Mr. Muhammad Mirza\n\n        \u003Cp>Propaganda Secretary\u003C\u002Fp>\n      \u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>WHEREAS the C.B.A and the Company served notice under Section 35 (1) of the\nIndustrial Relations Act, 2012 upon each other along with their respective\nCharter of Demands on 2nd May, 2012. (Copies of the said Charter of Demands are\nenclosed and marked as Annexure “A” and “B” respectively to this\nSettlement).\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS upon receipt of the said Charter of Demands under Section 35(1)\nof the Industrial Relations Act, 2012 the Company and the C.B.A entered into\nbilateral negotiations and collective bargaining on the said Charter of Demands\nperiod of which was mutually extended from time to time with a view to reach an\namicable settlement.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS during the course of discussion and negotiations, the C.B.A\npleaded increase in the Cost of Living and inflationary trend and the expected\nrise in the cost of living during the operative period of this Settlement as\njustification of its demands for higher monetary benefits to the workers which\nfactors have been taken into consideration by the Company to reach the\nfollowing full and final Settlement in respect of all the demand raised in the\nCharter of Demands submitted by the C.B.A and the Company.\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE this Settlement witness as follows:\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Ch2>1. INCREASES IN WAGES FOR YEARS 2012 &amp; 2013\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreasetype2\">\u003Cp>1.1 It has been agreed by the Management\u002FCompany and the C.B.A Union that\nthe wages of the eligible permanent workers of the Company who fall under the\npurview\u002Fambit of IRA, 2012 and who have completed on year continuous service as\non 01-05-2012 shall be increased by 14 (fourteen) percent only w.e.f\n01-05-2012.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>1.2 It has also been agreed that the wages of the eligible permanent workers\nof the Company who have completed one year continuous services as on 01-05-2012\nshall be given additional one-time flat increase of Rs. 600\u002F- only in their\nGross Salary w.e.f. 01-05-2012. The said flat increase will be given after\ncomputing the annual increase as defined in section 1.1 &amp; bifurcated into\nBasic Salary, House Rent and Utility Allowances.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>1.3 The Management\u002FCompany and the C.B.A Union have further agreed that the\nwages of eligible permanent workers of the Company who fall under the\npurview\u002Fambit of Industrial &amp; Commercial Employment (Standing Orders)\nOrdinance, 1968 and would complete one-year continuous service as on 01-05-2013\nshall be increased by 14 (fourteen) percent only w.e.f. 01-05-2013.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>1.4 It has been agreed between the Management\u002FCompany and C.B.A Union that\nwhile calculating the increase in wages as defined in section 1.1 &amp; 1.3,\nonly Basic Salary, House Rent Allowances, Utility Allowance, Conveyance\nAllowance, D.O.M Wages and Adhoc Relief shall be included for the increase.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>1.5 That the above mentioned increases in wage\u002Fsalary shall be bifurcated\ninto Basic Salary, House Rent Allowance, Utility Allowance.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. BONUS (Inclusive of Standing Order 10-C)\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>2.1 It has been agreed by the Management\u002FCompany and the C.B.A Union that\nall permanent eligible workers who have completed one year continuous services\nand who will be on the roll of the Company at the time of disbursement of Bonus\nfor year 2012 shall be paid a total of 35 days wages as defined under clause\n1.4 herein above of this Settlement towards Bonus for the year 2012 on the\noccasion of Eid (15 days wages on the occasions of Eid-ul-Fitar and 20 days\nwages on Eid-ul-Azha) as the case may be irrespective of profit of profit as\ncontemplated U\u002Fs.o 10-C of the Industrial &amp; Commercial Employment (Standing\nOrders) Ordinance 1968.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>2.2 It has been agreed by the Management\u002FCompany and the C.B.A Union that\nall permanent eligible workers who have completed one year continuous service\nand who will be on the roll of the Company at the time of disbursement of Bonus\nfor year 2013 shall be paid a total of 35 days wages as defined under clause\n1.4 herein above of this Settlement towards Bonus for the year 2013 on the\noccasion of Eid (15 days wages on the occasions of Eid-ul-Fitar and 20 days\nwages on Eid-ul-Azha) as the case may be irrespective of profit as contemplated\nU\u002Fs.o 10-C of the Industrial &amp; Commercial Employment (Standing Orders)\nOrder 1968.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>2.3 It has been further agreed between the Management\u002FCompany and the C.B.A\nUnion that in case of profit as contemplated and defined under Standing Order\n10-C of Industrial and Commercial Employment (Standing Orders) Ordinance 1968,\neligible workers shall be paid on full S.O. 10-C Bonus after audit for both\nyears i.e. 2012 and 2013.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>2.4 The above Bonuses under clause 2.1 and 2.2 for both the years 2012 and\n2013 shall be paid along with the monthly salary earlier of the said respective\nfestivals and C.B.A union shall not compel the Management\u002FCompany for any\nfurther or earlier payment in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. FAMILY MEDICAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccessrelatives\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It has been agreed by the Company that the monthly Family Medical Allowance\nwill be increased by Rs. 100\u002F- from Rs. 400\u002F- to Rs. 500\u002F- per month. Other\nterms and conditions shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. CYCLE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>it has been agreed by the Company that the Cycle Allowance will be\ndiscontinued effective 01 June 2014 or earlier provided that company provides\ntransport services for the workers residing at Sakaran.