Under section 35(1) of the Sindh Industrial\nRelations Act, 2013 forwarding therewith a Charter of Demands (Copy enclosed\nhereto marked as Annexure – A)\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the Union, as collective bargaining agent, also served upon the\nFactory a notice dated 1st January, 2015, under Section 35(1) of the Sindh\nIndustrial Relations Act, 2013, forwarding therewith a Charter of Demands (Copy\nenclosed hereto and marked as Annexure – B)\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS bilateral negotiations were held between the representatives of\nthe Factory and the Union on the dates as agreed upon by them and bilateral\nnegotiation failed on 22nd April 2015. Consequently, the Factory served upon\nthe Union a Notice of Lock-Out dated 27th April 2015 and Union served upon the\nFactory Notice of Strike dated 9th June, 2015 under Section 35(3) read with\nSection 37 of the Sindh Industrial Act, 2013 (copy of said Notice of Lock-Out\ndated 27th April, 2015 &amp; notice of Strike dated 9th June, 2015 are enclosed\nhereto and marked as Annexure – C &amp; D respectively).\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS in pursuance to the said notice of Lock-Out dated 27th April\n2015 &amp; Notice of Strike dated 9th June 2015 the Conciliator of the\nDirectorate of Labour, Government of Sindh (East Division) Karachi, intervened\n&amp; initiated the conciliation proceedings which were extended from time to\ntime with mutual consent of the parties.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS recognize the effects of inflation which has effected all\nsegments of our society, and more particularly the working class, the Company\nagreed to negotiate improvements in wages and allowances of workers and grant\nfinancial relief in anticipation of further rise in Cost of Living and\u002For grant\nof relief thereof in future by the Government.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS negotiations were held between the representatives of the\nFactory and the Union with the good offices of the Conciliator on different\ndated and consequently an amicable settlement has been reached in full and\nfinal settlement of all the demands contained in the aforesaid Charter of\nDemands.\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER:\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>1. Basic Wages\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Effective 1st January, 2015 the Factory agrees to an increase of Rs. 350\u002F=\n(Rupees Three hundred &amp; fifty only), on one time basic, in basic wages of\nall the permanent workmen in the employment of the Factory on the date of\nsigning of this Agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2. House Rent Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>Effective 1st January, 2015 the Factory agrees to allow an increase of Rs.\n125\u002F= (Rupees One hundred and Twenty five only) in House Rent Allowance thereby\nraising the same from Rs. 2050\u002F= (Two thousand &amp; fifty) to Rs. 2175\u002F=\n(Rupees Two thousand and one hundred &amp; seventy five only) per month to all\nthe permanent workers.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the eligibility etc. of the House\nRent Allowance shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>3. Conveyance Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>Effective 1st January, 2015 the Factory agrees to allow an increase of Rs.\n125\u002F= (Rupees One hundred and twenty five only) per month in the existing\nConveyance Allowance raising same from Rs. 905\u002F- to Rs. 1030\u002F-, from Rs. 915\u002F-\nto Rs. 1040\u002F-, &amp; Rs. 940\u002F- to Rs. 1065\u002F- per month to those workmen who\nreside at a distance of less than three miles and more than three miles but\nless than six miles and at a distance of six miles or more respectively.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions pertaining to the eligibility etc.\nof Conveyance Allowance shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. Annual Leaves\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>Effective 1st January 2015, Annual Leave shall now be 25 days per year\ninstead of 21 days per year.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the Privilege leave shall remain\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>5. Encashment of Sick \u002F Casual \u002F Privilege Leave\u003C\u002Fh2>\n\n\u003Cp>The Factory agrees to take the Conveyance, Washing, Attendance &amp; Meal\nAllowance into consideration while computing encashment of un-availed Sick,\nCasual &amp; Privilege Leave. All others terms and conditions for encashment of\nleave will remain unchanged.\u003C\u002Fp>\n\n\u003Ch2>6. Discount on Company’s Product\u003C\u002Fh2>\n\n\u003Cp>Effective from date of signing of this Agreement, permanent workers will be\neligible to purchase Company’s product on discount, as noticed by the Factory\nfrom time to time, after 2½ years instead of 5 years after their services.