This Memorandum of Settlement under Section 49 IRA-2012 is made on 18th\nSeptember, 2012 between Pakistan Sports Board, Islamabad hereinafter called\nmanagement of Board and the All Pakistan Sports Board Employees Union (CBA),\nIslamabad (Industry wise Trade Union) hereinafter called Collective Bargaining\nAgent (CBA) in the establishment of Pakistan Sports Board. This 4th Memorandum\nof Settlement shall be effective from 1st July, 2012 unless otherwise specific\nand shall continue to be in force and binding on the parties for a period of\ntwo years.\u003C\u002Fp>\n\n\u003Cp>2. In pursuance of office order No.F.41-2\u002F2012-PSB(Admn) dated 14th June,\n2012 the meeting of the committee constituted for the negotiation with CBA\nUnion on 4th Charter of Demands were held 12th July, 26th July, 10th, 13th\n&amp; 17th September, 2012 in PSB Committee Room. Whereas the PSB Employees Union (CBA), Islamabad (Industry wise Trade\nUnion) in the establishment of PSB had put 4th Charter of Demands dated\n25.09.2011 to the PSB Management which was discussed bilaterally by the\nnegotiation teams nominated by both sides and comments on each item of the\ndemand was prepared\u002Fconsidered and finally as per bilateral negotiations, a\nMemorandum of Settlement has been arrived at in the following manners: -\u003C\u002Fp>\n\n\u003Cp>PART - I\u003C\u002Fp>\n\n\u003Ch2>Item No. 1 &amp; 2\u003C\u002Fh2>\n\n\u003Cp>It has been mutually agreed that status-quo will be maintained in respect of\ndemands accepted in pervious Memorandums of Settlement as under: -\u003C\u002Fp>\n\n\u003Cp>i) No.F.41-28\u002F2003-PSB (Admn) dated 8th March, 2003\u003C\u002Fp>\n\n\u003Cp>ii) No.F.41-28\u002F2006-PSB (Admn) dated 21st April, 2006\u003C\u002Fp>\n\n\u003Cp>iii) No.F.41-42\u002F2012-PSB (Admn) dated 6th February, 2010\u003C\u002Fp>\n\n\u003Cp>The agreed demands which were from time to time revised in subsequent\nsettlement will be binding on both parties.\u003C\u002Fp>\n\n\u003Cp>PART - II\u003C\u002Fp>\n\n\u003Ch2>Item No. 3\u003C\u002Fh2>\n\n\u003Cp> in 3rd Memorandum of Settlement a committee under the Chairmanship of DG,\nPSB was constituted to purchase the land around Islamabad\u002FRawalpindi for\nresidential housing scheme (Sports Valley) on ownership basis for the PSB\nemployees. The committee will propose procedure\u002Fcriteria for purchase of\nland\u002Fplot, survey the area\u002Fland and investment of fund and submit its\nrecommendations\u002Ffeasibility report to DG, PSB within two months. The committee\nhas prepared rules\u002Fpolicy for placing before Executive Committee for its\napproval. For further necessary action the committee is reconstituted is as\nunder: -\u003C\u002Fp>\n\n\u003Cp>i) Audit\u002FAccounts Officer - Member\u003C\u002Fp>\n\n\u003Cp>ii) Secretary General\u002FPresident - Member\u003C\u002Fp>\n\n\u003Ch2>Item No. 4\u003C\u002Fh2>\n\n\u003Cp>a) It has been agreed that rate of membership free Swimming Pool &amp; other\nfacilities provided by PSB and its subordinate offices should be increased\n3-times and to discourage the culture of free membership. In this regard a new\npolicy will be introduce shortly in consultation with the concerned wing\nfurthermore, membership fees be increased 10% on annual basis.\u003C\u002Fp>\n\n\u003Cp>b) It has been agreed that two new Swimming Pools will be constructed in PSB\npremises to provide additional membership facilities and to increase the income\nresources of PSB, subject to completion of all codal formalities relating to\ndevelopment projects. P&amp;D Section of PSB will take necessary step to\nformulate the project.\u003C\u002Fp>\n\n\u003Cp>c) It has been agreed that during the functions of different private\norganization parking fee for private vehicles should be charged @ Rs. 20 &amp;\nRs. 10 per vehicle and motorcycle respectively with the coordination and\ncooperation of Facilities Wing. The income would be transferred to PSB A\u002Fc. The\npolicy\u002Frules in this regard will be formulated shorty with cooperation of\nFacilities Wing.