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. ATTENDANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>5.1 The monthly Attendance Allowance will be paid as follows:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) Rs. 600\u002F- on full attendance during the calendar month (without availing\nany leave)\u003C\u002Fp>\n\n\u003Cp>b) Rs. 350\u002F- on availing one approved leave during the calendar month.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>5.2 The monthly attendance allowance will not be payable in case of\nfollowing:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) On availing more than one leave\u003C\u002Fp>\n\n\u003Cp>b) Any absence without leave and\u002For leave without pay\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. EID ADVANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It has been further agreed between the Management\u002FCompany and the C.B.A\nUnion that all permanent eligible workers who have completed one year\ncontinuous service and who will be on the roll of the Company shall be paid a\ntotal 15 days wages towards Advance against salary for both the years 2012 and\n2013 on the occasion of Eid (7.5 days wages along with the salary before the\noccasion of Eid-ul-Fitar and 7.5 days wages along with the salary before\nEid-ul-Azha). The said advances will be deducted from employees next year’s\nApril salary in 2013 and 2014 respectively. However, in case of loss as\ncontemplated and defined under Standing Order 10-C of Industrial and Commercial\nEmployment Ordinance 1968, the Eid advances will not be recovered from\nemployees on special request of C.B.A.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. PICNIC\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that for the year 2012 and 2013 the amount for the arrangement\nof Annual Picnic is increased by Rs. 35,000\u002F- from 65,000\u002F- to Rs. 100,000\u002F-\nper annum.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. UNION OFFICE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It has been agreed by the Company that the monthly Union Office Rent will be\nincrease by Rs. 2,500\u002F- from Rs. 1,500\u002F- to Rs. 4,000\u002F- per month.\u003C\u002Fp>\n\n\u003Ch2>9. EID GIFTS\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It has been agreed that on occasions of Eid-ul-Fitar and Eid-ul-Azha the\nCompany will provide mixed available products to all permanent workmen\nequivalent to an amount of Rs. 3,000\u002F-\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. LONG SERVICE AWARD\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>It has been agreed that the Company shall give long service award to the\npermanent workers of the company on completion of 15 &amp; 25 years of\ncontinuous services with the company as follows from 10-05-2014:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) Rs. 15,000\u002F- on completion of 15 years of service.\u003C\u002Fp>\n\n\u003Cp>b) Rs. 25,000\u002F- on completion of 25 years of service.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>This award will be paid to the workers along with the monthly salary of the\nrespective month in which the worker has completed his along service. However,\nto keep the process transparent and fair with those permanent workers who as of\n10\u002F05\u002F2014 have already crossed the services milestone of 25 years of service,\nas a special case, they will be allowed 25 years award payment as this will be\nthe only long service award they will receive in their employment with the\ncompany.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. ANNUAL LEAVES\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause focus highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>It has been agreed that the Annual leaves entitlement will be increased from\n14 to 21 working days.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. PENDING LITIGATIONS\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>12.1 Upon signing of this settlement, the company shall withdraw Case No. 4A\n(54)\u002F2013 from the NIRC.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>12.2 Upon signing of this Settlement, the C.B.A has also agreed to withdraw\nCase No. 4A (37)\u002F2013 from the NIRC\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. DISCIPLINE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. That it has been agreed by the C.B.A Union that the C.B.A Union and\neligible workers shall abide with regards to maintaining discipline, reducing\nthe level of absenteeism and maintaining Cadbury Factory Quality, Health and\nSafety Standards as updated from time to time and other Quality Standards as\nlaid down in the Manual of Foods Laws 1994, Safety and Health standards as laid\ndown in the Factories Act, 1934.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. It has been agreed by the Union that the no worker will be allowed for\nsmoking, Niswar, Gul, Gutka, and\u002For Pan in the factory premises since the use\nof such things in a Food Factory due to quality standards are prohibited.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. In case if any worker is found indulging in consumption\u002Fuse of aforesaid\nsubstance as mentioned in clause 13(a) &amp; (b), strict disciplinary action\nwill be taken against him.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. SET OFF ADJUSTMENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>That it has been agreed by the Company and C.B.A union that in case if any\nincrease is announced by the Government during the tenure of this Settlement to\nmeet the increase in the cost of living, the same shall be decided as per\ncontents\u002Flanguage\u002Fspirit of such announcement\u002Forder\u002Flaw.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15. SETTLEMENT OF AMBIGUITY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>That it has been agreed by the Company and C.B.A Union that in case of any\nambiguity in this Settlement the C.B.A Union and the Company shall discuss the\nsame and try to settle amicably and in case the same is not settled between the\nparties, the Company’s decision in this connection shall be final and binding\non both the parties.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. CO-OPERATION BY C.B.A UNION\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>That it has been agreed by the C.B.A Union that in consideration and in\nacceptance of the aforementioned demands by the Company, the C.B.A Union will\nprovide their full cooperation to the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. CLEANLINESS IN THE FACTORY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cp>a.
