Mr. Jehanzeb Khan\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Short Recital of the Case:\u003C\u002Fp>\n\n\u003Cp>Whereas, the RITU (NIRC) certified the Federation as C.B.A vide Order dated\nJuly 06, 2005 and continues to act u\u002Fs. 21 of IRO 2011;\u003C\u002Fp>\n\n\u003Cp>AND Whereas, a Memorandum of Settlement was signed between the parties on\nSeptember 08, 2008 which was valid till July 31, 2011;\u003C\u002Fp>\n\n\u003Cp>AND Whereas, the C.B.A had served a fresh Charter of Demands on 12th July,\n2011 and a number of meetings between the parties were held for bilateral\nnegotiations on the said Charter of Demand.\u003C\u002Fp>\n\n\u003Cp>AND Whereas, the C.B.A pleaded inflation and rise in the cost of living as\njustification for their Charter of Demands and the Bank took into consideration\nthe rise in the cost of living during the preceding years, as well as the\nanticipated rise in the cost of living for the forthcoming two (2) years and in\norder to provide relief against such rises, the following settlement has been\nreached in respect of all matters relating to the terms and conditions of\nemployment.\u003C\u002Fp>\n\n\u003Cp>EFFECTIVENESS OF MEMORANDUM OF SETTLEMENT:\u003C\u002Fp>\n\n\u003Cp>It is hereby agreed that the terms of this Memorandum of Settlement shall be\neffective, binding and operative for two (2) years, commencing from 1st\nSeptember, 2011 and terminating on 31st August, 2013.\u003C\u002Fp>\n\n\u003Cp>TERMS MEMORANDUM OF SETTLEMENT:\u003C\u002Fp>\n\n\u003Ch2>1. INCREASE IN SALARY\u003C\u002Fh2>\n\n\u003Cp>a) One-time increase in salary\u003C\u002Fp>\n\n\u003Cp>In view of inflation and rise in the cost of living during the current year\nas well as anticipated rise in cost of living during the tenure of this\nMemorandum of Settlement, it has been agreed that the gross salary of all\npermanent and regular clerical and non-clerical workers of the Bank shall be\nincreased by 30%. However, out of this total of 30% increase, 20% increase will\nbe granted from the date of signing of this Memorandum of Settlement and the\nremaining 10% will be granted at the time of Performance Appraisals, in the\nyear 2012. However, there will be no other merit salary increment on top of\nthis fixed annual raise of 10% during a calendar year.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>b) Annual increase at the time of Performance Appraisal in the year 2013\u003C\u002Fp>\n\n\u003Cp>10% increase in gross salary, shall be allowed to all permanent and regular\nclerical and non-clerical workers at the time of annual performance appraisal\nfor the year 2013. However, there will be no other merit salary increment on\ntop of this fixed annual raise of 10% during a calendar year.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>All the above increases as allowed in Clause 1 shall be subject to the\nfollowing conditions:\u003C\u002Fp>\n\n\u003Cp>A) The salary increases mentioned in Clause 1(a) and Clause 1(b), shall only\nbe admissible to all such permanent and regular clerical and non-clerical\nworkers, who have been in service of the Bank, for at least six months during\nthe last calendar year;\u003C\u002Fp>\n\n\u003Cp>B) All such clerical and non-clerical workers who have been absent for more\nthan 90 days for any reason, during the previous calendar year (year prior to\nthe date of the effective date of increase in salary), shall not be entitled to\nreceive these increases;\u003C\u002Fp>\n\n\u003Cp>C) All such clerical and non-clerical workers who have been awarded\npunishments during the year (excluding warnings and reprimands) or whose\nadministrative action cases are pending shall not be entitled for these salary\nincreases. However, if the punishments are waived, set aside or proceedings are\ndropped; the benefits would be extended to such workers.