Sajjad.....Propaganda Secretary\u002F Finance Secretary\u003C\u002Fp>\n\n\u003Cp>Mr. Rehman Ziarat Gul.....Member Managing Committee\u003C\u002Fp>\n\n\u003Cp>Mr. Saqib Ali.....Member Managing Committee\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>Whereas the C.B.A under its covering letter dated 31st December, 2014\nsubmitted a Charter of Demands to the Company under section 42(2) of I.R.A,\n2012.\u003C\u002Fp>\n\n\u003Cp>Whereas the parties hereto held series of meetings in this behalf and\ndiscussed the said charter of demands and other matter of mutual interest\nincluding company’s financial and market condition.\u003C\u002Fp>\n\n\u003Cp>AND\u003C\u002Fp>\n\n\u003Cp>Whereas after series of bilateral negotiations held in between the\nrepresentatives of the company and office bearers of the Collective Bargaining\nAgent \u002FCBU over the issues of demands, taking into consideration in the rise of\ncost of living, Company’s financial position, market conditions and other\nmatter of mutual interest the Union and the company have reached at the\nfollowing full and final settlement of all demands and claims as contained in\nthe charters of demands dated 31st December, 2014.\u003C\u002Fp>\n\n\u003Cp>RE: UNION’S CHARTER OF DEMANDS\u003C\u002Fp>\n\n\u003Ch2>DEMAND NO. 1: HAJJ\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that the Company will bear the cost\u002F expenses in\nrespect of three permanent workers every year for the Hajj and one worker for\nUmrah for every year by air (economy class which cost\u002Fexpenses will include\nfare, boarding and lodging as per government Hajj policy). In case of\nentitlement of bonuses only the permanent workers who will be on the\ncompany’s regular payroll at the time of distribution will be paid such\nbonuses as under:\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 30 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of May,\n2015.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 45 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of July,\n2015 (Eid ul Fitr).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 30 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of\nSeptember, 2015 (Eid ul Azha).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 30 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of May,\n2016.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 45 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of July,\n2016 (Eid ul Fitr).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• One bonus equivalent to 30 days of basic salary plus House rent and cost\nof living allowance of the permanent worker may be paid in the month of\nSeptember, 2016 (subject to appearance of Eid ul Azha Moon).\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed and clearly understood between the parties hereto that\nthe aforesaid bonuses shall be inclusive of the bonus payable understanding\norder 10-c of the West Pakistan Industrial &amp; Commercial Employment\n(Standing Order) Ordinance, 1968 and the amount mentioned and accordingly the\nCompany shall be absolutely and fully absolved of any liability under the\nstanding order referred to herein above for the settlement period or on any\nground whatsoever.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>DEMAND NO. 5: UNIFORM\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>It is mutually agreed that the Company will give two sets of uniform of\naverage quality (maximum cost Rs. 400\u002F- each) (Shalwar Kameez or Pant Shirt) to\nevery permanent worker who will be on Company’s regular payroll on the\nsigning date of this agreement. Uniform for the year 2015 will be provided in\n2016 to its permanent workers who will be on Company’s regular payroll on the\nday of distribution of uniform in this behalf. It is also mutually agreed that\nwhen workers wil be in the factory for work they must be in uniform.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>DEMAND NO. 6: SHOES\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that the Company will provide once in a year one pair\nof shoes, on the sole discretion of the Management, to its every permanent\nworker who will be on Company’s regular payroll at the time of distribution.\nThe shoes for the year 2015 will be given in 2016 (Maximum cost of the shoes\nthat will borne by the company would be Rs. 400\u002F- per pair).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>DEMAND NO. 7: EID-E-MILAD-UN-NABI (S.A)\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It is mutually agreed that the Company will pay the amount of\nEid-e-Milad-un-Nabi (S.A) from existing Rs. 100,000\u002F- (Rupees one hundred\nthousand only) per annum.