Mr. Naubat Khan - Member\u003C\u002Fp>\n\n\u003Cp>This Agreement is made on this 27th day of May, 2014 between M\u002Fs Shell\nPakistan Limited, a company incorporated in Pakistan under the Companies\nOrdinance, 1984 and having its registered office at Shell House 6, Ch.\nKhaliquzzaman Road, Karachi, hereinafter referred for brevity sake as “the\nCompany” (which expression wherever the context so admits shall include and\nmean it successors and assigns) and the Shell Employees Union, having its\nregistered office at 4 Oriental Chambers, Altaf Hussain Road, Karachi, as\nindustry wise Trade Union, registered with the National Industrial Relations\nCommission under the relevant law and certified as the Collective Bargaining\nAgent by the Registrar, National Industrial Relations Commission vide C.B.A\nCertificate No. 6\u002F85 dated 5th August, 1985 for the workers employed by the\nCompany at its establishments throughout Pakistan, hereinafter referred for\nbrevity sake as “the Union” (which expression wherever the context so\nadmits shall include and mean its successors and assigns and all present and\nfuture permanent workmen employed by the Company at its establishments\nthroughout Pakistan).\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>WHERAS the Union in its capacity as the Collective Bargaining Agent of all\nworkmen employed by Shell Pakistan Limited stationed anywhere in Pakistan\nsubmitted a Charter of Demands under Section 35 of the Industrial Relations\nAct, 2012 to the Company vide its letter No. 786\u002FSEU-143\u002FCD\u002F2012\u002F2014 dated 2nd\nJuly, 2012.\u003C\u002Fp>\n\n\u003Cp>WHEREAS the Company submitted a Charter of Demands under Section 35 of\nIndustrial Relations Act, 2012.\u003C\u002Fp>\n\n\u003Cp>WHEREAS exhaustive discussions and negotiations have taken place on the\nCharter of Demands and other requests and proposal made during the negotiations\nand discussions held earlier between the representatives of the Union and the\nCompany.\u003C\u002Fp>\n\n\u003Cp>WHEREAS it is the intent of this Agreement to ensure better efficiency,\ndiscipline and higher productivity in order to promote and improve the\nindustrial and economic relationship between the Company and its workers, to\nprovide orderly means to resolve grievances through peaceful negotiations and\nto increase salary\u002Fwages, allowances and benefits in order to provide relief to\npermanent workers against any rise in the cost of living and also to modify\ncertain non-financial terms of employment applicable to the permanent workers\nand to set forth herein the basic and complete agreement between the parties\nhereto.\u003C\u002Fp>\n\n\u003Cp>NOW THE AGREEMENT HEREBY WITNESSETH as under:\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>1. Salary Increase\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Effective 1st July, 2012 workers listed in Annexure-A will be allowed a one\ntime salary increase as follows:\u003C\u002Fp>\n\n\u003Cp>a) Workers drawing a basic salary\u002Fwage up to Rs. 22,000\u002F- per month as on\n1st July, 2012, Rs. 4,500\u002F-\u003C\u002Fp>\n\n\u003Cp>b) Workers drawing a basic salary\u002Fwage of more than Rs. 25,001\u002F- per month\nas on 1st July, 2012, Rs. 5,000\u002F-.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. Salary Scales\u003C\u002Fh2>\n\n\u003Cp>Salary Scales of all the workers have been consolidated and revised and will\nbe those as specified in Annexure-A which shall form part of this Agreement\nrepresenting all Unionized Staff of the Company throughout Pakistan.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. House Rent Allowance\u003C\u002Fh2>\n\n\u003Cp>Effective 1st July, 2012 the House Rent Allowance payable to the workers\nlisted in Annexure-A will be revised from 58% of the basic salary to 61% of the\nbasic salary per month.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. Conveyance Assistance Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-COMMUTE_trigger\">\u003Cp>Effective 1st July, 2012 the Conveyance Assistance Allowance payable to the\nworkers listed in Annexure-A will be revised from 43% of the basic salary PLUS\nRs. 1,700\u002F- to 46% of the basic salary PLUS Rs. 2,000\u002F- per month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. Merit Increase\u003C\u002Fh2>\n\n\u003Cp>The Company shall provide a merit increase system in order to encourage and\nmotivate the performance of workers. The scale of annual increment will be as\nfollows, which will be applicable w.e.f. 01.01.2013.