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions to the Discount on Company’s\nProduct shall remain unchanged.\u003C\u002Fp>\n\n\u003Ch2>7. Daughter Marriage Grant\u003C\u002Fh2>\n\n\u003Cp>The Factory agrees to upgrade \u002F allow to give one Sewing Machine ZIG ZAG\nModel (8280) without accessories, instead of Standard Model No. 150-H, in the\nevent of a worker’s daughter marriage as a gift, at the sole discretion of\nManagement, effective from the date of signing of this Agreement.\u003C\u002Fp>\n\n\u003Ch2>8. Standards will be revised by the Factory, at its discretion, in the\nevent of change in technology, process or materials etc. take places.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) The Union also agrees to ensure production of quality products and\nminimizing wastages and scrap through-out the plant operations.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. General\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(a) The Factory and the Union voluntarily agrees that in case the Government\nannounces any Cost of Living Allowance, Special Allowance, Additional Special\nAllowance, Adhoc Relief, Dearness Allowance or any other allowance or financial\nbenefits etc., during the operative period of this Agreement it shall not be\naffected as a result of increase in wages granted to the workers under this\nAgreement. However, only differential, if any, shall be payable.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) The Union hereby undertakes to cooperate with the Factory in\nimplementing measures for improving labour productivity, quality and reducing\nabsenteeism and abide by all the work practices as establishment by the\nFactory.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) The Union hereby also agrees that, in consideration of the benefits\nprovided by the Factory under this Agreement, all remaining demands covered by\nthe Charter of Demands which have not been specifically mentioned in this\nAgreement shall be deemed to have been settled, satisfied and withdrawn.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(d) The Parties hereby agree that all such existing terms and conditions\nwhich have not been modified, altered of covered by this Agreement shall\ncontinue to be binding and operative.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(e) The parties hereby further agree that all such exiting terms and\nconditions regarding payment of various allowances\u002Fbenefits provided under this\nAgreement and which have not been specifically mentioned and\u002For modified in\nthis Agreement shall continue to remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(f) In consideration of the financial and non-financial benefits granted by\nthe Factory under this Agreement, the Union hereby agrees and undertakes:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(i) Not to raise any financial demands or pursue directly or indirectly\nduring period of operation of this Agreement, any demand or dispute involving\nfinancial burden on the Factory and also not to raise any demand whether\ncovered by this Agreement or the Charter of Demands or any other financial or\nother fresh demand whatsoever during the operation of this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(ii) Not to strike work or to instigate strike or go slow or lower\nproduction by any means and ensure that the workers do not indulge themselves\nin any activity.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(iii) Which may in any way adversely affect the production of the Factory or\ndisturb the industrial peace.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(iv) Maintain industrial peace, to abide by the Agreement for the operative\nperiod hereinafter provided, to cooperate fully with the Factory in matters of\ndiscipline, good conduct and to reduce absenteeism and improve productivity and\nquality.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(g) It is the essence of this Agreement that the increases given hereinabove\nhave been granted to the workers due to inflation and the rise in the Cost of\nLiving.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(h) That this Agreement is in full and final Agreement of all the demands\nincluding those contained in the Charter of Demands as per Annexure [A and B]\nas enclosed herewith.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. Duration of Agreement\u003C\u002Fh2>\n\n\u003Cp>The parties hereby agree that this Agreement will come into force w.e.f. the\ndate of its signing and will remain operative and binding upon the parties for\na period of two years commencing from 1st January, 2015 to 31st December, 2016\nand shall continue to be binding and operative even after the expiry of the of\ntwo months from the date when either party informs the other party of its\nintention to be no longer bound by this Agreement.\u003C\u002Fp>\n\n\u003Ch2>12.
