Mr. Anwar Kamal - Finance Secretary\u003C\u002Fp>\n\n\u003Cp>SHORT RECITAL OF THE CASE:\u003C\u002Fp>\n\n\u003Cp>WHEREAS Futehally Chemicals Mehnatkash Union the CBA Union as a Collective\nBargaining Agent of the workmen employed with the Company served upon the\nCompany a Charter of Demands dated July 01, 2013 under section 24 of the Sindh\nIndustrial Relations Act, 2013. A copy of the Charter of Demands is enclosed\nherewith and marked Annexure “A”.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS both parties held several meetings which were extended by mutual\nconsent from time to time and as a result of the discussions, bilateral\nnegotiations and collective bargaining on the said Charter of Demands, the CBA\nUnion and the Company have reached the following agreement taking into\nconsideration specifically the inflationary trends and expected rise in Cost of\nLiving in the future in full and final settlement of all the demands and claims\nof the CBA Union contained in the said Charter of Demands dated 1st July\n2013.\u003C\u002Fp>\n\n\u003Cp>TERMS OF THE AGREEMENT:\u003C\u002Fp>\n\n\u003Ch2>1. INDUSTRIAL PEACE AND PRODUCTIVITY\u003C\u002Fh2>\n\n\u003Cp>It is understood and agreed that in view of the signing of this\nAgreement:\u003C\u002Fp>\n\n\u003Cp>a. The CBA Union has agreed to continue to maintain industrial peace and\nharmony so that both the workers and the company devote their full attention\nand endeavor towards obtaining further and better results through improvement\nin productivity and maximizing production which is undisputedly accepted as the\nneeded of the hour.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. The CBA Union and all the workers shall continue to extend full\ncooperation to the Company for maintaining discipline at all times and\nundertake not to resort to strike or go slow in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. In order to achieve the above objective, the CBA Union has given\ncategorical assurance to the Company that it will extend full cooperation for\nminimizing absenteeism, improvement of punctuality, devoting of full working\ntime and efforts towards improvement of production \u002F overall increase in\nproductivity, maintain discipline and for a continued understanding and\ngoodwill at all levels.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>d. The CBA Union has agreed that all the workers will accept the standard\nwork allocation laid down or to be laid down from time to time by the Company,\nwill not loiter during their shifts \u002F working hours and will remain at their\nplaces of work producing normally until the end of their shifts. At the end of\ntheir shifts they will properly handover the charge of their jobs to their\nrelievers and then they should leave the place of their duty (without any loss\nof production). Workers abandoning their place of work without reasons or\npermission by their departmental heads will be subject to disciplinary\naction.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>e. The CBA Union has agreed that during the tenure of this Agreement the\nUnion shall make all efforts to improve productivity, quality, efficiency,\ndiscipline, housekeeping, cleanliness, adherence to starting &amp; closing time\nof work and attendance of workman.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>f. The CBA Union office Bearers, either signatories of the agreement or\nthose who by legal process replace them during the validity of this agreement,\nagree to refrain from using their elected post as an excuse for wandering\naround the factory premises and not working. They also agree, in their primary\ncapacity as workmen, to request and obtain leave before leaving their places of\nwork and to report back to the person in-charge when they return from the said\nleave.\u003C\u002Fp>\n\n\u003Ch2>2. APPLICATION &amp; ADMISSIBILITY OF THE BENEFITS OF THE AGREEMETN \u002F\nSETTLEMENT:\u003C\u002Fh2>\n\n\u003Cp>It is agreed and understood that:\u003C\u002Fp>\n\n\u003Cp>a. This agreement is confined to and covers only the regular permanent non\nmanagement staff and workers who are employed by the Company and were on its\npayroll as on 1st July, 2013 or who have retired due to old age from service\nafter 1st July, 2013 or expired while in service after 1st July, 2013 or may\njoin subsequently but within the period of this agreement remains in force.