Ltd. (herein after called “COMPANY”) and Helix\nPharma (Pvt.) Ltd. Employees Union (herein after called “THE C.B.A UNION”),\nwhich expression where ever applicable for the purpose of this agreement shall\ninclude and mean their successors assigns.\u003C\u002Fp>\n\n\u003Cp>Whereas the said C.B.A Union through its General Secretary submitted a\ncharter of demands dated January 1st, 2012, U\u002FS 42(1) of IRA 2010, while the\nmanagement has also served a Notice of demand under section 42(1) of IRA 2010,\nsimultaneously to the C.B.A union vide letter dated 02-01-2012. Various\nmeetings for bilateral negotiation where held between the parties but due to\nadamant attitude of C.B.A office bearers, the General Secretary, C.B.A issued a\nNotice of Strike dated 16.01.2012 under section 42 read with Section 48, IRA\n2010, while the management has also issued a Notice of Lock out date 16.01.2012\nunder section 42 read with section 44, IRA 2010 to the General Secretary C.B.A\nunion the copies endorsed to Area Conciliator and other where after, several\nmeetings were held before the Area Conciliator and demands raised by the C.B.A\nunion and the management were discussed at length. Lastly a joint meeting of\nparties in presence of Area Conciliator was held on today and realizing the\npresent situation have mutually agreed and in consequences whereof the\nfollowing settlement has been arrived between the parties being full and final\nsettlement of the demands raised by the C.B.A Union as well as by the\nmanagement in their afore-mentioned charter of demands and the settlement has\nbeen concluded which as follows.\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Ch2>1. SALAY \u002F WAGES\u003C\u002Fh2>\n\n\u003Cp>Taking into consideration the present inflation which has been increased\nconsiderably and pointed out by the C.B.A, the management has agreed to grant\nan increase of Rs. 2200\u002F- per month on the basis that 50% of the said increase\nwill be credited in the basic salary\u002Fwages while the remaining balance of 50%\nof present increase will be adjusted in other allowance w.e.f. 01.01.2012 to\nall permanent Workmen who were on the payroll of the company on 1st January,\n2012 and who have completed 12 months continuous service on the said date as\nworkmen and are still in the employment of the company on the date of singing\nof this Settlement.\u003C\u002Fp>\n\n\u003Ch2>2. ANNUAL INCREMENT\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>The Management has agreed to enhance the existing rate of Annual increment\nfrom 8% to 10% according to the following schedule. ATTENDANCE\u002FPUNCTUALITY ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>a) Attendance\u002FPunctuality allowance has been increased from Rs. 500\u002F- to Rs.\n600\u002F- (Six hundred only) per month.\u003C\u002Fp>\n\n\u003Cp>b) A total grace time of 5 minutes per day will be allowed to all\nworkers.\u003C\u002Fp>\n\n\u003Cp>c) if any worker is late for more than 5 minutes grace time for 5 days\nduring a month, then one half-day leave\u002Fwages will be deducted. Such workers\nwill not be eligible for Attendance\u002FPunctuality allowance during that\nparticular month.\u003C\u002Fp>\n\n\u003Cp>d) Workers availing more than one sick leave or casual leave (one half-day\nadditional leave in case of extreme emergency) in a month will disqualify\nhimself\u002Fherself for Attendance\u002FPunctuality allowance during that particular\nmonth.\u003C\u002Fp>\n\n\u003Cp>e) Worker reporting late for more than one hour after duty time will not be\nallowed to perform duty for that day.\u003C\u002Fp>\n\n\u003Cp>f) Relaxation may be given in case of public strike, any natural calamity or\nany untoward situation in the city at the sole discretion of the management\nhowever, habitual late comers will not be eligible for any relaxation.\u003C\u002Fp>\n\n\u003Ch2>4. EMERGENCY RELIEF\u003C\u002Fh2>\n\n\u003Cp>The Management has agreed to revise Emergency Relief from Rs. 12,000\u002F-\n(Twelve thousand only) to Rs. 15,000\u002F- (Fifteen thousand only) which will be\ngiven to the legal heirs of deceased workman who has died while in the\nemployment of the company.\u003C\u002Fp>\n\n\u003Ch2>5. APPRECIATION REWARD\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-incidentalbonustype2\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>A workman who has full attendance in a year and does not avail any leave\nduring the financial year will be given an Appreciation letter apart from cash\nreward which has been increased from Rs. 1200\u002F- (twelve hundred only) to Rs.\n1500\u002F- (Fifteen hundred only).\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Ch2>6. GRATUITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-SENIOR_trigger\">\u003Cp>The Management has agreed that if any worker having 22 years or more\nservice, retires, resigns or his services are terminated by the employer other\nthen for misconduct will be paid Gratuity of 42 days (30 days on gross and 12\ndays on basic plus COLAs).