Allied Bank Limited, having its registered office at 3-4, Tipu Block, New\nGarden Town Lahore (herein referred to as the ‘Bank’, which expression\nshall include its successors-in-interest, administrators and assigns)\u003C\u002Fp>\n\n\u003Cp>AND\u003C\u002Fp>\n\n\u003Cp>2. Allied Bank Workers’ Federation of Pakistan, a registered federation of\nTrade Union of Workmen of Allied Bank Limited (having been certified as\nCollective Bargaining Agent) by the Registrar of Industry-wise Trade Union\n(RITU), National Industrial Relations Commission (NIRC) vide certificate dated\nFebruary 15, 2012 (hereinafter referred to as the ‘C.B.A’ which expression\nshall include its successors, assigns and all permanent workman in actual\nemployment or to be employed by the Bank).\u003C\u002Fp>\n\n\u003Cp>Representing Employer:\u003C\u002Fp>\n\n\u003Cp>1.Mr. Tariq Mahmood\u003C\u002Fp>\n\n\u003Cp>2.Mr. Shafique Ahmed Uqaili\u003C\u002Fp>\n\n\u003Cp>3.Mr. Atif Izhar Syed\u003C\u002Fp>\n\n\u003Cp>Representing Workmen:\u003C\u002Fp>\n\n\u003Cp>1.Mr. Muhammad Akram Khan\u003C\u002Fp>\n\n\u003Cp>2.Mr. Muhammad Ajmal Khan\u003C\u002Fp>\n\n\u003Cp>3.Mr. Abu Zar Bukhari\u003C\u002Fp>\n\n\u003Cp>4.Mr. Sadiq Deraishak\u003C\u002Fp>\n\n\u003Cp>5.Mr. Muhammad Ayub Khan\u003C\u002Fp>\n\n\u003Cp>6.Mr. Jehazeb Khan\u003C\u002Fp>\n\n\u003Cp>Short Recital of the Case\u003C\u002Fp>\n\n\u003Cp>Whereas, the RITU (NIRC) certified the Federation as C.B.A vide Order dated\nFebruary 15, 2012;\u003C\u002Fp>\n\n\u003Cp>AND Whereas, a Memorandum of Settlement was signed between the parties on\nDecember 16, 2011 which was valid till August 31, 2013;\u003C\u002Fp>\n\n\u003Cp>AND Whereas, the C.B.A had served a fresh Charter of Demand on 21st June,\n2013 and bilateral negotiations were held between the parties on the said\nCharter of Demand.\u003C\u002Fp>\n\n\u003Cp>AND Whereas, the C.B.A pleaded inflation and rise in the cost of living as\njustification for their Charter of Demands and the Bank took into consideration\nthe rise in the cost of living during the preceding years, as well as the\nanticipated rise in the cost of living for the forthcoming two (2) years and in\norder to provide relief against such rises, the following settlement has been\nreached in respect of all matters relating to the terms and conditions of\nemployment.\u003C\u002Fp>\n\n\u003Cp>EFFECTIVE OF MEMORANDUM OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>It is hereby agreed that the terms of this Memorandum of Settlement shall be\neffective, binding and operative for the period, commencing from 1st September,\n2013 and terminating on 10th September, 2015.\u003C\u002Fp>\n\n\u003Cp>TERMS OF MEMORANDUM OF SETTLEMENT\u003C\u002Fp>\n\n\u003Ch2>1. INCREASE IN SALARY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>a) One-time Increase in Salary\u003C\u002Fp>\n\n\u003Cp>In view of inflation and rise in the cost of living during the current year\nas well as anticipated rise in cost of living during the tenure of this\nMemorandum of Settlement, it has been agreed that the gross salary of all\npermanent and regular clerical and non-clerical workers of the Bank shall be\nincreased by 23% w.e.f. 1st September, 2013.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) Annual Increase for the Years 2013 and 2014 to be paid in the years 2014\nand 2015 respectively\u003C\u002Fp>\n\n\u003Cp>Thereafter, on an annualized basis, 10% increase in gross salary, shall be\nallowed to all permanent and regular clerical and non-clerical workers, subject\nto recommendation, w.e.f. 1st September, 2014 (for the year 2013) and w.e.f.\n1st September, 2015 (for the year 2014).\u003C\u002Fp>\n\n\u003Cp>All the above increases as allowed in Clause 1 shall be subject to the\nfollowing conditions:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>A) The salary increases mentioned in Clause 1(a) and Clause 1(b), shall only\nbe admissible to all such permanent and regular clerical and non-clerical\nworkers, who have been in service of the Bank, for at-least six months during\nthe last calendar year;\u003C\u002Fp>\n\n\u003Cp>B) All such clerical and non-clerical workers or who have been absent for\nmore than 90 days for any reason, during the previous calendar year (year prior\nto the date of the effective date of increase in salary) shall not be entitled\nto receive these increases;\u003C\u002Fp>\n\n\u003Cp>C) All