Mr. Muhammad Rasool Khan - (Propaganda Secretary)\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE:\u003C\u002Fp>\n\n\u003Cp>WHEREAS, on the expiry of the Collective Bargaining Agreement dated\n30.04.2014 the UNION under its Notice dated 30th April 2014 submitted a Charter\nof Demands under Section 35 (1) of the Industrial Relations Act 2013 Sindh\n(Revival &amp; Amended) raising an industrial dispute upon the Management, the\ncopy of Charter of Demands is attached herewith and marked Annexure “A”\nwith a view to arrive at a new collectively bargained settlement.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS, pursuant to the said Notices the representatives of the\nMANAGEMENT and the UNION held bilateral discussions and negotiation on the said\nCharters of Demands and other requests and proposals made during the course of\nnegotiation in order to reach an amicable settlement through the process of\ncollective bargaining.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS, as a result of bilateral discussions and negotiations their\nfinal meeting on 20.06.2014 both the parties have arrived at a Collectively\nBargained Settlement taking into consideration the rise in cost of living and\nall the demands and claims of the UNION and contained in the said Charter of\nDemands and other claims \u002F demands for negotiations and discussions in the\ncourse of collective bargaining in full and final settlement as on the date of\nsigning of this AGREEMENT.\u003C\u002Fp>\n\n\u003Cp>NOW, THEREFORE, THIS AGREEMENT WITNESSES AS UNDER:\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT:\u003C\u002Fp>\n\n\u003Ch2>1. BASIC SALARY\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent workmen (Selection Grade to Grade ‘E’)\nwho are on Company’s payroll on the date of signing of this AGREEMENT would\neach be given an increase of Rs. 2.925\u002F= per month in Basic Salary with effect\nfrom 1st May 2014 thereby increasing the Basic Salary accordingly per month.\u003C\u002Fp>\n\n\u003Ch2>2. HOUSE RENT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent workmen (Selection Grade to Grade ‘E’)\nwho are on Company’s payroll on the date of signing of this AGREEMENT would\neach be given an increase of Rs. 1,350\u002F= per month in House Rent Allowance with\neffect from 1st May 2014 thereby raising the House Rent Allowance accordingly\nper month. The essential staff living in houses provided by the Company will\nalso be entitled to this benefit.\u003C\u002Fp>\n\n\u003Ch2>3. UTILITY ALLOWANCE;\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all the permanent workmen (Selection Grade to Grade\n‘E’) who are on Company’s payroll on the date of signing of this\nAGREEMENT would be given an increase of Rs. 225\u002F= per month in Utility\nAllowance with effect from 1st May, 2014 thereby raising the Utility Allowance\naccordingly.\u003C\u002Fp>\n\n\u003Ch2>4. RECREATION ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It is agreed that with effect from 1st May 2014, the Recreation Allowance\nfor all permanent workmen (Selection Grade to Grade ‘E’) who are on\nCompany’s payroll on the date of signing of this AGREEMENT will be Rs.\n20,760\u002F= per annum on the following terms and condition:\u003C\u002Fp>\n\n\u003Cp>a) Recreation Allowance will be paid to all the eligible permanent workmen\non Eid-ul-Fitr each year.\u003C\u002Fp>\n\n\u003Cp>b) This allowance will not be accumulated.\u003C\u002Fp>\n\n\u003Cp>c) Recreation Allowance will not be paid in advance or in installments.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>5. FAMILY MEDICAL ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It is agreed that with effect from 1st May 2014 the Family Medical Allowance\nis granted to all permanent workmen (Selection to Grade ‘E’) who are on\nCompany’s payroll on the date of signing of this AGREEMENT. This allowance\nwill be Rs. 9,060\u002F= per annum for treatment of their immediate family members\nand will be paid on Eid-ul-Fitr.