IR and Security\u003C\u002Fp>\n\n\u003Cp>REPRESENTING THE WORKERS:\u003C\u002Fp>\n\n\u003Cp>1.Mr. Yousaf - President\u003C\u002Fp>\n\n\u003Cp>2.Mr. Mohib ullah - General Secretary\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>a) Whereas the Company is a Trans-Provincial establishment having its\nregistered office F – 216, SITE Karachi, and branches through-out the\ncountry.\u003C\u002Fp>\n\n\u003Cp>b) And whereas Macter International Employees Union the C.B.A Union,\nsubmitted a Charter of Demands dated 30th May, 2013 upon the country.\u003C\u002Fp>\n\n\u003Cp>c) And whereas both parties held bilateral negotiations on the Charter of\nDemands. During the bilateral negotiations C.B.A Union explained the reasoning\nand the justifications of its charter of demands.\u003C\u002Fp>\n\n\u003Cp>d) As a result of bilateral negotiations on the charter of demands served by\nthe C.B.A Union, it is agreed between the Company and the C.B.A Union to\nincorporate all terms and conditions agreed between the Company and the C.B.A\nUnion into full and final settlement of their charter of demands.\u003C\u002Fp>\n\n\u003Cp>e) Now therefore, the parties above named realizing and accepting the\nviewpoints of each other, have been able to reach this settlement on the\nfollowing terms and conditions, as on June 12th, 2013.\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Cp>In view of all round inflationary trend &amp; increases in the cost living\nand in order to provide relief to the permanent workmen\u002Fworkers from such rise,\nthe following is agreed between the parties to this agreement.\u003C\u002Fp>\n\n\u003Ch2>1. INCREASE IN SALARY &amp; INCREMENT\u003C\u002Fh2>\n\n\u003Cp>It is agreed that:\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>a. During 1st year of this agreement all permanent workers\u002Fworkmen who are\non company’s payroll will get an increase as per below:\u003C\u002Fp>\n\n\u003Cp>I. Supervisor \u002F Skilled staff Rs. 1424\u002F- per month in gross salary.\u003C\u002Fp>\n\n\u003Cp>II. Functional Assistant staff Rs. 1164\u002F- per month in gross salary.\u003C\u002Fp>\n\n\u003Cp>III. Operator level staff Rs. 1057\u002F- per month in gross salary.\u003C\u002Fp>\n\n\u003Cp>IV. GW\u002FLow skilled staff Rs. 1000\u002F- per month in gross salary.\u003C\u002Fp>\n\n\u003Cp>The above is in w.e.f. 01-07-2013. In case if the Government increases the\nminimum wages by less than the above workers will continue to receive the\nincrease granted under this clause. However, the increase by the Government\nwill be set off.\u003C\u002Fp>\n\n\u003Cp>b. During 2nd year of this agreement a minimum increase of Rs. 800\u002F- per\nmonth will be given to all permanent workers w.e.f. 01-07-2014. However, during\nthe second year this increase can be further enhanced depending upon overall\nperformance of the company, therefore all workers will put in their best\nefforts to achieve the higher level of excellence in order to boost the overall\nperformance of the company, which will ultimately be beneficial to all.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. TRANSPORT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>It is agreed that the company will ensure to ply commuter buses\u002Fother\ntransport on already specified and mutually agreed 10 routes for the\ntransportation on permanent workers\u002Fworkmen who are on company’s payroll\nto\u002Ffrom the factory premises free of any charges of costs.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>3. OVERTIME\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-OVERTIME_trigger\">\u003Cp>It is agreed that all permanent workers\u002Fworkmen who are on company’s\npayroll will get the amount based on twice of the ‘ordinary rate of pay’\n(according to the relevant laws) as overtime on hourly basis against rendering\nassigned duties.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. MEAL ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent works\u002Fworkmen who will be required to\nperform over time duty after normal working hours and will stay till 8.30 p.m.\nshall be paid a sum of Rs. 40\u002F- as meal allowance.\u003C\u002Fp>\n\n\u003Ch2>5. NIGHT SHIFT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-NOCTPREM_trigger\">\u003Cp>It is agreed that all permanent workers\u002Fworkmen who are on company’s\npayroll and will stay in factory under supervisor written instructions (as per\ncompany rules) and perform assigned duties on overtime till 0800 am, will get\nRs. 100\u002F- as night shift allowance and Rs. 40\u002F- as breakfast allowance.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. STAFF LOAN\u002FZAKAT\u003C\u002Fh2>\n\n\u003Cp>a. Loan:it is agreed that all permanent workers\u002Fworkmen who are on\ncompany’s payroll can get loan easy terms as per Company policy.