Mr. Rasheed Khan - (Press \u002F Propaganda Secretary)\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE:\u003C\u002Fp>\n\n\u003Cp>This settlement is arrived on this 2nd day of June, 2014 at Karachi between\nM\u002Fs Helix Pharma (Pvt.) Ltd. (herein after called “ COMPANY” and Helix\nPharma (Pvt.) Ltd. Employees Union (herein after called “ THE C.B.A.\nUNION”), which expression wherever applicable for the purpose of this\nsettlement shall include and mean their successors assigns.\u003C\u002Fp>\n\n\u003Cp>Whereas the said CBA Union through its General Secretary Submitted a charter\nof demands dated January 01, 2014, U\u002FS. 35(1) of SIRA 2013. While the\nmanagement has also severed a Notice of demand under section 35(1), SIRA 2013,\nsimultaneously to the CBA Union vide letter dated 01. 01. 2014. Various\nmeetings for bilateral negotiations were held between the parties but due to\nadamant attitude of CBA office bearers, no settlement could be arrived at\nbetween the parties and the General secretary, CBA Union issued a Notice of\nStrike dated 28.01.2014 under section 35(3) SIRA, 2013 to the management, while\nthee management has also issued a Notice of Lock out dated 03.02.2014 under\nsection 35(3) SIRA, 2013 to the General Secretary CBA Union with copies\nendorsed to Area Conciliator and others were after, several conciliation\nmeeting were held before the Area Conciliator and demands raised by the CBA\nUnion and the management were discussed at length. Lastly a joint meeting of\nparties in presence of Area Conciliator was held on 27.05.2014 and the CBA\nUnion realizing the present situation have mutually agreed and in consequences\nwhereof the following settlement has been arrived between the parties being\nfull and final settlement of the afore-mentioned demands raised by the CBA\nUnion as well as by the management in their afore-said charter of demands and\nthe settlement has been concluded between the parties which as follows.\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Ch2>1. SALARY \u002F WAGES:\u003C\u002Fh2>\n\n\u003Cp>Taking into consideration the present inflation which has been increased\nconsiderably and as pointed out by the CBA, the management has agreed to grant\nan increase of Rs. 2900\u002F- per month on the basis that 50% of the said increase\nwill be credited in the basic salary\u002Fwages while the remaining balance of 50%\nof present increase will be adjusted in other allowances with effect from\n01.01.2014 to all permanent Workmen who were on the payroll of the company on\n1st January, 2014 and who have completed 12 months continuous service on the\nsaid date as workmen and are still in the employment of the company on the date\nof signing of this Settlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. ANNUAL INCREMENT:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>The Management has agreed to enhance the existing rate of Annual increment\nfrom 10% to 11% according to the following schedule. ATTENDANCE \u002F PUNCTUALITY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>a) Attendance \u002F Punctuality Allowance has been increased from Rs. 600\u002F- to\nRs. 700\u002F- (Seven hundred only) per month.\u003C\u002Fp>\n\n\u003Cp>b) A total grace time of 5 minutes per day will be allowed to all\nworkers.\u003C\u002Fp>\n\n\u003Cp>c) If any worker is late for more than 5 minutes grace time, for 5 days\nduring a month, then one half-day leave \u002F wages will be deducted. Such worker\nwill not be eligible for Attendance \u002F Punctuality Allowance during that\nparticular month.\u003C\u002Fp>\n\n\u003Cp>d) Worker availing more than one sick leave or casual leave (One half-day\nadditional leave in case of extreme eme4rgency) in a month will disqualify\nhimself\u002F herself for Attendance \u002F Punctuality allowance during that particular\nmonth.\u003C\u002Fp>\n\n\u003Cp>e) Worker reporting late for more than one hour after duty time will not be\nallowed to perform duty for that day.\u003C\u002Fp>\n\n\u003Cp>f) Relaxation may be given in case of public strike any natural calamity or\nany untoward situation in the city at the sole discretion of the management.\nHowever, habitual late comers will not be eligible for any relaxation.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. EMERGENCY RELIEF\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-funeralpay\">\u003Cp>The Management has agreed to revise Emergency Relief from Rs. 15,000\u002F-\n(Fifteen Thousand Only) to Rs. 25,000\u002F- (Twenty Five Thousand Only) which will\nbe given to the legal heirs of deceased workman who has died while in the\nemployment of the company. However, it shall not be treated as precedent in\nfuture.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. APPRECIATION REWARD\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>A workman who has full attendance in a year and does not avail any leave\nduring the financial year will be given an Appreciation Letter apart from cash\nreward which has been increased from Rs. 1500\u002F- (Fifteen hundred only) to Rs.\n2,000\u002F- (Two thousand only)\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. GRATUITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>The Management has agreed that if any worker having 22 years or more\nservice, retires, resigns or his services are terminated by the employer other\nthan for misconduct will be paid Gratuity of 43 days (30 days on gross and 13\ndays on basic plus COLAs)\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The quantum of payment of gratuity will be according to the following\nschedule:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>NO. OF YEARS IN CONTINUOUS SERVICE\u003C\u002Ftd>\n      \u003Ctd>GRATUITY APPLICABLE\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Up to 10 years \u003C\u002Ftd>\n      \u003Ctd>30 days\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>From 11 – 21 years\u003C\u002Ftd>\n      \u003Ctd>\u003Cp>36 days (30 days on gross &amp; 6 days on Basic + COLAs)\u003C\u002Fp>\n      \u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>22 years and above \u003C\u002Ftd>\n      \u003Ctd>43 days (30 days on gross &amp; 13 days on Basic + COLAs)\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. PROFIT BONUSES\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The management has agreed to pay annual Bonuses for the year ended 30th June\n2014 and 30th June 2015, in the event of profit only in accordance with the\nfollowing schedule\u002Fformula:-\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a)One and half Bonus on gross wages on financial year closing salary will be\npaid during the 4th week of Shaban.\u003C\u002Fp>\n\n\u003Cp>b)Bonus under Standing Orders 10-C of the Industrial and Commercial\nEmployment (Standing Orders) Ordinance, 1968 equal to one month’s gross wages\n&amp; half month gross wages \u002F salary on financial year closing salary as bonus\nwill be paid during early 1st week of Zil-hajj.