The C.B.A and the management\nunder section 35 of the Industrial Relations Act, 2012 exchanged their charter\nof demands both dated 01 Jan 2013 (photocopies of which are annexed hereto and\nmarked ‘C’ and ‘D’).\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the bilateral negotiations of the representatives of C.B.A and\ncompany commenced on 09-01-2013 and subsequently several meetings held with a\nview to reaching an amicable collectively bargained agreement. As a result of\ndiscussions, bilateral negotiations and collective bargaining, parties have\nreached the following agreement taking into consideration the cost of living\nallowances being paid by the company in accordance with provisions of the\nEmployees’ Cost of Living (Relief) Act, 1973 as amended up to date and to\nmeet the inflationary trends and present and future increases in the cost of\nliving and in FULL AND FINAL settlement of all the demands contained in the\nsaid charter of demands and all other demands raised by the C.B.A.\u003C\u002Fp>\n\n\u003Cp>NOW, THEREFORE, this agreement witnesseth as under:\u003C\u002Fp>\n\n\u003Cp>TERMS OF AGREEMENT\u003C\u002Fp>\n\n\u003Cp>The increases in salary &amp; benefits as agreed under this agreement shall\nbe applicable to all fWPL permanent workers only, of fWPL CBU who were on\ncompany’s payroll as on or after 1 Jan, 2013.\u003C\u002Fp>\n\n\u003Ch2>1. BASIC SALARY\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>It is agreed that all workers who were on the payroll of the company as on\nJanuary 1, 2013 or after will be granted a flat increase of Rs. 950\u002F- per month\nin their basic salary w.e.f. January 1, 2013 after the annual increment for the\nyear 2013 and will also be applicable to those who have been appointed after\nthe said date.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. HOUSE RENT ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>a. UTLITIES\u002FDEARNESS ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the Utilities\u002FDearness Allowance will be increased by Rs.\n850\u002F- for all workers w.e.f. January 1, 2013 appointed.\u003C\u002Fp>\n\n\u003Cp>i.Up to 31-12-2005 revising from Rs. 4,915\u002F- to Rs. 5,765\u002F- and\u003C\u002Fp>\n\n\u003Cp>ii.On or after 1-1-2006, as applicable\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. TRANSPORT\u002FCONVEYANCE ALLOWANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>a.It is agreed that the existing monthly Transport\u002FConveyance Allowance will\nbe increased by Rs. 550\u002F- for all workers w.e.f. 1 January, 2013.\u003C\u002Fp>\n\n\u003Cp>b.It is agreed that for calculating overtime, full respective conveyance\nallowance, as applicable, will be taken into account for all workers as\nusual.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions as already agreed under the previous\nagreements\u002F settlement\u002F award will remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>5. LEAVE FARE ASSISTANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>It is agreed that Leave Fare Assistance to workers will be increased as\nfollows w.e.f. 1 January, 2013.\u003C\u002Fp>\n\n\u003Cp>a. By Rs. 1,000\u002F- per annum from the exiting Rs. 8,404\u002F- to Rs. 9,404\u002F- for\nworkers appointed up to 31-12-2005.\u003C\u002Fp>\n\n\u003Cp>b. By Rs. 1,300\u002F- per annum from the existing Rs. 5,734\u002F- to Rs. 7,034\u002F- for\nworkers appointed on or after 1-1-2006.\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions pertaining to the payment of Leave Fare\nAssistance will remain unchanged as already settled under previous agreements\u002F\nsettlements\u002Faward.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>6. ALLOWANCE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the following allowances to workers for relevant\ndesignations\u002F departments wherever and whichever applicable, will be revised\nw.e.f. 1 January, 2013 as under:\u003C\u002Fp>\n\n\u003Cp>a. Checker Allowance to female and male workers will be increased by Rs.\n50\u002F- and the revised allowance will be from Rs. 505\u002F- to Rs. 555\u002F- per month\nand from Rs. 200\u002F- to Rs. 250\u002F- per month respectively.\u003C\u002Fp>\n\n\u003Cp>b. Manufacturing Process Allowance payable to Production Workmen and\nProduction Workmen\u002FOperators will be increased by Rs. 30\u002F- and the revised\nallowance will be from Rs. 430\u002F- to Rs. 460\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>c. Special Allowance to workers of Injectable Department will be increased\nby Rs. 30\u002F- and the revised allowance will be from Rs. 415\u002F- to Rs. 445\u002F- per\nmonth.\u003C\u002Fp>\n\n\u003Cp>d. Special Allowance to workers exclusively working on Ophthalmic Ointment\nFilling Machine &amp; Powder Filling (Cicatrin) will be increased by Rs. 30\u002F-\nand the revised allowance will be from Rs. 415\u002F- to Rs. 445\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>e.Special Allowance to General Workmen of Bottle Blowing will be increased\nby Rs. 30\u002F- and the revised allowance will be from Rs. 200\u002F- to Rs. 230\u002F- per\nmonth.\u003C\u002Fp>\n\n\u003Cp>f. It is agreed that Special Allowance (Overprinting) payable to Over\nPrinters will be increased by Rs. 25\u002F- and the revised allowance will be from\nRs. 290\u002F- to Rs. 315\u002F- per month.\u003C\u002Fp>\n\n\u003Cp>g. It is agreed that Machine Operating Allowance payable to Machine\nOperators, operating packaging or production machines will be increased by Rs.\n30\u002F- and the revised allowance will be from Rs. 260\u002F- to Rs. 290\u002F- per\nmonth.