 400,000\u002F= to the family.\nWhere the Employer demands evidence that the deceased is the employee’s own\nchild or parent, the employee must produce such evidence to the satisfaction of\nthe Employer.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>18.5. Other Leave\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-childcare\">\u003Cp>All other leave will be as per relevant Tanzanian Labour Law.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>19. LOANS AND CREDIT SOCIETY\u003C\u002Fh2>\n\n\u003Ch3>19.1\u003C\u002Fh3>\n\n\u003Cp>.Both parties agree that the Employer, in consultation with TUICO, will\nfacilitate collections from employees who borrow and contribute to their Credit\nand Savings Societies or Co-operative ventures. The Employer undertakes to\nassist in this endeavor to the best of its ability.\u003C\u002Fp>\n\n\u003Ch3>19.2.\u003C\u002Fh3>\n\n\u003Cp>Were an employee requires the employer to provide evidence of employment for\nthe purpose of obtaining a bank loan or credit loan the employer will provide\nsuch evidence in a timely manner.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Any dispute or grievance by any employee shall be dealt with in accordance\nwith the provisions of the Employment and Labour Relations Act, 2004 (or as\nupdated) and any rules made there under.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. DISPUTES RESOLUTION\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. RETIREMENT\u003C\u002Fh2>\n\n\u003Cp>Both parties have agreed that a permanently employed employee may retire in\naccordance with relevant labor law or under the following conditions:\u003C\u002Fp>\n\n\u003Cp>a.Upon attaining 55 years of age voluntarily and at the request of the\nemployee.\u003C\u002Fp>\n\n\u003Cp>b.Compulsorily at 60 years.\u003C\u002Fp>\n\n\u003Cp>Provided that, if the employer is in need of the services of a retired\nEmployee a separate and new arrangement may be contracted between the employer\nand the Employee.\u003C\u002Fp>\n\n\u003Cp>c.A retired employee is entitled to a bus fare or a second class fare for a\ntrain and ship for themselves, their spouse and up to four children under 18\nyears of age (or who are still in school or college and are recognized by the\ngovernment and the Employer).
