Box 4162 Dar es Salaam as The \"Employer” or the\n\"Company\" and Tanzania Union of Industrial and Commercial Workers (the\n\"Union”) of P.O. Box___ Dares Salaam acting solely and only for the benefit\nof employees of the Company being member of the respective Field Branches.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>PREAMBLE\u003C\u002Fp>\n\n\u003Cp>A. WHEREAS the field branches at the company locations in manufacturing\nplants and depots and elected representatives from Union Headquarters\nconstituted a committee to negotiate a Collective Agreement with the management\nof the company:\u003C\u002Fp>\n\n\u003Cp>B. WHEREAS the aforesaid committee met on 6th-8th October. 2010 in Dar es\nSalaam to prepare proposals for the Collective Agreement and\u003C\u002Fp>\n\n\u003Cp>C. WHEREAS the aforesaid proposals were submitted to the management of the\ncompany on 11th October. 2010 and 20th December. 2010 the said proposals were\nthen discussed between the committee and the management of the company between\n1lth October 2010 and 20th December. 2010.\u003C\u002Fp>\n\n\u003Cp>NOW IT IS HEREBY AGREED as follows:\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>1. DEFINITIONS:\u003C\u002Fh3>\n\n\u003Cp>“Acting Allowance”\u003C\u002Fp>\n\n\u003Cp>Means an allowance payable to any employee who is appointed to act in any\nposition whose holder is away for any reason\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Acting Appointment”:\u003C\u002Fp>\n\n\u003Cp>Means the appointment in writing by Head of Department and to be confirmed\nby Human Resources Department of a serving employee to any position whose\nholder is away for any reason. The said holder having duly handed over his\u002Fher\nduties.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Basic wages”:\u003C\u002Fp>\n\n\u003Cp>Means that part of an employees’ remuneration paid in respect of work done\nduring the hour ordinaly worked but not to include (a) allowance, whether or\nnot based on the employee rate of pay as reviewed every year by the company,\n(b) Pay for over time worked, (e) Additional pay work on Public holidays and\nrest days or additional pay for night work.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Company”:\u003C\u002Fp>\n\n\u003Cp>Shall mean SBC TANZANIA LIMITED\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Employer”:\u003C\u002Fp>\n\n\u003Cp>Shall means SBC TANZANIA LIMITED represented by Executive Director or his\nappointee in writing.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Employee”:\u003C\u002Fp>\n\n\u003Cp>Shall mean any person who has entered into or works under a contract, of\nservice with the Company who is either a member of the UNION .or any other\nemployee of the Company at a location where the UNION is the exclusive\nbargaining agent, or another employee of the Company who may subsequently\nsubscribe to the UNION\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Family”\u003C\u002Fp>\n\n\u003Cp>a) Employee's marital spouse but only one married legally, recognized with\nmarriage certificate registered in the Company's records.\u003C\u002Fp>\n\n\u003Cp>b) The employee's own or legally adopted children up to a maximum of 4\nchildren under 18 years of age as evidenced by birth certificates and in case\nof adopted children due certificates of adoption registered in the Company's\nrecords.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Government”:\u003C\u002Fp>\n\n\u003Cp>Means the Government of the United Republic of Tanzania\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Gross Salary”\u003C\u002Fp>\n\n\u003Cp>Shall mean total salary of any employee including basic salary and all\npayable allowances Minimum wages ”:\u003C\u002Fp>\n\n\u003Cp>Means the lowest basic wages in the company .and may be negotiated\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Medical Examination”\u003C\u002Fp>\n\n\u003Cp>Means an examination of an employee of the Company carried out by the\nCompany's Doctor or recognized Medical Practitioner duly approved by the\nCompany.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Overtime”:\u003C\u002Fp>\n\n\u003Cp>Means aggregate number of approved hours worked in excess of an employee's\nnormal working hours.