\u003C\u002Fp>\n\n\u003Cp>D) All such clerical and non-clerical workers who are availing LPR or who\nhave tendered resignations or opted for pre mature retirement from Bank’s\nservice shall not be entitled for these salary increases;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. EDUCATION ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-educationtuition\">\u003Cp>It has been agreed to revise the education allowance to all permanent and\nregular clerical and non-clerical workers for the education of their children,\nup to a maximum amount Rs. 2800\u002F- per month per clerical\u002Fnon-clerical employee,\nsubject to authentication and submission of original fee slips:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>i\u003C\u002Ftd>\n      \u003Ctd>Up to matriculation\u003C\u002Ftd>\n      \u003Ctd>Rs. 1,200 per child per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>ii\u003C\u002Ftd>\n      \u003Ctd>For college\u002Ftechnical education\u003C\u002Ftd>\n      \u003Ctd>Rs. 1,500 per child per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>iii\u003C\u002Ftd>\n      \u003Ctd>For professional education from HEC recognized university\u002Feducational\n      \u003C\u002Ftd>\n      \u003Ctd>Rs. 2,000 per child per month\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>iv\u003C\u002Ftd>\n      \u003Ctd>Cash prize for Hifz e Quran\u003C\u002Ftd>\n      \u003Ctd>Rs. 50,000 one time.\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>All the payments as per sub clauses 2(i), 2(ii), above are subject to\nsubmission of free receipt and verification by the Bank and will only be\nallowed after the date of signing of this Agreement. Moreover, the payments as\nper the sub clause 2 (iv), above, shall only be applicable to those children of\nworkers, who Hifz e Quran, after date of signing of this Memorandum of\nSettlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>3. CLOSING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to increase the Closing Allowance for all permanent and\nregular clerical and non-clerical workers from Rs. 500 to Rs. 1,000 twice a\nyear (June 30 and December 31).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. REVISION IN PAY RANGES\u003C\u002Fh2>\n\n\u003Cp>The Bank hereby agrees for revising the pay ranges of Clerical and\nNon-Clerical workers, in the upper limits, by 30% before 1st April, 2012.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. HOUSE BUILDING FINANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to fix the maximum House Building Finance entitlements as\nfollows, for all the permanent and regular clerical and non-clerical workers,\nsubject to all the existing terms and conditions, already in practices:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>a\u003C\u002Ftd>\n      \u003Ctd>House Building Finance for Scales 1 to 3:\u003C\u002Ftd>\n      \u003Ctd>Rs. 1,100,000\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>b\u003C\u002Ftd>\n      \u003Ctd>House Building Finance for Scales 4 to 7:\u003C\u002Ftd>\n      \u003Ctd>Rs. 1,600,000\u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>Moreover, clerical and non-clerical workers shall be eligible for applying\nfor second house building finance, only on account of transfer to another city,\nprovided their house building finance limits have cushion for the second time\nhouse building finance. All other terms and conditions shall remain the\nsame.\u003C\u002Fp>\n\n\u003Ch2>6. MOTOR-CYCLE FINANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to revise expiry period of 5 years applicable from the\ndate of last motor-cycle finance disbursement for all the permanent and regular\nclerical and non-clerical workers. The expiry period has been reduced from 5\nyears to 3 years and all other terms and conditions shall remain the same.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. HAJJ\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that ten (10) persons amongst the permanent and regular\nclerical and non-clerical workers (once during the entire service), shall be\nsent for Hajj every year, at the expense of the Bank. The management shall bear\nfull payment to the Federal Government for Hajj application under the normal\nGovernment scheme.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. CAR LEASING\u003C\u002Fh2>\n\n\u003Cp>The maximum car leasing entitlement have been increased as follows, for all\nthe permanent and regular clerical workers.