Phone #.\n022-278335, Fax #. 022-2784935\u003C\u002Fp>\n\n\u003Cp>REPRESENTING EMPLOYER\u003C\u002Fp>\n\n\u003Cp>Mr. Karim Buksh Rajar - Managing Director, Karim Buksh Coal Mines\u003C\u002Fp>\n\n\u003Cp>REPRESENTATIVE OF EMPLOYEES\u003C\u002Fp>\n\n\u003Cp>Mr. Qamoos Gull Khattak - General Secretary of Union\u003C\u002Fp>\n\n\u003Cp>SHORT RECITALS OF THE CASE\u003C\u002Fp>\n\n\u003Cp>WHEREAS, The Karim Buksh Coal Mines Worker’s Union is the collective\nbargaining agent of the Employees\u002FWorkmen of M\u002Fs Karim Buksh Coal Mines and the\nsaid C.B.A Union gave a charter of demands dated 08 August 2009 to the M\u002Fs\nKarim Buksh Coal Mines under section 43(1) of the I.R.A 2008 for direct\nbilateral negotiations and agreement and copies whereof sent to the concerned\nauthorities including Deputy Director Labour (Conciliation) Hyderabad Region,\nHyderabad.\u003C\u002Fp>\n\n\u003Cp>AND FURTHER WHEREAS on receipt of the above said notice the management of\nM\u002Fs Karim Buksh Coal Mines start the negotiations relating to differences and\ndisputes with C.B.A Union and the result of the negotiations this agreement is\nexecuted between the parties at Hyderabad on 22-10-2009.\u003C\u002Fp>\n\n\u003Cp>TERMS &amp; CONDITIONS OF AGREMENT\u003C\u002Fp>\n\n\u003Ch2>Demand No. 1: BONUS FOR FINANCIAL YEAR 2008 - 2009\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>It is agreed between the parties that the Workmen\u002FEmployees of the M\u002Fs Karim\nBuksh Coal Mines will be paid the aforesaid bonus for the financial year\n2008-2009 as under:\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that the Karim Buksh Coal Mines Lakhra will\npaid bonus allowance at the rate of Rs. 12\u002F- per ton every month.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 2: ENHANCEMENT IN WAGES\u002FSALARIES AND OTHER BENEFITS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that the Karim Buksh Coal Mines shall\nincrease the rates of wages\u002Fsalaries of the employees\u002Fworkmen w.e.f. 1st July\n2009 as under:\u003C\u002Fp>\n\n\u003Cp>(1) That an increase of Rs. 700\u002F- per month will be made in wages\u002Fsalaries\nof all monthly and daily rated employees\u002Fworkmen.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-LOWWAGE_provision\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-LOWWAGE_trigger\">\u003Cp>(2) It is also agreed that the unskilled worker\u002Femployee will be paid wages\nRs. 6000\u002F- per month as minimum wages.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>(3) It is agreed that the increase per ton will be made in the rate of Coal\nCutters, as per Schedule “A”.\u003C\u002Fp>\n\n\u003Cp>(4) It is agreed between the parties that the Jamadars commission, Material\nallowance and Amani allowance shall be increased as per schedule “B”.\u003C\u002Fp>\n\n\u003Cp>It is agreed that Coal Cutters will be paid summer allowance in the Category\n1 Seam Rs. 15, Category 2 Rs. 20 &amp; Category 3 Rs. 25 per ton from 1st April\nto 31st August every, Jamadars and Jorisars will pay summer allowance Rs. 5\u002F-\nton both categories.\u003C\u002Fp>\n\n\u003Cp>(5) Special Summer Allowance for small seam i.e. three feet or less than\nthree feet.\u003C\u002Fp>\n\n\u003Cp>i. It is agreed that, any Jori produce (400) four hundred to (450) four\nhundred fifty tons coal in a month shall be paid EXTRA Summer allowance at the\nrate of 25\u002F- per ton w.e.f. 1st April to 31st August every year and\nJamadar\u002FJorisar both will pay Rs. 5\u002F- per ton.\u003C\u002Fp>\n\n\u003Cp>ii. It is agreed that, any Jori produce (451) four hundred fifty one to\n(500) five hundred tons coal in a month shall be paid EXTRA Summer allowance at\nthe rate of 35\u002F- per ton for the above said period and Jamadar\u002FJorisar both\nwill pay Rs. 5\u002F- per ton.\u003C\u002Fp>\n\n\u003Cp>iii. It is further also agreed that, any Jori produce (501) five hundred one\ntons and above coal in a month shall be paid EXTRA Summer Allowance at the rate\nof 45\u002F- per ton and concerned Jamadar will be paid Rs. 5\u002F- and Joridar will\nalso be paid Rs. 5\u002F- per ton as extra summer allowance, under paragraph I to\niii sub clause (6) clause 2.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 3: That the Chappar Katai\u002FRoof Cutting rate has been as\nunder:\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>(a) The rate of Chappar Katai\u002FRoof Cutting of up to one ft. thickness will\nbe Rs. 80\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(b) The rate of Chappar Katai\u002FRoof Cutting up to two ft. thickness will be\nRs. 120\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>(c) The rate of Chappar Katai\u002FRoof Cutting up to three ft. thickness will be\nRs. 150\u002F- per running ft.