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Sick Leave”:\u003C\u002Fp>\n\n\u003Cp>Means approved absence from duty caused by illness of an employee as\nCertified by a recognized Medical Practitioner Board.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Union”:\u003C\u002Fp>\n\n\u003Cp>Shall mean TUICO (Tanzania Union of Industrial and Commercial Workers) of\nP.O.box 5680 Dar-es-salaam.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>...“Union Member(s)”\u003C\u002Fp>\n\n\u003Cp>\"Shall mean an Employee of the Company and w ho is a Member of the Union\n“Member” in relation to the Union shall mean a member of the Union:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Union Leaders (s)”:\u003C\u002Fp>\n\n\u003Cp>Shall mean any member(s) of the union who have been duly elected by member\nemployees to be their officials\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Negotiation Committee”:\u003C\u002Fp>\n\n\u003Cp>Means a Committee consisting of representatives of union members elected by\nsuch member from among union members of the Field Branch of the respective\nCompany location and representatives appointed by Union Head Quarters to\nrepresent the union members in negotiations with the Employer\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Representative”\u003C\u002Fp>\n\n\u003Cp>Shall mean a branch of TUI CO established b\\ the TUICO and consisting of\nduly elected representatives at the business of the Employer SBC Tanzania\nLimited.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>“Retrenchment”\u003C\u002Fp>\n\n\u003Cp>Means termination of employment arising from the operational requirement of\nthe business. Operational requirement is a requirement based on the economical,\ntechnological, structural or similar needs of the Employer.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>\"Dispute\"\u003C\u002Fp>\n\n\u003Cp>Shall have the meaning ascribed to it under Employment and Labour Relations\nAct No. 6 of 2004.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>\"Interpretation\"\u003C\u002Fp>\n\n\u003Cp>Unless otherwise provided and where the context so admits, in this\nagreement, words in the singular include the plural and vice versa.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>2. INTRODUCTION AND OBJECTIVE\u003C\u002Fh3>\n\n\u003Cp>Both parties to this Agreement TUICO herein called the \"UNION” and M\u002FS SBC\nTanzania Limited, herein called the “COMPANY”, are desirous of achieving\nthe following objectives:\u003C\u002Fp>\n\n\u003Cp>a) To facilitate the welfare of the employees.\u003C\u002Fp>\n\n\u003Cp>b) To increase productivity in whatever field the employees are engaged\nin.\u003C\u002Fp>\n\n\u003Cp>c) To improve terms and conditions of service.\u003C\u002Fp>\n\n\u003Cp>d) To create a healthy and motivated work environment built on mutual trust\nand respect for each other.\u003C\u002Fp>\n\n\u003Cp>To create harmony at the place of work:\u003C\u002Fp>\n\n\u003Cp>a) The Company recognizes the Union as the sole legitimate representative of\nall employees covered by this agreement in as far as their welfare and terms of\nservice are concerned.\u003C\u002Fp>\n\n\u003Cp>b) The Union recognizes the Company's rights and obligations to run the\nbusiness, administer the factories, including the employment and development of\n(employees, introduction of technical and administrative changes including\ndisciplinary action, in addition to the setting up of plans to increase\nproductivity.\u003C\u002Fp>\n\n\u003Cp>c) Both parties agree that the Company reserves the right to develop the\nbusiness of the Company and in collaboration with the Union to promote the\nwelfare of the employees.\u003C\u002Fp>\n\n\u003Cp>d) Both parties agree that, in order to maintain amicable relations. Union\nLeaders will be the legitimate representatives and participants in ensuring\nthat whatever has been agreed upon is implemented.