SHORT RECITAL OF THE CASE\u003C\u002Fh2>\n\n\u003Cp>2.1 WHEREAS the C.B.A UNION, as Collective Bargaining Agent served upon the\nCOMPANY a Charter of Demands dated: March 15, 2014.\u003C\u002Fp>\n\n\u003Cp>2.2 AND WHEREAS the bilateral negotiations between the COMPANY and C.B.A\nUnion were started consisting of series of bargaining sessions with a view to\nreach an amicable settlement.\u003C\u002Fp>\n\n\u003Cp>2.3 AND WHEREAS the Company maintains that any improvement in the existing\nwage rates and allowances and other terms of employment of the workmen can be\nmade in order to offset and neutralize the rise in cost of living during the\noperation of this settlement.\u003C\u002Fp>\n\n\u003Cp>2.4 AND WHEREAS THE C.B.A is conscious of the need as demanded by the\nManagement for improvement in productivity, quality, safety, work, ethics, work\nculture, discipline and attendance of workmen and optimum utilization of human\nresources, assured of its full cooperation and assistance to the Management for\nimplementation of suitable measures in future that may be deemed fit in this\nregard.\u003C\u002Fp>\n\n\u003Cp>2.5 AND WHEREAS in process of Collective Bargaining, in the interest of\nindustrial peace, increase in productivity and better industrial relations it\nhas been mutually agreed upon in full and final settlement of all the demands\ncontained in the above mentioned Charter of Demands as under:\u003C\u002Fp>\n\n\u003Cp>NOW THEREFORE THIS SETTLEMENT WITNESSETH AS UNDER:\u003C\u002Fp>\n\n\u003Ch2>3. TERMS OF THE SETTLEMENT\u003C\u002Fh2>\n\n\u003Ch3>3.1 RECOGNIZATION OF RIGHTS OF PARTIES\u003C\u002Fh3>\n\n\u003Cp>Managing operation of the business is the exclusive right of the COMPANY,\nwhich includes but not limited to following:\u003C\u002Fp>\n\n\u003Cp>3.1.1The right to direct and control the workforce, i.e. among others, the\nright to hire, promote, demote, transfer, maintain discipline, discharge, to\ncreate, discontinue or to reclassify jobs, to determine the number of employees\nneeded, employees’ qualification, pre-requisites, standards of performance,\nwork hours, job requirements, job contents and evaluation of performance of\nemployees.\u003C\u002Fp>\n\n\u003Cp>3.1.2 To establish plant and offices regulations.\u003C\u002Fp>\n\n\u003Cp>3.1.3 To make optimum utilization of its workforce, tools, equipment and\nother resources.\u003C\u002Fp>\n\n\u003Cp>3.1.4 To maintain employees’ discipline and production efficiency; and to\ndetermine the means, methods, processes materials, procedures and schedules of\nproduction. The Management’s exercise of its rights to manage shall not\nviolate any of the expressed provisions of this settlement or applicable laws.\nNo change to be brought through charter of demands in company policies.\u003C\u002Fp>\n\n\u003Cp>It is recognized that the function of the C.B.A Union is to serve, as the\nCollective Bargaining Agent, on matters expressed in this settlement\nexclusively for permanent workers of Fatima Fertilizer Company Limited, Mukhtar\nGarh.\u003C\u002Fp>\n\n\u003Cp>This recognition of C.B.A Union’s rights should be in no way be\ninterpreted as lessening of the COMPANY’s responsibilities to its individual\nworkers. For this reason, relationship between the COMPANY and C.B.A Union must\nbe governed by the principle that the COMPANY must maintain the right to\nprotest within the provisions of law and appeal against the action of COMPANY\nwhenever it believes that the COMPANY’s actions were contrary to the\nsettlement\u002Flaw.\u003C\u002Fp>\n\n\u003Cp>Both the parties to the settlement agree to respect and recognize each other\nrights discussed as above in the interest of ensuring harmonious industrial\nrelations.\u003C\u002Fp>\n\n\u003Ch3>3.2 INDUSTRIAL PEACE\u003C\u002Fh3>\n\n\u003Cp>Agreed that during the period of this settlement neither the C.B.A Union,\nnor any of the workers covered by this settlement will collectively, tacitly,\nconcertedly or individually engage in or participate, directly or indirectly in\nany strike, slowdown, stoppage or other interference in the process of\nproduction and Management of work during the term of this settlement.\nSimilarly, the COMPANY agrees that during the term of this settlement, it will\nnot declare any lockout of any of the employees covered by this settlement. The\nCOMPANY retains the right to discipline or discharge any employee who violates\nthis provision and to recover such damages as the COMPANY may suffer by reason\nof a breach thereof.