Abdul Shakoor - (Vice President)\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>Where RB Pakistan Workers’ Union Sindh hereinafter referred to as the\n“Union” in its capacity as Collective Bargaining Agent served a Charter of\nDemands dated 1st January, 2012, under Section 42(1) of the IR(R&amp;A) Act,\n2010 on the Management of Reckitt Benckiser Pakistan Limited, hereinafter\nreferred to as the “Company” and the Company also served a Charter of\nDemands dated 10th January, 2012, on the Union under the said Act pertaining to\nits Factory located at Plot No. F\u002F18, SITE, Karachi. Photostat copies of the\naforesaid two Charters of Demands are annexed herewith and are marked A &amp; B\nrespectively. Thereafter the C.B.A served a strike notice dated 12.1.2012 on\nthe Management under Section 42(3) of the said Act. Photostat copy of the\naforesaid strike notice is annexed herewith and is marked C. Upon receipt of\nthe said strike notice the Conciliator issued letter date 14.1.2012.\nConciliator took place on both the Charter of Demands from time to time and\nthat as a result of these meetings and discussions on both the Charter of\nDemands, the following Settlement\u002FAgreement has been reached:\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>The Union and the Company have signed this Settlement in full and final\nSettlement of all the Demands submitted by them through Annexure ‘A’,\n‘B’, &amp; ‘C’ hereto as under:\u003C\u002Fp>\n\n\u003Ch2>1. Basic Wages\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreasedate\">\u003Cp>The Company has agreed to increase the existing basic wages at a flat rate\non a one time basis by Rs. 767\u002F- (Rupees Seven Hundred Sixty Seven only).\n(After increment for the year 2012) effective 1st January, 2012.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>Provided that the aforesaid increase shall be adjusted against any increase\ntoward Cost of Living that is allowed and\u002For granted hereafter by the Federal\nand\u002For Provincial Governments by an enactment or otherwise, if such adjustment\nis permissible under the law.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2. House Rent Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The Company has agreed to increase the existing House Rent Allowance by Rs.\n450\u002F- (Rupees Four Hundred Fifty only) per month. Accordingly, the revised\nHouse Rent Allowance effective 1st January 2012, would be Rs. 4,285\u002F- (Rupees\nFour Thousand Two Hundred Eight Five only) per month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>3. Conveyance Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>The Company has agreed to increase the existing Conveyance Allowance of all\nmale and female workers by Rs. 300\u002F- (Rupees Three Hundred only). Accordingly,\nthe revised Conveyance Allowance effective January 1st, 2012 would be Rs.\n2,150\u002F- (Rupees Two Thousand One Hundred Fifty only) per month for male stop\nand Rs. Rs. 2,060\u002F- (Rupees Two Thousand Sixty only) for female staff. Other\nterms and conditions shall remain the same.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. Utility Allowance\u003C\u002Fh2>\n\n\u003Cp>The Company has agreed to increase the existing Utility Allowance by Rs.\n125\u002F- per month (Rupees One Hundred Twenty Five only). Accordingly, the revised\namount of Utility Allowance would be Rs. 800\u002F- (Rupees Eight Hundred only) per\nmonth effective 1st January, 2012.\u003C\u002Fp>\n\n\u003Ch2>5. Attendance Bonus\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE_trigger\">\u003Cp>The Company has agreed to increase the existing Attendance Bonus by Rs.\n700\u002F- per month (Rupees Seven Hundred only). Accordingly, the revised amount of\nAttendance Bonus would be (higher side) Rs. 1,020\u002F- (Rupees One Thousand Twenty\nonly) per month from January, 2012. Other terms and conditions shall remain the\nsame.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. Common Annual Increment Date\u003C\u002Fh2>\n\n\u003Cp>Currently we have three group of employees so far as the annual increment is\nConcerned i.e. one group of workers are given the annual increment from\nJanuary, the second group from April &amp; the third group from July. The\nmanagement agreed that in order to have common date of annual increment for all\nthe workers, the workers having increment date of 1st April &amp; 1st July will\nbe given prorata increment from January, 2012. For example, if the increment %\nis 9 for a worker who is entitled to increment from April will get 6.75% from\nJanuary &amp; the one who is entitled to increment from July will get 4.5% from\nJanuary. This is applicable for 2012 annual increment only and from 1st\nJanuary, 2013 all the workers will be given annual increment on the performance\nbased %. (………….)