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Clerical:Rs. 850,000\u002F-\u003C\u002Fp>\n\n\u003Cp>All the existing terms and conditions of Car Leasing shall remain the\nsame.\u003C\u002Fp>\n\n\u003Ch2>9. BURIAL EXPENSES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>It has been agreed to revise the payment of Burial Expenses from Rs. 20,000\nto Rs. 40,000 for the burial of the permanent and regular clerical and\nnon-clerical workers, their dependent family members, who pass away during the\nservice or during the LPR of that employee.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. MARRIAGE GRANT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-childcare\">\u003Cp>It has been agreed to allow Marriage Grant to permanent and regular clerical\nand non-clerical workers, from staff welfare fund, as follows:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>i\u003C\u002Ftd>\n      \u003Ctd>For Self (in case of 1st Marriage only)\u003C\u002Ftd>\n      \u003Ctd>Rs. 200,000\u002F-\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>ii\u003C\u002Ftd>\n      \u003Ctd>For any two real daughters\u003C\u002Ftd>\n      \u003Ctd>\u003Cp>Rs. 200,000\u002F- (for each of the two real daughters, in case of 1st\n        marriage only)\u003C\u002Fp>\u003C\u002Ftd>\u003C\u002Ftr>\u003C\u002Ftbody>\u003C\u002Ftable>\u003C\u002Fdiv>\u003Ctable border=\"1\" style=\"width: 100%\">\u003Ctbody>\u003Ctr>\u003Ctd>\n      \u003C\u002Ftd>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. GROUP LIFE INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It has been agreed that Group Life Insurance coverage for permanent and\nregular clerical and non-clerical workers, stand revised, effective from next\nrenewal of Group Life Insurance Policy arranged by the Bank.\u003C\u002Fp>\n\n\u003Cp>Effective from the next renewal, the revised Group Life Insurance shall be\nas follows:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>i\u003C\u002Ftd>\n      \u003Ctd>Clerical Workers:\u003C\u002Ftd>\n      \u003Ctd>Rs. 450,000\u002F-\u003C\u002Ftd>\n    \u003C\u002Ftr>\n    \u003Ctr>\n      \u003Ctd>ii\u003C\u002Ftd>\n      \u003Ctd>Non-Clerical Workers\u003C\u002Ftd>\n      \u003Ctd>Rs. 400,000\u002F-\u003C\u002Ftd>\u003C\u002Ftr>\u003C\u002Ftbody>\u003C\u002Ftable>\u003C\u002Fdiv>\u003Ctable border=\"1\" style=\"width: 100%\">\u003Ctbody>\u003Ctr>\n    \u003C\u002Ftr>\n  \u003C\u002Ftbody>\n\u003C\u002Ftable>\n\n\u003Ch2>12. BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It has been agreed that if the Bank make profit, then in that case, two\nbasic salaries shall be paid to all the permanent and regular clerical and\nnon-clerical workers, as bonus, on Eid-ul-Fitar and Eid-ul-Azha, respectively.\nWhereas, one gross salary shall be paid to all the permanent and regular\nclerical and non-clerical workers, as bonus, at the time of annual performance\nappraisal:\u003C\u002Fp>\n\n\u003Cp>a. One month’s basic salary by the first day of the month in which\nEid-ul-Fitar occurs;\u003C\u002Fp>\n\n\u003Cp>b. One month’s basic salary by the first day of the month in which\nEid-ul-Azha occurs and;\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>c. One month’s gross salary at the time of payment of performance bonus to\nthe management grades workers.\u003C\u002Fp>\n\n\u003Cp>The above payments include bonus under Standing Order 10-C of the Industrial\nCommercial Employment (Standing Orders) Ordinance, 1968.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>13. PROMOTIONS\u003C\u002Fh2>\n\n\u003Cp>All Clerical and Non-Clerical Workers shall be eligible for promotion in the\nManagement Grade as Teller ‘MG12’, provided they improve their\nqualification (at least graduation with 2nd division) before reaching the age\nof 35 years and qualifying the interview for the said promotion.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. DAILY ALLOWANCE\u002FOVER TIME\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>The daily allowance (DA) for clerical and non-clerical workers have been\nrevised from Rs. 250 per day to Rs. 500 per day subject to all other applicable\nterms and condition.
