MOHAMMAD HAYAT (5103) - TREASURER\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>WHEREAS the Factory served upon the Union, as Collective Bargaining Agent, a\nnotice dated 1st January, 2013 under Section 42(1) of the Industrial Relations\n(Revival and Amendment) Act, 2010 forwarding therewith a Charter of Demands\n(Copy enclosed hereto and marked as Annexure-A).\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the Union, as Collective Bargaining Agent also served upon the\nFactory a notice dated 1st January, 2013 under Section 42(1) of the Industrial\nRelations (Revival and Amendment) Act, 2010 forwarding therewith a Charter of\nDemands (Copy enclosed hereto and marked as Annexure-B).\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS bilateral negotiations were held between the representative of\nthe Factory and the Union on the dates as agreed upon by them and consequently\nan amicable settlement has been reached in full and final settlement of all the\ndemands contained in the above Charter of Demands.\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER\u003C\u002Fp>\n\n\u003Cp>TERM OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>1. Basic Wages\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Effective 1st January, 2013 the Factory agrees to allow an increase of Rs.\n400\u002F- (Rupees Four hundred only) on one time basic, in basic wages of all the\npermanent workmen including probationer in the employed of the Factory on the\ndate of signing of this Agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2. House Allowance\u003C\u002Fh2>\n\n\u003Cp>Effective 1st January, 2013 the Factory agrees to allow an increase of Rs.\n160\u002F- (Rupees one hundred sixty only) in House Allowance thereby raising the\nsame from Rs. 1890\u002F- to Rs. 2050\u002F- (Rupees Two thousand and fifty only) per\nmonth to all the permanent workers including probationers.\u003C\u002Fp>\n\n\u003Ch2>3. Conveyance Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>Effective 1st January, 2013 the Factory agrees to allow an increase of Rs.\n150\u002F- (Rupees one hundred and fifty only) per month in the existing Conveyance\nAllowance.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions pertaining to the eligibility etc.\nof Conveyance Allowance shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. Washing Allowance\u003C\u002Fh2>\n\n\u003Cp>Effective 1st January, 2013 the Factory agrees that the Washing Allowance\npresently being given to such workmen who have been provided with the\nFactory’s Uniforms and have to arrange their washing shall be increased from\nRs. 455\u002F- to Rs. 605\u002F- (Rupees Six hundred and five only) per month.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the eligibility etc. of the\nWashing Allowance shall remain unchanged.\u003C\u002Fp>\n\n\u003Ch2>5. Attendance Allowance\u003C\u002Fh2>\n\n\u003Cp>(a) Effective 1st January, 2013 the Factory agrees that the existing\nAttendance Allowance shall be increased from Rs. 875\u002F- per month to Rs. 1000\u002F-\n(Rupees one thousand only) per month.\u003C\u002Fp>\n\n\u003Cp>(b) The Factory agrees that no Attendance Allowance shall be deducted if a\nworker proceeds on, due. Privilege Leaves once in a month effective from the\ndate of signing of this Agreement.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the eligibility etc. of\nAttendance Allowance shall remain unchanged.\u003C\u002Fp>\n\n\u003Ch2>6. Meal Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>The Factory agrees that the existing Meal Allowance shall be increased from\nRs. 150\u002F- per month to Rs .315\u002F- (Rupees three hundred and fifteen only) per\nmonth effective from the date of signing of this Agreement.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the eligibility etc. of Meal\nAllowance shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>7. Annual Leave\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>The Factory agrees to allow minimum of three days Privilege Leave at a\ntime.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the Privilege Leave shall remain\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>8. Working Days\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-dayspweek_select\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspweek_select\">\u003Cp>(a) The Factory agrees to reduce weekly working days on the basis of 45\nweekly working hours and\u002For five days i.e. from Monday to Friday w.e.f. the\ndate of signing this Agreement as follows:\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SCHEDULE_trigger\">\u003Cp>Saturday &amp; Sunday as off days\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspday_select\">\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>DAY\u003C\u002Ftd>\n      \u003Ctd>FROM\u003C\u002Ftd>\n      \u003Ctd>TO\u003C\u002Ftd>\n      \u003Ctd>INTERVAL\u003C\u002Ftd>\n      \u003Ctd>WORKING HOUR\u003C\u002Ftd>\n      \u003Ctd>WEEKLY\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Monday to Friday\u003C\u002Ftd>\n      \u003Ctd>8:00 am\u003C\u002Ftd>\n      \u003Ctd>5:30pm\u003C\u002Ftd>\n      \u003Ctd>Half hour\u003C\u002Ftd>\n      \u003Ctd>9 hours\u003C\u002Ftd>\n      \u003Ctd>45 hours\u003C\u002Ftd>\u003C\u002Ftr>\u003C\u002Ftbody>\u003C\u002Ftable>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003Cdiv class=\"cbaClause highlight\" id=\"clause-hourspday_select\">\u003Ctable border=\"1\" style=\"width: 100%\">\u003Ctbody>\u003Ctr>\u003C\u002Ftr>\u003C\u002Ftbody>\u003C\u002Ftable>\u003C\u002Fdiv>\u003Ctable border=\"1\" style=\"width: 100%\">\u003Ctbody>\u003Ctr>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>(b) In view of above the Union\u002FWorkers agreed that no existing Production\nLevel shall be effected and remained as existing Schedule containing thirteen\n(13) pages being observed above weekly days.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) The Union also agrees and undertakes that in the event of strike, law\n&amp; order and catastrophe etc. situation in the city will be off day and\nManagement shall be authorized to require workmen to perform work on ensuing\noff day in place of aforesaid circumstances.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. Productivity\u002FProduction\u003C\u002Fh2>\n\n\u003Cp>(a) The Union agrees and undertakes that productivity shall be increased\nfrom the date of signing of this Agreement over and above the existing\nproduction level. Provided that Standard will be revised by the Factory at its\ndiscretion in the event of change in technology, process, materials etc. takes\nplace.