Malik Muhammad Nazeer\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Short Recital of the Case\u003C\u002Fh2>\n\n\u003Cp>WHEREAS the CBA had served a Charter of Demand dated 23.12.2011 received by\nthe Management on 30.12.2011 U\u002Fs 35 (I) of IRA 2012.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS Bilateral Negotiations were held between the parties on both the\naforesaid Charter of Demands; the settlement was required to be renewed with\neffect from 1st of December 2011, as per previous settlement increments were\nawarded with effect from December 2009. The management again awarded 10 %\nincrements from 1st of July 2010 and again 13 % from July 2011. Keeping in view\nthe increment history, it was mutually agreed between the parties that the\nincrements will be awarded from 1st of July 2012, it was further agreed that\nthe effective period of the settlement will be from July 2012 to June 2014 to\nmeet the financial period of the Company which starts from July.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the CBA pleaded inflation and rise in the cost of living as\njustification for their Charter of Demands.\u003C\u002Fp>\n\n\u003Cp>It is also considered necessary to bring on record that the overall package\nsettlement on the aforesaid Charter of Demands has been rechecked keeping in\nview of inflation and rise in the cost of living, rationalization of\nfacilities, capping of hidden costs and the assurance given to the Employer\nthat the workers shall work with more devotion and commitment and shall enhance\ntheir productivity;\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS alter detailed deliberations and exhaustive discussion and\nnegotiations, the Management and the CBA have arrived at a Settlement being in\nfull and final settlement of all the demands contained in the aforesaid Charter\nof demands, which is noted as settled against each of the Demand:\u003C\u002Fp>\n\n\u003Ch2>Terms of the Settlement:\u003C\u002Fh2>\n\n\u003Ch3>GENERAL:\u003C\u002Fh3>\n\n\u003Cp>1.It is hereby agreed that the Terms of this Memorandum of Settlement shall\nbe effective for Two years i.e. from July 2012 to June 2014.\u003C\u002Fp>\n\n\u003Cp>2.It is also agreed that during the operation of the Settlement, Feroze1888\nMazdoor Dost Union and\u002For any succeeding CBA shall not raise any demand(s),\nfinancial or otherwise, on the Employer.\u003C\u002Fp>\n\n\u003Cp>IN WITNESS WHEREOF, the parties above named have signed this Memorandum of\nSettlement at Karachi, on 12th day June 2012.\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Representing the Employer\u003C\u002Ftd>\n      \u003Ctd>Representing the CBA\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>1. This\nbenefit will be permissible only once in the total employment period of a\nworker.\u003C\u002Fp>\n\n\u003Ch3>Demand No. 2 (CIoths on Eids)\u003C\u002Fh3>\n\n\u003Cp>It was mutually agreed that on Eidul Fiter cloth will be given to the\nworkers who have completed 3 months employment with the Company.\u003C\u002Fp>\n\n\u003Ch3>Demand No. 3 (Transport)\u003C\u002Fh3>\n\n\u003Cp>This demand has been withdrawn by the Union.\u003C\u002Fp>\n\n\u003Ch3>Demand No. 4 (Attendance Allowance)\u003C\u002Fh3>\n\n\u003Cp>It was mutually agreed that the attendance allowance will be paid in various\ndepartments. The list of the departments where the attendance allowance will be\napplicable and rates of attendance allowance is annexed hereto and marked as\nAnnexure “A\".\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreasetype\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreaseperc1\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreasedate_date\">\u003Ch3>Demand No.5 (Increments)\u003C\u002Fh3>\n\n\u003Cp>The Management agreed for 5 % raise in the basic wages of workers with\neffect from 1st July 2012.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch3>Demand No.6 (Production Allowance)\u003C\u002Fh3>\n\n\u003Cp>It was mutually agreed to motivate and increase the production, production\nallowance will be given to weaving, sizing and warping departments as per\nIncentive Plan annexed hereto as Annexure “A\u002F1\" &amp; “A\u002F2”\u003C\u002Fp>\n\n\u003Ch3>Demand No.7 A, B, C &amp; D (Leaves)\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-holidaysdays\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>A, B, C. It was mutually agreed that 14 days Earned Leave, 10 days Casual\nLeave and 8 days Sick leave with pay per annum will be allowed to the\nworkers.