\u003C\u002Fp>\n\n\u003Ch2>7. Group Life Insurance Coverage Revision\u003C\u002Fh2>\n\n\u003Cp>The Group Life coverage for each worker has been revised from Rs. 500,000\u002F-\nto Rs. 700,000\u002F- w.e.f. January 1st, 2013.\u003C\u002Fp>\n\n\u003Ch2>8. Medical through Health Insurance Company\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccessrelatives\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It is agreed that w.e.f. January 1st, 2013 all the workers, their spouse\n&amp; Children will be provided Medical coverage for hospitalization through\nHealth Insurance company and an allowance of Rs. 800\u002F- per worker per month\nwill be given in monthly salary as OPD allowance. In view of the this the\ndirect medical facility available to 34 workers and their families will be\nwithdrawn and the RB surgical Scheme facility available for 154 workers and\ntheir families will also be withdrawn.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>9. Productivity\u003C\u002Fh2>\n\n\u003Cp>In order to cope with the challenges posed by increased commodity prices and\nincreased energy cost; Company needs a strong commitment and result from C.B.A\nto increase productivity on all lines. A minimum out put on all production\nlines is agreed with C.B.A and is mentioned in annexure ‘1’.\u003C\u002Fp>\n\n\u003Cp>• Machine break downs due to any engineering problem or material shortage\nwill be considered while monitoring the per shift output.\u003C\u002Fp>\n\n\u003Cp>• A ‘Productivity Committee’ is formed, which has the representations\nof the both Company &amp; Union. Production of all lines will be monitored as\nper this agreed output by the productivity committee fortnightly. Permanent\nmembers of the committee will be Factory Manager House Hold &amp; Factory,\nManager Health Care, Production Manager – House Hold and Production Manager\nHealth Care.\u003C\u002Fp>\n\n\u003Cp>&amp; respective Engineering Managers, Plant HR Manager &amp; the General\nSecretary C.B.A. Respective people of the production line can be invited into\nthe review meeting whenever required.\u003C\u002Fp>\n\n\u003Cp>• Any modification\u002Fwork design change in the production lines, which\nresults into the increase in Production, will be considered and the per shift\noutput will be increased accordingly.\u003C\u002Fp>\n\n\u003Cp>• In the case of disagreement, the matter under consideration will be\nreferred to the General Secretary and the Supply Chain Director who would give\na patient hearing to both the sides and their decision in the matter will be\nfinal.\u003C\u002Fp>\n\n\u003Ch2>10. Employment\u003C\u002Fh2>\n\n\u003Cp>It has been decided that the discussions on the employment of Son\u002FDaughter\nof the retired employee will continue.\u003C\u002Fp>\n\n\u003Ch2>11. Manning\u003C\u002Fh2>\n\n\u003Cp>Total requirement for Factory manning based on current work load is 188\npermanent workers. It may change depending upon the requirement.\u003C\u002Fp>\n\n\u003Ch2>12. General\u003C\u002Fh2>\n\n\u003Cp>12.1 That both the Union and the Company have agreed to accept above offers\nin full and final settlement of all their demands contained in Annexure\n‘A’, ‘B’ &amp; ‘C’ respectively for the operational period of this\nSettlement.\u003C\u002Fp>\n\n\u003Cp>12.2 That it is mutually agreed that the benefits agreed under Settlement\nshall apply to all the permanent workers of the factory located at F\u002F18, SITE,\nKarachi and shall be effective from 1st January, 2012 unless provided otherwise\nin the relevant clauses of this Settlement.\u003C\u002Fp>\n\n\u003Cp>12.3 That it is further agreed that the Settlement shall be effective from\n1st January, 2012 for a period of two years expiring on 31st December, 2013\nduring which period the Company and the Union undertakes not to raise any\ndemands financially or otherwise having direct or indirect financial\nimplications for the Company.\u003C\u002Fp>\n\n\u003Cp>12.4 That the Union and the Company further undertake to maintain industrial\npeace, not to take any action on account of legal Trade Union activities, not\nto cause cessation\u002Fgo slow of work on any pretext including canteen operation\nand wherever possible increase the level of productivity, efficiency when based\non mechanical improvements, process modification or new techniques as and when\nthese are implemented.