\u003C\u002Fp>\n\n\u003Cp>d) It has been agreed that agreement would be signed with different national\nand multinational companies for increasing PSB Facilities on sponsorship basis.\nIt has also been agreed that Multimedia\u002FCommercial Sign Boards etc. will be\nallowed subject to N.O.C by CDA. The policy\u002Frules in this regard will be\nformulated shortly with cooperation of Facilities Wing.\u003C\u002Fp>\n\n\u003Cp>e &amp; f) not agreed.\u003C\u002Fp>\n\n\u003Cp>g) It has been agreed that the area of previous Nursery will be converted in\nChildren Park for developing Kid's sports activities. The maintenance\ncharges\u002Fwages of staff would be charged through entry fees to run activities\nsmoothly. The policy\u002Frules in this will be formulated shortly with cooperation\nof Facilities Wing.\u003C\u002Fp>\n\n\u003Cp>h) It has been agreed that Snooker Hall will be opened for membership of\nSnooker players. The terms &amp; conditions will be formulated within the lines\nof membership policy adopted at swimming pools.\u003C\u002Fp>\n\n\u003Cp>PART - III\u003C\u002Fp>\n\n\u003Ch2>Item No. 5\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that following allowances would be paid\u002Fincreased to the\nemployees of different cadres according to their services\u002Fnature of duties at\nthe following rates: -\u003C\u002Fp>\n\n\u003Cp>a) The rate of Computer Allowance has been increased from Rs. 500\u002F- to Rs.\n750\u002F- per month. The Computer Operator-cum-Assistant will also be entitled to\nComputer and File Maintenance\u002FHandling Allowance at prescribed rates on\nexisting terms and conditions.\u003C\u002Fp>\n\n\u003Cp>b) Pool Cleaners, Welder &amp; Electrician-cum-plumber will also be entitled\nto Risk Allowance @ Rs. 500\u002F- p.m. on existing terms and conditions.\u003C\u002Fp>\n\n\u003Cp>c) The rate of Heat Allowance admissible to Assistant Cooks, Cooks and\nTandoorchies will be enhanced from Rs. 200\u002F- to Rs. 300\u002F- p.m.\u003C\u002Fp>\n\n\u003Cp>d) The rate of Special Overtime Allowance is entitled from Rs. 1200\u002F- to Rs.\n2500\u002F- p.m. admissible to following cadres in PSB Hostels i.e. Waiter,\nDishwasher, Tandoorchi, Missalchi, Cook, Helper, Assistant Cook, Cook,\nCaretaker, Assistant Superintendent Hostel &amp; Superintendent Hostel.\u003C\u002Fp>\n\n\u003Cp>e) Dropped\u003C\u002Fp>\n\n\u003Cp>f) The Store Staff i.e. Storeman, Storekeeper, Sr. Storekeeper will be\nentitled to Store Maintenance Allowance @ Rs. 300\u002F- p.m.\u003C\u002Fp>\n\n\u003Cp>g) On the written request of concerned employees working in BPS 11-16 to\nFederal Minster for IPC, the case for payment of rental ceiling with salary is\nunder process in the Ministry of Inter-Provincial Coordination. The\nManagement's Negotiation Team did not agree due to prevailing constraints. The\ndemand will be reconsidered in next Financial Year.\u003C\u002Fp>\n\n\u003Cp>However, it has been agreed that House Requisition Facility should be\nprovided to maximum number of employees working in BPS 11 to 16 every year as\nper budget provision. The seniority list will be strictly followed and no\nspecial case will be entertained in future. In this regard, upto-date seniority\nlists will be prepared by Administration Wing within one month and circulated\nwith a copy to Secretary General, CBA.\u003C\u002Fp>\n\n\u003Ch2>Item No. 6\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthcareaccess\">\u003Cp>a) With a view to provide better medical treatment facility to PSB\nemployees, it has been agreed that to constitute committee with following\ncomposition to thoroughly examine the engagement on PSB panel of Shifa\nInternational Hospital, Islamabad, C.M.H Rawalpindi, Al-Shifa Eye Trust,\nRawalpindi. Engagement of a Gynecologist and Dentist at different places of\ntwin cities and engagement of a Medical Care Centre &amp; Medical Store at\nBhara Kahu, Islamabad: -\u003C\u002Fp>\n\n\u003Cp>a) DG (Tech&amp;Trg) - Chairman\u003C\u002Fp>\n\n\u003Cp>b) DDG (R&amp;T) - Member\u003C\u002Fp>\n\n\u003Cp>c) Director (NF) - Member\u003C\u002Fp>\n\n\u003Cp>d) Secretary General\u002F\u003C\u002Fp>\n\n\u003Cp>President - Member\u003C\u002Fp>\n\n\u003Cp>The Committee will survey and collect rate lists and give its\nrecommendations within a period of one month. The committee will also examine\nthe utility of engagement of two medical laboratories at the same place and the\nanomaly in medical ceiling of employees appointed during 2000 to 2007 and those\nwho were appointed after 01-07-2007.