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>D. It was agreed that THREE days leave with pay will be allowed to worker in\ncase of death of his immediate family member (parents, spouse, children,\nbrother or sister) weekly or public holidays falling in between or at the end\nwill be excluded.\u003C\u002Fp>\n\n\u003Ch3>Demand No.8 (Loans)\u003C\u002Fh3>\n\n\u003Cp>This demand has been withdrawn by the Union.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Ch3>Demand No.9 (Dependence Help)\u003C\u002Fh3>\n\n\u003Cp>It was mutually agreed that in case death of worker the Management will pay\nan Amount of Rs. 10000\u002F- to the dependent of worker as funeral expenses.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>Demand No.10 (Marriage Grant)\u003C\u002Fh3>\n\n\u003Cp>This demand has been withdrawn by the Union\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-mealvouchers\">\u003Ch3>Demand No. 11A, B &amp; C (Canteen)\u003C\u002Fh3>\n\n\u003Cp>The Union and Management mutually agreed. The Management assured to improve\nfood and furniture quality, to provide sufficient crockery and to provide food\nagainst reasonable rates\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>Demand No. 12 A &amp; B (Uniform)\u003C\u002Fh3>\n\n\u003Cp>A. The Management agreed to provide 2 pairs uniform and 1 pair shoes to\nDrivers, Peons, Security &amp; Safety Guards and Maintenance workers per\nannum.\u003C\u002Fp>\n\n\u003Cp>B. This demand has been withdrawn by the Union.\u003C\u002Fp>\n\n\u003Ch3>Demand No. 13 (Quilt\u002FBlanket)\u003C\u002Fh3>\n\n\u003Cp>The Management agreed to provide quilt to workers with minimum 3 months\nservice with the Company, well before the start of winter.\u003C\u002Fp>\n\n\u003Ch3>Demand No. 14 A to E (Facilities for Union)\u003C\u002Fh3>\n\n\u003Cp>A. Mutually agreed.\u003C\u002Fp>\n\n\u003Cp>B. Mutually agreed.\u003C\u002Fp>\n\n\u003Cp>C. This demand has been withdrawn by the Union.\u003C\u002Fp>\n\n\u003Cp>D.It was agreed that the Jasarat news paper will be arranged for Union\noffice only for Monday.\u003C\u002Fp>\n\n\u003Cp>E.This demand has been withdrawn by the Union.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause focus highlight\" id=\"clause-hivpolicy\">\u003Ch3>Demand No. 15 A to D (Medical facilities)\u003C\u002Fh3>\n\n\u003Cp>A.Mutually agreed to arrange Dispensary in the Factory however Doctor will\nbe available once in a week.\u003C\u002Fp>\n\n\u003Cp>B.Mutually agreed that the Management will replace Ambulance with necessary\naccessories.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>C.Management agreed to treat injured worker on duly or to insure payment of\nleave encashment front Sindh \u002F Baluchistan Employees Social Security\nInstitute.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>D. Mutually agreed once a year.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>Demand No. 16 A to G (Miscellaneous)\u003C\u002Fh3>\n\n\u003Cp>A Mutually agreed once per annum.\u003C\u002Fp>\n\n\u003Cp>B. This demand has been withdrawn by the union.\u003C\u002Fp>\n\n\u003Cp>C. It was mutually agreed that the towels will be provided on concessional\nrates to\u003C\u002Fp>\n\n\u003Cp>D. Mutually agreed once a year.\u003C\u002Fp>\n\n\u003Cp>E. Mutually agreed.\u003C\u002Fp>\n\n\u003Cp>F. Mutually agreed. \u003C\u002Fp>\n\n\u003Cp>G. Mutually agreed.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>GENERAL TERMS AND CONDITIONS\u003C\u002Fh2>\n\n\u003Ch3>1.\u003C\u002Fh3>\n\n\u003Cp> It has been specifically agreed by both parties that this settlement shall\ncontinue to remain in force during the operative period of this settlement,\nwhich is valid from 1st July 2012 and shall continue to remain operative and\nvalid up to and after 30th June 2014, and until it is replaced by fresh\nsettlement.\u003C\u002Fp>\n\n\u003Ch3>2.\u003C\u002Fh3>\n\n\u003Cp> The Union hereby binds it self and all the workers of the Company that it\nshall not raise any demand having non-financial and\u002For of financial\nimplications for the Company or re-agitate any of the demands which has been\nfinally dropped by the Union or which has not been considered in this\nsettlement, during the operative period of this settlement.