\u003C\u002Fp>\n\n\u003Cp>e) Both parties agree that Union dues shall be deducted by the Company from\nUnion members' wages and agency fees shall be deducted from the remuneration of\nemployees who are not members of the Union but who enjoy, the service of the\nUnion and be remitted to the Secretary General of TUICO. The Secretary General\nor his representative shall notify the Company the rate of the Union dues\npayable along with the current list of the members and will communicate any\nchanges as and when they occur as per the requirement of the law on deductions\nof Union dues.\u003C\u002Fp>\n\n\u003Cp>f) Both parties agree that this agreement shall cover all Employees as\ndefined in this Agreement.\u003C\u002Fp>\n\n\u003Cp>g) Both parties recognize that transferring of employees within the Company\nand divisions is fully at the discretion of the Employer.\u003C\u002Fp>\n\n\u003Cp>However if the transfer involves a Trade Union Leader, the Employer should\nconsult the TUICO Regional secretary prior to the transfer.\u003C\u002Fp>\n\n\u003Cp>h) Both parties agree that the basic salary, meal allowance, transport\nallowance, responsibility allowance and housing allowance as Applicable to the\nrespective grade and pay point of the employee shall be the same in all\nlocations of the Company.\u003C\u002Fp>\n\n\u003Cp>i) Both parties agree that if a vacancy arises in the Company, advertisement\nfor the position should be done internally and externally simultaneously.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>3. PRODUCTIVITY PERFORMANCE AND EFFICIENCY\u003C\u002Fh3>\n\n\u003Cp>a) The employer and the field branches which shall take consultation of\nUnion will ensure that proper plans to increase productivity are implemented as\ndrawn by the Employer. Employees should not indulge themselves in acts, which\nare detrimental to productivity (e.g. wastage of materials, theft, negligence,\nlateness, absenteeism, insubordination. etc.).\u003C\u002Fp>\n\n\u003Cp>b) The Field Branch which shall take consultation of the Union in\ncollaboration with the Employer will ensure and facilitate that appropriate\nsteps are taken against culprits as mentioned in (a) above and facilitate\nimplementation of those steps.\u003C\u002Fp>\n\n\u003Cp>e) The Field Branch which shall take consultation of the Union in\ncollaboration with the - . Employer will ensure that targets are met and\nsurpassed.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-sundayallowanceperc1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-sundayallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-SUNDAY_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-schedulesrestpw\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-SCHEDULE_trigger\" class=\"cbaClause highlight\">\u003Cp>d) When the need arises employees may be required to work on Public Holidays\nand rest days provided that they are paid in respect of OVERTIME as per Laws of\nthe Country.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>e) The Employer shall encourage those employees whose performance exceeds\ntargets to be recognized in a manner to be determined by the Company and as may\nbe reviewed from time to time.\u003C\u002Fp>\n\n\u003Cp>f. The Company shall provide one case of liquid of soda to every employee at\neither ldd Fitr or Christmas depending on each employee's choice\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>4. GENERAL EMPLOYMENT PRINCIPLES:\u003C\u002Fh3>\n\n\u003Cp>a. Employment\u003C\u002Fp>\n\n\u003Cp>The appointment of employees shall be done by the Employer and any\nadvertisement of the position shall be done internally and externally.\u003C\u002Fp>\n\n\u003Cp>b. Retirement.\u003C\u002Fp>\n\n\u003Cp>That the voluntary retirement age shall be at 55 years and that the\ncompulsory retirement age at 60 years. “VOLUNTARY '' means reached under\nmutual agreement between employee and Employer\u003C\u002Fp>\n\n\u003Cp>c. Acting Allowance\u003C\u002Fp>\n\n\u003Cp>This allowance shall be paid to any employee who is appointed in wrting by\nHuman Resources Department as an acting employee to act in any position within\nthe Company other than the position for which the employee was originally\nemployed and for such acting period not exceeding four weeks and solely at\ndiscretion of the Employer. The Allowance payable to the acting employee shall\nbe the difference between the basic salary of the position for which the acting\nemployee was originally employed and the basic salary for the position the\nacting employee is acting for.