Rafique - Asstt: Office Secretary\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE\u003C\u002Fp>\n\n\u003Cp>THE General Secretary of Homsons Industries (Landhi Unit) Workers Union in\nthe capacity of Collective Bargaining Agent for all the Workers in the province\nof Sindh and Punjab, had served a charter of demand dated 19th March, 2012\nunder Section 35 of the Industrial Relation Act, 2012.\u003C\u002Fp>\n\n\u003Cp>That since Hamsons Industries had been declared as Collective Bargaining\nUnit by the Chairman N.I.R.C (RITU) for all the Factories situated at Bin Qasim\nLandhi, Karachi and the other Factory situated at Plot No. 54-B, Sector 28,\nKorangi Industrial Area, Karachi and sale office situated at 246-H, Margazar\nColony, Multan Road, Lahore. Hence, negotiation between parties took place and\nafter several joint meeting of the parties the following agreement has been\narrived at:-\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>1. \u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>That the Management in anticipation of net profit for the year ended on 31st\nDecember, 2011 has agreed to give one month wages as Profit Bonus under\nStanding Order 10-C to all those permanent Workers of the two factories\nmentioned above and the sale office at Lahore, who have completed one-year\ncontinuous Service to their credit and are on the roll of the Company on the\nday the settlement is signed. That those permanent Workers who have less than\nonce year continuous service but more than three-month continuous service to\ntheir credit on December 31st, 2011 will be given the aforesaid Profit Bonus on\nprorate basis.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp> That similarly the management has also agreed to give Profit Bonus under\nStanding Order 10(C) equal to one month wages to all those permanent workers\nwho will be on the pay roll of the company on 31st December, 2012 and who have\ncompleted one-year continuous service to their credit and are on the pay roll\nof the company at that time i.e. on December 31st, 2012.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. \u003C\u002Fh2>\n\n\u003Cp>That those permanent workers who have less than one-year but more than\nthree-month continuous services to their credit on 31st December, 2012 will be\ngiven the aforesaid Profit Bonus on pro-rata basis, provide they are on the pay\nroll of the company at the time when the Profit Bonus is declared.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. \u003C\u002Fh2>\n\n\u003Cp>That the aforesaid Profit Bonus is in full and final of the bonus under\nStanding Order 10-C of the Industrial and Commercial Employment (Standing\nOrder) Ordinance, 1968 for the year 31st December, 2011 and 31st December, 2012\nrespectively.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. \u003C\u002Fh2>\n\n\u003Cp>That the C.B.A\u002F workers shall not demand any further Bonus whatsoever for\nthe year ended 31st December, 2011 and 31st December, 2012 respectively.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. \u003C\u002Fh2>\n\n\u003Cp>That the Management has agreed to provide Iftar to the workers in the month\nof Ramzan.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. \u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-PAIDLEAV_trigger\">\u003Cp>That the Management has agreed to continue to give the following leaves with\npay in a year.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) Annual leave: 14 days Annual Leave will be given to all those Permanent\nworkers who have completed one-year continuous Service to their Credit.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-deathrelatives\">\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-childcare\">\u003Cp>b) 10 days Casual Leaves in a Calendar Year.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-sicknessmaxdays\">\u003Cp>c) 08 days Sick Leave in a Calendar Year.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-bankholidays1\">\u003Cp>d) Festival Holiday: According to Sindh Government Gazette Notification\nunder Factories Act, 1934.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>8. \u003C\u002Fh2>\n\n\u003Cp>That the Management has agreed that the increment will be given to the\nworkers keeping in view their efficiency, output and discipline of the past.\nHowever, this is the sole discretion of the Management and shall not be\nagitated at any stage in future.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>9.\u003C\u002Fh2>\n\n\u003Cp>That the C.B.A\u002Fworkers and management has agreed that the retirement age of\nthe Male workers will be 60 years and 55 for Female workers and those workers\nwho are unfit as per Doctor Certificate would be retired and will be given\none-month Notice or pay in lieu thereof.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>10. \u003C\u002Fh2>\n\n\u003Cp>That the Management has provided Eating Place in both the factories units\nfor having lunch by the workers who shall bring lunch from their home as they\nlike to prefer to have the home food.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>11. \u003C\u002Fh2>\n\n\u003Cp>That on the demand of the C.B.A union the management has agreed to have\nProvident Fund Scheme in lieu of gratuity w.e.f.