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b. Except as otherwise provided in any clause, this Agreement shall come\ninto force from 1st July 2013 and shall be binding on both the parties\nmentioned above for a period of two years from 1st July 2013 to 30th June,\n2015.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c. All benefits \u002F facilities and conditions of service existing as on the\ndate of signing of the agreement and not covered or modified in the Agreement\nshall continue to remain unchanged subject to the terms and conditions of this\nAgreement.\u003C\u002Fp>\n\n\u003Ch2>3. INCREMENTS\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>Due to rise in cost of living the Company has agreed to allow an increase of\n15% w.e.f. 1st July 2013 in existing Basic Salary of all permanent non\nmanagement staff members and workers in Grade 2a, 2b, 3a, 3b, 4a, 4b, 5a, 5b,\n6a, 6b, 7a and 7b. However increase of 16% w.e.f. 1st July 2013 in Basic Salary\nis allowed for all permanent non management staff members and workers in Grade\n8a and 8b.\u003C\u002Fp>\n\n\u003Cp>The above increase is allowed once as a special case without quoting as\nprecedence in future to all permanent non management staff members and workers\nin their existing grades as mentioned above.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>4. ADDITIONAL PROFIT BONUS \u002F RAMADHAN EIDI\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-ONCERISE_trigger\">\u003Cp>It has been mutually agreed between Company and CBA Union that with effect\nfrom 1st July 2014 to allow one Gross Salary as additional Profit Bonus \u002F\nRamdhan Eidi to all permanent staff members and workers after agreeing on the\nwithdrawal of 4 (four) Optional Holidays and Reduced working hours in the holy\nmonth of Ramadhan in all shifts detailed as under:\u003C\u002Fp>\n\n\u003Cp>It has been mutually agreed between Company and CBA Union that the following\nOptional Holidays earlier agreed through settlements now stands withdrawn with\nimmediate effect:\u003C\u002Fp>\n\n\u003Cp>- 1st January\u003C\u002Fp>\n\n\u003Cp>- New Year\u003C\u002Fp>\n\n\u003Cp>- 15th Shaban \u003C\u002Fp>\n\n\u003Cp>- Shab e Barat\u003C\u002Fp>\n\n\u003Cp>- 21st Ramadhan\u003C\u002Fp>\n\n\u003Cp>- Shahadat Hazrat Ali A.S.\u003C\u002Fp>\n\n\u003Cp>- 20th Safar\u003C\u002Fp>\n\n\u003Cp>- Chehlum Imam Hussain A.S.\u003C\u002Fp>\n\n\u003Cp>And now all the above days will be treated as normal working days.\u003C\u002Fp>\n\n\u003Cp>It has been mutually agreed that the Reduced working hours agreed through\nearlier settlements now stands withdrawn with effect from Ramadhan 1435 H for\nall shifts. As such now Ramadhan working hours in all shifts will be same as of\nthe other eleven months.\u003C\u002Fp>\n\n\u003Cp>However shift timings for Ramadhan shall be mutually agreed between CBA\nUnion and the Company for 2 shift operations one month before the next\nRamadhan.\u003C\u002Fp>\n\n\u003Cp>The aforesaid additional Profit Bonus \u002F Ramadhan Eidi of one Gross Salary\nshall be paid to all those permanent staff members and workers who are on\nCompany’s payroll at the time of its declaration during the month of Ramadhan\nand having completed one year’s continuous service. Those permanent staff\nmembers and workers having completed three months continuous service but less\nthan one year will be entitled for the aforesaid additional Profit Bonus \u002F\nRamadhan Eidi on pro-rata basis.\u003C\u002Fp>\n\n\u003Cp>Further the aforesaid additional Profit Bonus \u002F Ramadhan Eidi will not form\npart of wages for payment of Bonus, Provident Fund, Gratuity, calculation of\novertime, encashment of leaves etc.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>5. GROUP INSURANCE\u003C\u002Fh2>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-healthinsurance\">\u003Cp>It has been mutually agreed between Company and CBA Union that with effect\nfrom 1st November 2013 the individual sum assured and principal amount of\ncompensation under Group Life Insurance coverage for natural death to all\npermanent non management staff members and workers is enhanced from Rs.