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-contracttrial\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contracttrialperiod\" class=\"cbaClause highlight\">\u003Cp>d. Probationary Period:\u003C\u002Fp>\n\n\u003Cp>The probationary period shall be six months for all employees and may be\nextended in writing at the sole discretion of the Company for reasons to be\ncommunicated to the employee before or about the expiration date of the\nprobationary period.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-hourspweek\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-hourspweek_select\" class=\"cbaClause highlight\">\u003Cp>e. Working Hours and Public Holidays\u003C\u002Fp>\n\n\u003Cp>Both parties agree that:\u003C\u002Fp>\n\n\u003Cp>(i) Normal working hours will be 45 hours per week.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>(ii) Any work beyond 45 hours a week will be treated as overtime and payment\nfor same will be made.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-overtimeallowanceperc1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-overtimeallowancetypeperiod\" class=\"cbaClause\">\u003Cdiv id=\"clause-overtimeallowancetype\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-OVERTIME_trigger\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-bankholidays1\" class=\"cbaClause highlight\">\u003Cp>(iii) Any work ABOVE 45 hours and any gazetted public holidays shall be\ntreated as overtime and the Employer shall pay double the employee's basic\nsalary for each hour worked on that day\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>(iv) The above provision however shall not apply to employees in the sales\nfunction due to the nature of their work and their incentive scheme as\nimplemented in lieu of the admissible overtime payment.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-healthcareaccess\" class=\"cbaClause highlight\">\u003Cp>f. Medical Facilities\u003C\u002Fp>\n\n\u003Cp>(i) Medical facilities shall be covered by the existing stated medical\npolicy of the Company (Annexure to be supplied)\u003C\u002Fp>\n\n\u003Cp>(iv) In addition to the stated medical policy, the Company shall have\nClinics\u002FDispensaries operating within the Company manufacturing premises from\n8.00 a.m. to 5.00 p.m. from Mondays to Saturdays (except gazetted holidays)\nproviding medical care to employees at Company cost.\u003C\u002Fp>\n\n\u003Cp>(iii) The Company shall select the recognized hospitals for Out Patient\nServices for the employees and registered families in the Company records at\nmanufacturing locations for laboratory tests and treatment. The Company will\nendeavor to make similar arrangements on similar terms and conditions for\nlocations other than manufacturing locations.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv id=\"clause-disabilitypay\" class=\"cbaClause highlight\">\u003Cp>(iv) The Company shall meet 100% of the cost for all work related accidents\nin accordance with the company's stated medical policy and the Workmen's\nCompensation Act as amended from time to time.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>(v) The Company shall provide sufficient amount of money for medical\nattention and transport facility to transfer an employee from the work premises\nfor any work related accident to the approved medical facility.\u003C\u002Fp>\n\n\u003Cp>(vi) The Official Sick-sheet for work related accidents shall be provided by\nthe Company.\u003C\u002Fp>\n\n\u003Cdiv id=\"clause-healthcareaccessrelatives\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-healthinsurancerelatives\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-healthinsurance\" class=\"cbaClause highlight\">\u003Cp>(vii) The Company will provide in-patient medical facilities to employees\nand their Spouses under a health insurance scheme\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>g. Canteen\u003C\u002Fp>\n\n\u003Cp>(i) The Employer agrees to provide the Employees with suitable dining\nfacility clearly demarcated to facilitate taking their breakfast and meals. In\naddition, the employer at his cost shall designate places for selling\npre-cooked meals by pre-designated vendors inside the Company premises. The\nbreakfast shall be sold between 6.00 a.m to 8.00 a.m. whereas meals shall be\nsold between 12.00 noon to 2.00 p.m and 7.00 p in to 9.30 p.m strictly on all\nworking days to the desirous Employees\u003C\u002Fp>\n\n\u003Cp>(ii) It is agreed that it shall be the exclusive responsibility of the Field\nBranch Committees to identify, negotiate and administer on a day to day basis\nthe provision of selling pre-prepared food packets as mentioned in clause g (i)\nabove to the Employees.