\u003C\u002Fp>\n\n\u003Ch3>3.\u003C\u002Fh3>\n\n\u003Cp> In token of acceptance of various demands of the Union, the Company expects\nharmonious relationship between the workers and the Management of the Company\nto avoid any industrial unrest so as to achieve the corporate objectives of\noptimum production, minimum wastage and higher profitability which will enable\nthe Company to honour and full fill the aforesaid terms and conditions of the\nsettlement.\u003C\u002Fp>\n\n\u003Ch2>UNDERTAKING BY THE UNION\u002FWORKERS\u003C\u002Fh2>\n\n\u003Ch3>1.\u003C\u002Fh3>\n\n\u003Cp> The union has undertaken that it will render full co-operation to the\nmanagement of the Company in the matters of discipline and good conduct of all\nthe workers.\u003C\u002Fp>\n\n\u003Ch3>2.\u003C\u002Fh3>\n\n\u003Cp> The Union further undertaken on behalf all the workers that the workers\nwill not leave their places of duty\u002Fwork during duty hours to sleep inside or\noutside the mill premises or otherwise cause willful damage to production\neither in its quality or product or damage to machinery or raw material and\u002For\nreduction in normal production efficiency. The Union has agreed to cooperate\nwith the company to improve the production.\u003C\u002Fp>\n\n\u003Ch3>3.\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-violence\">\u003Cp> The Union has undertaken and assured the Management of the Company that it\nwill not allow any worker or Union office bearer to indulge in any form of\nthreat, physical assault, pressure, abuse and or otherwise commit any other\nunfair labour practice either inside the mill premises, either during the duty\nhours or when not on duty.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>4.\u003C\u002Fh3>\n\n\u003Cp> The Union has undertaken on behalf of all the workers that they will not\ninterfere in any way or prevent the Management of the Company or other\npersonnel from implementing Polices of the Company which may be introduced from\ntime to time.\u003C\u002Fp>\n\n\u003Ch3>5.\u003C\u002Fh3>\n\n\u003Cp> The Union has undertaken not to interfere in any way with the Company\ndirections or right to employ or not to employ workers and \u002F or members of the\nstaff and to transfer them from one Section or Department or Location to\nanother and \u002F or terminate the services by way of discharge, dismissal,\nretrenchment or to effect lay-off and \u002F or otherwise take such disciplinary\naction against any workman found guilty of an act of misconduct under Schedule\n15(3) of the Standing Order Ordinance and\u002For committing any criminal offence\nwhich is penal in nature of the Criminal Procedure Code and \u002F or of Pakistan\nPenal Code.\u003C\u002Fp>\n\n\u003Ch3>6.\u003C\u002Fh3>\n\n\u003Cp> The Union has undertaken to keep the industrial atmosphere peaceful and to\ncooperate fully and efficiently with the Management in its effort to increase\nefficiency, productivity and economy of the Company.\u003C\u002Fp>\n\n\u003Ch3>7.\u003C\u002Fh3>\n\n\u003Cp> The Union has undertaken that during the operative period of this\nsettlement there shall be no illegal strike, work stoppage and curtailment of\nproduction for any reason or cause arising out of the terms and conditions of\nthis settlement and\u002For for any cause of any nature whatsoever.\u003C\u002Fp>\n\n\u003Ch3>8.\u003C\u002Fh3>\n\n\u003Cp> The Union has undertaken not to hold any unlawful gate meetings or\ngatherings in the premises of the Mills raising and\u002For painting of slogans\nand\u002For using abusive languages and\u002For instigating the workers against the\nManagement of the Company.\u003C\u002Fp>\n\n\u003Ch3>9.\u003C\u002Fh3>\n\n\u003Cp> The settlement shall become effective and come into operation with effect\nfrom 01.07.2012 and shall remain operative and binding upon the parties for a\nperiod up to 20.06.2014 and there after shall continue to be binding and\neffective upon the EXPIRY of two months from the date of which either party\nhereto informs the other in writing of its intention no longer to be bound by\nthis settlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>REPRESENTING THE EMPLOYERS\u003C\u002Ftd>\n      \u003Ctd>REPRESENTING THE WORKERS\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>MR.