such clerical and non-clerical workers who are awarded punishment\nduring the year (excluding warnings and reprimands) or whose administrative\naction cases are pending shall not be entitled for these salary increases;\u003C\u002Fp>\n\n\u003Cp>D) All such clerical and non-clerical workers who are availing LPR or who\nhave tendered resignations or opted for pre-mature retirement from Bank’s\nservice shall not be entitled for these salary increases;\u003C\u002Fp>\n\n\u003Ch2>2. PENSION\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-pensionfund\">\u003Cp>With reference to the demand of the C.B.A regarding payment of pension, it\nwas not agreed by the Bank as per the terms of demand. However, the Bank and\nthe C.B.A agreed that incase, the Bank after obtaining approval from concerned\ncommissioner of Income\u003C\u002Fp>\n\n\u003Cp>Tax offer lump sum payment of pension, at net present value (NPV) after\napplying discounting then the C.B.A will have no objection to this offer,\nprovided such offer from Bank will be purely on voluntary basis. Once the Bank\noffers such option, it will be taken as consented by the C.B.A into inclusive\nof all its sub-conditions, as announced by the Bank.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. EDUCATION ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-educationtuition\">\u003Cp>It has been agreed to revise the education allowance allowable to all\npermanent and regular clerical and non-clerical workers for the education of\ntheir children, up to a maximum amount of Rs. 4,500 per month per\nclerical\u002Fnon-clerical employee, subject to authentication and submission of\noriginal fees slips.\u003C\u002Fp>\n\n\u003Cp>i) Up to matriculationRs. 1,500 per child per month\u003C\u002Fp>\n\n\u003Cp>ii) For college\u002Ftechnical educationRs. 2,250 per child per month\u003C\u002Fp>\n\n\u003Cp>iii) For professional education from\u003C\u002Fp>\n\n\u003Cp>HEC recognized university\u002Feducational Rs. 3,000 per child per month\u003C\u002Fp>\n\n\u003Cp>iv) Cash Prize for Hifz-e-QuranRs. 100,000 one time\u003C\u002Fp>\n\n\u003Cp>subject to verification by the Bank and will only be allowed to all those\nchildren who Hifz the Holy Quran after the date of signing of this Memorandum\nof Settlement.\u003C\u002Fp>\n\n\u003Cp>All payments under this clause are subject to submission of fee receipts and\nverifications by the Bank and will only be allowed after the date of signing of\nthis settlement. Likewise, case prize for Hifz-e-Quran shall only be applicable\nto those children workers who Hifz Quran after the date of signing of this\nsettlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. CLOSING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to increase the Closing Allowance for all permanent and\nregular clerical and non-clerical workers from Rs. 1,000 to Rs. 1,200 twice a\nyear (June 30 and December 31).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-incidentalbonustype2\">\u003Cp>It has been agreed that if the Bank makes profit, then in that case, two\nbasic salaries shall be paid to all the permanent and regular and non-clerical\nworkers, as bonus on Eid-ul-Fitr and Eid-ul-Azha, respectively. Whereas, one\ngross salary shall be paid to all the permanent and regular clerical and\nnon-clerical workers as bonus at the time of annual performance appraisal:\u003C\u002Fp>\n\n\u003Cp>a. One month’s basic salary by the first day of the month in which\nEid-ul-Fitr occurs;\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>b. One month’s basic salary by the first day of the month in which\nEid-ul-Azha occurs, and;\u003C\u002Fp>\n\n\u003Cp>c. One month’s gross salary at the time of annual performance appraisal in\nthe Bank.\u003C\u002Fp>\n\n\u003Cp>The above payments include bonus under Standing Order 10-C of the Industrial\nand Commercial Employment (Standing Orders) Ordinance, 1968.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>6. MOVE-OVER TO NEXT HIGHER SCALE\u003C\u002Fh2>\n\n\u003Cp>The Bank hereby agrees for allowing move-over into the immediate next scale\nonly to those workers who are above the maximum of their existing pay ranges.\nHowever, this will not apply to those workers who are already in the highest\npay scale i.e. scale 7.