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. CONVEYANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>a) It is agreed that only those workmen who are living at Mubarik colony,\nMatiari, Phuleli, Hussainabad, Pucca Qila, Hala Naka , Tando Alayar, Kohisar\n&amp; Gulshan-e-Zeal Pak Colony would be given an increase from Rs. 500\u002F= to\nRs. 550\u002F= as Conveyance Allowance per month with effect from 1st May, 2014 for\ncoming to pick-up \u002Fdrop points. This will be in addition to prevailing facility\nof Company’s transport.\u003C\u002Fp>\n\n\u003Cp>b) It is agreed that those workmen who are not using the company’s\ntransport and the residing at Jamshoro Colony, LMC University and nearby\nvillages would be given in increase in Conveyance Allowance from Rs. 400\u002F= to\nRs. 430\u002F= per month with effect from 1st May, 2014.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) It is agreed that in the absence of Company’s transport facilities the\nrate of rickshaw fare allowance in lieu thereof would be as follows with effect\nfrom date of signing this Agreement.\u003C\u002Fp>\n\n\u003Cp>i) For those residing in Latifabad - Rs. 220\u002F=\u003C\u002Fp>\n\n\u003Cp>ii) For those residing in Hyderabad - Rs. 220\u002F=\u003C\u002Fp>\n\n\u003Cp>iii) For those residing in KotriRs. 170\u002F=\u003C\u002Fp>\n\n\u003Cp>iv) For those residing in Jamshoro Colony, Petrol Pump near Rs. 120\u002F=\u003C\u002Fp>\n\n\u003Cp>Railway Crossing Jamshoro and Chakar Khan Village\u003C\u002Fp>\n\n\u003Cp>v) Qasimabad Bhittai Town - Rs. 220\u002F=\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>7. SHIFT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-NOCTPREM_trigger\">\u003Cp>It is agreed that only those permanent workmen who are required to work\nother than General Shift would be entitled to Shift Allowance as follows, with\neffect from the date of signing of this AGREEMENT.\u003C\u002Fp>\n\n\u003Cp>i) Night shift - Rs. 200\u002F= per shift\u003C\u002Fp>\n\n\u003Cp>ii) All other shifts (other than General Shift) - Rs. 170\u002F= per shift\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. FACILITIES DURING THE HOLY MONTH OF RAMAZAN\u003C\u002Fh2>\n\n\u003Cp>a) It is agreed that the Milk Allowance will increase from Rs. 35\u002F= to Rs.\n45\u002F= per day per worker for all Muslim workmen.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) It is agreed that the Tea Allowance for non-Muslim workmen will be\nincreased from Rs. 450\u002F= to Rs. 500\u002F= per month.\u003C\u002Fp>\n\n\u003Ch2>9. MEAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>It is agreed that with effect from the date of signing of the AGREEMENT the\nMeal Allowance will be increased from Rs. 150\u002F- to 170\u002F- per meal for permanent\nworkmen only. All other terms and conditions will remain the same\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>10. PICNIC\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the Company will contribute towards workmen’s picnic a\nsum of Rs. 175000\u002F= per year with effect from the year 2014 for the picnic to\nbe organized for all the permanent workmen of the factory by the UNION.\u003C\u002Fp>\n\n\u003Ch2>11. UNIFORMS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>a) JERSEY\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that permanent workmen who are at present entitled for jerseys\nwill be provided once in a year a Jersey costing Rs. 1,700\u002F= each during winter\nat the discretion of the MANAGEMENT. This will be effective from the year\n2014.\u003C\u002Fp>\n\n\u003Cp>b) SHOES\u003C\u002Fp>\n\n\u003Cp>It is agreed that effective from the date of this AGREEMENT the cost of\nShoes Slip will be issued twice in a year as under\u003C\u002Fp>\n\n\u003Cp>Selection Grade = From Rs. 1,700\u002F- per shoe slip\u003C\u002Fp>\n\n\u003Cp>Grade ‘A’ to ‘E’ = From Rs. 1,300\u002F- per shoe slip\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>12. MARRIAGE LOAN\u003C\u002Fh2>\n\n\u003Cp>It is agreed that a marriage loan of Rs. 140.000\u002F= will be granted to any\nfour permanent workers in a year, once in a service period on the following\nterms and condition.\u003C\u002Fp>\n\n\u003Cp>a) A worker must have completed 10 years of continuous service.