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) High Performance: 10% of Basic Salary\u003C\u002Fp>\n\n\u003Cp>(up to 15% of workers population)\u003C\u002Fp>\n\n\u003Cp>b) Very good performance: 9% of Basic Salary\u003C\u002Fp>\n\n\u003Cp>(up to 30% - 35% of workers population)\u003C\u002Fp>\n\n\u003Cp>c) Good Performance:8% of Basic Salary\u003C\u002Fp>\n\n\u003Cp>(up to 50% of workers population)\u003C\u002Fp>\n\n\u003Cp>The annual increment may be withheld by the Company in accordance with\nprovisions contained in the Standing Orders Ordinance, 1968 if the performance\nis below the accepted standard.\u003C\u002Fp>\n\n\u003Ch2>6. Leave Fare Assistance (LFA)\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>Effective 1st July, 2012 the quantum of LFA for workers in Annexure-A will\nbe revised from Rs. 14,500\u002F- to Rs. 17,000\u002F- per annum, which will be payable\nto all eligible workers along with their salary in the month January, 2012 at\nthe old rate for the year 2012 will be paid the difference of the aforesaid\nincrease i.e. one-time proportionate sum as arrears amounting to Rs. 1,250\u002F-\nfor six months (July – December, 2012). Whereas, those workers who have\nreceived LFA in the month of January, 2013 &amp; 2014 at the old rate, will be\npaid one-time difference i.e. 2,500\u002F- each for the years 2013 &amp; 2014\nrespectively.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. Festival Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>a. Allowance 1: Eid-ul-Fitr\u003C\u002Fp>\n\n\u003Cp>Effective 1st July, 2012 all Muslim workers shall be paid an amount of Rs.\n6,000\u002F- (Rs. Six thousand only) as Festival Allowance I, which will be paid\nduring the first week of Ramzan. Similarly, the Non-Muslim staff shall be paid\nthe amount at least one week before their important festival i.e. Christmas.\nThe aforesaid amount shall not be treated as part of wages for any purpose.\nThose workers who have already received festival allowance in 2012 &amp; 2013\nat the old rate will be paid the difference of the aforesaid increase i.e. Rs.\n1,500\u002F- each along with the arrears arising out of this settlement.\u003C\u002Fp>\n\n\u003Cp>b. Allowance 2: Eid-ul-Azha\u003C\u002Fp>\n\n\u003Cp>Effective 1st July, 2012 all Muslim workers shall be paid an amount of Rs.\n4,000\u002F- (Rs. Four thousand only) as Festival Allowance II, which will be paid\nat least two weeks before Eid-ul-Azha. Similarly, the Non-Muslim staff shall be\npaid the amount at least one week before their important festival i.e.\nChristmas. The aforesaid amount shall not be treated as part of wages for any\npurpose. Those workers who have already received festival allowance in 2012\n&amp; 2013 at the old rate will be paid the difference of the aforesaid\nincrease i.e. Rs 1,500\u002F- each along with the arrears arising out of this\nsettlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. Bonus\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>a) Effective 1st July, 2012 the Company shall pay Bonus on annual basis to\nthe workers as listed in Annexure-A which will be equal to 40% of the basic\nsalary and the cost of living allowance paid under Section 3 (2) and (3) of the\nEmployees’ Cost of Living (Relief) Act, 1973 earned\u002F received during the\nBonus year.\u003C\u002Fp>\n\n\u003Cp>The bonus under this clause shall be aid during the month of January after\nthe closing of accounts of the Company on 31st December of the respective\naccounting year.\u003C\u002Fp>\n\n\u003Cp>The word ‘basic salary’ shall have the same meaning as hitherto followed\nand accepted for the purpose of calculation of bonus paid under the previous\nAgreements.\u003C\u002Fp>\n\n\u003Cp>In case a worker retires, dies, is retrenched\u002F resigns or is promoted the\nManagement Cadre during the bonus year, he will be entitled to receive bonus in\nthe same proportion as the number of days he has worked in the bonus year. A\nprobationer confirmed as permanent worker in the bonus year shall be entitled\nto receive proportionate bonus for the probationary period also worked in that\nbonus year.