\u003C\u002Fp>\n\n\u003Cp>(iii) The OCCUPATION HEALTH AND SAFETY COMMITTEE shall ensure the general\ncleanliness of the canteen and dining facilities to deplore and supervise on a\nday to day basis by Field Brand Committee.\u003C\u002Fp>\n\n\u003Cp>(iv) The food packets as mentioned above can be purchased by the employees\nat their will and cost by making suitable payment as agreed between the vendor\nand the Field Branch Committee.\u003C\u002Fp>\n\n\u003Cp>(v) The Employer shall continue to pay employees the meal allowance as in\nthe current wage structure as per stated policy of the Company as negotiated\nfrom time to time.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Allowances\u003C\u002Fp>\n\n\u003Cp>i. The quality of uniforms should be highly considered.\u003C\u002Fp>\n\n\u003Cp>(iii) Responsibility of maintaining the uniform issued by the Company shall\nbe the sole responsibility of the employee to whom it is issued. The Company\nshall supply one bar of soap on a monthly basis to motor vehicle mechanics,\nMaintenance mechanics, and Cooler technicians. \u003C\u002Fp>\n\n\u003Cp>(iv) Uniforms so provided shall remain the properly of the Company and shall\nbe worn by the Employee during all working hours.\u003C\u002Fp>\n\n\u003Cp>(v) Uniforms shall be provided to all confirmed Employees\u003C\u002Fp>\n\n\u003Cp>(vi) The Parties agree that they shall make joint efforts to educate and\ncreate awareness for use of uniforms and cooperate to enforce the disciplinary\naction against non-conforming employees.\u003C\u002Fp>\n\n\u003Cp>n) Procurement\u003C\u002Fp>\n\n\u003Cp>The procurement of uniforms and protective gear will be in accordance with\ngood procurement practices as set by the Company taking into account quality,\npricing and warranty.\u003C\u002Fp>\n\n\u003Cp>o) Special Diet\u003C\u002Fp>\n\n\u003Cp>The company agrees to provide T.Shs.900.00 per employee to buy fresh milk\ndaily for employees in the following sections of operations:\u003C\u002Fp>\n\n\u003Cp>(i) Acid hand washing of bottles\u003C\u002Fp>\n\n\u003Cp>(ii) Bottle washing machine operators\u003C\u002Fp>\n\n\u003Cp>(iii) Water reclamation plant operators\u003C\u002Fp>\n\n\u003Cp>(iv) Boiler Operators\u003C\u002Fp>\n\n\u003Cp>(v) Cooler Technicians\u003C\u002Fp>\n\n\u003Cp>(vi) Filler Operators\u003C\u002Fp>\n\n\u003Cp>(vii) Syrup Room Operators\u003C\u002Fp>\n\n\u003Cp>(viii) Data code machine operators\u003C\u002Fp>\n\n\u003Cp>(ix) Water treatment plant operator\u003C\u002Fp>\n\n\u003Cp>Provided that the Occupational Health and Safety Committee shall conduct a\nstudy on other hazardous areas and make appropriate recommendation for\nprovision of protective gear, uniforms, special diet training and procurement\npolicy for those areas.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Cdiv id=\"clause-contractseverancepay1\" class=\"cbaClause highlight\">\u003Cdiv id=\"clause-contractseverancepay\" class=\"cbaClause highlight\">\u003Ch3>5. CONDOLENCE\u003C\u002Fh3>\n\n\u003Cp>The Parties agree that condolence assistance mentioned as under in each\ninstance will be disbursed by the Company. The death certificate or a\ncertificate to this\u003C\u002Fp>\n\n\u003Cp>effect issued by the local government authorities shall be furnished to the\nCompany as a proof in case of the mother and mother in-law father and father\nin-law the condolence amount shall be payable only once in each instance during\nthe tenure of the employee's service with the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Condolence amount payable for spouse and to a maximum of four dependent\nchildren shall be paid for such individuals who are registered in the Company\nrecords at the time of demise.