Allied Bank Worker’s Federation of Pakistan, a registered Federation of\nTrade Unions of Workmen of Allied Bank Limited, (having been certified as\nCollective Bargaining Agent) by the Registrar of Industry-wise Trade Unions\n(RITU), National Industrial Relations Commission (NIRC) vide Certificate dated\nJuly 06, 2005, hereinafter referred to as the CBA which expression shall\ninclude its successors.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Representing Employer:\u003C\u002Fp>\n\n\u003Cp>1. Mr. Abu Zar Bukhari.\u003C\u002Fp>\n\n\u003Cp>Short Recital of the Case:\u003C\u002Fp>\n\n\u003Cp>Whereas a Memorandum of Settlement was signed between the parties on August\n31, 2001 which memorandum of settlement enured till June 30, 2004;\u003C\u002Fp>\n\n\u003Cp>And whereas, the Bank challenged the legal ability of the Federation for\ncertification as CBA and Bank’s Appeal No. 12(24)\u002F2005 was dismissed by the\nfull Bench of NIRC vide Order dated November 30, 2006;\u003C\u002Fp>\n\n\u003Cp>And whereas the Bank filed a Writ Petition No. 68 of 2007 before the\nRawalpindi Bench of the Lahore High Court. The Writ Petition is now pending\nbefore the Islamabad High Court;\u003C\u002Fp>\n\n\u003Cp>And whereas The CBA on May 30, 2006 submitted a Notice u\u002Fs 25(1) of the\nIndustrial Relations Ordinance, 2002, enclosing therewith, a Charter of Demands\nwhich notice was followed by a Notice of Conciliation dated August 7, 2006 u\u002Fs\n25(3) of the Industrial Relations Ordinance, 2002:\u003C\u002Fp>\n\n\u003Cp>And whereas the Conciliator issued a letter dated October 03, 2006 and\nthereafter the CBA filed application for adjudication and determination of the\nindustrial dispute which is pending as Case No. 9(03).2006 before a Bench of\nNIRC at Islamabad;\u003C\u002Fp>\n\n\u003Cp>And whereas the parties recognize that there is a need for resolving\ndifferences through dialogue and understanding;\u003C\u002Fp>\n\n\u003Cp>And whereas the CBA pleaded and the management took into consideration the\nrise in the cost of living during the preceding years, as well as the\nanticipated rise in the cost of living for the forthcoming 3 years and in order\nto provide relief against such rises, the following settlement has been reached\nin respect of all matters relating to the terms and conditions of\nemployment.\u003C\u002Fp>\n\n\u003Cp>I. EFFECTIVENESS OF MEMORANDUM OF SETTLEMENT:\u003C\u002Fp>\n\n\u003Cp>a.This Settlement is being made expressly subject to the conditions\nprecedent mentioned in items (a) to (d), of Clause lll (Implementation) and as\nsoon as all of these conditions precedents are fulfilled, this Settlement shall\nbe deemed to have become effective and shall accordingly come into operation on\nAugust 01, 2008 and shall be binding and operative for a period of three (3)\nyears commencing from August 01, 2008 and terminating on July 31, 2011;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>II. TERMS OF MEMORANDUM OF SETTLEMENT:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>1) INCREASE IN SALARY:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>i) One time increase in salary:\u003C\u002Fp>\n\n\u003Cp>In view of the cost of living in the preceding years as well as anticipated\nrise in the cost of living during the tenure of this Memorandum of Settlement,\nit has been agreed that the gross salary of all permanent and regular clerical\nand non-clerical employees shall be increased by 15% with effect from August\n01, 2008. This increase is in addition to the increase allowed vide Circular\nNo. P\u002FINF-2007\u002F164 dated August 10, 2007 and Circular No. P\u002FINF-2008\u002F109 dated\nApril 25, 2008. The terms and conditions of employment, as per Circular No.\nP\u002FINF-2007\u002F164 dated August 10. 2007, are hereby agreed to form a part of this\nsettlement and shall have effect accordingly;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-wageincreasetype2\">\u003Cp>ii) Annual increase in salary (i.e., once in a calendar year):\u003C\u002Fp>\n\n\u003Cp>In the year 2009 and thereafter, on annualized basis, a minimum of 5%\nincrease in gross salary, shall be allowed to all permanent and regular\nclerical and non-clerical employees, and;\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>iii) Increase in salary on promotion:\u003C\u002Fp>\n\n\u003Cp>It is agreed that an increase in gross salary equivalent to 10% of the\nminimum of the pay range in which the employee is being promoted, shall be\nallowed to all permanent and regular clerical and non-clerical employees, if\nthey are promoted to the next grade. In such a case, the employee so promoted\nshall not get the increases as mentioned in Clause 1 (i) (one time increase in\nsalary). In case if the employee so promoted is entitled to receive annualized\nincrease in pursuance of Clause 1 (ii), only one of either the increase of\nsalary on promotion in pursuance of this Sub Clause (iii) or the payment in\nClause 1 (ii), whichever is greater, shall be paid.