\u003C\u002Fp>\n\n\u003Cp>b) The company on making profits during its financial year (January –\nDecember) shall pay bonus in accordance with the provisions of Standing Order\n10-C of the Industrial &amp; Commercial Employment (Standing Orders) Ordinance,\n1968.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. Gratuity \u002F Pension\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-pensionfund\">\u003Cp>Subject to the approval from the respective Government Authorities:\u003C\u002Fp>\n\n\u003Cp>1. Effective 1st July, 2012 workers\u002Fmembers eligible for Pension from Burmah\n– Shell Pakistan Pension Fund (Applicable to Clerical &amp; Labour Staff)\nwill be allowed Gratuity @ 30 days basic salary for each year of service\naccording to Shell Pakistan Labour &amp; Clerical Staff Gratuity Fund Rules. If\nsuch workers \u002Fmembers surrender their Pension rights before receiving any\nPension payment, they will be allowed Gratuity @ 64 days basic salary for each\nyear of service according to Shell Pakistan Labour &amp; Clerical Staff Fund\nRules.\u003C\u002Fp>\n\n\u003Cp>2. Workers\u002Fmembers ineligible for Pension from Burmah – Shell Pakistan\nPension Fund (Applicable to Clerical &amp; Labour Staff) will be allowed\nGratuity @ 64 days basic salary for each year of service according to Shell\nPakistan Labour &amp; Clerical Staff Gratuity Fund Rules.\u003C\u002Fp>\n\n\u003Cp>3. For purposes of Gratuity calculation, service will be calculated in\ncompleted year of continuous service. Such service will be increased by\none-twelfth of a year for each completed month in incomplete years of\ncontinuous service.\u003C\u002Fp>\n\n\u003Cp>The Company will request the Trustees to make suitable amendments in the\nBurmah – Shell Pakistan Pension Fund and Shell Pakistan Labour and Clerical\nStaff Gratuity Fund, through the Supplementary Trust Deeds, in order to reflect\nthe abovementioned provisions.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. Medical\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccessrelatives\">\u003Cp>The present rule with regard to providing financial assistance for Surgical\nOperation for workers and their families will be revised as follows:\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>A.Surgical Operation (for workers)\u003C\u002Fp>\n\n\u003Cp>All rules and other stipulations\u002Fconditions with regard to Surgical\nOperation (for workers) including up-country workers shall remain unchanged\nexcept the room charges shall be reimbursed at actuals or Rs. 2,000\u002F- per day,\nwhichever is less, up to a maximum of 30 days.\u003C\u002Fp>\n\n\u003Cp>B.Surgical Operations (for families)\u003C\u002Fp>\n\n\u003Cp>The present rule of providing financial assistance to the families of\nworkers including up-country worker for surgical treatment shall be replaced\nwith the following rule:\u003C\u002Fp>\n\n\u003Cp>i) The surgical operation charges except in respect of any diet shall be\nreimbursed at actual subject to a maximum or Rs. 40,000\u002F- for each\noperation.\u003C\u002Fp>\n\n\u003Cp>ii) Surgical operation shall be defined as follows:\u003C\u002Fp>\n\n\u003Cp>a) Surgeon’s fee\u003C\u002Fp>\n\n\u003Cp>b) Operation theater charges including Anesthesia\u003C\u002Fp>\n\n\u003Cp>c) Medicines\u003C\u002Fp>\n\n\u003Cp>d) Blood charges, if any\u003C\u002Fp>\n\n\u003Cp>e) X-Ray charges\u003C\u002Fp>\n\n\u003Cp>f) Laboratory charges\u003C\u002Fp>\n\n\u003Cp>g) Room charges at actual or Rs. 2,000\u002F- per day, whichever is less, up to a\nmaximum of 30 days.\u003C\u002Fp>\n\n\u003Cp>iii) Family mean wife, male children up to the age of 22 years and unmarried\nfemale children, who are registered with the Company.\u003C\u002Fp>\n\n\u003Cp>iv) The following conditions shall apply in each and every case of surgical\noperation:\u003C\u002Fp>\n\n\u003Cp>a) The Company’s Doctor shall be consulted by the worker or as the case\nmay be by this family, before undergoing any surgical treatment. The choice of\nSurgeon and\u002For Hospital for obtaining the surgical treatment shall rest with\nthe Company’s Doctor.