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 4: It is agreed between the parties that the Katacha Khudai\nwork\u002FFootana rate will be as under\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>a. The rate Katcha Khudai work\u002FFootana of mines deep will be increased from\nRs. 900\u002F- per running ft. to Rs. 1000\u002F- per running ft. (Size 5x6x7) but stone\nwill be paid double rate.\u003C\u002Fp>\n\n\u003Cp>b. The rate of Katcha Khudai work\u002FFootana of wall 8x8 increase from Rs.\n950\u002F- running ft. to Rs. 1100\u002F- per running ft. but stone will be paid double\nrate.\u003C\u002Fp>\n\n\u003Cp>c. The commission of Jamadars is Katcha Khudai works will be paid Rs. 60\u002F-\nper running ft. and haulage driver gani bags and other material will be\nresponsibility of the company.\u003C\u002Fp>\n\n\u003Cp>d. The Labour Jamadars will be paid Rs. 50\u002F- per door in Katcha Khudai deep\nwork.\u003C\u002Fp>\n\n\u003Cp>e.Extraction rate and khabra from mines will be paid Rs. 250\u002F- per ton.\u003C\u002Fp>\n\n\u003Cp>f. It is also agreed between the parties, that in case of water &amp; stones\ncoming way of Katcha Khudai of well and deep, check and Chunae work. The rate\nfixed sub clause (a) and (b) of clause 4 shall automatically stand double. It\nis also agreed that company shall provide compressor for cutting of stones and\ngenerator for water extraction from mines.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 5: Stopping Rates\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>(a) FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>(1) Stopping rate height up to Six ft. Rs. 1100\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping rate height above Six ft. up to Eight ft. is Rs. 1500\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(b) WITHOUT FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>(1) Stopping height up to three ft. Rs. 600\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping height above three ft. up to six ft. Rs. 900\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(3) Stopping height above six ft. up to eight ft. Rs. 1300\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 6: WAGES RATES OF THE COAL CUTTERS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is settled that the Rs. 200\u002F- per day in total will be the rate for\nGazette Holiday and Holiday and Gratuity for Coal Cutters.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 7: RESIDENTIAL FACILITIES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that management shall provide to each and\nevery workmen\u002Femployee free residential facilities with Bath-Rooms, Kitchen\netc. and further that the repairs, white-wash of the residential\npremises\u002Fquarters of the worker shall be undertaken by the management each\nyear, at its own cost in consultation with the C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 8: DISTRIBUTING FREE SEWING MACHINES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the M\u002Fs Karim Buksh Coal Mines shall distribute twenty\nfive (25) sewing machines free of cost through C.B.A Union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 9: MEDICAL FACILITIES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>(a) Rs. 5\u002F- per ton will be paid by the company on production of coal every\nmonth to the Medical Treatment Committee, for the Mines site Hospital expenses\nsalary of Staff and Doctors, Medicines and all requirement for treatment of\nworkers at mines site hospital.\u003C\u002Fp>\n\n\u003Cp>(b) In case the treatment of workers\u002Femployees is not possible at the\narrangement of mines site under sub clause (a), those workers\u002Femployees shall\nbe sent to those hospitals which is agreed by the union on the company\nexpenses.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-disabilitypay\">\u003Cp>(c) In case of accident the management of M\u002Fs Karim Buksh Coal Mines Lakhra\nonly shall be liable and responsible for every kind of treatment and medical\nfacilities at the all levels to such effected workers\u002Femployees at the company\nexpenses including hospitalization, food, medicines and all kind of requirement\nand Rs. 200\u002F- per day will be paid to the effected workers during the period of\ntreatment.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 10: PROVIDING TELEVISION SETS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that the management of M\u002Fs Karim Buksh Coal Mines will\ndistribute Five (5) TV sets with batteries free of cost to the workers through\nC.B.A Union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 11: INCREASE IN SPORTS FUND\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that Annual Sports Fund will be paid to the C.B.A Union of Rs.\n20,000\u002F- (Twenty thousand only).\u003C\u002Fp>\n\n\u003Ch2>Demand No. 12: PROVIDING FACILITIES FOR C.B.A UNION OFFICE\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002Fs Karim Buksh Coal Mines only swill provide Rs. 20,000\u002F-\n(Twenty thousand only) for the purchase of office equipment’s for C.B.A Union\noffice at Hyderabad.