Charter of Nineteen (19) Demands along with copy of the\nNotice is annexed hereto and marked as Annexure A;\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS during the course of negotiations\u002Fdiscussion and meetings held\nfrom time to time the parties considered the rise in the cost of living and\ninflation justification of the Union’s Charter of Demands while focusing\nimprovement in productivity, better cordial relation and industrial peace.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the “Company” pleaded rationalization of certain facilities\nand capping of hidden costs as justification for their Charter of Demands;\u003C\u002Fp>\n\n\u003Cp>It is also considered necessary to bring on record that the overall Package\nSettlement on aforesaid Charter of Demands has been reached keeping in view of\ninflation and rise in the cost of living, rationalization of facilities,\ncapping of hidden costs and the assurance given to the Employer that the\nworkers shall work with more devotion and commitment and shall enhance their\nproductivity;\u003C\u002Fp>\n\n\u003Cp>And Whereas as a result of a series of discussions, bilateral negotiations\nand collective bargaining considering the inflation, cost of living, the\nparties have reached to an Agreement for a period of two (2.0) years from July\n01, 2014 to June 30, 2016 with arrears for the period from January 01, 2014 to\nJune 30, 2014 being in full and final settlement of all the Demands served\nthrough Charter of Demands dated 01-01-2014, which is noted as settled against\neach of Demand and annexed herewith as Annexure-B. it has, however, been agreed\nbetween the “Company” and the “Union” that neither this agreed period\nof the Agreement nor the quantum of benefits\u002Ffacilities extended to permanent\nunionized workers awarded under this Agreement will ever be quoted as\nprecedence in future.\u003C\u002Fp>\n\n\u003Cp>THIS TERMS THUS AGREED WHEREOF ARE GIVEN UNDER: -\u003C\u002Fp>\n\n\u003Ch2>1. BASIC SALARY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed that all the permanent unionized workers who are on the\nconfirmed payroll of the “Company” on the date of signing of this Agreement\nwill be given one-time flat monthly increase of Rs. 1550.00 (Rupees One\nThousand Five Hundred Fifty only) in their respective Basic Salaries w.e.f.\nJuly 01, 2014. The Company shall however pay arrears for the period from\nJanuary 01, 2014 to June 30, 2014.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>2. HOUSE RENT\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all the permanent unionized workers who are on the\nconfirmed payroll of the “Company” on the date of signing of this Agreement\nwill be given one-time flat monthly increase of Rs. 800.00 (Rupees Eight\nHundred only) in their respective House Rent Allowance of December 31, 2013\nthus making a total of Rs. 5700.00 (Rupees Five Thousand Seven Hundred only)\nper month w.e.f. July 01, 2014. The Company shall however pay arrears for the\nperiod from January 01, 2014 to June 30, 2014.\u003C\u002Fp>\n\n\u003Ch2>3. CONVEYANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>It is agreed that all the permanent unionized workers who are on the\nconfirmed payroll of the “Company” on the date of signing of this Agreement\nwill be given one-time flat monthly increase of Rs.500.00 (Rupees Five Hundred\nonly) in their respective Conveyance Allowance of December 31, 2013 thus making\na total as under w.e.f. July 01, 2014.\u003C\u002Fp>\n\n\u003Cp>a) Male Workers - Rs. 4000.00 (Rupees Four Thousand only) per month.\u003C\u002Fp>\n\n\u003Cp>b) Female Workers - Rs. 3900.00 (Rupees Three Thousand Nine Hundred only)\nper month.\u003C\u002Fp>\n\n\u003Cp>The Company shall however pay arrears for the period from January 01, 2014\nto June 30, 2014.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. UTILITY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent unionized workers who are the confirmed\npayroll of the “Company” on the date of signing of this Agreement will be\ngiven one-time flat monthly increase of Rs. 250.00 (Rupees Two Hundred Fifty\nonly) in their respective Utility Allowance of December 31, 2013 thus making a\ntotal of Rs. 1250.00 (Rupees One Thousand Two Hundred Fifty only) per month\nw.e.f. July 01, 2014. This Utility Allowance will, however, not from part of\nwages for any purpose, whatsoever. The Company shall however pay arrears for\nperiod from January 01, 2014 to June 30, 2014.