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.3 INCREASE IN BASIC SALARY\u003C\u002Fh3>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed that in order to off set neutralize the rise in cost of living\nand dearness, following increase in basic salary is allowed to all those\npermanent staff who were on payroll of the COMPANY as on March 14, 2014.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Basic Salary Slab\u003C\u002Ftd>\n      \u003Ctd>Increase in Monthly Basic Salary\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>3,500 – 4,500\u003C\u002Ftd>\n      \u003Ctd>1300\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>4,501 – 6,000\u003C\u002Ftd>\n      \u003Ctd>1500\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>6,001 – 9,000\u003C\u002Ftd>\n      \u003Ctd>1700\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>9,001 – 15,000\u003C\u002Ftd>\n      \u003Ctd>1900\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>15,001 – 22,000\u003C\u002Ftd>\n      \u003Ctd>2000\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>22,001 – 30,000\u003C\u002Ftd>\n      \u003Ctd>2100\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>More than 30,000\u003C\u002Ftd>\n      \u003Ctd>2200\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is also agreed that during the operation of this settlement, if any\nfinancial increase in wages announced by Federal\u002FProvincial Government,\napplicable to the workers covered under this settlement, will first be adjusted\nagainst the financial increase allowed under this settlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.4 HAJJ SCHEME\u003C\u002Fh3>\n\n\u003Cp>It is agreed that every year COMPANY shall send 06 workers on Hajj through\nthe Government scheme on Company’s expense.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.5 ALLOWANCES\u003C\u002Fh3>\n\n\u003Cp>3.5.1 OUTLIVING ALLOWANCE\u003C\u002Fp>\n\n\u003Cp>In order to additionally compensate employees and their families residing\noutside the township, exiting outliving allowance is being increased by Rs.\n1,500\u002F- per month all categories.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-HARDSHIP_trigger\">\u003Cp>3.5.2 NP\u002FCAN HARDSHIP ALLOWANCE\u003C\u002Fp>\n\n\u003Cp>In order to compensate extra hardship being faced by employees working in\nNP\u002FCAN Plants, an allowances of Rs. 1,000\u002F- per month is being introduced for\nemployees permanently deputed at NP\u002FCAN Plants.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>3.5.3 MEAL ALLOWANCE\u003C\u002Fp>\n\n\u003Cp>Apart of existing Meal subsidy already being provided to employees, existing\nmeal allowance is being raised by Rs. 500\u002F- per month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch3>3.6 BONUSES\u003C\u002Fh3>\n\n\u003Cp>3.6.1 PROFIT BONUS (10C)\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed that COMPANY shall pay profit bonus equivalent to two month’s\nyear and basic pay for each of the financial years ending on December 31, 2013\nand December 31, 2014 under schedule No. 10-C of the Standing order of Punjab\nIndustrial &amp; Commercial Employment Act 2012. Only those workers shall be\nentitled for this bonus who have at least three months of continuous service in\nthe financial year for which bonus is due and are on payroll of the Company at\nthe time of disbursement. In case of deceased, newly inducted and retired\nworkers, payment will be made on prorate basis.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The above bonus for expired calendar year shall be paid in the first month\nof new\u002Ffalling calendar year or whenever requested by C.B.A after expiry of\ncalendar year for which bonus is due.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>3.6.2 MAINTENANCE OF INDUSTRIAL PEACE INCENTIVE (MOIPI)\u003C\u002Fp>\n\n\u003Cp>In consideration of the undertaking for maintenance of industrial peace and\nharmony, provided by the C.B.A UNION and workers, the COMPANY will pay\nMaintenance of Industrial Peace Incentive for the duration of settlement in the\nfollowing manner:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>3.6.2.1 An amount equivalent to one month’s last basic pay on completion\nof first year of this agreement.\u003C\u002Fp>\n\n\u003Cp>3.6.2.2 An amount equivalent to two month’s last basic pay on completion\nof second year of this agreement.\u003C\u002Fp>\n\n\u003Cp>3.6.2.3 In case of deceased, newly inducted and retired workers, payment\nwill be made on prorate basis.\u003C\u002Fp>\n\n\u003Cp>Amount of MOIPI shall not from part of wages for calculation of any other\nallowance\u002Fbenefit.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The worker(s) would not be entitled to this incentive if any of the\nfollowing happens:\u003C\u002Fp>\n\n\u003Cp>• If the C.B.A Union or any other registered Union of the COMPANY serves\nthe Management with Notice Demand or Notice of Strike while this settlement is\nin force.