The\nUnion enjoys the status of C.B.A for the workers employed by the company under\nSection 24 of SIRA, 2013.\u003C\u002Fp>\n\n\u003Cp>AND WHEREAS the parties held several meetings on the demands raised against\neach other, Bilateral negotiations between the parties held from time to time\nand demands raised by them were discussed at length. After deliberate\ndiscussion\u002Fnegotiations and as a result of mutual consent, the parties have\nreached to a settlement on all the demands contained in their Charter of\nDemands both dated 01.07.2013 raised by the C.B.A Union as well as the\nmanagement.\u003C\u002Fp>\n\n\u003Cp>NOW THIS SETTLEMENT WITHNESSTH AS FOLLOWS:\u003C\u002Fp>\n\n\u003Cp>TERMS OF SETTLEMENT\u003C\u002Fp>\n\n\u003Ch2>1. GENERAL\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>a) The Company and C.B.A Union have settled all the demands raised by them\nin their Charter of Demands dated 01.07.2013, which is as follows:\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) The demands of the C.B.A Union which are not specifically agreed to in\nthis settlement shall deemed to have been withdrawn for which the union has\nagreed not to press the same in any manner whatsoever.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) That the provisions of this settlement shall be applicable to permanent\nworkmen only who are employed in the factory (Battery Division) situated at A\n– 45, Hill Street, Manghopir Road, Karachi and any other worker who is not\nworking in the said factory shall not be entitled to get these facilities.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>2. SALARY &amp; BENEFITS\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-STRUCINCR_trigger\">\u003Cp>a) INCREASE IN BASIC WAGES\u002FSALARIES\u003C\u002Fp>\n\n\u003Cp>The company has agreed to grant one-time flat increase of Rs. 500 (Rupees\nFive hundred only) per month in the basic wages salary of all permanent workmen\nof the company w.e.f. 01.07.2013.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) INCREASE IN THE EXISTING PAY SCALE\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to enhance the minimum and maximum ceiling of all\ngrades\u002Fpay scales by Rs. 250\u002F- (Rupees Two hundred and fifty only) w.e.f. 1st\nJuly, 2013.\u003C\u002Fp>\n\n\u003Cp>No extra benefit whatsoever will be allowed because of the revision of\ngrades\u002Fscales of pay and no adjustment within the revised scales will be made.\nThe revised grades are as per Annex “C”.\u003C\u002Fp>\n\n\u003Cp>c) INCREASE IN RATE OF ANNUAL INCREASE\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to increase the rate of Annual Increment of all\npermanent workers’ grades\u002Fpay scales by Rs. 20\u002F- (Rupees twenty only) w.e.f.\n1st July, 2013 and the same shall be effective from their due date of annual\nincrement.\u003C\u002Fp>\n\n\u003Cp>d) CONVEYANCE ALLOWANCE\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-COMMUTE_trigger\">\u003Cp>The company has agreed to increase the entitlement of Conveyance Allowance\nby Rs. 740\u002F- (Rupees Seven Hundred forty only) per month all permanent workers.\nAs such conveyance allowance stand revised from Rs. 2053\u002F- per month to that of\nRs. 2793\u002F- per month w.e.f. 1st July, 2013.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>e) HOUSE RENT SUBSIDY\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to increase the House Rent Subsidy by Rs. 740\u002F-\n(Rupees Seven hundred forty only) per month all permanent workmen w.e.f. July\n1st, 2013. As such the House Rent Subsidy stands revised from Rs. 2695\u002F-\n(Rupees Two thousand six hundred ninety-five only) to that Rs. 3435\u002F- (Rupees\nthree thousand four hundred thirty-five only) per month w.e.f. 1st July, 2013.\nAll other provision of the Rules remains unchanged.\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight focus\" id=\"clause-healthandsafetypolicy\">\u003Cdiv class=\"cbaClause highlight\" id=\"clause-protectiveclothing\">\u003Cp>f) WOOLEN JERSEY ALLOWANCE\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to raise the entitlement of woolen jersey allowance\nfrom Rs. 805\u002F- (Rupees Eight hundred thirty-five only) to that of Rs. 1000\u002F-\n(Rupees one thousand only) once after a period of two years.\u003C\u002Fp>\n\n\u003Cp>g) SHOES SUBSIDY\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to raise the shoes subsidy from Rs. 835\u002F- (Rupees\nEight hundred thirty-five only) to that of Rs. 1000\u002F- (Rupees one thousand\nonly) yearly entitlement for Maintenance. L.S.P Department\u002FSecurity Staff and\nDrivers these categories shall however, not be entitled to get shoes as\nprovided issued to other workers of the factory.