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>b) It has been agreed that in case of Emergency\u002Ffor medical treatment and to\ncarry dead bodies, Ambulance Service shall be provided to PSB employees and\ntheir heirs on payment basis at the prescribed rates of the relevant vehicles.\nThe Ambulance will be provided immediately on receipt of request and formal\napproval of the competent authority shall be obtained later.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>c) It has been agreed that uniform to Para-Medical Staff of PSB i.e. Lab\nTechnician, Dispenser working in Rehabilitation Centre would be provided once a\nyear in the month of July\u002FAugust on department's cost. Specification of the\nuniforms will be recommended by DDG(R&amp;T).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>e) Dropped.\u003C\u002Fp>\n\n\u003Ch2>Item No. 7\u003C\u002Fh2>\n\n\u003Cp>a) It has been agreed that the Seniority of Plumbing\u002FPipe Fitting Staff will\nbe combined and a post of Foreman (Plumber\u002FPipe Fitter) BPS-15 will be created\nby upgradation of one of the existing posts alongwith the incumbent.\u003C\u002Fp>\n\n\u003Cp>b&amp;c) It has been agreed in principle, that the posts of Mali, Groundman,\nN\u002FQasid, Sanitary Staff, Lab Attended, Waiter, Missalchi, Fire Fighting Staff\nand Store Cadre will be upgraded as per criteria enclosed at Annex-A. A\ncommittee will be constituted by the DG, PSB for examination and recommendation\nfor approval of competent authority. Furthermore, a proposal for up-gradation\nof the posts of Jr. Coaches will be initiated by Administration Wing.\u003C\u002Fp>\n\n\u003Cp>d) The posts of Stenotypist in BPS-14 and Stenographer in BPS-16 has already\nupgraded in pursuance of Government Policy. New posts of Stenographer would be\ncreated according to the strength of officers in BPS-19 &amp; 20 and will be\nfilled by promotion of existing Stenotypist.\u003C\u002Fp>\n\n\u003Ch2>Item No. 8 \u003C\u002Fh2>\n\n\u003Cp>Dropped\u003C\u002Fp>\n\n\u003Ch2>Item No. 9 \u003C\u002Fh2>\n\n\u003Cp>In pursuance of previous Memorandum of Settlement\u002FDemands of CBA the number\nof employees performing on Hajj every year at PSB's expense was increased from\n3 to 4 in current financial year. The\nsons\u002Fdaughters of PSB's retired employees should be engaged on daily wages\nbasis without any discrimination on the recommendation of CBS subject to\nfulfillment of required qualification.\u003C\u002Fp>\n\n\u003Ch2>Item No. 13\u003C\u002Fh2>\n\n\u003Cp>It has been agreed that the cope with prevailing situation and to provide\nFinancial Assistance caused due to natural calamities i.e. Heavy Rains, Floods,\nEarthquake etc. Death Grant to legal heirs on death of an employee during the\nservice an Emergency Fund should be raised under the administrative control of\nPSB Employees Union (CBA). PSB Employees Union (CBA) will frame policy\u002Frules\nfor generation of Emergency fund and for its utilization. The Board will deduct\nthe amount from Salaries\u002FHonorarium after receipt of willingness of employees\nthrough Secretary General and the amount so recovered be sent to PSB Employees\nUnion Emergency Fund A\u002Fc.\u003C\u002Fp>\n\n\u003Ch2>Item No. 14 \u003C\u002Fh2>\n\n\u003Cp>The management team did not agree with the demand for opening a Middle\nSchool within premises of PSB.\u003C\u002Fp>\n\n\u003Ch2>Item No. 15 \u003C\u002Fh2>\n\n\u003Cp>It has been agreed that the posts of lying vacant in PSB in all grades\nshould not be filled by deputationists in future by protecting due interest of\nPSB employees.
