Raising Contractor L.C.D.C\nWorkers Union Lakhra is the Collective Bargaining Agent of the\nEmployees\u002FWorkmen of M\u002Fs Muhammad Jamil and Co Raising Contractor L.C.D.C\nKhanote Distt: Jamshoro and the said C.B.A Union gave the charter of demands\ndated 06th January, 2012. To the M\u002FS Muhammad Jamil &amp; Co (Pvt.) Ltd.\nRaising Contractor L.C.D.C Lakhra under section 43(1) of the I.R.A 2010 for\ndirect bilateral negotiations and agreement and copies sent to concerned\nauthorities including deputy director Labour (Conciliation) Hyderabad region\nHyderabad.\u003C\u002Fp>\n\n\u003Cp>AND FURTHER WHEREAS on receipt of the said notice management of M\u002Fs Muhammad\nJamil &amp; Co (Pvt.) Ltd. Raising Contractor L.C.D.C Lakhra started the\nnegotiations relating to differences and disputes with C.B.A union and the\nresult of the negotiations this is executed between the parties at Hyderabad on\n27th January, 2012 as under:\u003C\u002Fp>\n\n\u003Cp>TERMS AND CONDITIONS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>Demand No. 1: BONUS FOR FINANCIAL YEARS 2009-2010 AND 2010-2011\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that the Workmen\u002FEmployees of the M\u002FS\nMuhammad Jamil and Co (Pvt.) Ltd. Raising Contractor L.C.D.C Lakhra will be\npaid the aforesaid bonus for the financial years 2009-2010 and 2010-2011 as\nunder:-\u003C\u002Fp>\n\n\u003Cp>All the monthly and daily rated employees\u002Fworkmen shall be paid bonus for\nthe above financial years equivalent to their sixty (60) days salary\u002Fwages\nwhich quantum of gross salary\u002Fwages they were getting as on 31st December,\n2011. It is also agreed that the coal cutters shall be paid bonus on production\nof Rs. 12\u002F- per ton every month.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 2: ENHANCEMENT IN WAGES\u002FSALARIES AND OTHER BENEFITS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that M\u002FS Muhammad Jamil and Co (Pvt.) Ltd.\nRaising Contractor L.C.D.C Lakhra shall increase enhance the rates of\nwages\u002Fsalary etc. of the employees\u002Fworkman coal cutters and Jorhisars w.e.f.\n1st January, 2012 as under:\u003C\u002Fp>\n\n\u003Cp>1. That an increase of Rs. 1500\u002F- per month will be made in wages\u002Fsalaries\nof all monthly and daily rated employees\u002Fworkmen and Mines Sardar Rs. 2000\u002F-\nper month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>2. The increase\u002Fenhancement was agreed under agreements\u002Fsettlements between\nthe M\u002FS Muhammad Jamil and Co (Pvt.) Ltd. Raising Contractor L.C.D.C Lakhra\nUnion including under this agreement shall be part of basic pay of\nemployment\u002Fworkman of all categories for all employment benefits.\u003C\u002Fp>\n\n\u003Cp>3. It is further agreed if any employee\u002Fworkman during the financial year\nnot avail 45 days leave with pay those employees\u002Fworkman shall be paid\nencashment amount of leave.\u003C\u002Fp>\n\n\u003Cp>4. It is also agreed that the unskilled worker\u002Femployee will be paid wages\nRs. 7000\u002F- per month as minimum wages.\u003C\u002Fp>\n\n\u003Cp>5. It is agreed that, the increase will be made in the rate of Coal Cutter,\nas per schedule “A” enclose herewith.\u003C\u002Fp>\n\n\u003Cp>6. It is agreed between the parties that the Jorisars commission and\nMaterial allowance shall be increased and fixed as per schedule “B” enclose\nherewith.\u003C\u002Fp>\n\n\u003Cp>7. Commission of Labour Jamadar will increase and fixed as per schedule\n“B” enclose herewith.\u003C\u002Fp>\n\n\u003Cp>8. It is further agreed that the Jorisars will be paid of Rs. 10\u002F- per ton\nas summer allowance from 1st April to 31st August every year.\u003C\u002Fp>\n\n\u003Cp>9. It is agreed that Coal Cutter will be paid summer allowance in category 1\nseam Rs. 15 category 2 Rs. 20 &amp; category 3 Rs. 25 per ton from 1st April to\n31st August every year.\u003C\u002Fp>\n\n\u003Cp>10. Special summer allowance for small seam Less Than 3 ½ Feet.\u003C\u002Fp>\n\n\u003Cp>i. It is agreed that, any Jorhi produce Three hundred fifty (350) to four\nhundred (400) tons coal in month shall be paid to coal cutters EXTRA summer\nallowance at the rate of 25\u002F- per ton and Rs. 10\u002F- to Jorisar w.e.f. 1st April\nto 31st August every year.