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. It is further agreed that workers and dependents of male workers also be\nentitled for treatment at East Side Hospital, Main Korangi Road, Sector 23,\nKorangi, Karachi which is now on company’s panel.\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions governing this scheme will remain unchanged\nas per previous agreements\u002F settlements\u002F award.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>18. GRATUITY\u003C\u002Fh2>\n\n\u003Cp>It is agreed that management will give due consideration to revoke the\nexisting condition of maximum limit of 30 months basic salary on completion of\n30 years service or more and after it to the extent of actual years of service\ni.e. beyond 30 months, subject to approval from all competent authorities and\neffectiveness.\u003C\u002Fp>\n\n\u003Cp>All other terms and conditions governing to Gratuity scheme will remain\nunchanged as per previous agreements\u002Fsettlement\u002Faward.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>19. BONUS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>a. It is agreed that on the close of company’s financial years 2013 &amp;\n2014 (January – December) the permanent workers having completed 12 months\ncontinuous service in the respective financial year will be paid from the\nprofits of the company, bonus equivalent to seven months’ average basic\nsalary drawn in 2013 and 2014 including statutory cost of living allowances\nexcept set off allowed under previous agreements\u002F settlements\u002Faward and\nexcluding of statutory cost of living allowances set off\u002Fhas been merged in the\nHouse Rent Allowance for the workers appointed on or after 01 January 2006 as\nagreed under clause 2 (b) of this agreement.\u003C\u002Fp>\n\n\u003Cp>b. All bonuses (except 10-C) will be paid on prorate basis to workmen having\nless than 12 months service in the respective financial year.\u003C\u002Fp>\n\n\u003Cp>c. The said bonus will be inclusive of one month’s profit bonus payable\nunder Standing Order 10-C of the Industrial &amp; Commercial Employment\n(Standing Orders) Ordinance, 1968 and that the workmen would receive said seven\nmonths profit bonus in full satisfaction of the company’s liability to pay\nbonus payable under the said Standing Order Ordinance, 1968.\u003C\u002Fp>\n\n\u003Cp>d. It is agreed that all Muslim permanent workers with more than six\nmonths’ service will be given an advance equivalent to 2 months’ basic\nsalary including cost of living allowance along with the salary of the month\nimmediately before the month of Ramzan. This advance would be adjusted from the\nsaid seven months’ profit bonus which the company, as agreed to above, would\npay along with March salary each year following the close of company’s\nfinancial year so that those workers who have already received the said 2\nmonths advance before the month of Ramzan would be paid the said bonus\nadjustment of the said advance for the financial year 2013 &amp; 2014.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>20. GOOD ATTENDANCE BONUS\u003C\u002Fh2>\n\n\u003Cp>It is agreed that effective 01 January, 2013 the monthly Good Attendance\nBonus will be increased by Rs. 50\u002F- as follows:\u003C\u002Fp>\n\n\u003Cp>a. Full attendance without late in a calendar month from Rs. 350\u002F- to Rs.\n400\u002F-.\u003C\u002Fp>\n\n\u003Cp>b. On availing half day casual\u002Fsick leave and\u002For one late in a calendar\nmonth from Rs. 250\u002F- to Rs. 300\u002F-.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>21. It is agreed that existing Lunch allowance of Rs. 40\u002F- per day being paid\nto drivers (Admin) who cannot return from outdoor duty by 1.00 p.m. to take\nlunch will now be paid @ Rs. 43\u002F- per day.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>22. RETIREMENT GIFT\u003C\u002Fh2>\n\n\u003Cp>It is agreed that the existing Retirement Gift of Rs. 8,000\u002F- given to\nworkers on retirement on superannuation will be increased by Rs. 2,000\u002F- and\nthe revised amount will be Rs. 10,000\u002F- with retirement shield.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>23. RETIREMENT AGE\u003C\u002Fh2>\n\n\u003Cp>It is agreed that w.e.f. 20 December, 2013 Retirement Age of female workers\nwill be enhanced from 58 years to 60 years becoming equivalent to male\nworkers.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>24. FUNERAL EXPENSES\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-funeralpay\">\u003Cp>It is agreed to increase the existing Funeral Expenses of Rs. 21,000\u002F- by\nRs. 4,000\u002F- and the revised amount will be Rs. 25,000\u002F-. OTHER BENEFITS\u003C\u002Fh2>\n\n\u003Cp>a. Meal Allowance paid to workers doing overtime for 3 hours or more in\ncontinuation of his\u002Fher normal daily working hours will be increased by Rs.\n17\u002F- and the revised allowance will be from Rs. 33\u002F- to Rs. 50\u002F- per day.\u003C\u002Fp>\n\n\u003Cp>b. It is further agreed that workers doing overtime continuously for 3 hours\nof more on holidays will be paid meal allowance of Rs. 50\u002F- per day from the\nexisting Rs. 33\u002F- per day and if canteen facilities are made available to them,\nRs. 30\u002F- per day from the existing Rs. 27\u002F- per day will be deducted from their\nabove meal allowance. Conveyance Allowance paid to workers who are required to do overtime work\nbeyond normal working hours will be increased by Rs. 9\u002F- and the revised\nallowance will be from Rs. 31\u002F- to Rs. 40\u002F- per day (if transport is not\nprovided by the company) w.e.f. 1 January, 2013.