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The criteria for being eligible for the salary increases, as allowed in\nClause 1, above, shall be as follows:\u003C\u002Fp>\n\n\u003Cp>A) Shall only be admissible to all such permanent and regular clerical and\nnon-clerical employees, who have been in service of the Bank, for atleast six\nmonths during the previous calendar year of the effective date of the increase\n(i.e., if the effective date of respective increase is in the year 2008, then\nthe employee should have been in service for more than 6 months, during the\ncalendar year 2007);\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>B) Shall not be admissible for all such clerical and non clericals employees\nwho have been absent for more than 90 days for any reason, during the previous\ncalendar year of the effective date of the increase (year prior to the\neffective date of the respective increase in salary);\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>C) Shall not be admissible for all such clerical and non clericals employees\nwho are awarded punishment during the year (excluding warnings and reprimands)\nor whose administrative action cases are pending on the effective date of the\nrespective increase;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>D) Shall not be admissible for all such clerical and non clericals employees\nwho are availing LPR or who havae tendered resignations or opted for pre mature\nretirement from the Bank’s service, on or before the payment date of\nrespective increase;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>E) All such permanent and regular clerical and non-clerical employees, whose\ngross salaries are already at the maximum of their pay ranges (or whose gross\nsalaries are already at the maximum of their pay ranges (or whose gross\nsalaries cross the maximum of their pay ranges, due to this rise in salary),\nshall be paid an Out of Range Allowance (ORA) instead of an increase in their\nbasic salaries.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2) INCENTIVE ON ACQUIRING HIGHER EDUCATION:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-trainingprogrammes\">\u003Cp>The incentives for acquiring higher education has been agreed to be revised\nas follows:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>In case if a permanent and regular clerical and non-clerical employee\nimproves his\u002Fher educational qualification by acquiring a bachelors degree or a\nmasters degree from HEC recognized university\u002Feducational institution, an\nincrease of 15% in gross salary shall be allowed to those who secure first\ndivision and 10% in gross salary shall be allowed to those who secure below\nfirst division. This incentive on acquiring higher education shall only\napplicable to all such permanent and regular clerical and non-clerical\nemployees who pass examinations and obtain the qualifying results for bachelors\nor masters degrees after the date of signing of this Memorandum of\nSettlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3) DAILY ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(i) It has been agreed to allow half Daily Allowance (DA) to drivers on\nofficial tour lasts for more than eight (8) hours and continues beyond 9pm,\nsubject to the condition that the distance of the tour destination is more than\n70 kilometers far from the place of duty;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(ii) It has been further agreed that if a permanent and regular clerical and\nnon-clerical employee is posted on relieving duty, he\u002Fshe shall also be allowed\nhalf day daily allowance if the tour lasts for more than eight (8) hours and\ncontinues beyond 9pm, subject to the condition that the distance of the tour\ndestination is more than 70 kilometers far from the place of his\u002Fher duty.\nHowever, this allowance would not be paid for any relieving duty exceeding two\ndays.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The payments allowed as per Clause 3, above, shall be subject to the\nsatisfaction of all the other relevant rules and conditions, as per the Service\nRules of the Bank.