\u003C\u002Fp>\n\n\u003Cp>• If the workers or any of them jointly or individually resort to any kind\nof strike, cessation of work, subversive activity, slow down, stoppage,\ninterference in the process of production and Management of work or show to\nforce through any demonstration, violation of safety rules of the company\nincluding PSM, refusal to lawful order of seniors including refusal to attend\nany training, meeting, slogan or displaying banners with slogans or take out\nprocession in any section of the Plant or Township premises or at gates of\nPlant and \u002For Township or outside the Plant\u002FTownship within 200 meters of the\nboundary wall collectively or individually.\u003C\u002Fp>\n\n\u003Cp>• Any kind of protest in any form like sticking of posters for discredit\nof Management of the Company explicitly or implicitly, display of protest\nbands, or any other impediments to the smooth functioning of Plant operations\nand maintenance of discipline and good order.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>3.6.3 PRODUCTION BONUS\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE2_trigger\">\u003Cp>COMPANY on his own discretion shall pay worker Production bonus as per\nfollowing detail:\u003C\u002Fp>\n\n\u003Cp>For year ending December 2013 - Three month’s year end basic pay\u003C\u002Fp>\n\n\u003Cp>For year ending December 2014 - Two month’s year end basic pay\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Only those workers shall be entitled for production bonus who have completed\nat least three month service with the Company for the financial year in which\nproduction targets achieved and are on payroll of the COMPANY at the time of\ndisbursement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>In case of deceased, newly inducted and retired workers, payment will be\nmade on prorate basis.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The above bonus for expired calendar year shall be paid in the first month\nof new\u002Ffalling calendar year or whenever requested by C.B.A after expiry of\ncalendar year for which bonus is due.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.7 ESTABLISHMENT OF FUND FOR TREATMENT OF HEPATITIS B &amp; C CASES\u003C\u002Fh3>\n\n\u003Cp>It has been agreed that for treatment of Hepatitis B &amp; C cases\n(Employees \u002F eligible family members) for staff and Management, a contributory\nfund shall be established with following amount contribution:\u003C\u002Fp>\n\n\u003Cp>• Rs. 200\u002F- per month shall be contributed by each of staff employee\ndeducted from their salaries.\u003C\u002Fp>\n\n\u003Cp>• Rs. 400\u002F- per month be contributed by each of Management employee\ndeducted from their salaries.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Fund established shall be solely used for the treatment of Hepatitis B &amp;\nC cases and priority of treatment shall be defined by Company’s doctor.\nSeparate rules shall be developed to manage this fund.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.8 ABOLISHING DEDUCTION OF PROJECT ALLOWANCE DURING ANNUAL LEAVE\u003C\u002Fh3>\n\n\u003Cp>Deduction of project allowance during annual leaves shall be ceased w.e.f.\nJanuary 01, 2015.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.9 MOTORCYCLE LOAN\u003C\u002Fh3>\n\n\u003Cp>No. of motorcycle loan to workers shall be increased to 30. All other terms\nand condition will remain same.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.10 INCREASE IN MEAL AMOUNT DURING OFFICIAL TRAVELLING\u003C\u002Fh3>\n\n\u003Cp>It has been agreed to raise meal payment during official travelling to Rs.\n400\u002F- for complete day. All others terms and conditions of Company’s policy\non subject shall remain same.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch3>3.11 FINALITY\u003C\u002Fh3>\n\n\u003Cp>It is understood and agreed between the parties that increase in wages and\nimprovements in other conditions of employment of workmen as specified in this\nSettlement\u002FAgreement are inclusive of the increase in the Cost of Living.\nAccordingly, the increases in wages have been made to fully offset any increase\nin cost of living and\u002For such increase(s) that may be allowed in future. This\nwill also adjust any increase(s) given by the Federal of Provincial Governments\nthrough any circular or directive issued\u002Fannounced during the currency of this\nAgreement irrespective of whether or not any provision for setoff and\u002For\nadjustment is provided for therein.
