Jamshoro and the said C.B.A. Union gave the a charter of\ndemands dated 08 August 2009 to M\u002FS Habibullah Coal Mining Company Lakhra under\nsection 43(1) of the I.R.A. 2008 for direct bilateral negotiations and\nagreement and copies whereof sent to the concerned authorities including Deputy\nDirector Labour (Conciliation) Hyderabad Region Hyderabad.\u003C\u002Fp>\n\n\u003Cp>AND FURTHER WHEREAS on receipt of the above said notice the management of\nM\u002FS Habibullah Coal Mining Company Lakhra start the negotiations relating to\ndifferences and disputes with C.B.A. Union and the result of the negotiations\nthis agreement is executed between the parties at Hyderabad on 25th November,\n2009 is under:-\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>TERMS &amp; CONDITIONS OF AGREEMENT\u003C\u002Fp>\n\n\u003Ch2>Demand No. 1. BONUS FOR FINANCIAL YEAR 2008-2009.\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that the Workmen\u002FEmployees of the M\u002FS\nHabibullah Coal Mining Company Lakhra will be paid the aforesaid bonus for the\nfinancial year 2008-2009 as under:-\u003C\u002Fp>\n\n\u003Cp>All the monthly-rated and daily rated employees\u002Fworkmen shall be paid bonus\nfor financial year 2008-2009 equivalent to their sixty (60) day’s\nsalary\u002Fwages which quantum of gross salary\u002Fwages they were getting as on\n30-06-2009.\u003C\u002Fp>\n\n\u003Cp>(a) It is also agreed that the coal cutters shall be paid bonus as per\nprevious system Rs. 12\u002F- per ton.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 2. ENHANCEMENT IN WAGES\u002FSALARIES AND OTHER BENEFITS\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed between the parties that the Habibullah Coal Mining Company\nLakhra shall increase the rates of wages\u002Fsalaries of the employees\u002Fworkmen\nw.e.f. 1st July 2009 as under:-\u003C\u002Fp>\n\n\u003Cp>(1) That an increase of Rs. 700\u002F- per month will be made in wages\u002Fsalaries\nof all monthly and daily rated employees\u002Fworkmen.\u003C\u002Fp>\n\n\u003Cp>(2) It is agreed that the unskilled worker\u002Femployee will be paid wages Rs.\n6000\u002F- per month as minimum wages.\u003C\u002Fp>\n\n\u003Cp>(3) It is also that that the minimum wages of clerk will be paid rupees\n6500\u002F= and mine sardar will be paid rupees seven thousands per month.\u003C\u002Fp>\n\n\u003Cp>(4) It is agreed that the increase per ton will be made in the rate of Coal\nCutters, as per Schedule “A”.\u003C\u002Fp>\n\n\u003Cp>(5) It is agreed between the parties that the Jorisars commission, Material\nAllowance and Amani allowance shall be increase as per schedule “B”.\u003C\u002Fp>\n\n\u003Cp>(6) It is further agreed that the Coal Cutter will be paid summer allowances\nfor seam no 1 rupees 15 seam no 2 rupees 20 seam no 3 rupees 25 from 1st April\nto 31st August every year. And jorsar also will be paid Rs 10 for the above\nsaid period\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(7) Special Summer Allowance for small seam i.e. three feet or less than\nthree feet.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>i. It is agreed that, any Jori produce 400 four hundred to 450 four hundred\nfifty tons coal in a month shall be paid EXTRA Summer allowance at the rate of\n25\u002F- per ton w.e.f. 1st April to 31st August every year.\u003C\u002Fp>\n\n\u003Cp>ii. It is agreed that, any Jori produce 451 four hundred fifty to 500 Five\nhundred tons coal in a month shall be paid EXTRA Summer allowance at the rate\nof 35\u002F- per ton for the above said period.\u003C\u002Fp>\n\n\u003Cp>iii. It is further also agreed that, any Jori produce 501\u002F- Five Hundred One\ntons and above coal in a month shall be paid EXTRA Summer allowance at the rte\nof 45\u002F- per ton and Jorisar will be paid Rs. 10\u002F- per ton for the above said\nperiod.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No. 3. That the Chapper Katai\u002FRoof Cutting rate has been as\nunder:-\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(a) The rate of Chapper Katai\u002FRoof Cutting of up to one feet thickness will\nbe Rs. 80\u002F- per running feet.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) The rate of Chappar Katai\u002Froof Cutting up to two feet thickness will be\nRs. 120\u002F- per running feet.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) The rate of Chapper Katai\u002Froof Cutting up to three feet thickness will\nbe Rs. 150\u002F- per running feet.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No. 4. \u003C\u002Fh2>\n\n\u003Cp>It is agreed between the parties that the Katcha Khudai work\u002FFootana rate\nwill be paid as under:-\u003C\u002Fp>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>a. The rate Katcha Khudai work\u002FFootana of mines deep will be increase from\nRs. 900\u002F- per running ft. (Size 5x6x7)\u003C\u002Fp>\n\n\u003Cp>b. The rate of Katcha Khudai work\u002FFootana of wall 8x8 increase from Rs.