\u003C\u002Fp>\n\n\u003Cp>ii. It is also agreed that, any Jorhi produce (401) four hundred one to\n(450) four hundred fifty tons coal in month shall be paid to coal cutter EXTRA\nsummer allowance at the rate of 35\u002F- per ton and Rs. 10\u002F- Jorisar for the above\nsaid period.\u003C\u002Fp>\n\n\u003Cp>iii. It is further also agreed that, any Jorhi produce (451) four hundred\nfifty one tons and above coal in a month shall be paid to coal cutters EXTRA\nsummer allowance at the rate of 45\u002F- per ton and Rs. 10\u002F- to Jorisar for the\nabove said period.\u003C\u002Fp>\n\n\u003Cp>Note: The above special summer allowance scheme introduced for more\nproduction to make beneficial to workers.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 3 That the Chappar Katai\u002FRoof Cutting rate has been as\nunder:\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the rate of Chappar Katai will be increased and fixed as\nunder:\u003C\u002Fp>\n\n\u003Cp>(a) The rate of Chappar Katai\u002FRoof Cutting in Coal seam 5 to 6 feet will be\nRs. 70\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(b) The rate of Chappar Katai\u002FRoof Cutting up to one foot thickness will be\nRs. 100\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(c) The rate of Chappar Katai\u002FRoof Cutting up to two feet thickness will be\nRs. 145\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(d) The rate of Chappar Katai\u002FRoof Cutting up to three feet thickness will\nbe Rs. 210\u002F- per feet (Note Rs. 10\u002F- will be commission of Jorisars in the\nabove said rates)\u003C\u002Fp>\n\n\u003Ch2>Demand No. 4It is agreed between the parties that the Katcha Khudai\nwork\u002FFootana rate will be paid as under:-\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>(1) The rate Katcha Khudai work\u002FFootana of mines deep will be increased from\nRs. 800\u002F- per running ft. to Rs. 1100\u002F- per running ft. (Size 5x6x7)\u003C\u002Fp>\n\n\u003Cp>(2) The rate of Katcha Khudai work\u002FFootana of wall 8x8 increased from Rs.\n850\u002F- running ft. to Rs. 1200\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(3) The rate of mines deep GALA will be paid at the Rs. 15,000\u002F- per gala of\nmines.\u003C\u002Fp>\n\n\u003Cp>(4) The commission of Jorisars in Katcha Khudai works will be paid Rs. 150\u002F-\nper running ft.\u003C\u002Fp>\n\n\u003Cp>(5) The Jorisars will be paid Rs. 60\u002F- per door in Katcha Khudai deep\nwork.\u003C\u002Fp>\n\n\u003Cp>(6) Extra rate and Kharaba from mines will be paid Rs. 300\u002F- per ton.\u003C\u002Fp>\n\n\u003Cp>(7) Haulage driver footana will be paid Rs. 7000\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>(8) It is also agreed between the parties, that in case of water &amp;\nstones coming in way of Katcha Khudai of well and deep or check work. The rate\nfixed in sub clause (1) and (2) of clause 4 shall automatically stand double.\nIt is also agreed that, company shall provide compressor for cutting of stones\nand Generator for water extraction from mines.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 5: Stopping Rates\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the rate of Stopping increase and fixed as under:-\u003C\u002Fp>\n\n\u003Cp>(a) FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>(1)Stopping rates height up to four feet Rs. 900\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping rates eight above four feet up to six is Rs. 1200\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(3) Stopping rates height above six feet up to eight feet Rs. 1600\u002F-.\u003C\u002Fp>\n\n\u003Cp>(b) WITHOUT FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>(1) Stopping rates height up to four feet Rs. 700\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping rates height above four feet up to six feet is Rs. 900\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(3) Stopping rates height above six feet up to eight feet Rs. 1200\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 6: WAGES RATES OF THE COAL CUTTERS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the Rs. 300\u002F- per day will be paid for Gazette Holiday\nGratuity and other employment Benefits of Coal Cutters.