\u003C\u002Fp>\n\n\u003Cp>b) For claiming any reimbursement for surgical operation, all receipts\u002Fpaid\nbills and cash memos shall be countersigned by the Company’s Doctor.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>C. Hospitalization other than Surgical Operation:\u003C\u002Fp>\n\n\u003Cp>The Company shall provide financial assistance to the workers and their\nfamilies in case of hospitalization other than surgical operation as\nfollows:\u003C\u002Fp>\n\n\u003Cp>i) The hospitalization charges except in respect of any diet shall be\nreimbursed at actual subject to a maximum of Rs. 40,000\u002F- in case of worker\nhimself and Rs. 35,000\u002F- in case of his family.\u003C\u002Fp>\n\n\u003Cp>ii) Hospitalization charges shall be defined as follows:\u003C\u002Fp>\n\n\u003Cp>a) Dr.’s fee\u003C\u002Fp>\n\n\u003Cp>b) Medicine\u003C\u002Fp>\n\n\u003Cp>c) X-ray charges\u003C\u002Fp>\n\n\u003Cp>d) Laboratory charges\u003C\u002Fp>\n\n\u003Cp>e) Room charges at actual or Rs. 2,000\u002F- per day whichever is less up to a\nmaximum of 30 days.\u003C\u002Fp>\n\n\u003Cp>iii) Family has the same meaning as defined in clause 10(B) (iii) above.\u003C\u002Fp>\n\n\u003Cp>iv) The following conditions shall apply in each case of hospitalization\nother than surgical operation:\u003C\u002Fp>\n\n\u003Cp>a) The Company’s Doctor shall be consulted by the worker or as the case\nmay be, by his family before hospitalization. The choice of the hospital rest\nwith the Company’s Doctor.\u003C\u002Fp>\n\n\u003Cp>b) For claiming any reimbursement for hospitalization all receipt\u002Fpaid bills\nand cash memos shall be countersigned by the Company’s Doctor.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>D. In case the amount of Surgical\u002FHospitalization charges exceeds the\nprescribed limit as mentioned above, the worker shall submit his total claim to\nthe Chief Medical Officer of the Company who in consultation with Industrial\nRelations Department will review\u002F consider such claim and send his\nrecommendation to General Manager Human Resource for necessary action. The\nCompany will continue to cooperate in genuine medical cases. The decision of\nthe General Manager Human Resources shall be final and will not be called into\nquestion.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>E. Those workers who wish to take advance in connection with surgical\noperation\u002F hospitalization, they may apply along with relevant Doctor\u002FHospital\nadvice \u002F estimates to the Industrial Relations Department, so that their case\nin considered in consultation with the Company’s Chief Medical Officer, for\nallowing them reasonable advance from the General Purposes Loan as agreed under\nClause 13(b) of this Agreement. Such advance shall be adjusted against the\nfinal medical claim. In case the worker fails to submit final medical claim\nwithin a reasonable period, the advance amount will be recoverable from the\nsalary\u002Fdues payable to the concerned worker.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. Overtime\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>In supersession of the previous rule on overtime and at the request of the\nUnion, the impact on overtime on account of increase given in salary and\nallowances in this Agreement have been spread and included in such items in\norder to improve the monthly pay package of workers. The Union undertakes not\nto reopen this matter before any forum or authority. The Union also agrees on\nbehalf of all workers that no worker individually or collectively will agitate\nor reopen it before any forum or authority. The Union further agrees that the\nhourly overtime rate applicable to workers as at 30th June, 2012 will be\nrevised w.e.f. 1st July, 2012 by 10% and it shall remain valid and binding\nduring the currency of this Agreement and it shall not be called in question,\nbefore any forum or authority by the Union or any individual worker.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Without prejudice to the foregoing if there is any adverse decision in the\nmatter by any lawful authority, the Company shall be within its rights to make\nappropriate adjustments and reduce the increase in Salary and Allowances given\nin this Settlement. It is clearly understood that there shall be no increase in\nthe Company liability\u002Fcost in this regard. The Union has undertaken to extend\nits full support to the Company.