\n950\u002F- running ft. to Rs. 1100\u002F- per running ft.\u003C\u002Fp>\n\n\u003Cp>c. The rate of mines deep GALA will be paid at the Rs. 15,000\u002F- per gala of\nmines.\u003C\u002Fp>\n\n\u003Cp>d. The commission of Jorisars in Katcha Khudai works will be paid Rs. 60\u002F-\nper running ft and haulage driver guni bags and other material will be\nresponsibility of the company.\u003C\u002Fp>\n\n\u003Cp>e. The Jorisars will be paid Rs. 50\u002F- per door in Katcha Khudai deep\nwork.\u003C\u002Fp>\n\n\u003Cp>f. Extraction rate and kharaba form mines will be paid Rs. 250\u002F- per ton.\u003C\u002Fp>\n\n\u003Cp>g. Hauledge Driver Fotana will be paid Rs. 6000\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>h. It is also agreed between the parties, that in case of water &amp; stones\ncoming in way of katcha Khudai of well and deep or check and Chunae. The rate\nfixed in sub clause (1) and (2) of clause 4 shall automatically stand double.\nIt is also agreed that company shall provide compressor for cutting of stones\nand Generator for water extraction from mines.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 5. Stopping Rates\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>(a) FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(1) Stopping rates height up to six feet Rs. 1200\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping rates height above six feet up to eight feet is Rs. 1500\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(3) Stooping rates height above eight feet up to ten feet Rs. 2500\u002F-\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) WITHOUT FIRE STOPPING\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(1) Stopping height up to three feet Rs. 600\u002F- per stopping.\u003C\u002Fp>\n\n\u003Cp>(2) Stopping height above three feet up to eight feet Rs. 900\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(3) Stopping height above six feet up to eight feet Rs. 1200\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>(4) Stopping height above six feet up to ten feet Rs. 2000\u002F- per\nstopping.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No.6. WAGES RATES OF THE COAL CUTTERS.\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is settled that the Rs. 200\u002F- per day in total will be the rate for\nGazetted Holiday and Holiday and Gratuity for Coal Cutters.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No. 7. RESIDENTIAL FACILITIES.\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>1. It is agreed between the parties that management shall provide to each\nand every workmen\u002Femployee free residential facilities with Bath-Rooms,\nKitchens etc. and further that the repairs, white-wash of the residential\npremises\u002Fquarters of the workers shall be under taken by the management each\nyear, at its own cost in consultation with the CBA Union.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>2. It is also agreed that management of Habibullah Coal Mining Company\nLakhra already approached the Sindh Worker welfare Board for allotment of One\nHundred (100) constructed houses at Habibullah Coal Mining Company Lakhra\nLakhra Coal Field for workers\u002Femployees. The down payment and monthly\ninstallment will be paid by Management of the Company on behalf of allotee\nworker\u002Femployees.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>3. It is further agreed that the Management will provide one hundred fans\nfor the houses of workers at Lakhra Coal Field through C.B.A. union.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No.8. DISTRIBUTING FREE SWEING MACHINES\u002FFANS\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that the M\u002FS Habibullah Coal Mining Company Lakhra shall\ndistribute Two hundred sewing machines free of cost through C.B.A. union.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No. 9. MEDICAL FACILITIES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthcareaccess\">\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>(a) Rs. 5\u002F- per ton already paid by the company on production of coal every\nmonth to Medical Treatment Committee, for expenses salary of Staff &amp;\nDoctors, Medicines and all requirement for treatment of workers at mines site\nhospital.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) In case the treatment of effected workers\u002Femployees is not possible at\nthe arrangement of mines site under sub clause (a), those workers\u002Femployee\nshall be send to those Hospitals which is agreed by the union on the company\nexpenses.