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 7: RESIDENTIAL FACILITIES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>1. It is agreed between the parties that management shall provide to each\nand every workmen\u002Femployee free residential facilities with Bath-Rooms,\nKitchens etc. and further that the repairs, white-wash of the residential\npremises\u002Fquarters of the workers shall be undertaken by the management each\nyear, at its own cost in construction with the C.B.A union.\u003C\u002Fp>\n\n\u003Cp>2. It is also agreed that management of M\u002FS Muhammad Jamil and Co (Pvt.)\nLtd. Raising Contractor L.C.D.C Lakhra Coal field for allotment of One Hundred\nhouse down payment Rs. 500,000\u002F- already been paid to the Sindh Workers Welfare\nBoard and monthly installment shall be paid by the management of the company on\nbehalf of allotee worker\u002Femployee to Sindh Worker Welfare Board.\u003C\u002Fp>\n\n\u003Cp>3. It is further agreed that, the management will provide on hundred fans\nfor these houses of workers at Lakhra coal field through C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 9: PROVIDING TELEVISION SETS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the management of M\u002FS Muhammad Jamil and Co (Pvt.) Ltd.\nRaising Contractor L.C.D.C Lakhra will provide to distribute forty (40) TV sets\nwith batteries free of cost to the workers through C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 10: INCREASE IN SPORTS FUND\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that Annual Sports fund will be paid to the C.B.A union of Rs.\n180,000\u002F-for the period of this agreement.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 11: MEDICAL FACILITIES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>(a) It is agreed that Rs. 8\u002F- (Eight) per ton shall be paid by the company\non production every month including coal taken from Jorhisars for company stack\nand paid to him to the medical treatment committee through General Secretary of\nC.B.A union for the salary of Doctors, Drivers, Sanitary workers payment of\nElectricity Bill, Ambulance Expenses purchase of Medicines and other all kind\nrequirement of hospital and workers.\u003C\u002Fp>\n\n\u003Cp>(b) In case the treatment of workers\u002Femployees is not possible at the\narrangement of mines site Hospital under sub clause (a), those workers\u002Femployee\nshall be sent refer by the Doctor to Hyderabad Hospitals for further treatment,\nand the company expenses.\u003C\u002Fp>\n\n\u003Cp>(c) In case of accident the management of M\u002FS Muhammad Jamil and Co (Pvt.)\nLtd. Raising Contractor L.C.D.C Lakhra shall be liable and responsible for\nevery kind of treatment and medical facilities at the all levels to such\neffected workers\u002Femployees at the company expenses including hospitalization,\nmedicines and all kind of requirement and also will be paid Rs. 300\u002F- per day\nto under treatment workers for food.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 12: PROVIDING NEW MINES TO JORISARS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that only those Jorisars whose working in\nthe company shall be provided new mines with the recommendation of C.B.A\nUnion.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 13: INCREASE IN GRATUITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Muhammad Jamil and Co (Pvt.) Ltd. Raising Contractor\nL.C.D.C Lakhra shall pay gratuity to all monthly salary and daily wages paid\nworkers including Jorisar according the provision of West Pakistan Industrial\n&amp; Commercial Employment standing order Ordinance 1968. Raising Contractor\nL.C.D.C Lakhra will send three (3) workmen\u002Femployees every year to Hajj by Air\non company expenses.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 15: FAIR PRICE SHOP AT MINES SITE\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Muhammad Jamil and Co (Pvt.) Ltd. Raising Contractor\nL.C.D.C Lakhra will provide a facility of Fair price shop for workers\u002Femployers\nat no loss no profit basis providing them maximum commodities of consumer\ngoods, with the time to time concern of C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No.16: PROVIDING MEAT ON EID-UL-AZHA OCCASION\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Muhammad Jamil and Co (Pvt.) Ltd.
