Rawalpindi, herein after referred to as “the\nCompany” which expression wherever the context so admits shall mean and\ninclude its successors and assignees, on the one part.\u003C\u002Fp>\n\n\u003Cp>And\u003C\u002Fp>\n\n\u003Cp>Muree Brewery Workers Union, Acting as Collective Bargaining Agent having\nits registered office at Murree Brewery Company, Rawalpindi, herein after\nreferred to as “the C.B.A” which expression wherever the context so admits\nshall mean and include its successor and assignees, on other hand\u003C\u002Fp>\n\n\u003Cp>Short Recital of the Case.\u003C\u002Fp>\n\n\u003Cp>On 01.07.2013 the C.B.A served Demand Notice under section 35 of the IRA\n2012 to the Company. The Company arranged various meetings with the\nrepresentatives of the C.B.A with a view of reaching an agreement on the\ndemands through the process of dialogue. After various meetings between the\nparties following settlement\u002Fagreement arrived at and resultantly this\nagreement signed on 01.01.2014 by the following representatives of both the\nabove parties.\u003C\u002Fp>\n\n\u003Cp>* The Company’s Representatives\u003C\u002Fp>\n\n\u003Cp>1. Syed Ather Mehmood - (J\u002FS““) - W.C Member\u003C\u002Fp>\n\n\u003Cp>5. Shabbir Hussain Khokhar - (Chairman““) - W.C Member\u003C\u002Fp>\n\n\u003Cp>Terms of Settlement\u003C\u002Fp>\n\n\u003Cp>A. This agreement shall be valid for a period of two years effective from\n1st July, 2013 to 30th June 2015 and shall be applicable \u002F confined to only\nexisting regular permanent employees in grade I-X As on 1.7. 2013 The C.B.A\nagreed not to raise any financial demand what so ever till the expiry of this\nagreement; in general all workers and \u002F or staff members of the Company will\nnot be eligible\u002Fentitled to any financial benefit till the expiry of this\nagreement.\u003C\u002Fp>\n\n\u003Cp>B. It is further agreed that in case of any change\u002Frevision in liquor policy\nby the Federal or Provincial and Local Governments through which production of\nLiquor is effected or sale decreases due to this policy, benefits\u002Fallowances,\nbonuses and other incentives granted under current or pervious Agreements \u002F\nSettlements will be reviewed by both the parties and the CBA will have no\nobjection.\u003C\u002Fp>\n\n\u003Cp>C.That the C.B.A unconditionally and irrevocably indemnifies company against\nclaims or actions arising out the same from any of the worker (s) for and on\nbehalf of which it is acting and executing this agreement.\u003C\u002Fp>\n\n\u003Cp>D. It has been agreed that this agreement is full and final settlement of\nall the demands raised by the C.B.A as per their Charter of Demands attached as\n“Annex – A” and demands not mentioned in this agreement shall be treated\nas withdrawn by the CBA. Both the parties agreed to maintain industrial peace\nand abide by the settlement.\u003C\u002Fp>\n\n\u003Cp>E. In view of this settlement the C.B.A undertakes that its office bearers\nand workers will work whole heartedly and improve their efficiency for\nattaining the production targets and avoid malingering and wasteful working.\nThe C.B.A office bearers also undertake to maintain peace during the currency\nof this settlement and not to take recourse to any illegal steps disturbing the\nsmooth running of the Company and the C.B.A further undertakes not to take part\nin. Facilitate and or abet or backing in any activity that may result in go\nslow down, strike or stoppage of production in any manner or to any extent\nwhatsoever and howsoever.\u003C\u002Fp>\n\n\u003Cp>F. In view of this settlement, the C.B.A also undertakes whole heartedly not\nto support malingerers. Thieves, habitual sick-leavers, under – employed\nworkers. Time wasters and not to indulge in political activities during working\nhours. The C.B.A will fully cooperate with the management to improve\nproductivity \u002F disc pline and will prove themselves as exemplary workers like\nother employees in the organization. There are some employees, who take medical\nleaves and are found working somewhere else. Such employees will be earmarked\nby the management and the C.B.A will convince the workers not to follow this\nillegal practice and will also take up the matter with the Social Security\nDoctor to stop such practice and will not to support the workers in any case\nbefore any legal forum.\u003C\u002Fp>\n\n\u003Cp>G. It is agreed between the parties that subject to the terms and conditions\nincorporated in this Memorandum, all other terms and conditions of service,\nfacilities and benefits (not addressed \u002F modified \u002F revised herein and \u002F or\nremain unchanged) in terms of earlier signed with the union and existing \u002F\nunchanged as on the date of signing this Memorandum will continue to remain\napplicable in the same manner and conditions.\u003C\u002Fp>\n\n\u003Cp>Benefits\u002F Allowances Being Granted under this Settlement\u003C\u002Fp>\n\n\u003Ch2>1) Increase in Pay:\u003C\u002Fh2>\n\n\u003Cp>Agreed that Rs. !2,000\u002F- (Rupees twelve thousand only) as Special Dearness\nAllowance (S.D.A) per worker per month will be paid to all the existing\nregular\u002Fpermanent employees Grade I - × w.e.f. 1st July, 2013 and the\nsettlement will not be applicable to the employees confirmed in regular service\nafter 1.7.2013.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>i.