\u003C\u002Fp>\n\n\u003Ch2>4) EDUCATION ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-educationtuition\">\u003Cp>It has been agreed to revise the education allowance allowable to all\npermanent and regular clerical and non-clerical employees for the education of\ntheir children, subject to a maximum of Rs. 1,400 per month. This revision in\nEducation Allowance supersedes all previous entitlements of education\nallowances for children:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>i) Upto matriculation: Rs. 400 per child per month;\u003C\u002Fp>\n\n\u003Cp>ii) For college\u002Ftechnical education: Rs. 500 per child per month;\u003C\u002Fp>\n\n\u003Cp>iii) For professional education from HEC recognized university\u002Feducational\nInstitution or from a professional body: Rs. 800 per child per month;\u003C\u002Fp>\n\n\u003Cp>iv) Cash Prize for Hifz e Quran: Rs. 15,000 one time.\u003C\u002Fp>\n\n\u003Cp>Subject to verification by the Bank and will Only be allowed to all those\nchildren who Hifz the Holy Quran after the date of Signing this Memorandum of\nSettlement and submit An authenticated certificate.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>5) IN-SERVICE MEDICAL FACILITY:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>In addition to in-service medical facility being already provided including\nthe in-service facility as per Para 6 of the Memorandum of Settlement dated\nAugust 31, 2001, the following in-service medical facility shall also be\nentitled to all permanent and regular clerical and non-clerical employees;\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccessrelatives\">\u003Cp>a.Parents of all permanent and regular clerical and non-clerical employees,\nwho are wholly dependent upon such an employee shall also be provided\nhospitalization medical facilities on the same terms and conditions as are\napplicable to spouse and dependent children. However, the payment will be\nlimited to the amount of the employee’s share calculated by dividing the\nhospitalization medical expenses as allowed under the terms and conditions of\nthe Bank, divided by the number of brothers of the said employee (including the\nemployee). Furthermore, the said amount shall only be reimbursed for the\nparents of the said clerical and non-clerical employee if the parents (s) are\ndependent on the employee and do not have a separate source of income, for\nwhich an undertaking will be provided by the said employee at the time of\nclaiming of reimbursement.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-paidmaternityleavepay\">\u003Cp>b. Maternity charges:\u003C\u002Fp>\n\n\u003Cp>i) For delivery at home, maternity charges of Rs. 5,000 per delivery shall\nbe entitled to all permanent and regular clerical and non-clerical\nemployees;\u003C\u002Fp>\n\n\u003Cp>ii) For delivery at a hospital or at a maternity home, maternity charges of\nRs. 10,000 per delivery shall be entitled to all permanent and regular clerical\nand non-clerical employees, subject to deduction of hospitalization charges\npaid for the same.\u003C\u002Fp>\n\n\u003Cp>The Maternity charges, as allowed in 5 (b) (i) and 5 (b) (ii) shall only be\napplicable to all deliveries which take place after the date of the signing of\nthis Memorandum of Settlement and will be restricted to three (3) deliveries,\nincluding deliveries that have taken place before the date of this settlement.\nTherefore no maternity charges for any child beyond three will be paid by the\nBank.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6) ALLOWANCES FOR GUARDS:\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to revise the allowances for all permanent and regular\nguards. The new structure for the guards shall be as follows, and there shall\nnot be any other allowance for guards, except for the ones mentioned below.\nThis revision in the allowances for guards supersedes all previous entitlements\nof allowances:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) Gun Allowance:\u003C\u002Fp>\n\n\u003Cp>i) Branch having two or more guards: Rs. 200 per guard per month;\u003C\u002Fp>\n\n\u003Cp>ii) Branch having only one guard: Rs. 400 per guard per month;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) Duty during weekly or gazette holidays:\u003C\u002Fp>\n\n\u003Cp>i) In case of one guard on duty: Rs. 170 per day;\u003C\u002Fp>\n\n\u003Cp>ii) In case of two or more guards on duty: Rs. 100 per day;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) Saturday allowance:\u003C\u002Fp>\n\n\u003Cp>It is also agreed that the guards performing day duty on Saturdays, shall be\npaid an additional allowance of Rs. 100 for every Saturday on day duty.