ZAFAR IQBAL - FINANCE SECRETARY\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>Phoenix Armour Employees Union, Room No. 15, Orakzai Plaza, Town Chowk,\nUniversity Road, Peshawar, in its capacity as Collective Bargaining Agent\ndetermined by the National Industrial Relations Commission, Islamabad, vide\nRegistration No. 5\u002F2004, served a Charter of Demands, dated January 2, 2013 to\nthe Management of M\u002Fs Phoenix Armour (Pvt.) Ltd. P&amp;O Plaza, I.I Chundrigarh\nRoad, Karachi under section 34 of the Industrial Relations Act, 2012.\u003C\u002Fp>\n\n\u003Cp>Management on the receipt of the Charter of Demands dated January 2, 2013\nentered into negotiation with the union. After a series of meetings, wherein\nthe Union pleaded inflation and rise in the cost of living which factor\nprimarily weighed in acceptance of the demands provided herein below with\nmutual understanding between the C.B.A Union and the Management, the parties\narrived at a full and final settlement on all the demands contained in the said\nCharter of Demands as detailed hereinafter:\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>1. INCREASE IN SALARY\u002FWAGES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is submitted by the C.B.A Union that the Company has already increased\nRs. 1,500\u002F- (Salary &amp; allowance) w.e.f. 1st June, 2012 as per demands of\nunion and the wages presently being paid by the company are higher any other\nsecurity company, in the country.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is also agreed by the C.B.A Union that the company is paying all\nallowances payable to the workmen, as per the applicable laws of Federal and\nProvincial Government. Hence, in consideration of above, the demand for further\nincrease in salary has been withdrawn by the C.B.A Union.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>In addition to above, Management, as per demand of the C.B.A Union agreed to\npay following allowances to various categories of workmen, as per condition\nlaid down herein below:\u003C\u002Fp>\n\n\u003Cp>a. Matric Allowance\u003C\u002Fp>\n\n\u003Cp>Matric Allowance Rs. 100\u002F- per month, to all guards who possess\nMatriculation Certificate.\u003C\u002Fp>\n\n\u003Cp>b. Washing Allowance\u003C\u002Fp>\n\n\u003Cp>Washing Allowance Rs. 24\u002F- per month, all guards staff, where washing\narrangements are not made by the company or its client.\u003C\u002Fp>\n\n\u003Cp>c. Risk Allowance\u003C\u002Fp>\n\n\u003Cp>As per the discretion of the management for Hard Area notified.\u003C\u002Fp>\n\n\u003Cp>d. Officiating Allowance\u003C\u002Fp>\n\n\u003Cp>As per the Rules and Regulations framed by the Company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed between the parties that the Company’s existing results and\nbusiness losses do not permit grant of two Bonuses each year. However, Company\nwill pay Bonus, subject to profits as per law.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It is agreed that the following Insurance Cover will be provided by the\ncompany for the workmen.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. Accidental Death\u002F injury, on duty (including group insurance) Rs. 3 Lacs\n- PAPL [Guarding Staff].\u003C\u002Fp>\n\n\u003Cp>b. Accidental Death\u002F injury, off duty (including group insurance) Rs. 2.0\nLacs – PAPL [Guarding Staff].\u003C\u002Fp>\n\n\u003Cp>c. Death of office staff on duty \u002F off duty Rs. 2 Lacs.\u003C\u002Fp>\n\n\u003Cp>d. Accidental Death of office staff Rs. 4 Lacs.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The Insurance Cover taken by the management will have proper schedule of\ncompensation in case of total\u002Fpartial permanent disability during the course of\nperformance of duty.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. PERMANENT EMPLOYMENT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-contracttrial\">\u003Cp>It is agreed that all employees who are working on 9 months contract basis\nagainst permanent nature of job and have completed successfully 3 months\nprobationary period shall be confirmed\u002Fmade permanent employee w.e.f. November\n22, 2012.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. LEAVE WITH PAY ON ACCIDENT INJURY\u002FHOSPITALIZATION\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>The management has agreed to accept the demand of the C.B.A union as to\nleave with pay during hospitalization due to accidental injury and it is agreed\nto incorporate it is Agreement that in case of any workman sustaining injury\nduring the performance of his duty and this fact is established by the report\nof the Controlling Manager, supported by the Medical Certificate of the\nArmy\u002FGovernment Hospital, Special Leave with pay up to three months will be\npermissible. The system of obtaining the sanction of the management will remain\noperative.