Bakhat Ali - Treasurer\u003C\u002Fp>\n\n\u003Cp>KOHINOOR SOAP &amp; DETERGENT EMPLOYEES UNION Karachi in its capacity and\nthe Collective Bargaining Agent of ‘Workers’ (hereinafter referred to as\nthe ‘C.B.A’ served; Charter of Demands dated 01-01-2014 U\u002FS 35(1) of\nS.I.R.A. 2013 and a notice of conciliation dt. 17-01-2014 purporting to be U\u002FS\n35(3) of S.I.R.A. 2013.\u003C\u002Fp>\n\n\u003Cp>As a consequence of the said notice conciliation, conciliation proceedings\nwere held under auspices of the conciliator West Division. Government of Sindh,\nKarachi. As a result of conciliation proceedings extended over several joint\nmeetings and extended from time to time with mutual consent. The following\nagreement has been arrived at in full and final settlement of all the demands\nraised by and on behalf of the ‘WORKERS’ as on the date of signing of this\nsettlement.\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Ch2>1.\u003C\u002Fh2>\n\n\u003Cp>That with effect from January, 1st 2014, the Basic wages of all permanent\nworkmen who are in the employment of the Company on the date of execution of\nthis settlement will be increased as under:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Unskilled worker\u003C\u002Ftd>\n      \u003Ctd>Rs. 1600\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Semi-Skilled worker \u003C\u002Ftd>\n      \u003Ctd>Rs. 1700\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Skilled worker\u003C\u002Ftd>\n      \u003Ctd>Rs. 1800\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>It is agreed that workmen employed after the execution of this settlement\nwill not be entitled to receive this increase but will be given existing grades\nof wages applicable to them.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2.\u003C\u002Fh2>\n\n\u003Cp>That w.e.f. January, 1st 2014 existing rate of house rent of the permanent\nworkmen employed at the Factory and who are in the employment of the company on\nthe date of execution this ‘Settlement’ will be increased as under:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Unskilled worker\u003C\u002Ftd>\n      \u003Ctd>Rs. 960\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Semi-Skilled worker \u003C\u002Ftd>\n      \u003Ctd>Rs. 1020\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Skilled worker\u003C\u002Ftd>\n      \u003Ctd>Rs. 1080\u002F- per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>This increase will be effective from 01-01-2014 of those permanent\n‘Workmen’ who are on the roll of the ‘Company’ on the day of signing of\nthis Settlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4.\u003C\u002Fh2>\n\n\u003Cp>That with effect from 01-01-2014 the Attendance Allowance will be paid Rs.\n250\u002F- per month only those permanent workmen will be entitled for this\nAttendance Allowance who will not avail more than 2 days of any type of leave\nwith pay in any month. No attendance Allowance will be paid in case of absence\nwithout pay of single day even in the month.\u003C\u002Fp>\n\n\u003Ch2>5.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>Bonus will be paid at the rate of ONE MONTH and seventy three days skilled\nand semi-skilled workers and ONE MONTH and seventy seven days for unskilled\nworkers on basic wages excluding allowances for the financial year July-June\npayable in January, 2014 and January, 2015 respectively to all those\n‘Workmen’ who have completed ‘ONE YEAR’ Service on December each year.\nIt is agreed that in one month ‘BONUS’, the amount of COLA will be\nincluded. ‘Workmen’ who have or had rendered 90 days or more continuous\nservice during each such year shall be paid the above amount on prorata basis.\nWorkmen having less than 90 days service will not be entitled to receive any\n‘BONUS’.\u003C\u002Fp>\n\n\u003Cp>It is expressly and clearly agreed that payment of ‘BONUS’ as aforesaid\nshall be inclusive of and in complete discharge of ‘BONUS’ payment under\nStanding Order 10-C of the West Pakistan Industrial and Commercial Employment\n(Standing Orders) Ordinance 1968. It is further agreed that no claim for\n‘BONUS’ whether on the basis of profit or otherwise will be raised by the\nC.B.A in respect of the aforesaid years. The basis of payment will be as in the\npast.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>It is agreed that as under the present settlement, the total\u002Foverall\nincrease if any, in monthly emoluments to be agreed in all future settlements\nshall also be divided among the head of the Basic. Conveyance Allowance and\nHouse Rent in the proportion\u002Fpercentage as shown below.\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Basic\u003C\u002Ftd>\n      \u003Ctd>50%\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Conveyance\u003C\u002Ftd>\n      \u003Ctd>20%\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>House Rent\u003C\u002Ftd>\n      \u003Ctd>30%\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>It is also agreed that no increase\u002Fchange in the above agreed percentage\nwill be made on demanded by C.B.A Union.