Mr. Akbar Ali - Executive Member, Mardan\u003C\u002Fp>\n\n\u003Cp>Short Recital of the Case\u003C\u002Fp>\n\n\u003Cp>Whereas the Union along with its letter dated: January 1, 2015 submitted to\nthe Company a Charter of Demands in accordance with the provisions of the\nIndustrial Relations Act, 2012 and the Rules framed under.\u003C\u002Fp>\n\n\u003Cp>And whereas the Company under cover of its letter #. HRD\u002FM&amp;P\u002F879\u002F2014\ndated December 29, 2014 also served a Charter of Demands on the Union\n(C.B.A).\u003C\u002Fp>\n\n\u003Cp>And whereas pursuant to the aforesaid Charter of Demands, Industrial Dispute\nhaving arisen; a number of meetings were held between both the parties during\nthe period extended up to May 14, 2015.\u003C\u002Fp>\n\n\u003Cp>And whereas during the bilateral negotiations the Union pleaded inflation\nand rise in the cost of living as a basis and justification for the acceptance\nof their demands which fact was also recognized by the Company.\u003C\u002Fp>\n\n\u003Cp>And whereas the Company and the Union inn full and final settlement of all\ntheir demands and claims raised or which could have been raised by the Union\nand the Company in the above referred to Charter of Demands and during the\nbilateral negotiations have settled all the disputes as per following\nSettlement.\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE THIS SETTLEMENT HEREBY WITNESSETH AS FOLLOWS:\u003C\u002Fp>\n\n\u003Cp>TERMS OF THE SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>The following has been mutually agreed upon between the Company and the\nUnion.\u003C\u002Fp>\n\n\u003Ch2>1. BASIC PAY, HOUSE RENT ALLOWANCE AND CONVEYANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>Keeping in view of inflation and the rise in the cost of living, all workers\non payroll as on the date of the signing of this Settlement will be given an\nincrease in their Basic Pay, House Rent Allowance and Conveyance Allowance\nw.e.f. January 1, 2015 or date of joining as the case may be, as per details\ngiven below:\u003C\u002Fp>\n\n\u003Cp>a. HOUSE RENT ALLOWANCE (H.R.A)\u003C\u002Fp>\n\n\u003Cp>From Rs. 1,725\u002F- to Rs. 2,250\u002F- per month (increase of Rs. 525\u002F-)\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>c. CONVEYANCE ALLOWANCE (C.A)\u003C\u002Fp>\n\n\u003Cp>From Rs. 995\u002F- to Rs. 1,520\u002F- per month (increase of Rs. 525\u002F-)\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions related to above mentioned House\nRent Allowance and Conveyance Allowance shall remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. SPECIAL UP-COUNTRY DAILY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>a. (Up-Country Deliverymen and Drivers only – with Night Stay)\u003C\u002Fp>\n\n\u003Cp>The Company will give Up-Country Deliverymen and Drivers a Special\nUp-Country Daily Allowance and the same will be paid at the flat rate Rs. 285\u002F-\n(Rs. Two Hundred Eighty-Five only) instead of Rs. 215\u002F- (Rs. Two Hundred &amp;\nFifteen only) per actual days worked, when according to the tour program an\nover-night stay at the town away from their head-quarters\u002Fbase town is\ninvolved.\u003C\u002Fp>\n\n\u003Cp>b. (Up-Country Deliverymen and Drivers only – with Night Stay)\u003C\u002Fp>\n\n\u003Cp>The Company will give to Up-Country Deliverymen and Up-Country Drivers a\nSpecial Up-Country Daily Travelling Allowance and the same will be paid at the\nflat rate of Rs. 205\u002F- (Rs. Two Hundred and Five only) instead of Rs. 170\u002F-\n(Rs. One Hundred and Seventy only) per actual days worked, when according to\nthe tour program they are not required to make an over-night stay.\u003C\u002Fp>\n\n\u003Cp>c. (Marketing Allowance – Local Deliverymen and Drivers only)\u003C\u002Fp>\n\n\u003Cp>The Company will give Local Deliverymen and Drivers a Local Daily Allowance\nand the same will be paid at the flat rate of Rs. 400\u002F- (Rs. Four Hundred only)\nper month instead of Rs. 365\u002F- (Rs. Three Hundred Sixty-Five only) on actual\ndays worked.\u003C\u002Fp>\n\n\u003Cp>All other exiting terms and conditions in this connections shall remain\nunchanged.\u003C\u002Fp>\n\n\u003Ch2>3. HELPER TO THE DELIVERY STAFF\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that an Allowance of Rs. 160\u002F- instead of Rs. 140\u002F- would\nbe paid to the respective Deliverymen for delivered orders at more than 45\nshops (irrespective of No. of Cash Memos) in case of Company’s Vehicle, and\nmore than 38 shops (irrespective of No. of Cash Memo) in case of Contractor’s\nVehicle.\u003C\u002Fp>\n\n\u003Cp>However, in case a helper is provided subject to the availability, the\nallowance of Rs. 160\u002F- would not be paid to the respective Deliveryman.\u003C\u002Fp>\n\n\u003Cp>All other existing terms and conditions in this connection shall remain\nunchanged.\u003C\u002Fp>\n\n\u003Ch2>4. LATE WORKING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>a. (Local Deliverymen and Drivers only)\u003C\u002Fp>\n\n\u003Cp>The Company will give to Local Deliverymen and Drivers a Late Working\nAllowance for working late after normal working hours to complete the work\nassigned to them for the day and the same will be paid at the flat rate of Rs.