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. RETIREMENT AGE\u003C\u002Fh2>\n\n\u003Cp>Management explained that the objective of retirement is to induct new blood\nin the organization and provide chance of promotion\u002Fdevelopment to other\nemployees. Further, being a security company, the employee deputed on\nCash-in-Transit service \u002F operational duties and other related duties should be\nactive, physically and mentally fit to endure the strain and stress of the job\nand hence people of advance age will have to be replace by young blood.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>However, company has agreed the demand of union to fix retirement age at 60\nyears. All workers shall retire service of company on attaining the age of\nsuperannuation.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is also agreed that:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>I. The management shall have right to verify the age of an employee in any\nmanner it considers best.\u003C\u002Fp>\n\n\u003Cp>II. The management shall have the right retire any employee earlier than the\nage stipulated above, on medical grounds after obtaining opinion from\ndoctor\u002Fmedical board.\u003C\u002Fp>\n\n\u003Cp>III.An employee may also request for early retirement 2 years before\nattaining age retirement. The management may use its discretion on such\nrequests on case to case basis. This provision will not be applicable to\nemployees against whom disciplinary proceedings are in progress.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is further agreed that since the superannuation age for retirement has\nbeen fixed herein above, however, based on the nature of the job in general,\nthe management may consider extension in service of the deserving employees in\neach category as follows:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7(A). PAPL Guarding Staff\u002FOperational Staff\u003C\u002Fh2>\n\n\u003Cp>One-year maximum 05 years extension may be considered by the management\nsubject to good discipline and medical\u002Fwork fitness and past performance of the\nemployee. The committee consisting on Director Finance\u002FG.M operations, Senior\nManager P&amp;A and Departmental Head will decide such cases.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7 (B). Permanent Office Staff\u003C\u002Fh2>\n\n\u003Cp>One-year to 05 years extension in retirement may be considered by the\nManagement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. LOANS\u003C\u002Fh2>\n\n\u003Cp>Management is of the view that loans put the workmen in financial problem\nand its repayment puts them to hardship, hence taking loans are to be\ndiscouraged. C.B.A Union agreed with the view of the management but stressed\nthat at the time applying for loan, the Management should consider the genuine\nrequests. Therefore, it is agreed that the Management will take some provision\nfor loans to be granted after strict scrutiny of the cases. The criteria to be\nkept in view will be:\u003C\u002Fp>\n\n\u003Cp>a. Genuineness of the loan.\u003C\u002Fp>\n\n\u003Cp>b. Length of service of applicant.\u003C\u002Fp>\n\n\u003Cp>c. Repayment capacity of applicant.\u003C\u002Fp>\n\n\u003Cp>d. Proper surety\u002Fguarantee of another permanent worker.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The loans may be granted, on the management’s discretion for:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>e. Marriage of one daughter\u003C\u002Fp>\n\n\u003Cp>f. Meet medical emergency of self or wife.\u003C\u002Fp>\n\n\u003Cp>g. Enhancement of educational qualification.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. UNIFORMS\u002FSHOES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-protectiveclothing\">\u003Cp>It is agreed by the Management that following uniforms will be provided.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a. Guards &amp; Drivers:\u003C\u002Fp>\n\n\u003Cp>• 2 sets of uniforms consisting of a trouser &amp; a shirt per annum.\u003C\u002Fp>\n\n\u003Cp>• One pair of DMS Shoes\u002FDrivers Shoes (to drivers) per annum.\u003C\u002Fp>\n\n\u003Cp>• 2 Vets of cotton per annum.\u003C\u002Fp>\n\n\u003Cp>• 2 pairs Socks per annum.\u003C\u002Fp>\n\n\u003Cp>• Jacket\u002FJersey to PAPL guarding staff as per requirement.\u003C\u002Fp>\n\n\u003Cp>b. Technical Staff:(EBAS, Control Room)\u003C\u002Fp>\n\n\u003Cp>• Two sets of uniforms per annum.\u003C\u002Fp>\n\n\u003Cp>• One pair of Shoes per annum.\u003C\u002Fp>\n\n\u003Cp>c. Office Peons (Permanent)\u003C\u002Fp>\n\n\u003Cp>• 3 sets of Shirts &amp; Trouser every year.\u003C\u002Fp>\n\n\u003Cp>• One pair of Shoes every alternate year.