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>NOTE: Due to situation arises during the month of June, 2014, when the\ncompany has to pay bonus as mentioned at Sr. No. (a) above during the fourth\nweek of Shaban while the financial year shall be completed on 30.06.2014, when\nthe holy month of Ramzan shall be commenced, the matter has been discussed\nbetween the parties and it has been amicably settled that the afore-said bonus\nmentioned at (a) may be distributed amongst the workers as advance in\nanticipation of declaring profit and in case the company sustains financial\nloss, such amount of bonus would be recovered in easy installments from the\nmonthly salary of workers.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8 – Health Insurance through Insurance Company.\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurancerelatives\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It has been agreed by the management that all eligible workers including\ntheir family members (spouse &amp; children) shall be insured for health\ninsurance viz hospitalization with any insurance company of Pakistan for which\nthe eligible workers shall supply authentic documentary proof of their spouse\nand children viz. Registration form issued by NADRA and in absence whereof no\nclaim in this regard shall be entertained.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9- Umrah\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It has been agreed by the management that only one worker shall be selected\nthrough balloting to perform Umrah for a period of 07 days in each financial\nyear in the event of profit for which the company shall bear such expenses\nwhile the worker concerned should provide his passport and other required\nantecedents to fill-up the requisite formalities. However, selection of tour\noperators shall be the sole discretion of the management.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10- SET OFF\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a)Since the increase in wages and other allowances has been given and\nincrease in attendance allowance has been allowed due to rise in cost of living\nand present inflation, therefore, in the event of any indexation of wages and\nany other allowance such as Special Allowance \u002F Additional Special Allowance or\nany other payment including that of Cost of Living Allowance that may be\nintroduced \u002F granted \u002F awarded whether by Federal \u002F Provincial Government and \u002F\nor any Competent Authority in future by way of Legislation, Ordinance,\nDirective or Order etc. or in any other manner whatsoever, the MONETARY\nBENEFITS ALLOWED UNDER THIS SETTLMENT SHALL BE SET – OFF.\u003C\u002Fp>\n\n\u003Cp>b) Any raise \u002F increment allowed by the management in the past due to any\nconsideration or any settlement including the present increase being allowed\nunder this settlement shall not be quoted as practice or precedence in\nfuture.\u003C\u002Fp>\n\n\u003Cp>c) Financial benefits \u002F increase given in Terms 1 &amp; 2 above under this\nsettlement will be applicable \u002F calculated for the purpose of salary \u002F wages.\nOvertime payment, gratuity, bonus and leaves only.\u003C\u002Fp>\n\n\u003Cp>d) That the existing facilities which are enjoyed by the workmen before this\nsettlement will continue to be enjoyed unless altered, modified by this\nsettlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. MAINTAINING OF DISCIPLINE AND PRODUCTIVITY OF THE FACTORY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. It has been agreed that the CBA Union shall exercise its influence upon\nworkers in extending full co-operation to the company for maintaining\ndiscipline in the Factory.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. CBA Union will also exercise its influence upon workers in curtailment of\nlate coming, absenteeism and loss of time by the workers on false and frivolous\npretext and shall co-operate to increase the productivity and efficiency\namongst the workers.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. The CBA Union has further agreed to maintain industrial peace and harmony\nin the factory and shall not give any cause of complaint to the management for\nloss of time and they shall maintain discipline amongst the workers.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>d. The CBA Union further undertakes not to resort to Go-slow, illegal strike\nor damage to any machinery or property of the factory and to assist the\nmanagement in controlling theft and further assure to support the management\nand curtailment of production due to any cause whatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>e. The CBA Union shall not interfere in the acts of Administration\nvis-à-vis transfer of workers and in the matters of disciplinary cases etc.\nagainst the workers in any manner whatsoever and they should maintain\ndiscipline and avoid creating any unrest amongst the workers on any pretext.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>f. The CBA Union will also exercise its influence in curtailment of short\nleaves and the same should be restricted only in unavoidable circumstances.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. SETTLEMENT CONCLUSIVE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a.It has been agreed that this settlement is full &amp; final in respect of\nall demands raised by the said CBA Union as well as by the management vide\ntheir Charters of Demand dated 01st January, 2014 respectively, which followed\nwith Notice of Strike dated 28. 01. 2014 and Notice of Lock-out dated\n03.02.2014 and nothing remains to be settled between the parties in any manner\nwhatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b.Any move in respect of the said demands raised by the Union as well as by\nthe management or which could have been raised and such of the demands that are\nnot raised are covered by the said settlement and shall be deemed to have been\ngiven up by the CBA Union and shall not raise any demand financial or otherwise\nduring the currency period of this settlement and they shall abide by the terms\nof the present settlement in letter and spirit.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. TENURE OF SETTLEMENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>That aforesaid Settlement shall come in to operation w.e.f. 1st January,\n2014 and shall be binding on both the parties, their heirs, successors or\nassigns and or any other Union herein after so determined as CBA for a period\nof at least 2 years i.e., up to 31st December, 2015 and shall continue to be\nbinding for a period even thereafter unless terminated by any of the party\nbound by the terms of the said Settlement.