\u003C\u002Fp>\n\n\u003Ch2>5. HEALTHCARE INSURANCE SCHEME\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccessrelatives\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>It is agreed that existing medical benefits of Annual Hospitalization\ncoverage under Healthcare Insurance Scheme for the Permanent Unionized Workers\nwho are not covered under Government’s Social Security Scheme have been\nalready on July 01, 2014. It is further agreed that 50% enhancement over and\nabove allowable hospitalization limit in Health Insurance shall be considered\nin genuine cases as the case may be.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurancerelatives\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It is reiterated that effective July 01, 2014, Health Insurance Scheme\npertains to Medical Benefits under Hospitalization coverage will also be\nextended to all those permanent unionized workers who are covered under\nGovernment’s Social Security Scheme with the application of same and exiting\nbenefits which are being availed by all other permanent unionized workers. It\nis further agreed that such Social Security Covered Permanent Unionized Workers\nSHALL NOT claim any benefit(s) or apply for leaves from Social Security\nInstitution once they are registered under Company’s Health Hospitalization\nInsurance Scheme.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>6. GROUP LIFE INSURANCE\u003C\u002Fh2>\n\n\u003Cp>While superseding all relevant previous settled\u002Fagreed clauses in respecting\nof group insurance, it is informed that effective date of signing of this\nAgreement Group Insurance for Permanent Unionized Workers shall be revised as\nunder:\u003C\u002Fp>\n\n\u003Cp>In case of Natural Death during the service-Rs. 1,000,000.00 (Rs. One\nMillion only)\u003C\u002Fp>\n\n\u003Cp>In case of Accidental Death during service-Rs. 2,000,000.00 (Rs. Two Million\nonly)\u003C\u002Fp>\n\n\u003Cp>However, any increase during currency of this Agreement, if conferred\nthrough legislative amendment, is liable to be set off.\u003C\u002Fp>\n\n\u003Ch2>7. NIGHT SHIFT EX-GRATIA\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-NOCTPREM_trigger\">\u003Cp>It has been agreed that effective July 01, 2014 those Permanent Unionized\nWorkers who are required to work in full working night will be paid Night Shift\nEx-Gratia @ Rs. 80.00 (Rs. Eighty only) per full working night instead of Rs.\n65.00 (Rs. Sixty-Five only) per full working night. The Company shall however\npay arrears for the period from January 01, 2014 to June 30, 2014.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>8. FINANCIAL ASSISTANCE FOR EDUCATION OF WORKERS’ CHILDREN AT\nINTER\u002FGRADUATION LEVEL\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-educationtuition\">\u003Cp>It has been agreed that the Company will provide Scholarship to six (06)\nchildren of permanent unionized workers in an academic year with following\nconditions which are required to be fulfilled:\u003C\u002Fp>\n\n\u003Cp>• The Scholarship will be offered to children of permanent unionized\nworkers who will enroll with their HSC or Graduation level studies with\nGovernment accredited colleges\u002FInstitution and obtain 70% marks in preceding\nexamination.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• The amount of Scholarship to the children of permanent unionized workers\nwill be 50% of the total fee or maximum up to Rs. 50,000\u002F- per academic year or\nRs. 25,000\u002F- per semester in a year.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• The payment of Scholarship will be formalized upon production of\nTranscripts of all documents including Marks Statement, Provincial\u002FCharacter\nCertificate, NADRA Registration Form, Fee admission\u002F admission receipts or any\nother document if required by the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>• After first year of academic session or at end of two semesters, renewal\nof this benefit will be subject to maintaining merit standards accordingly.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. ACCIDENT DURING WORK\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-disabilitypay\">\u003Cp>It has been agreed in principle that Company shall bear all expenses if a\npermanent union worker is met with an accident during working at Plant’s\nWorkplace. However, in case of non-compliance\u002Fnegligence or casual approach, if\nreported by Concerned Manager, a thorough investigation will be conducted.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>10. ATTENDANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed that effective July 01, 2014, the Attendance Allowance for the\npermanent union workers shall be paid @ Rs. 500.00 (Rs. Five Hundred only) per\nmonth to each such permanent unionized worker who has not availed any leave or\nabsence off his account during the calendar month.