Mr. Sakhi Mohammad - Member, Managing Committee\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>WHEREAS the Ghandhara Nissan Limited Workers Union, functioning as a\nCollective Bargaining Agent of the workmen employed by the Company served a\nnotice under Section 42 (2) of the Sindh Industrial Relations (Revival &amp;\nAmendment) Act, 2010 dated July 1, 2011 (a true copy attached hereto as\nAnnexure “A”) along with a Charter of Demands (true copy attached herewith\nas Annexure “B”) raising demands with a view to reach a new collective\nbargained settlement;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS pursuant to the said Charter of Demands an industrial dispute\nhaving arisen, the Company and the Union entered into bilateral negotiations\nunder Section 42 (2) of the Sindh Industrial Relations (Revival &amp; Amendment\nAct, 2010 and discussions which commenced in July 2011 and thereafter various\nmeetings were held upto the signing of this settlement;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS in the process of negotiations and collective bargaining, the\nCompany and the union have arrived at an agreement contained hereinafter\nrepresenting full and final settlement of all the demands directly or\nindirectly specified in the Charter of Demands, or proposals and requests\notherwise raised from time to time during the course of negotiations between\nthe Company and the CBA verbally or in writing leading upto the signing of this\nagreement;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS, as a result of the said collective bargaining and negotiations,\nthe CBA and the Company have reached the following settlement which includes\nclauses hereunder for enhancement in pay and other allowances to meet the rise\nin the cost of living, to further improve the standard of living and to\nincrease the daily production. The Settlement covers all the demands and claims\nof the CBA contained in the Charter of Demands in full and final Settlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE THIS SETTLEMENT WITNESSETH AS UNDER:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>1. INCREASE IN BASIC WAGE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed that all permanent workers on the payroll of the Company\ncovered under this Settlement will receive a flat increase of Rs. 1,000\u002F-\n(Rupees One thousand only) effective July 1, 2011 in their basic monthly wage,\n(basic wage inclusive of all statutory allowances \u002F payments payable under the\nrelated statute.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. HOUSE RENT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that subject to existing practice and terms and conditions\npertaining to the House Rent Allowance, all permanent workers will receive a\none-time flat increase of Rs. 500\u002F- (Rupees Five hundred only) per month in\ntheir House Rent Allowance with effect from July 1, 2011.\u003C\u002Fp>\n\n\u003Ch2>3. CONVEYANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>It is agreed that subject to existing practice, terms and conditions\npertaining to the Conveyance Allowance, all permanent workers will receive a\none-time flat increase of Rs. 500\u002F- (Rupees Five hundred only) per month in\ntheir Conveyance Allowance with effect from July 1, 2011.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. WASHING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that all permanent workers will receive a one-time flat\nincrease of Rs. 200\u002F- (Rupees Two hundred only) per month in their Washing\nAllowance with effect from July 1, 2011.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The main purpose of giving washing allowance is that each and every\npermanent worker will wear neat and clean uniform during duty hours. CBA office\nbearers will ensure that every permanent worker during duty hours will wear\nneat and clean uniform i.e. shirt, trousers, shoes, cap, jersey etc. etc.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Management will take strict disciplinary action against those who will not\nbe in proper working uniform in tidy condition during working hours.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. UNIFORM MAINTENANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that all permanent workers will receive a one-time flat\nincrease of Rs. 150\u002F- (Rupees One hundred fifty only) per month in their\nUniform Maintenance Allowance with effect from July 1, 2011.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. MEDICAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It is agreed that subject to existing practice, terms and conditions\npertaining to the Medical Allowance, all permanent workers will receive a\none-time flat increase of Rs. 150\u002F- (Rupees One hundred fifty only) per month\nin their Medical Allowance with effect from July 1, 2011.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. UTILITIES ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that all permanent workers will receive a one-time flat\nincrease of Rs. 300\u002F- (Rupees Three hundred only) per month in their Utilities\nAllowance with effect from July 1, 2011.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. DAILY ATTENDANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that Rs. 44\u002F- (Rupees Forty-four only) per month @ Rs. 2\u002F-\n(Rupees Two only) per actual attendance will be increased in the Daily\nAttendance Allowance of all permanent workers. After this increase, the Daily\nAttendance Allowance will become Rs. 34\u002F- (Rupees Thirty-four) per actual\nattendance with effect from July 1, 2011.