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. HOUSE BUILDING FINANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to fix the maximum House Building Finance entitlements as\nfollows, for all the permanent and regular clerical and non-clerical workers,\nsubject to all the existing terms and conditions, already in practice:\u003C\u002Fp>\n\n\u003Cp>a) House Building Finance for scales 1 to 3: Rs. 1,350,000\u003C\u002Fp>\n\n\u003Cp>b) House Building Finance for scales 4 to 7: Rs. 1,850,000\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions shall remain the same.\u003C\u002Fp>\n\n\u003Ch2>8. MOTOR-CYCLE FINANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to revise maximum limit of motorcycle finance from Rs.\n70,000\u002F- to Rs. 80,000\u002F- all other terms to remain unchanged. This increase\nwill be applicable upon fresh requisitions submitted after the signing of this\nsettlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. PERSONAL LOAN\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that workmen will have an option to avail personal loan\nup to the maximum limit of either their respective 5 monthly Basic Salaries or\nequivalent to 3 monthly Gross Salaries (excluding out of range allowance). All\nthe other terms of this loan\u002Ffinance will remain unchanged.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. HAJJ\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that twelve (12) persons amongst the permanent and\nregular clerical and non-clerical workers (once during the entire service)\nshall be sent for Hajj every year, at the expense of the Bank effective from\nHajj 1435 Hijri. There will be two separate balloting i.e. 1st ballot for\nselection of 10 workers from the total eligible strength of the permanent and\nregular clerical and non-clerical workers and 2nd ballot for selection of 2\nworkers will be from those who have less than 24 months to attain\nsuperannuation. The management shall bear full payment to the Federal\nGovernment for Hajj application under the normal Government scheme.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. IN SERVICE MEDICAL FACILITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It has been agreed to revise the reimbursement of Maternity charges up to\nRs. 10,000\u002F- per delivery (for delivery at home) and up to Rs. 20,000\u002F- per\ndelivery (for delivery at hospital). All other terms as mentioned in Para 5 of\nMemorandum of Settlement dated 8th September, 2008 will remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. BURIAL EXPENSES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>It has been agreed to revise the payment of Burial Expenses from Rs.\n40,000\u002F- to Rs. 60,000\u002F- for the burial of the permanent and regular clerical\nand non-clerical workers their dependent family members (dependent family\nmembers include dependent parents, spouse and real children) who pass away\nduring the service or during the LPR of that employee.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. MARRIAGE GRANT\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to revise the Marriage Grant to permanent and regular\nclerical and non-clerical workers, from Staff Welfare Fund, as follows:\u003C\u002Fp>\n\n\u003Cp>i) For self (in case of 1st marriage only)Rs. 300,000\u002F-\u003C\u002Fp>\n\n\u003Cp>ii) For any two real daughtersRs. 300,000\u002F- (for each of the two\u003C\u002Fp>\n\n\u003Cp>real daughters, in case of 1st marriage only)\u003C\u002Fp>\n\n\u003Ch2>14. GROUP LIFE INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It has been agreed that Group Life Insurance coverage for permanent and\nregular clerical and non-clerical workers, stands revised, effective from next\nrenewal of Group Life Insurance Policy arranged by the Bank.\u003C\u002Fp>\n\n\u003Cp>Effective from the next insurance renewal, the revised Group Life Coverage\nshall be as follows:\u003C\u002Fp>\n\n\u003Cp>i) Clerical workers....Rs. 550,000\u002F-\u003C\u002Fp>\n\n\u003Cp>ii) Non-clerical workers.....Rs. 450,000\u002F-\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15. DAILY ALLOWANCE\u002FOVER-TIME\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>The Daily Allowance (DA) for clerical and non-clerical workers (except\nDrivers) has been revised from Rs. 500 per to Rs. 700 per day subject all other\napplicable terms and condition. However, the DA entitlement for Drivers who\nperform duties after close of business hours has been revised as follows:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>Description\u003C\u002Ftd>\n      \u003Ctd>Previous\u003C\u002Ftd>\n      \u003Ctd>Revised\u003C\u002Ftd>\n      \u003Ctd>Conditions\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd rowspan=\"3\">Protocol Drivers (Drivers particularly posted as\n        ‘Protocol Drivers’ at Karachi, Multan, Lahore and Faisalabad)\u003C\u002Ftd>\n      \u003Ctd>Rs. 400\u003C\u002Ftd>\n      \u003Ctd>Rs. 500\u003C\u002Ftd>\n      \u003Ctd>If the duty goes beyond 6.00 p.m. but lasts before 1.00 a.m. on\n        working day as over-time.