\u003C\u002Fp>\n\n\u003Cp>It is agreed that effective July 01, 2014 Attendance Allowance @ Rs. 250.00\n(Rs. Two Hundred Fifty only) per month will be paid to such permanent unionized\nworker(s) who avails maximum of a single half day Leave or absence during a\nwhole calendar month. Any worker having leave or absence for more than a single\nhalf day in calendar month shall not be entitled for the attendance allowance.\nThe Company shall however pay arrears for the period from January 01, 2014 to\nJune 30, 2014.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>11. WITHDRAWAL OF UNION DEMANDS\u003C\u002Fh2>\n\n\u003Cp>The rest of Union Demands served in the “Union” Charter of Demands dated\n01-01-2014, which were not settled in negotiations between “Union” and the\n“Company” shall stand withdrawn by “Union” unconditionally.\nFurthermore, Demand No. 28 of Charter of Demands of 01-01-2012 which will still\nremain operative and both agree to leave Demand No. 28 on the decision of Full\nBench of NIRC in Appeal No. 12(07)\u002F2013-K CMA No. 24(06)\u002F2013-K of 2013 to\nnegotiate the same in the light of the decision of NIRC under due process of\nlaw.\u003C\u002Fp>\n\n\u003Ch2>12. COST OF LIVING ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It has been agreed that any financial increase in future if made by the\nGovernment or awarded through any legislation during the currency of this\nSettlement, either in Salary\u002FCost of Living Allowance or in facilities\nincreasing directly \u002Findirectly the individual’s emoluments, shall be set-off\n\u002Fadjusted against the aforesaid increase made by the “Company” through this\nSettlement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>13. GENERAL\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) The “Union”, its office bearers and its members will use their best\nendeavors to protect the interest of the “Company”, work for Company’s\nprosperity and give services of highest equality with increased productivity.\nThe “Union” will make all out efforts to increase the efficiency of workers\nand create harmony amongst the workers and Management for collective interest\nof the “Company” and its employees.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) The “Company” and its management staff will play guiding role to\nmotivate the workers to achieve best possible productivity and will look after\nfor their betterment, welfare and dignity.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) Any change in the composition of office bears of the “Union” (the\nC.B.A) of formation of a new union shall not affect the operation and binding\nnature of this Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. FINALITY\u003C\u002Fh2>\n\n\u003Cp>It is agreed by the “Union” that they shall not raise any further\ndemands whatsoever, having direct or indirect financial implications for the\n“Company” during the period covered by this Settlement and the benefits of\nthis Settlement shall not be reduced during the validity period of this\nSettlement.\u003C\u002Fp>\n\n\u003Ch2>15. DISCIPLINE AND PRODUCTIVITY\u003C\u002Fh2>\n\n\u003Cp>It is also agreed by the “Union” that the “Union” itself, it’s\noffice bearer and its members shall continue to educate\u002Fcounsel their workers\nabout all aspect of their personal discipline particularly late reporting to\nworkplace, early leaving from workplace, intermittent unauthorized absences\nfrom work place during the working hours, unauthorized absences.\u003C\u002Fp>\n\n\u003Cp>The “Union”, its office bearer and its members have also ensured that\nduring currency of this Agreement they will not resort to illegitimate strike\nbeyond the ambit of legal provisions, glow-slow, demonstration or agitation.\nThe “Union” has also agreed to increase the productivity through\nimprovement in attendance and strict observance of Current Good Manufacturing\nPractices (cGMP), Occupational Health &amp; Safety Standards, and personal\nhygiene etc.\u003C\u002Fp>\n\n\u003Ch2>16. SAVING OF TERMS AND CONDITIONS OF EMPLOYMENT\u003C\u002Fh2>\n\n\u003Cp>All terms and conditions of employment as on December 31, 2013 applicable to\nall permanent unionized worker under previous agreement\u002Fsettlements will remain\neffective and operative in so far as these are not repugnant to or inconsistent\nwith the text and scope of this Settlement.\u003C\u002Fp>\n\n\u003Ch2>17.