\u003C\u002Fp>\u003C\u002Fdiv>\u003C\u002Fdiv>\n\n\u003Cp>h) LEAVE FARE ASSISTANCE\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ANNLEAVE_trigger\">\u003Cp>The Company has agreed to raise the entitlement of Leave Fare Assistance\nfrom Rs. 3500\u002F- (Rupees three thousand five hundred only) to that of Rs. 4500\u002F-\n(Rupees four thousand five hundred only) per annum to the workmen on the same\nterms and conditions as agreed in the previous memo of agreement dated\n01.09.2005.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>i) RETIREMENT BENEFITS\u003C\u002Fp>\n\n\u003Cp>The Company has agreed to enhance retirement benefit from Rs. 24000\u002F-\n(Rupees twenty-four thousand only) to that of Rs. 25000\u002F- (Rupees twenty-five\nthousand only) on retirement of permanent workman\u002Femployee who attained the\nsuperannuation age in addition to his legal dues.\u003C\u002Fp>\n\n\u003Cp>j) MEAL ALLOWANCE\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-MEALALL_trigger\">\u003Cp>The Company has agreed to enhance Meal Allowance subsidy from Rs. 50\u002F- to\nRs. 60\u002F- (Rupees sixty only) w.e.f. 1st July, 2013 only when the factory\ncanteen remains closed i.e. on Sundays and other holidays. All other Meal\nAllowance terms and conditions shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>k) NIGHT SHIFT ALLOWANCE\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-NOCTPREM_trigger\">\u003Cp>The company has agreed to increase in Night Shift Allowance from Rs. 15\u002F- to\nRs. 25\u002F- per shift per worker w.e.f. 1st July, 2013. All other Night Shift\nAllowance rules shall remain unchanged.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>l) SPECIAL ALLOWANCE\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE_trigger\">\u003Cp>The company has agreed to introduce special allowance that will be paid @\nRs. 1500\u002F- per month to all permanent workmen who perform physical work in the\nfactory or granted leave with pay by the competent authority but the same shall\nnot be allowed in the event of leave without pay or absence.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>m) PROFIT BONUS\u003C\u002Fp>\n\n\u003Cdiv class=\"cbaClause highlight\" id=\"clause-ONCERISE2_trigger\">\u003Cp>The management has agreed to pay bonus in the following manner in the event\nof net profit during the financial year to all permanent workers on the\nconditions mentioned hereunder:\u003C\u002Fp>\n\n\u003Cp>a) Five (5) bonuses on the basis of pay only with COLA.\u003C\u002Fp>\n\n\u003Cp>b) Two (2) bonuses on the basis of pay only without COLA.\u003C\u002Fp>\u003C\u002Fdiv>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>3. INDUSTRIAL PEACE, DISCIPLINE &amp; PRODUCTIVITY\u003C\u002Fh2>\n\n\u003Cp>It is understood and agreed between the parties that in view of signing this\nagreement.\u003C\u002Fp>\n\n\u003Cp>a) The C.B.A Union\u002Fworkers have agreed to continue and maintain industrial\npeace existing production targets and harmony so that both the workers and the\nCompany may devote their full attention and endeavor towards obtaining further\nand better results through improvement in efficiency\u002Fdiscipline which is\nundisputedly accepted as the need of the hour due highly competitive\nenvironment.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>b) The union and workers shall continue to extend full cooperation to the\nCompany for maintaining discipline at all levels at all times.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>c) In order to achieve the above objective, the C.B.A Union has undertaken\nto extend its full cooperation.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>d) The C.B.A Union has further agreed not to resort to any strike, work\nstoppage, go-slow or curtailment of production due to any cause or reason and\nshall maintain requisite targets and to extend full cooperation with the\nmanagement personnel at all levels.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>e) The C.B.A further agreed to ensure to maintain discipline and observance\nof existing Company’s Rules and Regulations in letter to spirit.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>f) All the terms and conditions of services of employees covered by the\nsettlement and under existing service rules and union\u002Fmanagement’s settlement\nin effect prior to signing this settlement (excluding the changes where effect\nand agreed) shall continue to remain in force save to extend amended, varied\nrescinded or superseded through this settlement.\u003C\u002Fp>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Ch2>4. PERIOD OF SETTLEMENT AND APPLICABILITY\u003C\u002Fh2>\n\n\u003Cp>\u003C\u002Fp>\n\n\u003Cp>i) This settlement shall come into force w.e.f.