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7) SPECIAL DUTY ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It has been decided to pay Special Duty Allowance @ Rs. 300 per month to the\nfollowing categories of all permanent and regular clerical and non-clerical\nemployees;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. Duplicating Machine Operator\u003C\u002Fp>\n\n\u003Cp>b. Photocopiers Operator\u003C\u002Fp>\n\n\u003Cp>c. Telex Machine Operator\u003C\u002Fp>\n\n\u003Cp>d. Telephone Operator\u003C\u002Fp>\n\n\u003Cp>e. Machine Operator\u003C\u002Fp>\n\n\u003Cp>f. A\u002Fc Machine Operator\u003C\u002Fp>\n\n\u003Cp>g. Bill Machine Operator\u003C\u002Fp>\n\n\u003Cp>h. Carpenter\u003C\u002Fp>\n\n\u003Cp>i. Masson\u003C\u002Fp>\n\n\u003Cp>j. Lift Operator\u003C\u002Fp>\n\n\u003Ch2>8) CLOSING ALLOWANCE:\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It has been agreed to increase the Closing Allowance for all permanent and\nregular clerical and non-clerical employees from Rs. 250 to Rs. 500, twice a\nyear (June 30 and December 31).\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9) LEAVES\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>a) Privilege Leave Encashment:\u003C\u002Fp>\n\n\u003Cp>It has been agreed to allow a non-time (only) privilege leave encashment of\nmaximum of 30 days on the basis of salary as on June 30, 2007, to all permanent\nand regular clerical and non-clerical employees, subject however to the proviso\nthat the remaining accumulataed privilege leave balance of the employee, after\nthis leave balance of the employee, after this leave encashment, is not less\nthan 150 days, as on June 30, 2007;\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) Hajj leave:\u003C\u002Fp>\n\n\u003Cp>In addition to any and all other leave entitlements, a permanent and regular\nclerical and non-clerical employee shall be allowed Hajj leave for actual\nnumber of days (inclusive of date of departure from and arrival in Pakistan)\nfor performing Hajj, and;\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. Provisions for leave and leave encashment as already modified:\u003C\u002Fp>\n\n\u003Cp>It has been agreed that all the other provisions for leave and leave\nencashment, as modified by Circular No. P\u002FINF-2007\u002F164 dated August 10, 2007,\nshall remain unchanged and in force.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10) HOUSE BUILDING FINANCE\u003C\u002Fh2>\n\n\u003Cp>It has been agreed to fix the maximum House Building Finance entitlements as\nfollows. The employees and regular clerical\nand non-clerical employees shall be eligible to participate in the Draw who\nhave been in the regular service of the Bank for atleast 5 years from the date\nof the Draw and who have not performed Hajj before.\u003C\u002Fp>\n\n\u003Ch2>15) BURIAL EXPENSES:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>It has been agreed to revise the payment of Burial Expenses from Rs. 10,000\nto Rs, 20,000 from the Bank’s resources, for the burial of the permanent and\nregular clerical and non-clerical employees, who pass away during the service\nor during the LPR. This revision in Burial expenses supersedes all previous\nentitlements of Burial expenses.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16) UNIFORMS:\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cp>It has been agreed to revise the facilities for uniforms, for all permanent\nand regular non clerical employees, as follows. A joint application is made to the Bench dealing with Case No. 9(03)\u002F2006\npending before Single Bench of NIRC at Islamabad with a prayer of disposal of\nthe case in terms of the settlement and the case is disposed off\naccordingly.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. A joint application is made in Writ Petition No. 68\u002F2007 praying therein\nthat Para II on Page 15 of the Judgment be deleted and the Writ Petition be\ndisposed of on the above terms and writ petition is disposed off accordingly.\nTill such disposal, nothing contained in this settlement shall derogate from\nthe stand taken by the Bank.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>d. All cases filed against the Bank, which the CBA, its constituent Unions\nor any of the members of the constituent Unions have filed, initiated or\nparticipated in, are withdrawn and a documentary court evidence of these\nwithdrawals, is provided to the Bank.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>IV.