\u003C\u002Fp>\n\n\u003Cp>• 2 Vests cotton per annum\u003C\u002Fp>\n\n\u003Cp>• 2 pairs of Socks per annum.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. TA \u002F DA\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Management confirmed that TA\u002FDA rules with schedule of rate have already\nbeen revised. C.B.A Union is satisfied with the confirmation of the Management\nand has dropped the demand in this respect.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. FUNERAL EXPENSE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>Management agreed to the following.\u003C\u002Fp>\n\n\u003Cp>a. DEATH ON DUTY\u003C\u002Fp>\n\n\u003Cp>If any guard expires while on duty due to accident or otherwise it will be\nresponsibility of the company to send the dead body to his native place by\nfastest means. The concerned manager, in such cases, should get the formalities\ncompleted and arrange dispatch of the dead body to the native place of the\ndeceased by booking the coffin box through air\u002Fambulance as per the\nsituation.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>Since, offices of the Company are operating in almost all the big\ncities\u002Ftowns of Pakistan, the office nearer the native place of the deceased\nshall be informed to receive the dead body and arrange its proper delivery to\nthe family\u002Frelatives of the deceased. One of the supervisors\u002Fofficer of the\nnearby station may represent the company at time of burial.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is agreed that a sum of Rs. 10,000\u002F- will be paid to the family of the\ndeceased for meeting funeral and burial expenses.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>It is also agreed that Company will pay Rs. 20,000\u002F- to the family of the\ndeceased in case guard is killed by the bullet of the dacoits during performing\nof duty.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. DEATH WHILE ON LEAVE\u002FNOT ON DUTY\u003C\u002Fp>\n\n\u003Cp>In case the guard was away on leave from his place of posting and dies,\nthere will no responsibility of the company make any sort of arrangements. If\nthe guard expires within the jurisdiction of his place of posting and no\nrelative or family member is available to take care of the body, company will\narrange its dispatch to his native place. The procedure detailed in (a) above\nto be followed in such cases.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>The procedure of dispatch of dead body will also be applicable in case of\naccidental death of a guard on duty or off duty.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. EID HOLIDAY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It is agreed that company will pay Rs. 500\u002F- per day to CIT, Response Force\nand EBAS staff who are required to perform duty on 1st and 2nd day of Eid.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. GENERAL\u003C\u002Fh2>\n\n\u003Cp>a. It is agreed that increase in wages\u002Fallowance etc. under this settlement\nis intended to provide relief, to the workmen due to rise in the cost of living\nand as such the increase in wages allowance etc. agreed to under this\nsettlement is liable to be set off against any statutory increase which the\ngovernment may grant to the workmen under any head, name, nomenclature\nwhatsoever during and beyond the operation of this settlement subject to the\nmanner as may be specified by the Government in the Statue or Ordinance.\u003C\u002Fp>\n\n\u003Cp>b. It is agreed that this settlement is in fill and final settlement of all\ndisputes, demands and claims of the Union\u002FWorkmen contained in the Charter of\nDemands dated January 2, 2013.\u003C\u002Fp>\n\n\u003Cp>c. It is agreed that during the tenure of this settlement the Union shall\nimprove efficiency, discipline and attendance of the workmen and shall keep and\npromote industrial peace harmony and shall fully cooperate with the Company in\nits efforts to increase efficiency and productivity and to achieve quality and\neconomy. The union assures their full support and cooperation to meet the\nqualitative and quantitative production norms and standards as laid down by the\ncompany from time to time. The union also undertakes to cooperate with the\nmanagement in the business and efficiency improvement schemes as and when\nintroduced.\u003C\u002Fp>\n\n\u003Cp>d.In consideration of the benefits to the workmen under this settlement, the\nunion undertakes that it will not raise or pursue any demand whatsoever,\ndirectly or indirectly involving financial implications upon the company during\nthe pendency of this settlement.\u003C\u002Fp>\n\n\u003Cp>e. It has been agreed between the parties that this settlement shall become\neffective and comes into operation w.e.f.