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. Ex-Gratia Payment\u003C\u002Fh2>\n\n\u003Cp>All permanent workers on the pay roll of the Company on the date of signing\nof this Agreement shall receive a one-time Ex-Gratia amount of Rs. 700\u002F- (Rs.\nSeven hundred only) to mark the occasion of signing this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. General Purpose Loan\u003C\u002Fh2>\n\n\u003Cp>a) The Company’s allocation to General Purpose Loan shall revised from Rs.\nEighteen Lacs to Rs. Twenty Lacs for advancing loans for general purpose to the\nworkers.\u003C\u002Fp>\n\n\u003Cp>b) The loan amount to a worker shall not exceed his 8 month’s basic salary\nor Rs. 150,000\u002F- (Rs. One lac fifty thousand only) whichever is less and shall\nbe recoverable in 40 equal installments. The loan amount recovered from a\nworker shall be available for advancing loans to other workers for the same\npurpose.\u003C\u002Fp>\n\n\u003Cp>c) The loan amount will be administered by a Committee comprising of two\nrepresentatives of the Company and two representatives of the Union duly\nnominated in writing by the Company and the Union respectively for this\npurpose.\u003C\u002Fp>\n\n\u003Cp>d) The cases of workers recommended by the Committee shall be forwarded to\nthe Company for arranging payment.\u003C\u002Fp>\n\n\u003Cp>e) Other details and procedure in this regard will remain the same as\npresently applicable, which have already been worked out by the Company in\nconsultation with the Union.\u003C\u002Fp>\n\n\u003Cp>f) In addition to the above amount, the Company will allocate an amount of\nRs. One Lac in the General Purpose Loan Fund for allowing reasonable advance in\nconnection with Operation\u002FHospitalization charges as per Clause 10 (E) of this\nAgreement. The advance amount recovered\u002Fadjusted from the workers final medical\nclaim shall be available for allowing similar advance to other workers for the\nsame purpose.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. Motor Cycle Loan\u003C\u002Fh2>\n\n\u003Cp>a) The company’s total allocation to motor cycle loan fund shall be\nrevised from Rs. 8 Lacs to Rs. 10 Lacs for advancing loan to workers, whose\nperiod of service in the Company is not less than 10 years for the sole purpose\nof purchasing motor cycle.\u003C\u002Fp>\n\n\u003Cp>b) The loan amount shall not exceed Rs. 80,000\u002F- (Rs. Eighty thousand only)\nin each case and shall be recoverable through payroll deduction in 50 equal\nmonthly instalments. The loan amount recovered from workers will be available\nfor advancing loans to other workers for the same purpose.\u003C\u002Fp>\n\n\u003Cp>c) The above loan shall be given to the eligible workers only twice in their\nservice period with the Company.\u003C\u002Fp>\n\n\u003Cp>d) Other details and procedures in this regard will be worked out by the\nCompany in consultation with the Union.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15. Meal \u002F Tea Allowance\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>The amount of Meal\u002FTea Allowance will be revised as follows:\u003C\u002Fp>\n\n\u003Cp>Lunch\u002FDinner from Rs. 30\u002F- to Rs. 50\u002F-\u003C\u002Fp>\n\n\u003Cp>Tea from Rs. 8\u002F- to Rs. 12\u002F- per cup\u003C\u002Fp>\n\n\u003Cp>Other rules\u002Fstipulations regarding Meal\u002FTea Allowance shall remain\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. Washing Allowance\u003C\u002Fh2>\n\n\u003Cp>Effective 1st July, 2012 the rule of washing allowance applicable to\nup-country workers (except located at Karachi) will be revised from Rs. 150\u002F-\nto Rs. 200\u002F- per month. Other rules\u002Fstipulations will remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. Special Facilities Payment\u003C\u002Fh2>\n\n\u003Cp>Effective 1st July, 2012 the special facilities payment applicable to\ncertain workers at Keamari Installation will be increased by Rs. 50\u002F- per\nmonth. Other rules\u002Fstipulations.