\u003C\u002Fp>\n\n\u003Cp>(b) The Union also agrees to ensure production of quality and minimizing\nwastages and scrap throughout the plant operations.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. Time Keeping\u003C\u002Fh2>\n\n\u003Cp>(a) The Union\u002FWorkers agreed to observe w.e.f. following time keeping.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) One hour (60 minutes) from start shift shall be marked as Late-coming;\nover and above one hour (60 minutes) would be marked to Half-day for that\nday.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) The Union agrees that workers who discharge their duties, in the\nfactory, less than 41\u002F2 hour (270 minutes) shall marked as absent for that\nday.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(d) The Union further agrees that workmen who leave Factory for personal\nwork shall be marked half-day on that day.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. Refreshment Allowance\u003C\u002Fh2>\n\n\u003Cp>The Factory agrees that a worker required overtime at least hours in the\nFactory shall be paid Rs. 100\u002F- per day additionally effective from the date of\nsigning of this Agreement.\u003C\u002Fp>\n\n\u003Ch2>12. Daughter Marriage Gift\u003C\u002Fh2>\n\n\u003Cp>The Factory agrees to give one (Standard Model No. 150-H or its equivalent\nwith accessories and carrying case) in the event of a worker’s daughter\nmarriage as a gift at the sole discretion of Management effective from the date\nof signing of this Agreement.\u003C\u002Fp>\n\n\u003Ch2>13. Retirement Benefit\u003C\u002Fh2>\n\n\u003Cp>The Factory agrees to give one available product with accessories up to Rs.\n12,000\u002F- instead of Singer Sewing Machine (Standard Model No. 15-KSV or its\nequivalent with accessories and carrying case) to those permanent workers who\nretire from the Company’ services on attaining the age of retirement as\ndetermined by the Company effective from the date of signing of this\nAgreement.\u003C\u002Fp>\n\n\u003Ch2>14. Funeral Expenses\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>The Factory agrees to increase the existing payment of Rs. 6500\u002F- towards\nfuneral expenses to Rs. 15000\u002F- (Rupees fifteen thousand only) in the event of\ndeath of a worker during this service with the factory.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>(Points 15 &amp; 16 (a to c) are missing)\u003C\u002Fh2>\n\n\u003Cp>(d) The Parties hereby agree that all such existing terms and conditions\nwhich have not been modified, altered or covered by this Agreement shall\ncontinue to be binding and operative.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(e) The Parties hereby further agree that all such existing terms and\nconditions regarding payment of various allowances\u002Fbenefits provided under this\nAgreement and which have not been specifically mentioned and\u002For modified in\nthis Agreement shall continue to remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(f) In consideration of the financial and non-financial benefits granted by\nthe factory under this Agreement, the Union hereby further agrees and\nundertakes:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(i) Not to raise any financial demands or pursue directly or indirectly\nduring the period of operation of this Agreement, any demand or dispute\ninvolving financial burden on the Factory and also not to raise any demand\nwhether covered by this Agreement or the Charter of Demands or any other fresh\ndemand whatsoever during the operation of this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(ii) Not to strike work or to instigate strike or go slow or lower\nproduction by any means and ensure that the workers do not indulge themselves\nin any activity which may in any way adversely affect the production of the\nFactory or disturb the industrial peace.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(iii) To maintain industrial peace, to abide by the Agreement for the\noperative period hereinafter provided, to cooperate fully with the Factory in\nmatters of discipline, good conduct and to reduce absenteeism and improve\nproductivity and quality.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(g) It is the essence of this Agreement that the increases given hereinabove\nhave been granted to the workers due to inflation and the rise in the Cost of\nLiving.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(h) That this Agreement is in full and final Agreement of all the demands\nincluding those contained in the Charter of Demands as per Annexure (A &amp; B)\nas enclosed herewith.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(i) The Factory agrees that (100 days basic wages amount) shall be paid\nbefore 30th June on the existing terms and conditions.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(j) The Factory agrees to pay Leave Fare Assistance before 30th November on\nthe existing terms and conditions.\u003C\u002Fp>\n\n\u003Ch2>17. Duration of Agreement\u003C\u002Fh2>\n\n\u003Cp>The Parties hereby agree that this Agreement will come in to force w.e.f.\nthe date of its signing and will remain operative and binding upon the parties\nfor a period of two years commencing from 1st January, 2013 to 31st December,\n2014 and shall continue to be binding and operative even after the expiry of\nthe aforesaid period until the expiry of two months from the date when either\nparty informs the other party of its intension to be no longer bound by this\nAgreement.\u003C\u002Fp>\n\n\u003Ch2>18. Scope and Application\u003C\u002Fh2>\n\n\u003Cp>(a) The Parties hereby agree that the benefits provided under this Agreement\nwill be applicable to those permanent workers only who are in the employment of\nthe Factory on the date of signing of this Agreement\u003C\u002Fp>\n\n\u003Cp>(b) The Parties hereby also agree that the monetary benefits provided under\nthis Agreement shall be effective from the dates as mentioned hereinabove for\nthose permanent workers only who are in the employment of the Factory on the\ndate of signing of this Agreement.\u003C\u002Fp>\n\n\u003Cp>IN WITNESS whereof the parties hereto have hereinto set their hands this 2nd\nAugust,