\n300,000\u002F- to Rs. 400,000\u002F-, which is inclusive of Group Insurance under\nStanding Order 10(B).\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Ch2>6. GOOD MANUFACTURING PRACTICES\u003C\u002Fh2>\n\n\u003Cp>Both CBA Union and all the workers have expressed their commitment to Good\nManufacturing Practices, thereby maintain the equipments and production areas\nneat and clean, following all the Company procedures to ensure high quality\nproduct and discouraging improper clad and careless working habits.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>7. GENERAL CONDITIONS\u003C\u002Fh2>\n\n\u003Cp>The CBA Union hereby agrees that this Agreement is full and final settlement\nof all their demands contained in the Charter of Demands dated July 01, 2013.\nThose demands or disputes not specifically mentioned herein but covered or\nraised by the said Charter of Demands or in the course of discussions, shall be\ndeemed to have been settled, modified and \u002F or withdrawn in accordance with and\n\u002F or in consideration of the benefits given in this Agreement. Any demands not\nspecifically mentioned \u002F settled herein have been withdrawn by the CBA\nUnion.\u003C\u002Fp>\n\n\u003Cp>It has been agreed between the CBA Union and the Company that all other\nterms and conditions of employment and provisions of the previous Agreements \u002F\nSettlements, not covered or modified by this Agreement, shall continue\nunchanged subject to the Company’s right to amend the service rules and other\nterms and conditions of the employment and enforcement of the relevant laws.\u003C\u002Fp>\n\n\u003Cp>In consideration of the increase in wages granted to all the permanent non\nmanagement staff and workers the CBA union under take not to re-agitate demands\nthat have been raised and disposed off by this Settlement or raise any further\ndemands whether having financial or non financial implication on the Company\nupto 30th June, 2015.\u003C\u002Fp>\n\n\u003Cp>The CBA Union and all the workers agree and accept that above benefits have\nbeen given and agreed by the Company keeping in view specifically the\ninflationary trends and expected rise in Cost of Living in future. Any\nbenefits, increase or allowance that are given during the operative period of\nthis agreement by the Federal or Provincial Government under the Worker’s\nCost of Living, the Sindh Worker’s Special Allowance or any other law, rules\nor notification under any head or name whatsoever, are hereby deemed to have\nbeen granted in terms of the provisions of this Settlement and shall be set off\naccordingly. However if there is no set off clause than the said amount would\nbe withdrawn from this agreement accordingly.\u003C\u002Fp>\n\n\u003Cp>It is mutually agreed and understood that with the development of cordial\nand mutual confidence amongst the Management and all the workmen concerned the\nCompany will be in a position to attain and maintain an optimum level of\nproductivity and efficiency. This is turn will enable the Company and all its\nworkmen, to contribute effectively and meaningfully towards the Company’s\nobjectives of improving the efficiency and productivity.\u003C\u002Fp>\n\n\u003Cp>It is further agreed by the CBA Union \u002F workers that during the tenure of\nthis agreement, there shall be no strike and work stoppage, slow down,\ncurtailment of production, for any cause whatsoever. The CBA Union undertakes\nto fully support the Company’s efforts to increase production and efficiency\nand to fully cooperate with the Company in maintaining strict discipline.\u003C\u002Fp>\n\n\u003Cp>It has also been agreed by the CBA Union that it will make every endeavor\ntowards maximizing production, avoiding waste of working hours in\nnon-productive and un official work and encourage workers towards higher\nproductivity and excellence of discipline and will increase the present\nproduction positively.\u003C\u002Fp>\n\n\u003Cp>It is further agreed that CBA Union will fully support the Company’s\nefforts in enforcing Safety, Security and Hygiene on site.