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>18. Shoes Facility\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>Effective 1st July, 2012 the quantum of payment in lieu of shoes facility\nfor certain workers Annexure ‘A’ will be revised from Rs. 3,500\u002F- per annum\nto Rs. 4,000\u002F- per annum which will be payable to workers along with their\nsalary in the month of January each year. However, those workers who have\nalready received shoe facility payment in the month of January 2012, at the old\nrate will be paid the difference of the aforesaid increase i.e. one-time\nproportionate sum as arrears amounting to Rs. 250\u002F- for six months (July –\nDecember, 2012). Whereas, those workers who have received shoes facility\npayment in the month of January 2013 and 2014 at the old rate will be paid\none-time difference of Rs. 1,000\u002F- for year 2013 and 2014. Other\nrules\u002Fstipulations regarding shoes facility will remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>19. Cost of Living Allowance\u002FSpecial Allowance\u002FAd-hoc Relief\u002FAny other\nAllowance\u003C\u002Fh2>\n\n\u003Cp>It is agreed that if payments like COLAs\u002FSpecial Allowances\u002FAd-hoc relief or\nany other allowances \u002Fwages increases are announced by the Government during\nthe operative period of this Agreement, the increases in salary\u002FAllowances\ngiven in this Agreement shall be adjusted and set off against such payments.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. Long Service Award\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>In order to facilitate the workers arriving from up-country stations to\nreceive their Long Service Awards, it has been agreed that a sum of Rs.\n50,000\u002F- per annum will be earmarked for this purpose, which will be\ndistributed equally among such workers, after receiving their awards.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The aforesaid amount includes all travelling, accommodation and daily\nexpenses. It will be the worker’s responsibility to make his own\ntravelling\u002Faccommodation and other arrangements. Except for the aforesaid\namount no TA\u002FDA, Taxi\u002FRickshaw fare etc. will be paid.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. \u003C\u002Fh2>\n\n\u003Cp>The Union undertakes to keep industrial peace &amp; co-operate with the\ncompany in its efforts to increase productivity and not to resort to any\nactivity causing curtailment of production, indiscipline, inefficiency,\nstoppages or work, go slow, illegal strike or refusal to work overtime by\nworkers of any section of any establishment of the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>22.\u003C\u002Fh2>\n\n\u003Cp>The Union undertakes that all its member shall abide by and be governed by\nthe:\u003C\u002Fp>\n\n\u003Cp>• Policy regarding Health &amp; Safety at work &amp; protection of the\nenvironment including, but not limited to, Seat Belt\u002FHelmet, Mobile Phone, No\nSmoking Policies.\u003C\u002Fp>\n\n\u003Cp>• Statement of General Business Principles.\u003C\u002Fp>\n\n\u003Cp>• Security &amp; Safety Policy\u003C\u002Fp>\n\n\u003Cp>• Drug &amp; Alcohol Policy\u003C\u002Fp>\n\n\u003Cp>• Code &amp; Conduct\u003C\u002Fp>\n\n\u003Cp>• Life Saving Rules\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The Union assures for the enhancement of awareness of such matter among\nworkers in this regard and ensuring the workers adopt safe and healthy\npractices at work.\u003C\u002Fp>\n\n\u003Ch2>23. \u003C\u002Fh2>\n\n\u003Cp>The Union assures the Company its support in enforcement of new system for\nbetter control and discipline access and card punching system.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>24.\u003C\u002Fh2>\n\n\u003Cp>This Agreement is in full and final Agreement of all demands raised\nincluding those mentioned in the Charter of Demands and disputes in existence\nup to the signing of this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>25.\u003C\u002Fh2>\n\n\u003Cp>The Union undertakes not to raise or pursue, directly or indirectly during\nthe currency of this Agreement, any demands involving direct or indirect\nfinancial commitment on the part of the Company or touching upon any matter\ncovered by the demands enumerated in the Charter of Demands. The Union shall\nnot raise any dispute or any demand whatsoever during the operation of this\nAgreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>26.