\n875\u002F- (Rs. Eight Hundred Seventy-Five only) per month, instead of Rs. 750\u002F-\n(Rs. Seven Hundred Fifty only).\u003C\u002Fp>\n\n\u003Cp>With this payment, the Union and\u002For the workers concerned will have no\nfurther right to claim any additional payment whatsoever for working late after\nnormal working hours.\u003C\u002Fp>\n\n\u003Cp>The Deliverymen and Drivers will ensure that the work assigned to them for\nthe day is completed without fails.\u003C\u002Fp>\n\n\u003Ch2>5. UNIFORMS, SHOES\u002FSOCKS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-protectiveclothing\">\u003Cp>a. The Company will continue to provide two sets of summer uniforms and two\nsets of winter uniforms consisting of shalwar and kameez every year to all the\nconfirmed Deliverymen, Drivers, Packers, Peons, Gate Keepers, Chowkidars and\npermanent Sweepers.\u003C\u002Fp>\n\n\u003Cp>It is further agreed that the cost per summer and winter uniform will be\npaid @ Rs. 900\u002F- (Rs. Nine Hundred only) per set instead of Rs. 650\u002F- (Rs. Six\nHundred Fifty only). The total cost of four sets of uniforms will not exceed\nRs. 3,600\u002F- (Rs. Three Thousand Six Hundred only) in a year.\u003C\u002Fp>\n\n\u003Cp>It is also agreed that the Company will arrange supply of stitched uniforms\nto the eligible workers through the Depots. The cost of cloth and the\nstitching, etc. of summer\u002Fwinter uniform shall be within the above mentioned\nlimit and the Company will not allow any additional increase over and above to\nthe approved limit. One Representatives of Union (C.B.A) will accompany with\nDepot Manager for selection of cloth.\u003C\u002Fp>\n\n\u003Cp>b. SHOES &amp; SOCKS\u003C\u002Fp>\n\n\u003Cp>The Company will continue to pay a sum of Rs. 500\u002F- (Rs. Five hundred only)\ninstead of Rs. 450\u002F- (Rs. Four hundred fifty only) per annum, in lieu of shoes\nand socks to those workers who are entitled to uniforms.\u003C\u002Fp>\n\n\u003Cp>If a worker\u002Fworkers who have been provided with the uniform and have also\nbeen paid agreed amount for shoes and socks, report for duty without wearing\nthe current uniform, the concerned Manager\u002FIncharge will have the discretion to\nrefuse to take him\u002Fthem on duty on such days.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>6. WASHING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>The Company will continue the existing arrangement for getting the uniform\nwashed at Head Office, Karachi. At other Establishments, the Company will pay\nRs. 325\u002F- (Rupees Three Hundred Twenty-Five only) per month instead of Rs.\n280\u002F- (Rs. Two Hundred Eighty only) per month Washing Allowance to those\nworkers who are entitled to uniforms.\u003C\u002Fp>\n\n\u003Ch2>7. GRATUITY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The Company will continue to pay gratuity for 30 days in accordance with the\nModified Gratuity Scheme, dated 11-04-1973. It is further agreed that the limit\nof maximum days of entitlement to the payment of gratuity will 440 days instead\nof 432 days.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. LOAN FOR MOTORCYCLE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. The Company will grant loan for the purchase of new motorcycle to (21)\nTwenty-One permanent workers instead of (18) workers every year to the extent\nof Rs. 40,000\u002F- (Rs. Forty Thousand only). The Union and the Company will\nselect (21) workers entitled to this loan. The concerned workers must have a\nminimum of ten years of continuous service to be entitled to this facility. The\nloan will be deducted in 40 monthly equal installments. The Road Tax,\nInsurance, Maintenance Charges, etc. will be borne by the concerned worker. The\nmotorcycle will be registered in the name of the Company till the loan is\nrepaid in full by the worker. The Company will disburse the loan of Rs.\n40,000\u002F- (Rs. Forty Thousand only) after the selected worker has deposited the\nbalance amount required to purchase a new motorcycle a worker will be eligible\nto the motorcycle loan only once in service. Unpaid loan amount shall be\nadjusted against his legal dues in case retirement, termination of service,\ndismissal or death.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. LOAN IN LIEU OF MOTORCYCLE\u003C\u002Fp>\n\n\u003Cp>If a selected worker request in writing to allow him to utilize Rs. 40,000\u002F-\n(Rs. Forty Thousand only) for any other purpose, instead of purchasing\nmotorcycle, he will be paid Rs. 40,000\u002F- (Rs. Forty Thousand only) as loan on\nthe same terms and conditions for payment as mentioned in Clause-10(a),\nprovided he has no outstanding loan from Provident Fund. The Provident Fund of\nsuch worker will be treated as a security for such loan is outstanding. In case\nsuch worker insists on loan from Provident Fund, the loan from Provident Fund\nwould be granted only after the balance amount of the loan granted under the\nprovision of this article is repaid.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Such worker will not be granted any other loan from the Company till the\namount of Rs. 40,000\u002F- is fully paid by him.