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Daily Attendance Allowance, which is paid on the basis of actual attendance,\nwill not be deducted when a worker will be on prior approved privilege leave\nhenceforth.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. SHIFT &amp; TECHNICAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that Rs. 156\u002F- (Rupees One hundred fifty six only) per month\nwill be increased in Shift &amp; Technical Allowance for all permanent shift\nworks with effect from July 1, 2011. This allowance will not become a part of\nwages for the purpose of over time or for any other purpose.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. LEAVE FARE ASSISTANCE\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>It is agreed that all permanent workers on the payroll of the company will\nbe paid Leave Fare Assistance at the lumpsum rate of Rs. 2,300\u002F- (Rupees Two\nthousand three hundred only) instead of Rs. 2,100\u002F- (Rupees Two thousand one\nhundred only) once a year, subject to utilization of at least 12 consecutive\ndays annual privilege leave with effect from July 1, 2011.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>\u003C\u002Fh2>\n\n\u003Ch2>11. LUNCH TO PERMANENT WORKERS\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that with effect from the date of signing of this agreement,\nthe Company will provide the same lunch which is cooked for Management staff at\nPlant to permanent workers present at the time of lunch. Every permanent worker\nwho will purchase the lunch will pay Rs. 1\u002F- as token money to the Canteen\nContractor. One nominee of CBA will also be included in the Canteen\nCommittee.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. CANTEEN MEAL SUBSIDY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-mealvouchers\">\u003Cp>The existing Canteen Meal Subsidy of Rs. 25\u002F- (Rupees Twenty five only) per\nday at Truck Plant and Rs. 22\u002F- (Rupees Twenty two only) per day at Car Plant\nwill continued to be paid and will not be linked with actual attendance of\nworker and will be paid for fixed 22 days, i.e. Rs. 550\u002F- per month at Truck\nPlant and Rs. 484\u002F- per month at Car Plant.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. UNION OFFICE RENT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that the Company will pay Rs. 3,000\u002F- (Rupees Three thousand\nonly) per month instead of Rs. 2,500\u002F- (Rupees Two thousand five hundred only)\nper month to CBA on account of Union Office Rent with effect from July 1,\n2011.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. RECREATION GRANT\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The company will pay a fixed amount of Rs. 40,000\u002F- (Rupees Forty thousand\nonly) per year instead of Rs. 35,000\u002F- (Rupees Thirty five thousand only) per\nyear as Recreation Grant to CBA Union for recreation purpose with effect from\nJuly 1, 2011. The CBA Union will be directly responsible for utilizing this\ngrant and the company will, in no way, be involved in the administration of the\ngrant. In addition, the Company will provide two buses free of cost to CBA\nUnion for picnic of one day once a year.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15. DATES (KHAJOOR) &amp; ONE BOTTLE OF SHARBAT IN THE HOLY MONTH OF\nRAMADAN\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that in the month of Holy Ramadan, the Company would provide\n2kgs Dates (Khajoor) and one bottle of Sharbat (RoohAfza – standard size\nbottle) to all permanent workers on the payroll of the company on the date of\nsigning of this agreement. The cost of these 2 items would not exceed Rs. 350\u002F-\n(Rupees three hundred and fifty only) instead of Rs. 170\u002F- agreed in the\nMemorandum of Settlement for the period July 2005 to June 2007.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. JACKET\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>The Company provides one Jacket every alternate year to all permanent\nworkers under Memorandum of Settlement 2003-05.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that the cost involved for jacket would be increased to Rs.\n850\u002F- (Rupees Eight hundred fifty only) instead of Rs. 500\u002F- (Rupees Five\nhundred only) per Jacket.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. EID ADVANCE AS EIDI (NON-REFUNDABLE)\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The Company provides an Eid Advance of Rs. 1,000\u002F- (One Thousand only) each\nto all permanent workers on the occasion of Eid-ul-Fitr, which is presently\ndeducted from the wages of the workers in three equal montly installments. It\nis now agreed that with effect from forthcoming Eid-ur-Fitr, this amount of Eid\nadvance of Rs. 1,000\u002F- (One Thousand only) will be paid to all permanent\nworkers on the payroll of the company, and treated as Eidi (Non-refundable) on\nthe occasion of Eid-ul-Fitr, after signing of the agreement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>18. HOSPITALIZATION FACILITY THROUGH MEDICAL INSURANCE COVER\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurancerelatives\">\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthinsurance\">\u003Cp>It is agreed that all permanent workers will be provided hospitalization\nfacility through medical insurance cover for self, one spouse and children upto\nthe age of 24 years (for boy) and for girl till the time she remains unmarried.