Ltd\nUnited Workers Union, (CBA) submitted a charter of demand dated 20.10.2014\nconsisting 07 demands under Section 35 (1), SIRA, 2013, due to frustration and\ndejection amongst the old workers who would not be benefitted by the new\nminimum wage limit of Rs. 12,000 pm announced by the Sind Govt as their wages\nwere already around this unit due to long period of service but each new worker\nwould receive an increase of Rs.2000 pm although both were badly hit by\ninflation equally. Besides, the CBA Union has further stressed that although\nthe provincial government announced enhancement of minimum wages effective\n01.07.2014, but no notification has so far been issued and therefore, the\nmanagement did not increase the wages and since the management has taken the\nsaid request of CBA into consideration and at the same time, the CBA has\ncategorically agreed that in case the management increase the wages of workers\nat the par of expected increase in the minimum wages during the year 2014, they\nshall not demand any further increase particularly to enhance the salary\u002Fwages\nof the workers if the same is not less than the proposed and incoming increase\nin the Minimum Wages. This matter was also discussed between the management and\nCBA Union who have further agreed the formula to increase wages\u002Fsalaries of old\nworkers who were on the roll of the company on 31.12.2012 and new recruited\nworkers effective 01.01.2013 till date with some difference. Due to present\nsituation, the CBA felt deeply concern which has also badly effecting the day\nto day production and in such situation, the management also intend to overcome\nand give some relief to the workers so as to maintain cordial atmosphere in the\nfactory and maintain good and harmonious relations with the CBA Union and\nworkers as well. Since the CBA Union after receipt of afore-mentioned notice of\ndemand has vigorously approached the management to cope up with such situation\nand particularly for the reason that the old workers may not be deprived due to\nthe said proposed increase in wages, joint meetings between the management and\nrepresentatives of CBA Union held wherein the matter was discussed at length\nand taking into consideration all pros and cons of the matter, the management\nhas agreed to sign a new agreement of settlement which would be effective from\n1st July, 2014 to 3rd June, 2016, to which the CBA Union has also agreed. Apart\nfrom above during the course of joint meetings, the whole charter of demand\nsubmitted by CBA Union was discussed in the light of financial constraints of\nthe company due to enormous increase in the overall cost of production due to\nvarious other factors including the proposed enhanced minimum wages. The\nmanagement, however, realizing need for allowing reasonable increase in wages\nof all workers due to ever increasing cost of living as a result of high\ninflation, agreed to enter into an agreement of settlement. Finally, both the\nparties agreed in the meeting held on 11th November, 2014, to the following\nterms of settlement which should take place from 1st July, 2014, for a period\nof two years i e., up to 3rd June, 2016. The benefits under this agreement will\naccrue to all the workers of the factory who are in service of the company at\nthe time of signing of this Agreement, i.e. on 13th November, class=\"cbaClause highlight\" id=\"clause-LOWWAGE_trigger\">\u003Cp>a) In case the federal or provincial government allows any increase in the\nwages\u002Fsalaries and\u002For allowances during the currency of this settlement, the\nsame shall be adjusted and the workers\u002Femployees would not be paid less amount\nto that of minimum wages so allowed by the said government.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>b) The Company and CBA Union have settled all the demands raides by the CBA\nUnion vide their Charter of Demands dated 20.10.2014 as mentioned\nhereinabove.\u003C\u002Fp>\n\n\u003Cp>c) The demands of the CBA Union which are not specifically agreed to in this\nsettlement shall be deemed to have been withdrawn for which the union agreed\nnot to press the same in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>d) All other terms and conditions and benefits presently enforced which are\nnot altered, changed and\u002For modified by this settlement, will continue binding\nas per existing and prevalent terms and conditions.\u003C\u002Fp>\n\n\u003Cp>e) The CBA Union and through it, all employees\u002Fworkmen employed and working\nin the factory hereby undertake that they shall extend full cooperation to the\nmanagement in maintaining the discipline, punctuality, daily attendance,\nindustrial peace, good order\u002Fconduct and also to increase production and to\nmaintain production target at their best and further try to increase the same\nso far as possible.\u003C\u002Fp>\n\n\u003Cp>f) The CBA Union has also undertake thatl in case the required\nproduction\u002Fstandard and\u002For the target IS not maintained and achieved, the\nmanagement is at its discretion to take appropriate action and to proceed and\ninitiate disciplinary action against who so ever would be involved in such\nmatter which may also result in termination of their services in accordance\nwith the provisions of law.\u003C\u002Fp>\n\n\u003Cp>g) The CBA Union has also agreed to ensure the punctuality in attendance and\nalso to avoid absenteism or late attendance by the employees\u002Fworkmen.\u003C\u002Fp>\n\n\u003Cp>h) Since this agreement is being entered between the CBA Union and the\nmanagement purely as a special ease and circumstances, the union shall not\nquote this as a precedent in future.\u003C\u002Fp>\n\n\u003Cp>i) The CBA Union has further undertakes not to raise ot submit any demand(s)\nto the management having financial implications\u002F impact or otherwise during\ncurrency of this settlement.\u003C\u002Fp>\n\n\u003Cp>j) The CBA Union has further agreed not to interfere in the acts of\nadministration.