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Rs. 600\u003C\u002Ftd>\n      \u003Ctd>Rs. 650\u003C\u002Ftd>\n      \u003Ctd>If the duty goes beyond 1.00 a.m. on working day. And in case of a\n        night stay out of base station, the Daily Allowance’ as admissible to\n        other clerical and non-clerical employees will be paid and no other\n        allowance will be admissible in that situation.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Rs. 600\u003C\u002Ftd>\n      \u003Ctd>Rs. 800\u003C\u002Ftd>\n      \u003Ctd>For duty on weekly and public holidays.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>Other Drivers\u003C\u002Ftd>\n      \u003Ctd>Rs. 250\u003C\u002Ftd>\n      \u003Ctd>Rs. 350\u003C\u002Ftd>\n      \u003Ctd>Half Daily Allowance (DA) shall be allowed to (permanent and regular)\n        drivers on official tour if the tour lasts for more than eight (8)\n        hours and continues beyond 9.00 p.m. In case of a night stay out of\n        base station, the Daily Allowance’ as admissible to other clerical\n        and non-clerical employees will be paid and no other allowance will be\n        admissible in that situation.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Notwithstanding the above, in case of ‘Protocol Drivers’ performing\nduties at Islamabad, Lahore, Multan and Karachi beyond 11.00 p.m. on any given\nday or on Sundays\u002FPublic Holidays, such ‘Protocol Drivers’ shall be given\nan additional Rs. 300\u002F- per day as Conveyance Allowance for their travel from\nhome to office ad back in odd hours.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. UNIFORM ACCESSORIES ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>It has been agreed to revise the following uniform accessories allowance to\nnon-clerical workers:\u003C\u002Fp>\n\n\u003Cp>a. Stitching charges:Rs. 1,000 per suit (No. of suits remain unchanged i.e.\nsix (6) suits per annum)\u003C\u002Fp>\n\n\u003Cp>b. Two pairs of shoes: @ Rs. 1,500 per pair\u003C\u002Fp>\n\n\u003Cp>c. Six pairs of socks: @ Rs. 200 per pair\u003C\u002Fp>\n\n\u003Cp>d. Two caps: @ Rs. 500 per cap for Guards only\u003C\u002Fp>\n\n\u003Cp>e. Two Jerseys:on an annual basis @ Rs. 2,500 per Jersey\u003C\u002Fp>\n\n\u003Cp>In addition to the above, an additional amount of Rs. 2,000\u002F- will be paid\nto the Scooter Riders as cost of Helmets once in two years.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. CONTINUOUS BANKING ALLOWANCE (9.00 AM TILL 8.00 PM)\u003C\u002Fh2>\n\n\u003Cp>Clerical and Non-clerical employees who are assigned to work late in those\nBranches which operate from 9.00 am. till 8.00 pm. will be allowed Continuous\nBanking Allowance @ Rs. 1,500 per month. This allowance will be admissible as\nlong as such employees remain posted in those Branches which operate from 9.00\nam. till 8.00 pm. Further, it will also be discontinued, if Branch’s working\nhours are reduced back to conventional working hours. This will not be\nadmissible to the Security Guards on shift duty.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. GENERAL\u003C\u002Fh2>\n\n\u003Cp>a. The C.B.A, its Allies and Successors agree and accept that the above\nbenefits and increases are being given and agreed to, by the Bank, keeping in\nview the rise in cost of living and as a relief due to rise in cost of living\nin the part, as well as for the next two (2) years. Any benefits, increases or\nallowances that are given during the operative period of this agreement by the\nfederal or provincial government under any law, rules or notifications, are\nhereby deemed to have been granted in terms of the provisions of this\nsettlement and shall not therefore be separately payable, hence liable to be\nset\u002Foff;\u003C\u002Fp>\n\n\u003Cp>b.