\u003C\u002Fp>\n\n\u003Cp>The quantum of payment of gratuity will be according to the following\nschedule:\u003C\u002Fp>\n\n\u003Ctable border=\"1\" style=\"width: 100%\">\n  \u003Ccaption>\u003C\u002Fcaption>\n  \u003Ccolgroup>\u003Ccol>\n  \u003Ccol>\n  \u003C\u002Fcolgroup>\u003Ctbody>\n    \u003Ctr>\n      \u003Ctd>NO. PROFIT BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The management has agreed to pay annual Bonuses for the year ended 30th\nJune, 2012 and 30th June, 2013 in the event of profit only in accordance with\nthe following schedule:\u003C\u002Fp>\n\n\u003Cp>a) One and half Bonus on gross wages on financial year closing salary will\nbe paid during the 4th week of Shaban.\u003C\u002Fp>\n\n\u003Cp>b) Bonus under Standing Orders 10-C of the Industrial and Commercial\nEmployment (Standing Orders) Ordinance, 1968 equal to one month’s gross wages\nand half month gross wages\u002Fsalary on financial year closing salary as bonus\nwill be paid during early 1st week of Zil-hajj\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>8. TOWEL\u003C\u002Fh2>\n\n\u003Cp>The management has agreed to give 2 towels to all unionized workers once in\na year.\u003C\u002Fp>\n\n\u003Ch2>9. SET OFF\u003C\u002Fh2>\n\n\u003Cp>a)Since the increase in wages and other allowances has been given and\nincrease in attendance allowance has been allowed due to rise in cost of living\nand present inflation, therefore in the event of any indexation of wages and\nany other allowance such as Special Allowance\u002FAdditional Allowance or any other\npayment including that of Cost of Living Allowance that may by\nintroduced\u002Fgranted\u002F awarded whether by Federal\u002FProvincial Government and\u002For any\nCompetent Authority in future by way of Legislation, Ordinance, Directive or\nOrder etc. or in any other manner whatsoever, the MONETARY BENEFITS ALLOWED\nUNDER THIS SETTLEMENT SHALL BE SET-OFF.\u003C\u002Fp>\n\n\u003Cp>b) Any raise\u002Fincrement allowed by the management in the past due to any\nconsideration or any settlement including the present increase being allowed\nunder settlement shall not be quoted as practice or precedence in future.\u003C\u002Fp>\n\n\u003Cp>c) Financial benefits\u002Fincrease given Terms 1 &amp; 2 above under this\nsettlement will be applicable\u002Fcalculated for the purpose of salary\u002Fwages,\novertime payment, gratuity bonus and leaves only.\u003C\u002Fp>\n\n\u003Cp>d) That the existing facilities which are enjoyed by the workmen before this\nsettlement will continue to be enjoyed unless altered, modified by this\nsettlement.\u003C\u002Fp>\n\n\u003Ch2>10. MAINTAINING OF DISCIPLINE AND PRODUCTIVITY OF THE FACTORY\u003C\u002Fh2>\n\n\u003Cp>a. It has been agreed that the C.B.A Union shall exercise its influence upon\nworkers in extending full co-operation to the company for maintaining\ndiscipline in the Factory.\u003C\u002Fp>\n\n\u003Cp>b. C.B.A Union will also exercise its influence upon workers in curtailment\nof late coming, absenteeism and loss of time by the workers on false and\nfrivolous pretext and shall co-operate to increase the productivity and\nefficiency amongst the workers.\u003C\u002Fp>\n\n\u003Cp>c. The C.B.A Union has further agreed to maintain industrial peace and\nharmony in the factory and shall not give any cause of complaint to the\nmanagement for loss of time and they shall maintain discipline amongst the\nworkers.\u003C\u002Fp>\n\n\u003Cp>d. The C.B.A Union further undertakes not to resort to Go-slow, illegal\nstrike or damage to any machinery or property of the factory and to assist the\nmanagement in controlling theft and further assure to support the management\nand curtailment of production due to any cause whatsoever.\u003C\u002Fp>\n\n\u003Cp>e. The C.B.A Union shall not interfere in the act of Administration\nvis-à-vis transfer of workers etc. on any manner whatsoever and they should\nmaintain discipline and avoid creating any unrest amongst the workers on any\npretext.\u003C\u002Fp>\n\n\u003Cp>f. The C.B.A Union will also exercise its influence in curtailment of short\nleaves and the short leave should be restricted to only unavoidable\ncircumstances.\u003C\u002Fp>\n\n\u003Ch2>11. SETTLEMENT CONCLUSIVE\u003C\u002Fh2>\n\n\u003Cp>a. It has been agreed that this settlement is full &amp; final in respect of\nall demands raised by the said C.B.A Union as well as by the management vide\ntheir Charter of Demand dated 1st January, 2012 &amp; 2nd January, 2012\nrespectively, which followed with Notice of Strike\u002F and Notice of Lock-out\ndated 16.01.2012 and nothing remains to be settled between the parties in any\nmanner whatsoever.\u003C\u002Fp>\n\n\u003Cp>b. Any move in respect of the said demands raised by the Union or which\ncould have been raised and such of the demands that are not raised are covered\nby the said settlement and shall be deemed to have been given up by the C.B.A\nUnion and shall not raise any demand financial or otherwise during the currency\nperiod of this settlement and they shall abide by the terms of the present\nsettlement in letter and spirit.\u003C\u002Fp>\n\n\u003Ch2>12. TENURE OF AGREEMENT\u003C\u002Fh2>\n\n\u003Cp>That aforesaid Settlement shall come to operation w.e.f. 1st January, 2012\nand shall be binding on both the parties, their heirs, successors or assigns\nand or any other Union herein after so determined as C.B.A for a period of at\nleast 2 years i.e. up to 31st December, 2013 and shall continue to be binding\nfor a period even thereafter unless terminated by any of the party bound by the\nterms of the said Settlement.