\u003C\u002Fp>\n\n\u003Cp>b. Zakat:It is agreed that Zakat from Zakat Fund will be allowed to\ndeserving workers\u002F workmen on case to case basis, under the defined rules.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. MACHINE OPERATOR\u002FSTERILE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent workers\u002Fworkmen who are on company’s\npayroll will get the following allowances:\u003C\u002Fp>\n\n\u003Cp>a. Machine Operator Allowance\u003C\u002Fp>\n\n\u003Cp>(1) Senior Operator - Rs. 1250\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>(2) Skilled Operator - Rs. 950\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>(3) Junior Operator - Rs. 650\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>b. Sterile Allowance - Rs. 500\u002F- per month.\u003C\u002Fp>\n\n\u003Ch2>8. SPECIAL DAY EID BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed that:\u003C\u002Fp>\n\n\u003Cp>a.All permanent Muslim workers\u002Fworkmen who are on company’s payroll will\nget a fixed amount of Rs. 2000\u002F- as Eid-ul-Fitr bonus once in a year.\u003C\u002Fp>\n\n\u003Cp>b.All permanent non-Muslim workers\u002Fworkmen who are on company’s payroll\nwill get a fixed amount of Rs. 2000\u002F- as special day bonus once in a year.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9. GRATUITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>It is agreed that one gross salary shall be accrued as gratuity to all\npermanent workers\u002Fworkmen after completion of one year of service, which is\npayable on the discharge of a workman, except when a worker is dismissed for\nmisconduct. The amount of gratuity shall be worked out as per the applicable\nlaws.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. HAJJ AND UMRAH POLICY\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the company will allow one permanent worker to perform\nHajj &amp; one to perform Umrah, on yearly basis. The selection of the worker\nfor Hajj\u002FUmrah shall be made through a ballot under the company policy on the\nsubject.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. DEATH GRANT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>In case of death of a permanent worker\u002Fworkman who is on company’s\npayroll, the balance amount of loan will be deducted from his full and final\nterminal benefits receivable from the company.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>12. MEDICAL FACILITY \u002F SESSI\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthcareaccess\">\u003Cp>It is agreed that:\u003C\u002Fp>\n\n\u003Cp>(a) All permanent workers\u002Fworkmen who are on company’s payroll will be\nregistered in SESSI and accordingly cards will be prepared and issued to\nthem.\u003C\u002Fp>\n\n\u003Cp>(b) Eye test of workers working at departments requiring accurate eye sight\nwill be conducted by qualified Eye specialist within factory premises during\nworking hours at company’s expense.\u003C\u002Fp>\n\n\u003Cp>(c) An emergency vehicle will be on stand-by in the factory premises, in\norder to cater for any emergency situation.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>13. CANTEEN\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-mealvouchers\">\u003Cp>It is agreed that food will be given free of cost to all the workers and the\nexiting menu of canteen will be improved. Meat will be included one extra time\nin a month, as compared to the existing menu.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>14. FAMILY WELFARE SCHEME\u003C\u002Fh2>\n\n\u003Cp>It is agreed that in case of death of a permanent worker\u002Fworkman during\nemployment, the company will offer the employment to one of the children of the\ndeceased, if he\u002Fshe meets the company policy for appointment and fulfills the\ncriterion for a particular available post\u002Fjob.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>15. YEARLY GET TOGETHER\u003C\u002Fh2>\n\n\u003Cp>It is agreed that company will arrange an annual get together of all\nworkers\u002Fworkmen who are on company’s payroll after “Eid-ul-Fitr\nParty”.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>16. UNIFORM\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>It is agreed that following dress items will be issued by the Company in a\nyear starting w.e.f. 1st of July each year.\u003C\u002Fp>\n\n\u003Cp>a. 3 uniforms after completion of 2 years to the workers of Maintenance\nDeptt. Electrical Deptt. Canteen, Messengers and Liquid Packing Department.\u003C\u002Fp>\n\n\u003Cp>b. 2 x Lab Coats, 2 x cap \u002Fscarf and 1 x pair slippers to the workers\nassigned for work in Production Department.