\u003C\u002Fh2>\n\n\u003Cp>The Union represents only the permanent workers who are presently employed\nand are on the pay roll of the Company or who may be employed hereafter by the\nCompany at its establishment throughout Pakistan and the Company remain the\nsole judge for the suitability and number of workers required for various jobs,\nclassification and types of jobs.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>27.\u003C\u002Fh2>\n\n\u003Cp>This Agreement shall apply and its benefits be applicable to the permanent\nworkers mentioned in Annexure ‘A’ who are on the pay roll of the Company,\non the date signing of this Agreement at the Company’s establishments\nthroughout Pakistan in respect of which the Union is presently the Collective\nBargaining Agent, or those who may be employed hereafter by the Company as\npermanent workers at such establishment.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>28.\u003C\u002Fh2>\n\n\u003Cp>The benefits of revision of Salary, House Rent Allowance, Conveyance\nAllowance, LFA, Bonus, Festival Allowance (where applicable), and Gratuity \u002F\nPension under this Agreement shall also be payable on proportionate basis to\nall those workers who were on the pay roll of the Company on 1st July, 2012 and\nhave since ceased to be in the employment of the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>29.\u003C\u002Fh2>\n\n\u003Cp>The term ‘worker’ wherever appearing in this Agreement shall mean,\nunless mentioned specifically otherwise, those permanent workmen only who are\npresently employed by the Company and are on the pay roll of the company or who\nmay be employed in future as permanent workmen at Company’s establishments\nthroughout Pakistan as mentioned in Annexure ‘A’.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>30.\u003C\u002Fh2>\n\n\u003Cp>All existing terms and conditions of service shall continue to remain in\nforce except to the extent modified by this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>31.\u003C\u002Fh2>\n\n\u003Cp>Any dispute of difference arising out of the construction or interpretation\nof any clause of this Agreement may be referred to a Court or Authority having\njurisdiction, either by the Union or the Company, for decision. This reference\nshall be made only if the discussion between the Company and the Union result\nin disagreement on the issue in question.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>32.\u003C\u002Fh2>\n\n\u003Cp>This Agreement shall remain in force and in effect till 30th June, 2015 and\nthereafter indefinitely until terminated by either party hereto upon giving to\nthe other party, two months notice in writing of its intention to terminate\nthis agreement in accordance with the relevant provisions of law.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>33.\u003C\u002Fh2>\n\n\u003Cp>If at any time after signing this Agreement, any other Trade Union is\ncertified to be the Collective Bargaining Agent in respect of all or any of the\nworkers employed by the Company at its establishments throughout Pakistan, the\nfinality, validity and sanctity of this Agreement shall neither be adversely\naffected nor the same be challenged directly or indirectly by any other Trade\nUnion who may become a C.B.A or by any worker covered under this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>34.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that if any benefits similar to those contained in this\nAgreement are legislated in future then such legislated benefits shall replace,\nbut shall not be in addition to those contained herein. Provided that if the\nbenefits by this Agreement are more than those provided by law, the provision\nof this Agreement shall prevail.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>35.\u003C\u002Fh2>\n\n\u003Cp>The benefits given under this Agreement shall be effective from the date of\nsigning of this Agreement unless specifically mentioned otherwise in a\nparticular clause of this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>IN WITNESS WHEREOF the parties hereunto set their respective signatures
