SHORT RECITAL OF THE CASE\u003C\u002Fh2>\n\n\u003Cp>Whereas the Pakistan Oil Fields United Workers Union Khaur (Attock), the\nCollective Bargaining Agent (hereinafter called C.B.A), representing the\nWorkers of Pakistan Oil Fields Limited (hereinafter called Company) submitted a\nCharter of Demands (Annexure “A”) to the “Company” vide their letter\ndated the October 25, 2013 under the Punjab Industrial Relations Act, 2010 and\nPakistan Essential Services (Maintenance) Act, 1952.\u003C\u002Fp>\n\n\u003Cp>And whereas bilateral negotiations commenced on the Charter of Demands,\nwhich were extended from time to time, with mutual consent to enable the\nParties to arrive at an overall settlement.\u003C\u002Fp>\n\n\u003Cp>And whereas, the Company maintains that unless overall productivity is\nincreased, it will not be possible to make any substantial improvement in the\nwage rate and other terms and conditions of workmen.\u003C\u002Fp>\n\n\u003Cp>And whereas, the C.B.A appreciated the need for improving labour\nproductivity, and assured its full cooperation in implementing measures for\nimproving productivity, maintaining discipline and industrial peace, refraining\nfrom interfering in the inherent functions, rights, powers and prerogative of\nManagement.\u003C\u002Fp>\n\n\u003Cp>And whereas, the Company maintained that the existing wage rates, Allowances\nand other terms and conditions of service of its workmen compared favourably\nwith the same in other comparable establishments. However, keeping in view the\nrising cost of living and other considerations of Collective Bargaining with\nthe C.B.A with Company agreed to consider and discuss the Charter of Demands\nwith the C.B.A.\u003C\u002Fp>\n\n\u003Cp>Now therefore, the following has been agreed between the Parties in full and\nfinal settlement of all exiting demands raised by the C.B.A. The Agreement\nwitnesseth as follows: -\u003C\u002Fp>\n\n\u003Cp>A. In consideration of the C.B.A, entering into and abiding by this\nAgreement, for the period hereinafter stated.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>B. Accepting the terms of Agreement, in full and final settlement of all\ndemands, and disputes in existence upon the time of signing of this\nAgreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>C. Undertaking to keep Industrial peace at all places of work at all times\non the one hand and to cooperate full and effectively with the Company, in its\nefforts to increase efficiency, productivity and economy on the other hand.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>D. Agreeing to abide by the Rules of safety and security and to act in\nconformity with the instructions issued by the Company from time to time. And\nagreeing that in acute emergency, workers will be called on overtime with a\nview to maintain the continuity of process.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>E. Undertaking not to raise or pursue during the terms of this Agreement any\ndemand(s), involving direct or indirect financial commitments on the parts of\nthe Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>F. The Company undertakes to abide by the terms of the Settlement and\nimplement the same the cooperation of the C.B.A\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. TERMS OF AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(1) That this Agreement shall come into force with effect from 1st day of\nJuly, 2013 and its terms will be effective from the 1st day of July, 2013,\nunless otherwise specifically provided, and the Agreement shall continue to\nremain in force until 30th day of June, 2015 and thereafter shall remain\noperative unless terminated by either party upon giving to the other party a\nnotice prescribed under The Punjab Industrial Relations Act, 2010.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(2) Both the Parties shall abide by the Agreement during the period\nspecified above.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(3) It is agreed that if the Government legislates any payment for\nIndustrial Workers on account of increase in the cost of living during the\noperative period of this settlement, both the Parties shall mutually examine\nits impact taking into consideration any benefits\u002Fpayment already given by the\ncompany during the said period on account of increase in cost of living and\nnecessary adjustments shall be made accordingly without placing either party at\na disadvantaged position, provided that the company shall not assume any\nadditional financial burden unless explicitly required under any law.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. INCREASE IN BASIC WAGES\u002FPAY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>In view of the rise in cost of living and essential commodities, the Company\nagrees to allow an increase in the basic wages admissible to the workers on\n30th June, 2013 at the rate of 19% (Nineteen percent) w.e.f. July 01, 2013. It\nis also agreed that if the Government announces any increase in wages after the\ndate of signing of this Agreement, such increase will not be automatically\neffective but would be subject to negotiations between Management and C.B.A.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. ASSITANCE TOWARDS HOUSE RENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The Company agrees to revise the House Rent Assistance as per following:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>\u003Cp>For Fields staff living in their own accommodation:\u003C\u002Fp>\n      \u003C\u002Ftd>\n      \u003Ctd>From 28% to 30% of Basic Pay.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>\u003Cp>For Rawalpindi (Head Office) Staff:\u003C\u002Fp>\n      \u003C\u002Ftd>\n      \u003Ctd>From 28% to 30% of Basic Pay.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>All other terms and conditions will remain the same.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. UTILITY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed to increase the Utility Allowance from 18% to 20% of Basic\nPay.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. FESTIVAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Ch2>\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The Company agrees to revise the existing Festival Allowance from Rs.\n6,000\u002F- Rs. 7,000\u002F-\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions applicable to this allowance shall remain\nunchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>7. SHIFT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>The Company agrees to increase the Shift Allowance from Rs. 500\u002F- per month\nto Rs. 600\u002F- per month for all Shift Workers.\u003C\u002Fp>\n\n\u003Ch2>8. SPECIAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>Special Allowance for Meyal fields has been increased from Rs. 550\u002F- to Rs.\n750\u002F- per month to entitled workers.\u003C\u002Fp>\n\n\u003Cp>Special Allowance for other fields has been increased from Rs. 400\u002F- to Rs.\n550\u002F- per month to entitled workers.\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions will remain the same.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. CYCLE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed to increase the Cycle Allowance from Rs. 180\u002F- to Rs. 300\u002F- per\nmonth.\u003C\u002Fp>\n\n\u003Ch2>11. SPECIAL ALLOWANCE (2009)\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The Company agrees to increase the existing Special Allowance (2009) from\nRs. 400\u002F- to Rs. 500\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>All other terms &amp; conditions will remain the same.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>16. UNIFORM\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthandsafetypolicy\">\u003Cp>It is agreed that uniforms will be issued every year to two Sr. Foreman\n(Motor Mechanic) working in Motor Shed.