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) Death of an Employee\u003C\u002Fp>\n\n\u003Cp>(l) Both parties agree that the Company shall contribute towards burial\ncosts which will include transportation of the dead body to the deceased's home\nand other requirements for burial such as coffin, shroud, hard board, cemetery\ncross, etc. at a flat sum of Tshs. 350.000.00 in addition to transportation on\nan actual basis.\u003C\u002Fp>\n\n\u003Cp>(ii) Both parties agree that, the Company will give, in addition to the\nabove. Tshs. 300.000.00 as condolence to the bereaved family\u003C\u002Fp>\n\n\u003Cp>(iii) Both parties agree that the Company shall pay to a decease employee's\nspouse dependent the death benefit as stipulated under the Company Policy. The\nrate of severance allowance shall be 10 days for each year of service.\u003C\u002Fp>\n\n\u003Cp>(iv) Two Representatives i.e. one from the Field Branch of the respective\ncompany location and one from Management will accompany the Route to the home\nvillage of the deceased.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Death of Wife\u002FHusband or Child\u003C\u002Fp>\n\n\u003Cp>Both parties agree that the company shall give Tshs. 250.000.00 to the\nbereaved Employee's family as condolence.\u003C\u002Fp>\n\n\u003Cp>r) Death of Father and Father In-Law, Mother and Mother In-Law\u003C\u002Fp>\n\n\u003Cp>Both parties agree that the company will provide Tshs. 120.000.00 as\ncondolence to the bereaved Employee.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>7. CO-OPERATIVE ACTIVITIES\u003C\u002Fh3>\n\n\u003Cp>Both parties agree collectively to make efforts and encourage employees to\nform a SAVING AND CREDIT SOCIETY.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>8. CHANGE OF EMPLOYER\u003C\u002Fh3>\n\n\u003Cp>a) The Parties agree that the Company shall not transfer any Employee to\nanother Employer without due consent of the Union.\u003C\u002Fp>\n\n\u003Cp>b) In the event of the Union having consented to the transfer of his\u002Fher\nservices to the new Employer, the transfer shall be done on the then existing\ncontractual terms including the terms of this Agreement.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>10. GENERAL\u003C\u002Fh3>\n\n\u003Cp>The Parties agree that the Management will endeavor to have a scheme of\nservice in place as soon as possible.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>11. INTERPRETATION OF THIS AGREEMENT\u003C\u002Fh3>\n\n\u003Cp>a) Employment and Labour Relations Act, 2004.\u003C\u002Fp>\n\n\u003Cp>It is jointly agreed that no section of this Agreement shall have the\nmeaning of going against laws of Tanzania, regulations, directives, conditions\nor legal orders concerning employment.\u003C\u002Fp>\n\n\u003Cp>a)If any differences in the interpretation or implementation of the\nagreement arise, both parties will deliberate, with a view to finding a\nsatisfactory formula\u002Fsolution. In case of non-resolution of the issues, the\ndifference shall be submitted by the aggrieved party to a body or forum of\ncompetent jurisdiction in accordance with applicable law.\u003C\u002Fp>\n\n\u003Ch3>\u003C\u002Fh3>\n\n\u003Ch3>12. PERIOD AND DATE OF COMMENCEMENT OF THE AGREEMENT\u003C\u002Fh3>\n\n\u003Cp>a) This Agreement will commence on the 1st February. 2011 and shall be in\nforce for a period of 24 months from the dale of signing.\u003C\u002Fp>\n\n\u003Cp>b) In the event that no party submits information depicting an intention to\nalter or otherwise amend the Agreement and reasons thereof, then this agreement\nshall be deemed to be in force and remain binding until a new agreement is\nsigned.\u003C\u002Fp>\n\n\u003Cp>c) Any party with intention to alter or otherwise amend a section of this\nAgreement shall give written notice of at least two months to the other party\nexplaining the reasons thereof.\u003C\u002Fp>\n\n\u003Cp>d) In the event that both parties agree to negotiate a new collective\nagreement, this agreement shall remain valid until the new agreement is\nsigned.\u003C\u002Fp>\n\n\u003Cp>The above provisions to this Collective e Agreement are a true record of\nwhat has been discussed and