\nThe annual hospitalization limit will be Rs. 50,000\u002F- (Rupees Fity thousand\nonly) instead of Rs. 40,000\u002F- (Rupees Forty thousand only) at present. This\nfacility will be provided with effect from the date of signing of the\nagreement.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>19. IFTARI TO ROTATING SHIFT WORKERS\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that the Company will provide Iftari to all those permanent\nworkers who perform their duty in rotating shifts and are on the duty at the\ntime of Iftari during Ramazan with effect from forthcoming month of Ramazan.\nThe cost of Iftari will be upto maximum of Rs. 100\u002F- (Rupees One hundred only)\nper iftari, instead of Rs. 40\u002F- at present.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. FUNERAL EXPENSES\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that the in case of death of a worker, the Company will bear\nexpenses for transportation of dead body to his native town along with one\nperson by paying a total amount of Rs. 25,000\u002F- (Rupees Twenty-five thousand\nonly) out of which Rs. 20,000\u002F- (Rupees Twenty thousand only) will be\ntransportation charges, while Rs. 5,000\u002F- (Rupees Five thousand only) will\ntraveling expenses for the accompanying person for returning back to Karachi,\neither by train or by road, with special five days leave with pay.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. EX-GRATIA PAYMENT\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the Company will pay Ex-Gratia, equivalent to 30 days\nbasic wage plus admissible Colas, under this agreement for the financial year\n2011-12 and 2012-13, subject to profitability in the said financial years. This\nEx-Gratia payment will not be treated as terms of employment or allowance for\nany purpose in future.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>22. FINALITY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) It is agreed that this settlement is full and final settlement of all\ndisputes, demands and claims of the Union \u002F Workmen contained in the Charter of\nDemands dated July 1, 2011\u003C\u002Fp>\n\n\u003Cp>or otherwise mentioned above.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) It is agreed that monetary increase in basic wage, house rent allowance,\nconveyance allowance, conveyance allowance, washing allowance, uniform\nmaintenance allowance, medical allowance, utilities allowance, daily attendance\nallowance, shift &amp; technical allowance, leave fare assistance, lunch to\npermanent workers, canteen meal subsidy, union office rent, recreation grant,\ndates &amp;sharbat, Jacket, Eid advance as Eidi (non-refundable),\nhospitalization facility through medical cover, Iftari to rotating shift\nworkers, funeral expenses and ex-gratia payment have been granted to meet rise\nin the cost of living during and \u002For for the period covered by this settlement\nand therefore if the Federal Government and\u002For the Provincial Government grant\nany monetary increases or grant any allowance which is intended to meet rise in\nthe cost of living during and\u002For for the period of this settlement, then\nmonetary increases granted under this settlement shall be set-off and\u002For\nadjusted against any monetary increases granted or may be granted by the\nFederal\u002FProvincial Government, subject to the manner as may be specified by the\nGovernment in the statute or ordinance.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) It is agreed that the benefits given hereinabove are also subject to that\nduring the tenure of this settlement, the Union shall improve productivity,\nquality, efficiency, discipline and attendance of the workmen and shall keep\nand promote industrial peace and harmony and shall fully cooperate with the\nCompany in its effort to increase efficiency and productivity and to achieve\nquality and economy. The Union assures their full support and cooperation to\nmeet qualitative and quantitative production norms and standards as laid down\nby the Company from time to time. The Union also undertakes to cooperate with\nthe Management in the productivity and efficiency improvement schemes as and\nwhen introduced.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>d) The Union and the Company agree to maintain industrial peace and abide by\nthis settlement under the law for the operative period of this settlement and\neven thereafter. It is further agreed that in consideration of the benefits and\nincrease given as per this settlement that the Union will not raise or pursue\ndirectly or indirectly any demands covered by this settlement or the said\nCharter of Demands and\u002For any other demand whatsoever involving financial\nimplications upon the Company, or otherwise during the period of this\nsettlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>e) All facilities and conditions of service existing as on the date of\nsigning of this settlement and also those not altered or modified by this\nsettlement will continue to remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>23.