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>DEMAND NO. 8: OPERATION PERIOD OF SETTLEMENT\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that the operation period of this agreement shall be\nfrom 1st January, 2015 to 31st December, 2016 and the settlement date shall be\nbinding on both the parties hereto, their successors, assigns, replacement,\nnominees and representatives including workers of the factory. It is mutually\nagreed that all the benefits and provision as contained in this settlement\nshall be paid effective from the date of signing of the settlement or as\nmentioned against each.\u003C\u002Fp>\n\n\u003Ch2>DEMAND NO. 9: PRODUCTION\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that subject to the benefits so agreed in settling the\ndemand rose by the C.B.A\u002FCBU Union the workers will increase target production\nof Tiles in Glost as follows from the date of signing of this agreement.\u003C\u002Fp>\n\n\u003Cp>6500 m2 of 8x8 tiles (working days 30 per month)\u003C\u002Fp>\n\n\u003Cp>6500 m2 of 8x12 tiles (working days 30 per month)\u003C\u002Fp>\n\n\u003Cp>6500 m2 of 10x13 tiles and all sizes.\u003C\u002Fp>\n\n\u003Cp>It is further agreed that the production in the factory will be a continuous\nprocess twenty-four hours, with no shift change over breakdown. Shift\nchange-over will take place inside the factory in their effective\ndepartment.\u003C\u002Fp>\n\n\u003Cp>It is also further agreed that in the interest of production, the C.B.A\u002FCBU\nunion assured that the CBU\u002FC.B.A Union and Workers will cooperate with the\nmanagement to produce quality products, minimum 90% Prime and Standard\nquality.\u003C\u002Fp>\n\n\u003Cp>Other Production Targets:\u003C\u002Fp>\n\n\u003Cp>65 cars from Kiln per day\u003C\u002Fp>\n\n\u003Cp>65 cars from Glaze line per day\u003C\u002Fp>\n\n\u003Cp>6500 m2 per day from press\u003C\u002Fp>\n\n\u003Cp>6500 m2 per day from Biscuit Kiln\u003C\u002Fp>\n\n\u003Cp>It is also mutually agreed the Glaze, Engobes etc. for the increased\nproduction target and incentive also.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed that department will work to achieve the increased\nproduction. Likewise, all other departments shall also increase the existing\nproduction proportionately.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed Tiles Ware House workers will deliver first one\nvehicle without over time.\u003C\u002Fp>\n\n\u003Cp>It is also mutually agreed that increase in Basic Wages as per Demand No. 2\nand other Allowances as per Demand No. 3, of the Charter of Demand and\nproduction targets, (attendance) allowance will be subject to Production Target\nas set above. In case production is decreased below target, the workers will\nget benefits accordingly and their Basic Pay and other allowances as well as\nproduction target will be decreased in proportionate with decrease in\nproduction.\u003C\u002Fp>\n\n\u003Ch2>DEMAND NO. 10: CATEEEN\u003C\u002Fh2>\n\n\u003Cp>Canteen rates to be increased as per list attached.\u003C\u002Fp>\n\n\u003Cp>GENERAL\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The Union has given assurance to cooperate with the management to minimize\novertime in the factory in order to reduce cost of production.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed that the workers going of factory will obtain written\npermission from head of department or manager and will also deliver attendance\ncard in gate office.\u003C\u002Fp>\n\n\u003Cp>The Union of behalf of worker hereby undertake to give full cooperation and\nsupport to the Company\u002F Management for maintaining industrial peace and\ndiscipline and achieving increase in production &amp; improvement in quality,\nthe union shall ensure that all the workers including union office bearers\nshall attend to their duties whole heartedly and shall at their respective work\nplace and perform work\u002Fduty during the working hours so as to maximize\nproduction and improve the quality of the production. All the Union activity\ni.e. meeting\u002F discussions be carried out after duty hours. The Company \u002F\nManagement on its part also undertakes to continue to give its full\ncooperation\u002F support to the growth of healthy trade unionism in the company\nwithin the limits of law.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed that the Union will cooperate with Management so that\nthe canteen hours be strictly observed and any worker found sitting in canteen\nin off hours will be dealt with according to law.\u003C\u002Fp>\n\n\u003Cp>The Company\u002F Management will also consider job application of the legal heir\nof the deceased worker for employment provided he attains the age of 18 years\nand suitable for the job available.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed that this agreed is in full and final settlement of\nall the demands and claims up to date including Union Charter of Demands.