\u003C\u002Fp>\n\n\u003Ch2>6.\u003C\u002Fh2>\n\n\u003Cp>It is specifically understood and agreed that any monetary increase(s) in\nwages, allowance or otherwise whether on account of rising cost of living or\notherwise which may be granted allowed by any legislation during the currency\nof this settlement shall be liable to be adjusted against the monetary increase\ngranted under this settlement under head of basic, conveyance, attendance and\nor house rent as the company decide, so that the C.B.A union\u002Fworker may elect\nto receive the relevant legislated monetary benefit and forego so much of the\nsum total of the monetary increase granted under this settlement, as does not\nexceed the monetary benefits granted under the relevant legislation.\u003C\u002Fp>\n\n\u003Ch2>7.\u003C\u002Fh2>\n\n\u003Cp>ALL WORKMEN who are entitled for a ‘WOOLEN JERSEY’ in two years (i.e.\nexcluding those workmen who are provided with ‘WOOLEN JERSEY’) will be paid\nRs. 1,100\u002F- in lieu of the Woolen Jersey due for the calendar year 2013 and\n2014. The payment of Rs. 1,100\u002F- will be made by the end of November, 2014.\u003C\u002Fp>\n\n\u003Ch2>8.\u003C\u002Fh2>\n\n\u003Cp>It is agreed to provide in the month of August of every year a total amount\nof upto Rs. 50,000\u002F- (Rupees Fifty Thousand only) for two employees only\npurchasing two motorcycles at price not exceeding Rs. 25,000\u002F- (Rupees\nTwenty-Five Thousand only) for each. An employee who may be granted such loan\nshall repay the same in monthly installment of Rs. 850\u002F- which shall be\ndeducted from his wages every month. In view of the amount of loan and of the\nmonthly installment, only an employee with Ten or more years rendered services\nwill be entitled to submit his application to the Management (to join in the\nlot to be drawn for motorcycle) provided he agreed to create a lien in favor of\nthe Company concerned in respect of all his finalized dues such as\n‘GRATUITY’ Provident Fund etc. as the case may be besides agreeing to abide\nby the rules which have been framed by the Company in this behalf full secured\nand indemnify the company in respect of repayment of the loan. The employee\nconcerned shall purchase a Motorcycle within a month from the day of payment of\nloan and produce relevant documents to the Management in evidential proof of\npurchase. In case the said amount runs short for purchase of Motorcycle, the\nemployee concerned shall be bound to pay the discrepancy to the ‘SELLER’\nconcerned. The employees concerned shall before taking such load, provide\nwritten GUARANTEES of two employees acceptable to the Management for immediate\nrepayment of the loan or balance thereof. In case the employee taking the loan\nmakes any default in repayment of the loan or any instalment at any stage, the\nwhole load shall become repayable forthwith by the employee in case his\nemployment comes to an end for any reason whatsoever, it is specifically agreed\nthat this Motorcycle to be purchased shall be for in the personal use only of\nthe workmen obtaining the loan. If this condition violated the whole unpaid\nloan shall become repayable forthwith.\u003C\u002Fp>\n\n\u003Ch2>9.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that an amount of Rs. 1,285\u002F- will be paid Uniform in the month\nof June, every year all workmen except Maintenance Department workmen shall be\npaid an amount of Rs. 1,877\u002F- excluding Boiler House for Uniform in the month\nof June every year. Boiler House workmen shall be paid same as all other\nworkmen.\u003C\u002Fp>\n\n\u003Cp>10.The existing extra duty allowance of Drivers and Chowkidars performing\n(12) hours duty will be raised from Rs. 1,140\u002F- to Rs. 1,500\u002F- and Rs. 1,120\u002F-\nto Rs. 1,500\u002F- per month respectively w.e.f. 01-01-2014.\u003C\u002Fp>\n\n\u003Cp>*****\u003C\u002Fp>\n\n\u003Cp>GENERAL\u003C\u002Fp>\n\n\u003Cp>The settlement shall become effective and come into operation w.e.f.\nJanuary, 1st 2014 and shall remain in full force up to 31st December, 2015. In\nconsideration of the benefits allowance under this settlement of C.B.A agrees\nand undertakes that it will not raise during the operative period of this\nsettlement.\u003C\u002Fp>\n\n\u003Cp>A. Any demand involving financial implications directly or indirectly\nwhatsoever on the Company.\u003C\u002Fp>\n\n\u003Cp>B. Any of the demands contained in the Charter of Demands submitted by the\nC.B.A hereto subject to what has been agreed above and any other demands will\nbe deemed to have been dropped and\u002For withdrawn by the C.B.A and these will not\nbe raised again in any from whatsoever during the period of operation of this\nsettlement. The benefits granted under this settlement will be given to\npermanent workmen only.\u003C\u002Fp>\n\n\u003Cp>The C.B.A hereby also agrees:\u003C\u002Fp>\n\n\u003Cp>1. To co-operate with the Management of the Company in maintaining\ndiscipline and industrial peace in the establishment.\u003C\u002Fp>\n\n\u003Cp>2.