\u003C\u002Fp>\n\n\u003Cp>b) This loan will be granted on marriage of daughter \u002F sister \u002F son \u002F or in\ncase of self only in case of first marriage.\u003C\u002Fp>\n\n\u003Cp>c) The loan will be recoverable in 5 years.\u003C\u002Fp>\n\n\u003Ch2>15. HOUSE BUILDING CONSTRUCTION \u002F PURCHASE LOAN:\u003C\u002Fh2>\n\n\u003Cp>It is agreed that interest free loan of Rs. 150,000\u002F= will be granted to 5\npermanent worker once in a service period on the following terms and\ncondition.\u003C\u002Fp>\n\n\u003Cp>a) A worker must have completed 15 years of continuous service.\u003C\u002Fp>\n\n\u003Cp>b) This loan is repayable in 60 Installment. In case of retirement \u002F\nresignation or termination of service, the entire loan amount will be recovered\nin lump-sum from the final settlement of the employee.\u003C\u002Fp>\n\n\u003Cp>c) This loan should be used only for the purchase \u002F construction of a house\n\u002F Flat. The ownership of the property should be in the name of worker or his\nspouse.\u003C\u002Fp>\n\n\u003Ch2>16. ANNUAL INCREMENT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed that with effect from 1st January 2015, the Annual Increment\nwill be based on percentage of the basic salary and will be as follows:\u003C\u002Fp>\n\n\u003Cp>a) 4% if absenteeism during the year is in excess of 3 Advance leaves.\u003C\u002Fp>\n\n\u003Cp>NOTE:Once in three years 10 advance leaves are allowed when considering the\nabsenteeism.\u003C\u002Fp>\n\n\u003Cp>b) 8% &amp; 9% depending on the performance to be decided by the\nmanagement.\u003C\u002Fp>\n\n\u003Cp>c) Annual Increment for the workers will be made at the same time as when\nthe Salary Review for Executives takes place.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>17. BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed that with effect from 1st May 2014, amount paid as bonuses\nother than 10C will no longer be paid and will now be merged into the salary as\nper defined proportion in:\u003C\u002Fp>\n\n\u003Cp>i) Basic Salary\u003C\u002Fp>\n\n\u003Cp>ii) House Rent\u003C\u002Fp>\n\n\u003Cp>iii) Utility Allowance\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>18. GENERAL\u003C\u002Fh2>\n\n\u003Cp>a) The UNION hereby agrees that in consideration of the benefits given to\nall permanent workmen by the MANAGEMENT under this AGREEMENT, all remaining\ndemands appearing in Annexures ‘A’ and other claims raised during\nnegotiation which have been dropped and\u002For withdrawn by the UNION and shall be\ndeemed to have been settled to the UNION’S full satisfaction by this\nAGREEMENT.\u003C\u002Fp>\n\n\u003Cp>d) It is agreed that the existing terms and conditions of service shall\ncontinue to remain the same except as altered\u002Famended\u002Fmodified by this\nAGREEMENT.\u003C\u002Fp>\n\n\u003Cp>e) It is agreed that clauses\u002Fterms of this agreement will be applicable and\nbinding on all the permanent workers at Jamshoro Plant at the time of execution\nof this settlement.\u003C\u002Fp>\n\n\u003Ch2>19. DURATION OF SETTLEMENT\u003C\u002Fh2>\n\n\u003Cp>It is agreed by the MANAGEMENT as well as the UNION that this AGREEMENT\nshall remain in force and binding upon both the parties for a period of two\nyears commencing from 1st May 2014 and ending on 30th April, 2016\u003C\u002Fp>\n\n\u003Ch2>20. COST OF LIVING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is mutually agreed that the increase in wages, various allowances and\nother benefits given under this AGREEMENT take into account rise in the cost of\nliving including all COLA(s) announced between 1st May 2014 to 30th April 2016\nunder Employees Cost of Living (Relief Act – 1973) or any other Act,\nOrdinance, Order issued \u002F to be issued by the Federal, Provincial or Local\nGovernment providing relief on account of actual or expected rise in the cost\nof living have been included. Consequently, it is further agreed upon that no\nincrease whatsoever in wages, various allowances and other benefits etc. shall\nbe considered till 30th April 2016 and this Collectively Bargained Settlement\nshall, therefore, be treated as final.\u003C\u002Fp>\n\n\u003Ch2>21.