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 13: PROVIDING NEW MINES TO JAMADARS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that Jamadars whose working in the company\nwill be provided new mines with the recommendation of C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 14: INCREASE IN GRATUITY\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002Fs Karim Buksh Coal Mines shall pay gratuity to the\nworkers\u002Femployers according the provision of West Pakistan Industrial &amp;\nCommercial Employment standing order ordinance 1968. It is further agreed\nbetween the parties that the above said gratuity shall be paid 60 days per\nannum to those employees whose services are more than 10 years.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 15: SENDING WORKMEN ON HAJJ\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002Fs Karim Buksh Coal Mines will send one (1)\nworkmen\u002Femployee every year to Hajj by Air through C.B.A Union on company\nexpenses as under:\u003C\u002Fp>\n\n\u003Ch2>Demand No. 16: FAIR PRICE SHOP AT MINES SITE\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002Fs Karim Buksh Coal Mines will provide a facility of Fair\nPrice Shop for workers\u002Femployers at no loss no profit basis providing them\nmaximum commodities of consumer goods, with the time to time concern of C.B.A\nunion.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 17: PROVIDE MEAT ON EID-UL-AZHA OCCASION\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002Fs Karim Buksh Coal Mines will provide meat on the\noccasion of Eid-ul-Azha as per recommendation of C.B.A union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 18: WORKMEN COMPENSATION &amp; GROUP INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-disabilityfund\">\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that all workers\u002Femployees shall be paid\ndeath and disability compensation and group insurance amount as under:\u003C\u002Fp>\n\n\u003Cp>(a) Death compensation and disability compensation according amendment\nworkmen compensation Act 1923 dated 06 October, 2001 Rs. 200,000\u002F- (Rupees Two\nhundred thousand only).\u003C\u002Fp>\n\n\u003Cp>(b) It is also agreed that in case of death and disability in case on mining\naccident EXTRA amount of Rs. 50,000\u002F- (Rupees Fifty thousand only) will be paid\naccording previous Agreements\u002FSettlements and also Rs. 2000\u002F- (Two thousand\nonly) per month shall be paid to legal heir’s of the expired worker from the\ndate of accident up to five (5) years.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>(c) It is also agreed that the amount of group insurance will be paid with\nEXTRA amount in total Rs. 210,000\u002F- (Rupees Two Hundred &amp; Ten thousand\nonly).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>(d) It is also agreed that the expenses of death bodies will be paid Rs.\n50,000\u002F- (Rupees fifty thousand only) for those who died during the case of\nemployment of this company.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>(e) It is also agreed that workers\u002Femployees who are disable during the\nemployment will be paid disability allowance Rs. 3000\u002F- per month for\nlifetime.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 19: PROVIDING AMBULANCE SERVICE TO WORKERS\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is also agreed between the parties that, Management shall provide an\nambulance for the workers and the same shall in no case be used by the\nmanagement except by the workers\u002Femployees for medical treatment etc.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 20: VENTILATION OF MINES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is also agreed between the parties that in order to improve working\nconditions in mines and to arrange proper ventilation for fresh air, Fans will\nbe installed in all mines of company.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 21: IMPROVING WOKRING CONDITIONS IN SMALL SEAM MINES\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that, management of the company will be\nbound to provide facilities to improve the working condition in the mines, as\nunder:\u003C\u002Fp>\n\n\u003Cp>i. Each mine will have two shafts with haulages, installed.\u003C\u002Fp>\n\n\u003Cp>ii. Rail line will be provided in main centers.\u003C\u002Fp>\n\n\u003Cp>iii. Fans will be provided to improve ventilation.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 22: WELFARE FUND\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that welfare fund will be paid at the rate\nof Rs. 5\u002F- per ton.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 23: Eid-ul-Fitar Package\u003C\u002Fh2>\n\n\u003Cp>Agreement\u003C\u002Fp>\n\n\u003Cdiv