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) In case of accident the management of M\u002FS Habibullah Coal Mining Company\nLakhra shall be liable and responsible for every kind of treatment and medical\nfacilities at the levels to staff effected workers\u002Femployees at the company\nexpenses including hospitalization food, medicines and all kind of\nrequirement.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 10. PROVINDING TELEVISION SETS\u003C\u002Fh2>\n\n\u003Cp>Agreement. It is agreed that the management of M\u002FS Habibullah Coal Mining\nCompany Lakhra will distribute thirty (30) TV sets with betteries free of cost\nto the workers through C.B.A. Union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 11. INCREASE IN SPORTS FUND\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that Annual sports fund will be paid to the C.B.A Union of Rs.\n80,000\u002F- (Eighty Thousand Only)\u003C\u002Fp>\n\n\u003Ch2>Demand No.12. PROVIDING FACILITIES FOR C.B.A. UNION OFFICE\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Habibullah Coal Mining Company Lakhra will provide Rs.\n100,000\u002F- (One hundred thousand Only), for the purchase of office equipment’s\nfor C.B.A. Union office at Hyderabad.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 13. PROVIDING NEW MINES TO JORISARS\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that Jorisars whose working in the company\nwill be provided new mines with the commendation of C.B.A. Union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 14. INCREASE IN GRATUITY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Habibullah Coal Mining Company Lakhra shall pay\ngratuity to all monthly salary and daily wages paid workers according the\nprovision of West Pakistan Industrial &amp; Commercial Employment standing\norder ordinance 1968. It is further agreed between the parties that the above\nsaid gratuity shall be paid 60 days per annum to those employees whose services\nare more than 03 years.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>Demand No. 15. SENDING WORKMEN ON HAJJ\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Habibullah Coal Mining Company Lakhra will send Two\n(2) workmen\u002Femployees every year to Hajj by Air through C.B.A. Union on company\nexpenses as under:-\u003C\u002Fp>\n\n\u003Cp>(1) One person will be selected from Coal cutters not less than 3 months.\u003C\u002Fp>\n\n\u003Cp>(2) One person will be selected from employees working in Head Office and\nmines site and Jorisars\u002FCommissions.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 16. FAIR PRICE SHOP AT MINES SITE\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Habibullah Coal Mining Company Lakhra will provide a\nfacility of Fair price shop for workers\u002Femployers no loss no profit basis\nproviding them maximum commodities of consumer goods, with the time to time\nconcern of C.B.A. Union.\u003C\u002Fp>\n\n\u003Ch2>Demand No. 17. PROVIDING MEAT ON EID-UL-AZHA OCCASION\u003C\u002Fh2>\n\n\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed that M\u002FS Habibullah Coal Mining Company Lakhra will provide\nmeat on the occasion of Eid-ul-Azha as per recommendation of C.B.A. union.\u003C\u002Fp>\n\n\u003Ch2>Demand No.18. WORKMEN COMPENSATIONN &amp; GROUP INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>Agreement.\u003C\u002Fp>\n\n\u003Cp>It is agreed between the parties that all workers\u002Femployees shall be paid\ndeath and disability compensation and group insurance amount as under:-\u003C\u002Fp>\n\n\u003Cp>(a) Death compensation and disability compensation according amendment\nworkmen compensation Act 1923, Rs. 200.000\u002F- (Rupees Two Hundred Thousand\nOnly)\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(b) It is also agreed that in case of death and disability in case of mining\naccident EXTRA amount of Rs. 30,000\u002F- (Rupees Thirty Thousand Only) will be\npaid according previous Agreements\u002FSettlements and also Rs. 2000\u002F- (Two\nThousand Only) per month shall be paid to legal heir’s of the expired worker\nfrom the date of accident up to five (5) years.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(c) It is also agreed that the amount of group insurance will be paid with\nEXTRA amount Rs. 210,000\u002F- (Rupees Two Hundred &amp; Ten Thousand Only) in\ntotal.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(d) It is also agreed that the expenses of death bodies will be paid Rs.\n50,000\u002F- (Rupees Fifty Thousand Only) for those who died during the case of\nemployment of this company.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>(e) It is also agreed that workers\u002Femployees who are disable during the\nemployment will be paid disability allowance Rs. 3000\u002F- per month for\nlifetime.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>Demand No. 19.