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The workers will be required to execute an agreement and\u002For surety bond as\nper requirement of the Company from time to time.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>This loan will be given to a worker only once during his service. Unpaid\nloan amount shall be adjusted against his legal dues in case of retirement,\ntermination of service, dismissal of death.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. INTEREST FREE LOAN OF SMALL AMOUNT\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that the fund allocated for the interest free small\nloans will remain the same i.e. Rs. 80,000\u002F- (Rs. Eighty Thousand only) the\nmaximum amount of loan to a worker at a time will not exceed Rs. 4,000\u002F- (Rs.\nFour Thousand only) and this loan will be given only to those permanent workers\nwho have completed at least three-years continuous service. The workers who\nhave not completed three-years continuous service are not entitled to avail\nthis facility. This loan will be deducted in 10 equal monthly installments. It\nis also agreed that this loan will be given a worker only once during the\ntenure of this Settlement i.e. from 01-01-2015 to 31-12-2016.\u003C\u002Fp>\n\n\u003Ch2>10. TRANSFERS\u003C\u002Fh2>\n\n\u003Cp>a. The worker will be entitled to a one-time payment of Rs. 4,100\u002F- (Rs.\nFour Thousand One Hundred only) instead of Rs. 3,800\u002F- (Rs. Three Thousand\nEight Hundred only) when the Company on its own discretion, transfers him from\none city to another city.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. However, it is agreed that workers will not be entitled to this Allowance\nif a transfer is made on their own request.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. SPECIAL INCREMENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>It is agreed that the Workers who completed 15-years of service, 20 years of\nservice and 25 years of service will be paid special increment as follows:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The above rates will be effective from January 1, 2015.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>12. MERGER OF COLA’S\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the existing amount of COLA’s being paid to various\nworkers (maximum Rs. 475\u002F-) will be merged in their existing basic pay.\u003C\u002Fp>\n\n\u003Cp>It has also been agreed that the Union Representatives\u002Fworkers will not\nraise any demand for payment of COLA’s in future which have been merged in\ntheir basic pay.\u003C\u002Fp>\n\n\u003Ch2>13. LEAVE ENCASHMENT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>It is agreed that the Company will encash the Privilege Leave up to maximum\nof 30 days once in a Calendar year if so requested by the worker when Privilege\nLeave due to him 40 days (instead of 45 days) above days.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>14. DURATION OF SETTLEMENT\u003C\u002Fh2>\n\n\u003Cp>It is agreed by the Company and the union that this settlement will remain\nin force and binding upon the parties and their successors for a period of two\nyears commencing from January 1, 2015 and ending on December 31, 2016.\u003C\u002Fp>\n\n\u003Ch2>15. EFFECTIVE DATE OF BENEFITS\u003C\u002Fh2>\n\n\u003Cp>All benefits, facilities and terms of employment conferred under this\nsettlement will be effective from January 1, 2015 unless and except as\nspecifically provided otherwise.\u003C\u002Fp>\n\n\u003Ch2>16. FINALITY\u003C\u002Fh2>\n\n\u003Cp>a. It is agreed that the benefits under this Settlement is the total\nfinancial burden taken by the Company during the operative period of this\nSettlement and this Settlement has taken in view the anticipated increase in\nwages, the Cost of Living Allowance, Special Allowance or otherwise which may\nbe allowed by the Government by any order or law during the operation of this\nSettlement and the same shall be set off against the benefits of this\nSettlement and only the difference, if any, after such set off\u002Fadjustment shall\nbe payable to the workers and this condition forms the basis of giving benefits\nby the Company to the workers under this Settlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. This Settlement is in full and final settlement of all the demands raised\nor could have been raised by the Union in the respective Charter of Demands,\n(attached as Annexure ‘A’ and Annexure ‘B’ referred to above) and\u002For\nraised during the course of bilateral negotiations. It is further agreed that if at a future date\u002Ftime, any trade union\neither provincially registered or registered as an industry-wise trade union is\ndeclared to be a “Collective Bargaining Agent” if a new union is formed or\nany other trade union comes into existence or the Union loose its character of\ncollective bargaining agent, the finality, validity and sanctity of this\nCollective Settlement shall neither be adversely affected nor shall it be\nchallenged directly or indirectly by the workmen, in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. The company as a gesture of good will and in consideration of the Union\narriving at a peaceful Settlement has agreed to make a one-time payment of Rs.\n100\u002F- (Rs.
