AMIR ALI - SECRETARY FINANCE\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>The Regent Plaza Hotel &amp; Convention Centre Labour Union has been\ncertified as C.B.A for the workmen employed in all the establishments of Regent\nPlaza Hotel &amp; Convention Centre by the National Industrial Relations\nCommission vide C.B.A Certificate bearing No. 03\u002F2007 dated 14.05.2007 and\n22.05.2010. Thereafter the C.B.A vide its letter dated 16.06.2013 submitted to\nthe company a communication along with a Charter of Demands under the I.R.A\n2012. A photocopy of the said communication and accompanying charter of demands\nare annexed herewith and marked A &amp; A\u002F1 respectively. Upon receipt of the\nsaid communication negotiations the C.B.A was informed of the financial \u002F\nbusiness position of the company. As a result of the said negotiations the\nparties have agreed to sign this settlement. Accordingly, this settlement is\nbeing signed between the parties keeping in view the financial position of the\ncompany.\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>In full and final settlement of all the demands contained in annexure A-1,\nit is agreed as follows:\u003C\u002Fp>\n\n\u003Ch2>1.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-LOWWAGE_government\">\u003Cp>The minimum wages of the workers as announced by the Federal\u002FProvincial\nGovernment shall be paid to the workers and if there is any increase the same\nshall be paid by the company form the stipulated date.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2.\u003C\u002Fh2>\n\n\u003Cp>Laundry and Engineering Department workers will be provided\ncold-drink\u002Fsquash to drink in view of the nature of their job.\u003C\u002Fp>\n\n\u003Ch2>3.\u003C\u002Fh2>\n\n\u003Cp>Workers are presently being given a loan which will continue to be given as\nper policy of the company.\u003C\u002Fp>\n\n\u003Ch2>4.\u003C\u002Fh2>\n\n\u003Cp>Workers gathering party as presently being held will also continue to be\nheld in future at the discretion of the Management.\u003C\u002Fp>\n\n\u003Ch2>5.\u003C\u002Fh2>\n\n\u003Cp>The grievances, if any, in respect of the food, crockery and cleanliness\netc. being provided in the canteen to the staff will be looked into. In this\nrespect a committee will be constituted comprising of one representative of\nworkers and one representative of the management to look into the affairs.\u003C\u002Fp>\n\n\u003Ch2>6.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cp>Every year 2 pairs of uniform will continue to be provided to the\nworkers.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>7.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The attendance allowance of Rs. 100\u002F- per month presently being paid to the\nC &amp; D category of the workers on full attendance will continue to be\npaid.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>8.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>The increment to the worker will continue to be paid at the discretions of\nthe Management as per present practices.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>9.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>Every year one worker will continue to be sent for Hajj as per present\npractices.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>10.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-apprenticeships\">\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-trainingprogrammes\">\u003Cp>The Management may provide the facility of internship to the dependents of\nthe workers for training but they shall not be entitled to any stipend or any\nemoluments.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>GENERAL\u003C\u002Fp>\n\n\u003Cp>a. This settlement has been executed in full and final settlement of all\ndemands contained in annexure A-1. Accordingly, subject to what has been agreed\nabove, all demands contained in annexure A-1 and which have not been\nwithdrawn\u002Fdropped by the C.B.A.\u003C\u002Fp>\n\n\u003Cp>b. This settlement shall become effective from 15.06.2013 and shall remain\nin force and binding upon the parties for a period of 3 years up to\n14.06.2016.\u003C\u002Fp>\n\n\u003Cp>c. The C.B.A agrees, stipulates and undertakes that it shall not raise any\ndemand during the said period of this settlement which is effective and binding\non the parties as stated above.\u003C\u002Fp>\n\n\u003Cp>d. It is further agreed that whatsoever having financial implications or\neven otherwise directly or indirectly affect the company and\u002For any of the\ndemands contained in annexure A-1 hereto have been dropped or withdrawn.\u003C\u002Fp>\n\n\u003Cp>e. The C.B.A will cooperate strictly in maintaining discipline, industrial\nharmony and understanding in the establishment and in this context they will\nrendered every assistance by itself and through the workers to increase\nefficiency to promote the business.