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>17. MILK FACILITY\u003C\u002Fh2>\n\n\u003Cp>It is agreed that company will provide a glass of milk in a day to\nManufacturing staff of Powder department.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>18. IFTAR\u003C\u002Fh2>\n\n\u003Cp>It is agreed that Iftar \u002F dinner will be served to all the workers on duty\nduring the Holy Month of Ramzan.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>19. SOFT TIMINGS DURING RAMZAN\u003C\u002Fh2>\n\n\u003Cp>It is agreed that during the Holy month of Ramzan soft timings will be\nobserved in the company with the mutual consent as per laid down\npolicy\u002Fguidelines.\u003C\u002Fp>\n\n\u003Ch2>20. MISCELLANEOUS WELFARE MEASURES\u003C\u002Fh2>\n\n\u003Cp>It is agreed that following measures will be ensured for the general welfare\nof employees.\u003C\u002Fp>\n\n\u003Cp>a. Award of gift and arrangement of tea session on retirement would be done\nin order to see off outgoing employee in a respectable manner.\u003C\u002Fp>\n\n\u003Cp>b. Arrangement will be made for availability of suitable prayer area\nseparately for the ladies and gents within the factory premises.\u003C\u002Fp>\n\n\u003Cp>c. Suitable break will be given for the prayers falling during the working\nhours.\u003C\u002Fp>\n\n\u003Cp>d. Availability of required Medicines produced in Macter of cost basis.\u003C\u002Fp>\n\n\u003Cp>e. Availability of proper change rooms and washroom separately for\nfemales\u002Fmales at appropriate locations in the factory will be ensured.\u003C\u002Fp>\n\n\u003Cp>f. Maintenance and proper seating arrangements at the canteen for all\nworkers will be ensured.\u003C\u002Fp>\n\n\u003Cp>g. Installation of water coolers at suitable places within the factory will\nbe ensured.\u003C\u002Fp>\n\n\u003Cp>h. Provision of filtered water and installation of filter at drinking water\nsource in canteen will be ensured.\u003C\u002Fp>\n\n\u003Cp>i. Balance of the Casual and Sick leaves not availed during the years and\nverified by HR department will be enchased at the end of each financial\nyear.\u003C\u002Fp>\n\n\u003Cp>j. Proper and timely distribution of 10 C bonus as per relevant law will be\nensured.\u003C\u002Fp>\n\n\u003Cp>k. Proper and timely distribution of share of workmen for Workmen Profit\nParticipation Fund (WPPF) will be ensured as per relevant law.\u003C\u002Fp>\n\n\u003Cp>l. Arrangements for Group Life Takaful will be made as per relevant law.\u003C\u002Fp>\n\n\u003Cp>m. Arrangements\u002Fpayments of EOBI for all permanent employees will be done as\nper relevant law.\u003C\u002Fp>\n\n\u003Ch2>21.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that all permanent employees as on 1st June 2013, will ensure\ntimely attendance with punctuality at work place and deliver 100% efforts to\nachieve goals of the company.\u003C\u002Fp>\n\n\u003Ch2>22.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that late coming and absenteeism will be addressed as per\ncompany policy\u002F guidelines and labour laws.\u003C\u002Fp>\n\n\u003Ch2>23.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that any damage to the property or fixtures or material\nincluding finished goods, knowingly by any worker with intent will be addressed\nin line with company guidelines and labour laws.\u003C\u002Fp>\n\n\u003Ch2>24.\u003C\u002Fh2>\n\n\u003Cp>It is agreed that use of any “go slow” methods, individually or as pa\ngroup, is prohibited an if found to be happening, it will be addressed as per\ncompany guidelines and labour laws.\u003C\u002Fp>\n\n\u003Ch2>25.\u003C\u002Fh2>\n\n\u003Cp>Any attempt of rioting, creating unrest of disturbing the peace and harmony\nat the work place, misbehavior with the management etc. will result in\nsuspension \u002F termination of involved employee in line with company policies and\nlaws of the country.\u003C\u002Fp>\n\n\u003Ch2>26. EXISTING FACILITIES\u003C\u002Fh2>\n\n\u003Cp>It is agreed that subject to terms and conditions incorporated in this\nSettlement, all terms and conditions of service, facilities accrued from time\nto time and existing prior to this settlement will continue to remain\napplicable in the manner and conditions as were applicable, save to the extent\nthat all or any of such terms and conditions of service, facility and benefits\nare not withdrawn, altered, modified or revised under this settlement.\u003C\u002Fp>\n\n\u003Ch2>27. DURATION\u003C\u002Fh2>\n\n\u003Cp>This settlement will come into effect form 12th June, 2013 and shall remain\nin force and binding upon the parties for the period of two years i.e. till\n11th June, 2015.\u003C\u002Fp>\n\n\u003Ch2>28.
